The most documented juridical studies about hispanic woman in the late Middle Ages, belong to three specialities: political law, civil or common law (matrimonial), and criminal law. It is in the sphere of matrimonial law where the influence of christian principles has been described as prominent, contributing to the juridical conjugal parity, thus recognizing woman a full civil capability.

Most of the characters in the work live their lives as transgression; their disorderly conduct leads inevitably to their death and destruction [Baranda 9]. The negative example offered by this work was, according to Maravall, what led early readers such as Quevedo to understand how the work: “debaxo del nombre de Comedia, enseña a vivir bien, moral y políticamente, acreditanto las virtudes y disfamando los vicios [under the title of Comedy, teaches one to live well, both moral and politically, accrediting virtues and discrediting vices]” [qtd. in Maravall 19].1 The Celestina lays bare its social and moralistic message by exposing the corruption of social and moral values prevalent in this late fifteenth-century work. Bringing together the aristocratic world of courtly love (already brought low through the Calisto’s crass treatment of waspish Melibea) and the bawdy world of the whorehouse, Rojas debases the people and passions therein. Connecting both worlds through her comings and goings is Celestina. Characterized as abeja, a political animal used in the Middle Ages and early modern period that informs the ideal structure of society, Celestina exposes a satire of society and its corruption of moral values.As the Síguese and prologue indicate, the tragicomedy was written with a dual and moral intent. The author wrote to disabuse the many “galanes y enamorados mancebos [handsome young men and enamored youth]” of his country from the cruel and evil fires of love, but also to expose “engaños de las alcahuetas y malos y lisonjeros siruientes [the deceptions of procuresses and evil sycophantic servants].” In the Celestina, the deceits of the bawd and servants Sempronio and (later) Pármeno complicate the narrative and move it to its tragic conclusion. As Celestina and Sempronio set out to profit by Calisto’s lovesickness, they are met with opposition from Pármeno. The initial resistance Pármeno puts up to defend himself and his master from the economic lust felt by Celestina and Sempronio serves to expose a conflict in social class. The heedless attainment of wealth demonstrated by the servants contradicts a more aristocratic principle that was perceived to guide economic thought in the Middle Ages [Maravall 60]. Celestina’s spoken adage, “[a] tuerto o a derecho, nuestra casa hasta el techo [by hook or by crook, our house [End Page 147] through the roof],” exposes her unmitigated greed and contrasts sharply with Calisto’s more courtly (if yet parodic) examples of largesse. The alcahueta’s greed is not merely opportunistic, it belies a certain Schadenfreude felt for Calisto’s woes. Like “cirurjanos [ante] los descalabrados [surgeons before patients with head trauma],” Celestina pursues Calisto in search of money, which at this particular moment in history was slipping through the hands of her real-life counterparts and into those of state-appointed brothel keepers. As Lacarra notes, the granting of royal mercedes for the incomes derived from prostitution to royal towns or notable persons became prevalent during the reign of Ferdinand and Isabel [40]. One must imagine women such as Celestina doubly feeling the pinch from this seemingly “catholic” imposition. Income from the alcahueta livelihood from all of Castile certainly must have been dwindling. At the same time, the alcahueta’s dishonest way of living was being usurped by speciously honorable citizens who no doubt maligned the prostitutes on whom their wealth was gained. Despite the growing danger of her increasingly clandestine profession, Celestina shows little shame or fear. Indeed, her sense of “honor” for the putería is so brightly and enthusiastically expressed in the work bearing her name that one wonders if it might not stem from... (shrink)

Background: The high level of satisfaction of users of a health service is largely due to the fact that they receive excellent care from healthcare professionals. Compassionate care is an essential component of excellent care. But what do nurses understand compassion to be? Research objectives: To analyse the concept of compassion from the perspective of nurses in the Andalusian Public Health System, Spain. Research design: This is a qualitative study following the grounded theory model. Four focus groups and 25 in-depth (...) interviews were conducted. Participants and research context: A total of 68 nursing professionals working in the Andalusian Public Health System (Spain) participated. Theoretical sampling was used, with participants being recruited using the snowball technique. Ethical considerations: This research was approved by the Research Ethics Committee of the Centro-Almería Health District (CEICA 27/9/17). Findings: From the analysis of the data, four themes emerged that helped to understand the concept of compassion according to nurses: ‘Negative perception of the term compassion’, ‘Compassion and empathy as synonyms’, ‘Beyond empathy’, and ‘Effects of having a compassionate attitude’. Discussion: Nurses perceive the concept of compassion differently to each other and even contradictorily. This concept is imbued with cultural elements, which adds confusion to understanding it, and is even perceived as something negative similar to pity. Conclusion: Nurses confuse the concepts of empathy and compassion as if they were synonymous. Before considering training in compassion for healthcare professionals, it is essential to clarify the concept of compassion through educational interventions. (shrink)

This article develops the argument that the interplay between emotions and cognitive biases influences corporate decision-making on climate change adaptation. Our theoretical analysis examines how emotions can change the effect of cognitive biases on adaptation decisions by influencing how firms select, access, and process complex and uncertain climatic information. We draw on research on climate adaptation, social psychology, and managerial cognition and focus on three forms of bias: availability heuristic, framing, and anchoring. We explain how each bias shapes the decision-making (...) process on adaptation and theorize how emotions of different valence and arousal affect this process. We shed light on the underlying mechanisms that explain how emotions influence the effect of cognitive biases as a source of inaction on adaptation in firms. Our analysis provides a new perspective on how firms approach the strategic decision to adapt to climate change by considering both cognitive and emotional aspects. (shrink)

One of the sectors for which Artificial Intelligence applications have been considered as exceptionally promising is the healthcare sector. As a public-facing sector, the introduction of AI applications has been subject to extended news coverage. This article conducts a quantitative and qualitative data analysis of English news media articles covering AI systems that allow the automation of tasks that so far needed to be done by a medical expert such as a doctor or a nurse thereby redistributing their agency. We (...) investigated in this article one particular framing of AI systems and their agency: the framing that positions AI systems as replacing and outperforming the human medical expert, and in which AI systems are personified and/or addressed as a person. The analysis of our data set consisting of 365 articles written between the years 1980 and 2019 will show that there is a tendency to present AI systems as outperforming human expertise. These findings are important given the central role of news coverage in explaining AI and given the fact that the popular frame of ‘outperforming’ might place AI systems above critique and concern including the Hippocratic oath. Our data also showed that the addressing of an AI system as a person is a trend that has been advanced only recently and is a new development in the public discourse about AI. (shrink)

This paper challenges the view that contentment leads to personal freedom and autonomy and argues for a relational and exercise concept of de facto freedom in the Zhuangzi 莊子. I first review influential interpretations of freedom in the Zhuangzi that equate freedom with contentment and nonfrustration, starting with Guo Xiang's 郭象 (d. 312 CE). By putting these interpretations in dialog with contemporary social philosophy (Christman, Meyers, Pettit, Elster, and Khader), I reflect on the two seminal problems of the psychologizing causal (...) and procedural approaches that allow the interpretation of freedom as contentment: the “happy slave” problem and the “sour grapes” problem. Proving this account of freedom inadequate, I argue for a different interpretation of freedom in the Zhuangzi that resembles a weakly substantive and constitutive account of freedom and autonomy in modern‐day social philosophy terms, such as Marina Oshana's. The theory of freedom that I analyze in the Zhuangzi, however, helps us correct the risk of material determinism of the constitutive account, offering a description of relational freedom and autonomy as constituted by socio‐material conditions but not determined by them. This paper presents an empirical study that analyzes everyday practices regarding the health care and education of middle class families grounded in a phenomenological perspective. Everyday practices are linked to the system of expectations and goals built around practices, constituting a configurations of meaning that involves both aspects of the Life-World, which is affected by social class and other social determinants that define areas of experiences and opportunities for social interaction. In this sense, we see that social class and gender (...) intersect each other, enabling and limiting horizons of expectations for children, raising specific jurisdictions to males and females. Finally, we reflect on how the constitution of meanings and everyday practices influences the construction of social relations of the educational and health environments. (shrink)

Aunque durante años hemos asistido a un persistente interés sociológico por la dimensión subjetiva de las prácticas de clase, hasta la fecha pocos son los estudios que han abordado esta problemática desde la perspectiva fenomenológica. Tomando como punto de partida autores que nos antecedieron en esta tarea, el objetivo del presente trabajo es reflexionar sobre los fundamentos de la teoría fenomenológica de Schutz sobre la acción social y su conceptualización de las tipificaciones para el análisis del sentido común y las (...) prácticas de clase. En la primera sección proponemos una breve discusión conceptual en torno a la definición del mundo de la vida proveniente de la teoría de Schutz y su utilidad para el análisis de la estructura social en la línea teórico-metodológica que analiza la reproducción intra-clase y las relaciones entre clases. A continuación resumimos las ideas y conceptos de Weber sobre las clases sociales, acción social y tipo ideal, para luego establecer sus nexos y relaciones con Schutz. Por último, e incorporando la resignificación y complejización que Schutz da a los términos weberianos, proponemos el uso de herramientas fenomenológicas para el análisis de clase. (shrink)

El empleo de softwares, aplicaciones y programas especializados ha cambiado la forma de desarrollar investigaciones, por lo que, en el ámbito universitario cobra especial importancia la inserción de estas herramientas en el aula. Así, en este trabajo se presentan dos programas informáticos ampliamente usados en la investigación lingüística y se expone la metodología seguida para su inclusión en una asignatura concreta. The Escuela Feminista de Teología de Andalucía [the Andalusian School of Feminist Theology], held a conference titled ‘Feminine Mysticism and Counterculture: A Rebellious Genre’ October 15-17, 2009 at the University of Seville. This annual seminar is held thanks to an agreement between the University of Seville and EFETA, with the direct support of the research group ‘Escritoras y Escrituras,’ whose principal researcher is Mercedes Arriaga. The guest of honour at this year’s conference was Lisa Isherwood, who kindly presented EFETA (...) with the opportunity to publish some of the seminar’s papers in Feminist Theology, and who we here in Spain thank wholeheartedly for her contributions. This book explores the future of critique in view of our planetary condition. How are we to intervene in contemporary constellations of finance capitalism, climate change and neoliberalism?

The first contribution, by Mercedes Valmisa, begins by repositioning the Zhuangzi 莊子 as a whole within pre-Qin thought under the impact of newly excavated materials. Moving away from the traditional classification of texts according to schools, it focuses instead on varying approaches to life issues. Centering the discussion on life situations and changes we have no control over, including the unpredictable vagaries of fate (ming 命), it outlines several typical responses. One is adaptation, finding ways to go along with (...) what life demands, and even availing oneself of the new opportunities it brings about. Another is a turning inward, a focus on the inner self, holding on to ethical and other standards and making sure on does the right thing regardless of the outcomes of one's actions. While the former appears in several chapters of the Zhuangzi, notably in chapter 6, the latter is central to the Qiongda yishi 窮達以時 (Failure and Success Depend on Opportunity), a manuscript excavated at Guodian. However tempting it may be to characterize one approach as Daoist and the other as Confucian, they both appear within the Zhuangzi together with a third approach to fate, showing the fluidity of philosophical discussion and the futility of thinking along the lines of traditional boundaries. This study aimed to determine the predictive character of organizational socialization and occupational positive mental health on organizational commitment in higher education teachers. A sample of 279 teachers from higher education institutions who signed an informed consent form was used. Fifty-four point five percent of the participants were women, with a mean age of 44.05 years. The participants completed the Organizational Socialization Inventory, the Positive Occupational Mental Health Questionnaire and the Organizational Commitment Scale, and for data analysis descriptive statistics, correlation (...) analysis and multiple linear regression with stepwise method were applied, entering each dimension of organizational commitment separately as a dependent variable. As a result, moderate to weak correlations were identified between the study variables, and it was found that the final models indicate that the future perspectives and socio-affective dimensions predict affective commitment by 38%; that future perspectives, spirituality and age predict normative commitment by 22.8%; and that the future perspectives dimension predicts commitment of continuity by 9.2%. It is concluded that teachers’ expectations about their development in the institution, as well as their interactions at the socio-affective and spiritual level with the work context, are factors that partially influence their attachment to the educational organization. Philosophy of action in the context of Classical China is radically different from its counterpart in the contemporary Western philosophical narrative. Classical Chinese philosophers began from the assumption that relations are primary to the constitution of the person, hence acting in the early Chinese context necessarily is interacting and co-acting along with others –human and nonhuman actors. This book is the first monograph dedicated to the exploration and rigorous reconstruction of an extraordinary strategy for efficacious relational action devised by Classical (...) Chinese philosophers in order to account for the interdependent and embedded character of human agency –what the author has denominated “adapting” or “adaptive agency” (yin 因). As opposed to more unilateral approaches to action also conceptualized in the Classical Chinese corpus, such as forceful and prescriptive agency, adapting requires great capacity of self and other-awareness, equanimity, flexibility, creativity, and response, which allows the agent to co-raise courses of action ad-hoc: unique and temporary solutions to specific, non-permanent, and non-generalizable life problems. Adapting is one of the world’s oldest philosophies of action, and yet it is shockingly new for contemporary audiences, who will find in it an unlikely source of inspiration to deal with our current global problems. This book explores the core conception of adapting both on autochthonous terms and by cross-cultural comparison, drawing on the European and Analytic philosophical traditions as well as on scholarship from other disciplines, opening a brand-new topic in Chinese and comparative philosophy. ArgumentThis paper analyzes the public fasts of two Italian “hunger artists,” Giovanni Succi and Stefano Merlatti, in Paris in 1886, and their ability to forego eating for a long period (thirty and fifty days respectively). Some contemporary witnesses described them as clever frauds, but others considered them to be interesting physiological anomalies. Controversies about their fasts entered academic circles, but they also spread throughout the urban public at different levels. First, Succi and Merlatti steered medical debates among physicians on the (...) “scientific” explanations of the limits of human resistance to inanition, and acted as ideal mediators for doctors’ professional interests. Second, they became useful tools for science popularizers in their attempt to gain authority in drawing the boundaries between “orthodox” and “heterodox” knowledge. Finally, in the 1880s, Succi and Merlatti’s contest, the controversy around the liquids they ingested, and their scientific supervision by medical doctors, all reinforced their own professional status as itinerant fasters in a golden decade for that kind of endeavor. For all those reasons, Succi and Merlatti can be viewed as useful, epistemologically-active charlatans. (shrink)

Several recent publications attest to a renewed interest, at the dawn of the 21st century, in the philosophy of Charles S. Peirce. While agreeing with the relevance of Peirce philosophy for the 21st century, we disagree with some interpretations of Peirce as a utilitarian-based pragmatist, or with attempts to extract from Peirce a theory of social justice for 21st century societies. A critical exploration of Peirce’s philosophy of science, particularly his idea of scientific inquiry as “the study of useless things”, (...) serves to illuminate the un-pragmatic and anti-utilitarian dimension of Peirce’s thought, as well as to reveal his true ethical relevance for the 21st century. Philosophers sometimes wonder whether academic work can ever be truly interdisciplinary. Whether true interdisciplinarity is possible is an open question, but given current trends in higher education, it seems that at least gesturing toward such work is increasingly important. This volume serves as a testament to the fact that such work can be done. Of course, while it is the case that high-level theoretical work can flourish at the intersection of dance and philosophy, it remains to be seen how we (...) might share this with undergraduate students. For many of us in philosophy and dance, a large number of the students we teach are neither philosophy nor dance majors. As such, we are familiar with the challenge of convincing our students to care about our fields. Both philosophy and dance, qua disciplines on a college campus, face similar challenges. These disciplines are often deeply misunderstood, frequently presumed to be “impractical” (a powerful, but confused objection), intimidating, and frivolous. In this chapter, we offer an account of the course we co-taught at Southern Utah University in the Spring of 2016 titled “Movement and Space” as a rough framework for how to introduce the intersection between philosophy and dance to students. We simultaneously attempted to break students of their misconceptions about philosophy and dance, and worked to engage students and professors alike in a truly interdisciplinary educational experience. Treating philosophy as an embodied endeavor, and employing philosophical concepts through the act of dance encouraged students and faculty alike to rethink the fundamental nature of aesthetics. Despite the recognized importance of bodily movements in spatial audition, few studies have integrated action-based protocols with spatial hearing in the peripersonal space. Recent work shows that tactile feedback and active exploration allow participants to improve performance in auditory distance perception tasks. However, the role of the different aspects involved in the learning phase, such as voluntary control of movement, proprioceptive cues, and the possibility of self-correcting errors, is still unclear. We study the effect of guided reaching exploration on perceptual (...) learning of auditory distance in peripersonal space. We implemented a pretest-posttest experimental design in which blindfolded participants must reach for a sound source located in this region. They were divided into three groups that were differentiated by the intermediate training phase: Guided, an experimenter guides the participant’s arm to contact the sound source; Active, the participant freely explores the space until contacting the source; and Control, without tactile feedback. The effects of exploration feedback on auditory distance perception in the peripersonal space are heterogeneous. Both the Guided and Active groups change their performance. However, participants in the Guided group tended to overestimate distances more than those in the Active group. The response error of the Guided group corresponds to a generalized calibration criterion over the entire range of reachable distances. Whereas the Active group made different adjustments for proximal and distal positions. The results suggest that guided exploration can induce changes on the boundary of the auditory reachable space. We postulate that aspects of agency such as initiation, control, and monitoring of movement, assume different degrees of involvement in both guided and active tasks, reinforcing a non-binary approach to the question of activity-passivity in perceptual learning and supporting a complex view of the phenomena involved in action-based learning. Mercedes Valmisa turns our attention to the relations between truth and practice in classical Chinese philosophy. In this tradition, truth is conceived of, in a pragmatic-like spirit, as a series of embodied beliefs and perspectives that lead to fitting dispositions, emotions, and actions (regardless of whether they accurately describe the world, or whether there are other competing beliefs and perspectives that equally accurately or inaccurately describe the world). This means that we should care about truth because of its normative (...) power to guide our behavior in the most fitting way, not because of a theoretical interest in accurately describing reality. Valmisa Oviedo traces the development of this conception of truth in the Mohists and Zhuangists, leading to two radically different sociopolitical and ethical positions: the Mohists used single-truth discourses to enforce ideological monopolies that could not allow pluralism in values, norms, beliefs, and practices, while the Zhuangists warned us against the dangers of such dogmatism. Este trabajo analiza la respuesta que el Estado español, como Estado-nación, está dando a la integración del inmigrante como ciudadano. Frente a quienes consideran que la residencia ha de ser la vía de acceso a la ciudadanía ante la crisis del Estado nación y la movilidad geográfica que impone la globalización económica a las personas, aquí se defiende, por el contrario, la relevancia política de la nacionalidad, como parte alícuota individual de pertenencia al poder constituyente, en relación armónica con un (...) concepto flexible de residencia. La investigación está dividida en cinco apartados, en los que se estudia la nacionalidad y el poder constituyente, las vías de acceso a la nacionalidad española, el conflicto Estado o nación, las peculiaridades de la nacionalidad originaria y , finalmente, los criterios que los Estados utilizan para la selección de la inmigración potencial. El recorrido crítico por la legislación española en materia de nacionalidad y ciudadanía acompañado de los debates teóricos al respecto, ha permitido concluir con una propuesta de lege ferenda centrada en una reforma radical en materia de nacionalidad. In this research, we analyse the impact of the inclusion of ethical expressions in the prospectuses of socially responsible (SR) mutual funds on money flows. We contribute to the existing literature by proposing a text-based measure that integrates three attributes that are relevant to whether clients are attracted: exclusiveness, intensity and lexical diversity. We analyse a sample formed of 266 SR US equity mutual funds in the period 1999–2019. Our findings show that both the proposed indicator and other alternative partial (...) proxies based on textual data have a positive impact on the money flows of the SR funds. This effect is more relevant in the case of SR mutual funds belonging to smaller families. Besides, persistence in money flows is more intense for SR mutual funds that are more attractive because of their ethical expressions. Another finding shows that return-chaser behaviour occurs among all SR investors, independently of the level of text attractiveness of the mutual funds in which they invest, revealing that they take into account both financial and non-financial outcomes. Our results indicate that policymakers should control fund prospectus information, given its importance for investors' decisions. In addition, managers should be especially cautious with the information provided in prospectuses because of its impact on investor decisions. (shrink)

Entre las teorías de Thomas Hobbes y Baruch de Spinoza hay destacadas coincidencias y también importantes diferencias. Inician y revelan cambios en la teoría y la práctica políticas que ocurren en corto espacio de tiempo pero que son decisivos. Antecesores del positivismo, ambos compartieron bases ontológicas y metodológicas, lo que suele interpretarse, por razones cronológicas, como una influencia de Hobbes en Spinoza. Las diferencias entre ambos versan sobre el sentido de la religión en relación con su papel en la política; (...) las relaciones entre la revelación divina, la ley y la razón naturales y el orden moral; el iusnaturalismo como fundamento del sistema jurídico-político; el sentido y contenido del contrato social como fundamento de la obligación civil. Todas estas divergencias conducen a la más importante de todas, y es que Hobbes se enroca en un absolutismo que desconoce los derechos de la conciencia, mientras que Spinoza se erige en defensor del fuero interno. ArgumentThis paper analyzes the political dimension of Miguel Masriera's (1901–1981) science popularization program. In the 1920s, Masriera worked at the Swiss Federal Institute of Technology (ETH) in Zurich – with Hermann Staudinger, the luminary of polymer chemistry – to later become a lecturer of theoretical and physical chemistry at the University of Barcelona. After living in exile in Paris, at the end of the Civil War he returned to Spain but never recovered his position. Instead, Masriera became an active popular (...) science writer and adapted to the severe constraints of General Franco's military dictatorship (1939–1975). Inspired by the astronomer Arthur Eddington's world view, Masriera wrote and translated popular science books, and published articles in daily newspapers and journals. By examining Masriera's popular works, in particular his program for spreading “atomic culture” in Spain during the Cold War, this paper aims to contribute to the assessment of the role of science popularization in the domestic legitimization of that dictatorial regime and also its use as a vehicle for international recognition abroad. la juventud se ha convertido, desde el inicio de la crisis en 2008, en un tema mediático y objeto de estudio e investigación así como de diseño de políticas públicas que incluyan el objetivo de paliar la situación de dificultad y precariedad en la que se encuentran muchos jóvenes en la actualidad. Jóvenes con una gran formación y que tienen que abandonar el país por no encontrar empleo adecuado en españa; jóvenes que abandonaron el sistema educativo para incorporarse al mercado (...) laboral y que con la crisis se han quedado sin empleo; jóvenes que no pueden emanciparse por carecer de medios y que como consecuencia de ello, alargan la permanencia en casa de sus padres. Jóvenes que en definitiva ven un futuro incierto en sus vidas. el objetivo de esta introducción es ofrecer una breve panorámica y una presentación de los diferentes artículos incluidos en el presente número de la revista.Youth has become since the beginning of the crisis in 2008, a media subject and also an object of study and research as well as an object of design of public policies with the aim of alleviating the difficult and precarious situation in which many young people are today. Young highly educated who have to leave the country because they don’t find suitable employment in Spain; young people who left the education system to enter the labor market and lost their jobs with this crisis; young people who can not emancipate for lack of means and as a result, extend the stay at their parental home. Young ultimately see an uncertain future in their lives. The purpose of this introduction is to provide a brief overview and presentation of the different articles in this issue of the magazine.
