The genealogy of capitalism sketched by Foucault at the end of the 1970s shakes up whatever we thought we knew about liberalism. Adam Smith’s observation retains all its relevance : politics and the economy are neither to be superposed nor to be reconciled. Liberal governance attempts to face this fact. Its tasks of circumventing, encircling, reaching from the outside are mediated by two modalities of application, which correspond to two techniques of normalisation : the first one , predominant, deals with (...) the bigger items ; the second one , active in the underground, deals with the details. It corners more closely the multiplicities, life and the conducts. A true politics of multiplicities would suppose an intervention “from the outside of” the agents we take for natural or spontaneous, but which are the objects of a constant care and re-institution : market, firms, workers. The paper takes into consideration the different degrees of power and control that can be exercised by the mediator/arbitrator. This issue is investigated with particular regard to such aspects as the nature of the ADR procedure adopted, the cultural context in which the procedure takes place, and the formulation of specific legal norms. The analysis both of a few arbitration rules and some data from real arbitral proceedings shows great reliance on the arbitrator’s discretion and use of common sense, which (...) is in line with the idea itself of arbitration. Moreover, the high degree of power autonomy enjoyed by the arbitrator during the whole procedure derives from the presupposition that the parties accept the arbitrator’s personal opinion and final judgment and from the fact that the majority of the disputes in international commercial arbitration are of a technical and complicated nature. The analysis also shows that the legal background of most arbitrators tends to surface even when they are involved in alternative dispute resolution proceedings and is clearly visible in the orderly allocation of turns and the strict control over the procedures to be followed. Especially when arbitrators are lawyers or judges, they tend to promote a feeling of belonging to the same professional community, which induces a greater spirit of cooperation and a lowering of the control level. The sorites as a formal theory. The sorites paradox has been understood as a failure of classical logic and a way out can be found by choosing a non classical logic (fuzzy logic, for instance). We understand the sorites not as a problem of logic but of ontology, so we preserve classical logic and submit the premisses of the argument to a deeper analysis. As a result we obtain two theories for soritical arguments and enlighten the kind of structure requested (...) by these arguments. The former theory has a lattice theoretic flavor and is fitted for paradoxes like “the heap” and “the bald man”; the latter is group theoretic in character and can manage paradoxes based on observational predicates like “tall”, “red” and so on. In both cases the contradiction is derived from a larger set of hypotheses than in usual analysis and some of these hypotheses make assertions whose empirical meaning can be questioned. (shrink)

Lazzarato calls instead for a new theory capable of explaining how signs function in the economy, in power apparatuses, and in the production of (...) subjectivity. Moving beyond the dualism of signifier and signified, Signs and Machines shows how signs act as “sign-operators” that enter directly into material flows and into the functioning of machines. Money, the stock market, price differentials, algorithms, and scientific equations and formulas constitute semiotic “motors” that make capitalism's social and technical machines run, bypassing representation and consciousness to produce social subjections and semiotic enslavements. Lazzarato contrasts Deleuze and Guattari's complex semiotics with the political theories of Jacques Rancière, Antonio Negri and Michael Hardt, Paolo Virno, and Judith Butler, for whom language and the public space it opens still play a fundamental role. Lazzarato asks: What are the conditions necessary for political and existential rupture at a time when the production of subjectivity represents the primary and perhaps most important work of capitalism? What are the specific tools required to undo the industrial mass production of subjectivity undertaken by business and the state? What types of organization must we construct for a process of subjectivation that would allow us to escape the hold of social subjection and machinic enslavement? A history of colonization inflicts psychological, physical, and structural disadvantages that endure across generations. For an increasing number of Indigenous Australians, environmental epigenetics offers an important explanatory framework that links the social past with the biological present, providing a culturally relevant way of understanding the various intergenerational effects of historical trauma. In this paper, we critically examine the strategic uptake of environmental epigenetics by Indigenous researchers and policy advocates. We focus on the relationship between epigenetic processes and Indigenous views of (...) Country and health—views that locate health not in individual bodies but within relational contexts of Indigenous ontologies that embody interconnected environments of kin/animals/matter/bodies across time and space. This drawing together of Indigenous experience and epigenetic knowledge has strengthened calls for action including state-supported calls for financial reparations. We examine the consequences of this reimagining of disease responsibility in the context of “strategic biological essentialism,” a distinct form of biopolitics that, in this case, incorporates environmental determinism. We conclude that the shaping of the right to protection from biosocial injury is potentially empowering but also has the capacity to conceal forms of governance through claimants’ identification as “damaged,” thus furthering State justification of biopolitical intervention in Indigenous lives. In this paper I first offer a systematic outline of a series of conceptual novelties in the life-sciences that have favoured, over the last three decades, the emergence of a more social view of biology. I focus in particular on three areas of investigation: (1) technical changes in evolutionary literature that have provoked a rethinking of the possibility of altruism, morality and prosocial behaviours in evolution; (2) changes in neuroscience, from an understanding of the brain as an isolated data processor (...) to the ultrasocial and multiply connected social brain of contemporary neuroscience; and (3) changes in molecular biology, from the view of the gene as an autonomous master of development to the ‘reactive genome’ of the new emerging field of molecular epigenetics. In the second section I reflect on the possible implications for the social sciences of this novel biosocial terrain and argue that the postgenomic language of extended epigenetic inheritance and blurring of the nature/nurture boundaries will be as provocative for neo-Darwinism as it is for the social sciences as we have known them. Signs of a new biosocial language are emerging in several social-science disciplines and this may represent an exciting theoretical novelty for twenty-first social theory. (shrink)

This article investigates the intense debate on the figure of “Chinese public intellectuals,” which has gained increasing importance, both inside and outside Mainland China, during the last decade. The climax was reached in the year 2004, when the debate on the search for and against a role for the “public intellectuals” became the litmus test of the intellectual intersections between the State actors and the public. Through a close reading of the crucial documents, this article critically engages with the terminology (...) and the interpretive paradigms employed. Thus the article highlights the contribution of the scholars examined to a dialogue on the role of critical thinking within China as well as globally. In fact, the exploration of the diversity of contemporary Chinese thought on the topic of “public intellectuals” can be inscribed within the framework of the following questions: How is the social category of “public intellectuals” used and why? And, ultimately, what does it really means to be an intellectual for the public in China today? In this sense, the article sheds light on the indigenous and foreign understandings of “public” and “intellectual.”. (shrink)

Chapter 1st of the book. This chapter explores the fundamental ambiguity of the concept of plasticity – between openness and determination, change and stabilization of forms. This pluralism of meanings is used to unpack different instantiations of corporeal plasticity across various epochs, starting from ancient and early modern medicine, particularly humouralism. A genealogical approach displaces the notion that plasticity is a unitary phenomenon, coming in the abstract, and illuminates the unequal distribution of different forms of plasticities across social, gender, and (...) ethnic groups. Taking a longer view of the plastic body as a ubiquitous belief in traditions predating and coexisting with modern medicine will help contextualize the seeming radicalism of today’s turn to permeability and the exceptionalism of Western findings. By highlighting the complex biopolitical usages of plasticity in the past, the chapter warns against simplistic appropriations of the term in contemporary body/world configurations driven by findings in neuroscience, epigenetics and microbiomics. L'article indique brièvement les éléments qui expliquent cette situation paradoxale et met en valeur les contributions de l'École de Tübingen (Krämer, Gaiser), qui insistent sur les « auto-témoignages » de Platon et sur la tradition (...) indirecte en vue d'une compréhension tout à fait nouvelle de Platon. L'auteur tente ensuite de dissiper quelques-unes des équivoques les plus graves qui grèvent le débat qu'elles ont suscité. L'article expose les analyses de Reale, qui éclairent d'un jour nouveau la valeur paradigmatique de cette nouvelle position, et l'apport de Szlezák, qui produit l'analyse des techniques d'écriture employées par Platon. The article tackles the roots of the « Plato mystery », beginning with its « inexplicable » existence. It is a nonsensical that an author, whose written corpus we possess, is not only open to different valid interpretations, but even to contradictory ones. After pointing out the elements behind this paradoxical situation, the contributions of the Tübingen school (Krämer, Gaiser) that enhance Plato's own testimony and the indirect tradition in respect of a renewed Platonic comprehension, are underlined. The author then attempts to eliminate some of the major misunderstandings which blocked the previous debate. The article exposes Reale's analysis, who clarifies the paradigmatic value of the new proposal, and the Szlezák's contribution, who threats the analysis of the writing techniques of Plato. Finally Movia's and Migliori's commentaries verify the hermeneutical capabilities of the « new paradigma » and bring a set of thorough examination of the dialectic mainly. (shrink)

Tomorrow’s politics will be a politics of multiplicity. Contemporary Marxism, in its political and trade-unionist manifestations, appears as a major obstacle, given its inability to escape from totalising categories and to reflect upon the political need for innovation . Maurizio Lazzarato attempts to show that this double inability originates in an ontological view of relations, present in Marx himself, a view which needs to be reconsidered in light of the philosophy of multiplicity developed during the same period. William James’ (...) pragmatism, for instance, allows us to understand how deeply Marx’s ontology of relation is indebted to the idealist philosophy of the 19th century, thus revealing the ontological limits of Marxist politics.
