The paper compares the hermeneutical strategies of the radical and magisterial branches of Reformation. The author detects the peculiarities of the hermeneutical principles and ways of understanding the biblical text which were offered by Menno Simons, a recognized Anabaptist leader, and compares these principles and ways with their counterparts practiced by Luther and other figures of the classical Reformation. Although the radical reformers did not create a holistic theology, their interpretative strategy is quite significant for understanding the phenomenon (...) of the “Protestant hermeneutics.” -/- Menno Simons’ interpretative system is rarely mentioned in the contemporary historical/philosophical and theological discussions. The author of this article argues that such omission is caused by the domination of one-dimensional stereotypes: the overwhelming majority of the researchers who speak about the Protestant hermeneutics tend to present this area as narrowed and somewhat impoverished as they reduce it to the hermeneutics of Luther and Calvin. -/- The article demonstrates that Menno Simons developed an applied interpretative strategy borrowed from some examples found in the Gospels. This hermeneutical system was founded upon the theocentric idea of personal Revelation and living Presence and thus inevitably led to: (1) “the Bible interprets itself” principle; (2) the search for “the clear meaning of the Scripture” – something that could be different from the original meaning. An interpretative model developed as the result was based on: (a) a holistic approach, (b) applied hermeneutics, (c) corporate hermeneutics, (d) hermeneutics of obedience. In this paper I defend two propositions. The first is that the concept of location is, initial impressions perhaps to the contrary, a formal concept and that it can be exhibited far beyond the obvious application of spatial location. The second is that there are two kinds of formal ontological analysis of phenomena with extended location, which I call concentration and dispersion. This opposition can be used to throw uniform light on several problems, including different analyses of change.

The basic linguistic phenomenon of presupposition is commonplace and intuitive, little different from the relation described by the word presuppose in its everyday usage. In ordinary language, when we say that someone presupposes something, we mean that they assume it, or take it for granted. The term is used in the same way when we talk of a speaker presupposing something, although typically we are interested in those assumptions which are revealed by what the speaker says. George Boolos's employment of plurals to give an ontologically innocent interpretation of monadic higher‐order quantification continues and extends a minority tradition in thinking about quantification and ontological commitment. An especially prominent member of that tradition is Stanislaw Leśniewski, and shall first draw attention to this work and its relation to that of Boolos. Secondly I shall stand up briefly for plurals as logically respectable expressions, while noting their limitations in offering ontologically deflationary accounts of higher‐order quantification. Thirdly I shall focus (...) on the key idea of ontological commitment and investigate its connection with the idea of truth‐making. Fourthly I shall consider how different interpretations of quantification may sideline Boolos's work, but finally I shall largely support his analysis of quantification involving nominal expressions, while arguing, in the spirit of Arthur Prior, that non‐nominal quantification is non‐committing. In this paper, we develop the notion of a natural convention, and illustrate its usefulness in a detailed examination of indirect requests in English. Our treatment of convention is grounded in Lewis’s seminal account; we do not here redefine convention, but rather explore the space of possibilities within Lewis’s definition, highlighting certain types of variation that Lewis de-emphasized. Applied to the case of indirect requests, which we view through a Searlean lens, the notion of natural convention allows us to give (...) a nuanced answer to the question: Are indirect requests conventional? In conclusion, we reflect on the consequences of our view for the understanding of the semantics/pragmatics divide. (shrink)

A recurrent theme in the characterization of synthetic biology is the role of engineering. This theme is widespread in the accounts of scholars studying this field and the biologists working in it, in those of the biologists themselves, as well as in policy documents. The aim of this article is to open this black-box of engineering that is supposed to influence and change contemporary life sciences. Too often, both synthetic biologists and their critics assume a very narrow understanding of what (...) engineering is about, resulting in an unfruitful debate about whether synthetic biology possesses genuine engineering methodologies or not. By looking in more detail to the diversity of engineering conceptions in debates concerning synthetic biology, a richer perspective can be developed. In this article, I will examine five influential ways in which engineering is understood in these debates, namely engineering as applied science, as rational methodology, context-sensitive practice, cunning activity or design. The claim is first of all thus to argue that engineering must not be seen as something stable or characterized by a fixed essence. It rather has multiple meanings and interpretations. Secondly, the claim is that most of the debates on synthetic biology cannot be indifferent towards the question which conception of engineering is at play, since the specific questions and concerns that pop up depend to a great extent on the precise conception of engineering one has in account. Many of the existing debates around synthetic biology can thus be reinterpreted and readdressed once one is aware of which conception of engineering is at play. (shrink)

Substantial research examines the follower consequences of leader alignment of words and deeds, but no research has quantitatively reviewed these effects. This study examines extant research on behavioral integrity and contrasts it with two other constructs that focus on alignment: moral integrity and psychological contract breaches. We compare effect sizes between the three constructs, and find that BI has stronger effects on trust, in-role task performance and citizenship behavior than moral integrity and stronger effects on commitment and OCB than psychological (...) contract breach. These stronger attitudinal consequences run counter to our initial expectations, but they provide evidence of important conceptual distinctions and mechanisms that we articulate. BI theory suggests that BI’s greater performance impact is due to the notion that BI affects communication clarity in addition to attitudes. Results of meta-analytic structural equation modeling are consistent with this proposed dual path of BI’s impact. We highlight avenues for future research on BI and discuss how our findings inform the broader research on leader alignment. (shrink)

In a compelling chronicle of her search to understand Beauvoir's philosophy in The Second Sex, Margaret A. Simons offers a unique perspective on Beauvoir's wide-ranging contribution to twentieth-century thought. She details the discovery of the origins of Beauvoir's existential philosophy in her handwritten diary from 1927; uncovers evidence of the sexist exclusion of Beauvoir from the philosophical canon; reveals evidence that the African-American writer Richard Wright provided Beauvoir with the theoretical model of oppression that she used in The Second (...) Sex; shows the influence of The Second Sex in transforming Sartre's philosophy and in laying the theoretical foundations of radical feminism; and addresses feminist issues of racism, motherhood, and lesbian identity. Simons also draws on her experience as a Women's Liberation organizer as she witnessed how women used The Second Sex in defining the foundations of radical feminism. This is the first major study of Michel Foucault as a political thinker. Written in clear prose, Foucault and the Political explores the ramifications for political theory of the whole range of Foucault's writing, including materials only recently made available. Jon Simons argues that Foucault's work is animated by a tension between his presentation of modern life as "unbearably heavy" and his temptation to escape its limitations by aiming for "unbearable lightness." Through expositions of Foucault's ideas on power/knowledge, subjectification, (...) governmentality, political rationality and the aesthetics of existence, Simons demonstrates how Foucault resists both extremes. Foucault's thought entails an ethic of permanent resistance, best embodied in radical democracy. Simons relates Foucault's work both to contemporary political thinkers, such as Michael Walzer, Charles Taylor and Jurgen Habermas, as well as to scholars challenging conventional political categories, especially feminist and gay theorists such as Judith Butler. Frege's obscure key concept of the unsaturatedness of functions is clarified with the help of the concepts of dependent and independent parts and foundation relations used by Husserl in describing the ontology of complex wholes. Sentential unity in Frege, Husserl and Wittgenstein: all have a similar explanation. As applied to linguistic expressions, the terms 'unsaturated' and 'incomplete' are ambiguous: they may mean the ontological property of Unselbständigkeit, inability to exist alone, or the property of being what categorial grammar calls a (...) functor. Separation of these two senses resolves a dispute between Dummett and Geach on the nature of predicates. (shrink)

We only need to think for a moment about surfaces and other interfaces to realise their enormous importance in everydaylife. There are numerous branches of physics, chemistry, biology, and materials science concerned wholly or largely with surfaces, and one sometimes comes across the expression ‘surface science’ Among the natural phenomena connected with surfaces which have aroused scientific interest are surface tension, surface waves, photoelectric emission, reflection, refraction, evaporation, adsorption, adhesion, thin films, detergents, catalysts, cell membranes, skin. All of these phenomena (...) are complex, interesting, and some of them are still far from completely understood. Are surfaces important for philosophy? An epistemologist might well answer affirmatively, thinking of Quine’s "surface irritations" as the basis of our knowledge of the physical world, or Berkeley’s theory of vision, or the view that we perceive a material object in virtue of suitable causal interaction with its surfaces. But at first sight it seems that there is not much of interest for an ontologist. In his work on surfaces, especially in the book of that name, Avrum Stroll has shown to the contrary that there is much ontological interest in surfaces} Every ontologist delights in a newly discovered or hitherto neglected member of the ontological zoo: surfaces are not exactly new, but they have been neglected, and we can be grateful to Stroll for bringing them to greater prominence. Massimiliano Simons provides the first systematic study of Serres' work in the context of late 20th-century French philosophy of science. By proposing new readings of Serres' philosophy, Simons creates a synthesis between his predecessors, Gaston Bachelard, Georges Canguilhem, and Louis Althusser as well as contemporary Francophone philosophers of science such as Bruno Latour and Isabelle Stengers. Simons situates Serres' unique contribution through his notion of the quasi-object, a concept, he argues, organizes great parts of Serres' work into (...) a promising philosophy of science as well as a challenge to the narrower field of French epistemology, to which it has often been limited. Simons highlights how the concept encompasses Serres' commitment to positive relations between science and culture and his rejection of pleas to purify the scientific self from imaginative and cultural elements. It helps to situate Serres between the distinct traditions of Bachelard and Latour as well as progressing the innovative aspects of Serres' philosophy for current debates in the philosophy, history, and sociology of science. Showing how Serres' philosophy can serve as a normative approach to science and technology, Michel Serres and French Philosophy of Science takes in themes of materiality, religiosity, modernity and ecology to advance a timely alternative to philosophy of science for contemporary life. Bolzano's theory of collections (Inbegriffe) has usually been taken as a rudimentary set theory. More recently, Frank Krickel has claimed it is a mereology. I find both interpretations wanting. Bolzano's theory is, as I show, extremely broad in scope; it is in fact a general theory of collective entities, including the concrete wholes of mereology, classes-as-many, and many empirical collections. By extending Bolzano's ideas to embrace the three factors of kind, components and mode of combination, one may develop a coherent (...) general account of collections. But it is most difficult to take Bolzano's view to fit modern set theory. So while Krickel's positive thesis is rejected, his negative thesis is confirmed. (shrink)

The responsible corporate officer doctrine is, as a formal matter, an instance of strict criminal liability: the government need not prove the defendant’s mens rea in order to obtain a conviction, and the defendant may not escape conviction by proving lack of mens rea. Formal strict liability is sometimes consistent with retributive principles, especially when the strict liability pertains to the grading of an offense. But is strict liability consistent with retributive principles when it pertains, not to grading, but to (...) whether the defendant has crossed the threshold from noncriminal to criminal conduct? In this essay, I review the two most plausible arguments supporting an affirmative answer in the context of the RCO doctrine. First, perhaps this doctrine reflects a rule-like form of negligence, akin to a rule that prohibits selling alcohol to a minor. Second, perhaps this doctrine expresses a duty to use extraordinary care to prevent a harm. Neither argument is persuasive. The first argument, although valid in some circumstances, fails to explain and justify the RCO doctrine. The second argument, a duty to use extraordinary care, is also inadequate. If “extraordinary care” simply means a flexibly applied negligence standard that considers the burdens and benefits of taking a precaution, it is problematic in premising criminal liability on ordinary negligence. If instead it refers to a higher duty or standard of care, it has many possible forms, such as requiring only a very slight deviation from a permissible or justifiable standard of conduct, placing a “thumb” on the scale of the Learned Hand test, identifying an epistemic standard more demanding than a reasonable person test, or recognizing a standard that is insensitive to individual capacities. However, some of these variations present a gratuitous or incoherent understanding of “negligence,” and none of them sufficiently explain and justify the RCO doctrine. (shrink)

What is the proper role of cost-benefit analysis in understanding the tort concept of negligence or reasonable care? A straightforward question, you might think. But it is a question that manages to elicit groans of exasperation from those on both sides of the controversy. For most utilitarians and adherents to law and economics, the answer is obvious: to say that people should not be negligent is to say that they should minimize the sum of the costs of accidents and the (...) costs of preventing accidents. Under the economic formulation of the famous Learned Hand test, they should take a precaution if but only if the marginal costs (or burden, B) of that precaution are less than its marginal benefits (in the form of reduced risks of injury, measured by multiplying the probability (P) of the injury times the magnitude (L) of the injury if it occurs). If B>PxL, it would be absurd to require the greater expenditure, B. For many advocates of a fairness, corrective justice, rights-based, or contractualist perspective, the opposite answer is equally obvious. Permitting a person to impose risks of harm on others merely because he would thereby obtain a benefit (or would otherwise incur a burden) greater than the discounted value of the harm he might inflict, amounts to authorizing him to dump the costs of his risky activities on innocent victims. To permit this type of sacrifice of individuals on the altar of aggregate social welfare is morally abhorrent. Both sets of criticism have important elements of truth. Neither an unqualified cost-benefit analysis nor an unqualified rights-based rejection of tradeoffs is defensible - either as a description of tort doctrine and practice or as a normative prescription. However, a qualified (sensitive) consequentialist approach can accommodate legitimate criticisms of cost-benefit analysis: the consequentialist can launder preferences, and can consider the distribution of risk both in the social welfare calculus and in determining whether to compensate. At the same time, a qualified (tough-minded) deontological approach can accommodate the legitimate need to recognize tradeoffs: the deontologist can permit intrapersonal but not interpersonal aggregation of risks and benefits, can apply the concept of threshold deontology to risky activity, and can consider individual rather than population risk. I conclude that the formulation of the Learned Hand test found in the Restatement Third of Torts is broad enough to encompass each of these qualified approaches. (shrink)

This chapter first outlines some of Foucault' s conceptualizations of forms of power, focusing on discipline and biopower. The first section explores the extent to which Foucault understood modern power relations to be constraining limits, inhospitable to freedom. The second section focuses on some of Foucault's general conceptualizations rather than specific historical analyses of power and resistance. The third section follows Foucault's conceptualization of power relations as more expansive and complex than domination. In the final section Foucault's affirmative conceptualization of (...) power relations in the forms of liberty and freedom, not only resistance, comes to light. The section argues that Foucault's theorization and practice of resistance and liberty illustrate that, under contemporary conditions, resistance is the most viable way to practice freedom. Most of Foucault's work on ethical concern for the self focuses on the Classical Greek and Hellenistic eras, as Greek ethics turns power relations on the self. (shrink)

Michel Serres’s proposal to extend the social contract to a natural contract has been met with criticism and misunderstanding. In this article, I would like to respond to common criticisms by reconsidering two central related concepts. It is claimed that we cannot represent nature’s interests and therefore cannot come to an agreement, and thus a contract, with nature. However, I will suggest a way out by reinterpreting representation and agreement. I will start with the problem of representation: nature cannot be (...) represented. Specifically, I will present two counterarguments. The first argument is that political representation is always difficult, even in the case of human beings. Representing nature only seems more difficult because we have forgotten the difficulties associated with representing humans. The second argument aims to rethink representation. Representing nature only seems so hard because we tend to follow a cognitive understanding of representation, as if representation is about representing the ideas of the represented party. Instead, following Michael Saward, I propose an alternative understanding of representation as a game of representative claims and counterclaims: political representation is about claiming to speak on behalf of a referent and then allowing that referent to respond to that claim. Then I turn to the problem of agreement. A natural contract seems difficult because it is hard to imagine what it would mean for nature to agree to a particular proposal. To counter this, I turn to the notion of symbiosis, found in the work of Serres. A natural contract, I will argue, need not be a contract of consensus or synthesis. The alternative is a contract of symbiosis, which does not require all parties to have a common understanding of the situation. Instead, it allows for an agreement in which all parties have their own interests and definition of the situation. In this sense, a natural contract can make sense if it is understood as a contract in which symbiosis is achieved through political representation based on a game of claims and counterclaims. Since linguists began extensive work on presupposition in the 1970's, a long and heterogeneous list has been compiled of expressions, expression types and constructions that give rise to presuppositions. In the current literature, the principal (but by no means sole) diagnostic for presupposition typically appealed to is the tendency of the particular element of meaning to project, i.e. to escape the scope of operators such as negation, the question operator, or modals. An important intuition also routinely appealed to is that (...) the element of meaning is in some sense backgrounded, or treated by the speaker as taken for granted. There seems little doubt that there are interesting and theoretically relevant distinctions to be made between different types of presuppositions within this heterogeneous set. But the study of these distinctions is of interest primarily in light of the intuition that the members of this set share some common feature: that there is some singular phenomenon of presupposition to be described and explained. This paper is concerned with what presuppositions have in common, and offers an alternative to the current standard view. On the view currently prevalent in the linguistic literature, presuppositions constitute constraints on the common ground, or on an interlocutor’s “take” on the common ground, at the point at which 1 the presupposing utterance is interpreted. I do not intend to offer here a detailed critique of this standard theory, but perhaps a few words of justification are in order. The motivation for seeking a new account comes in part from the same considerations cited by Abbott 2000, in her critique of the standard view. Abbott’s central point is that the driving idea behind the common ground view is that presuppositions are identified with “old” information, or information that the speaker is treating as “old.” This idea, while perhaps helpful as an initial approximation, rapidly runs up against the observation that it is normal and commonplace for....
