It has become increasingly difficult for individuals to exercise meaningful control over the personal data they disclose to companies or to understand and track the ways in which that data is exchanged and used. These developments have led to an emerging consensus that existing privacy and data protection laws offer individuals insufficient protections against harms stemming from current data practices. However, an effective and ethically justified way forward remains elusive. To inform policy in this area, we propose the Ethical Data (...) Practices framework. The framework outlines six principles relevant to the collection and use of personal data—minimizing harm, fairly distributing benefits and burdens, respecting autonomy, transparency, accountability, and inclusion—and translates these principles into action-guiding practical imperatives for companies that process personal data. In addition to informing policy, the practical imperatives can be voluntarily adopted by companies to promote ethical data practices. (shrink)

The correspondence theory of truth is often thought to be supported by the intuition that if a proposition (sentence, belief) is true, then something makes it true. I argue that this appearance is illusory and is sustained only by a conflation of two distinct notions of truthmaking, existential and non-existential. Once the conflation is exposed, I maintain, deflationism is seen to be adequate for accommodating truthmaking intuitions.

The mind-body problem has a long history that begins well before Descartes made it extreme by presenting mind as unextended active thinking and (...) matter as unthinking passive extension. This absolute division was motivated in some part by the desire to present the soul as an entity that can survive the death of the body. This is difficult to maintain if the soul is merely the form or the vital force motivating a human body. But the advance of physiology has led more and more to the conclusion that the functions often attributed to the soul are actually carried out by the brain. Thinking may be as natural (and perhaps as determined) a function of the body as is digestion. And if digestion does not survive the death of the body, maybe thinking does not either.This collection of studies provides a detailed introduction to both medical and metaphysical views and theories concerning the relation of mind to body. In particular, the first article by Beate Gundert on Hippocratic Medicine sets the stage by showing that "mind and body in the Hippocratic writings, while distinguished empirically by being related to different types of phenomena, are both ultimately accounted for by the same explanatory model: Human nature (physis), which embraces the totality of bodily structures, physiological processes, and psychic events" (35). T. M. Robinson shows that Plato admits of no solution as to how mind and body interact, and Philip J. van der Eijk argues that "to detach the essence of man completely from his physical make-up would run counter to Aristotle's biological approach to man as a natural living being, the ultimate implication of his view on the divinity of nous is that the fullest realization of what it is to be a human being is to go beyond the limits of corporeality and mortality, and to become, if only temporarily, a god" (77). Heinrich von Staden covers Epicurus, Herophilus, Erasistratus, the Stoics, and Galen, concluding that "The discovery of the nerves entailed the first significant erosion of the vast territory ruled by the soul in Platonic and Aristotelian philosophy, an erosion accompanied by an expansion of the rule of 'nature,' visible not only in medicine, but also in philosophy" (116). Theo K. Heckel discusses Saint Paul's insistence upon the whole person, and Gareth Matthews shows that, prior to Descartes, Augustine presents "a radically new argument for mind-body dualism... an internalist argument... that proceeds from what, allegedly, the mind can know concerning itself to the conclusion that the mind is incorporeal" (145). Emily Michael discusses Pomponazzi's view that we know the immortality of the soul only by faith and the scholastic attempts to show that the soul is a substantial form. Guillaume Lamy, for example, criticized Descartes for having a soul only of thinking, whereas the soul must be of life. Steven Voss shows how at the end of his life, Descartes did discuss in detail how thinking affects the body, particularly in the management of health and the curing of disease. But Descartes does not solve the problem of how this interaction takes place. Thomas Lennon discusses the views of Bayle on Leibniz's monadic forces and Locke's fideism. And Francois Duchesneu continues the discussion of Stahl and Leibniz, to [End Page 142] conclude that "Leibniz attempts to discover the formal foundation of the organism, which he locates in the capacity of perception-appetition proper to the dominant monad" (235).John P. Wright gives an exposition of a very important distinction between Cartesian dualism and the functional dualism that came to dominate medical thought, that is, the question of how the brain and vital organs interact. Standard accounts of the senses attempt to answer the question how and why we count five senses ; none of the standard accounts is satisfactory. Any adequate account of the senses must explain the significance of the senses, that is, why distinguishing different senses matters. I provide such an explanation, and then use it as the basis for providing an account of the senses and answering the counting question.

What is it like to live with the label “Disability?” NIB editorial staff and narrative symposium editors, Jeffery Bishop and Naomi Sunderland developed a call for stories, which was sent to several list serves, shared with the 1000 Voices Project community and posted on Narrative Inquiry in Bioethics ’ website. The request for personal stories from people who identify with the label “disabled” asked them to: consider how the label “disability” interacts with other aspects of their life in health care (...) settings; does the term “disability” reflect their actual embodied experiences of impairment or does it fail to do justice to their particular experience of impairment; describe the kind of experiences that are possible because of the impairment(s); discuss how the label has affected their “authentic voice”; and many other concepts about what effects the label has on their lives. These authors share deeply personal experiences that will help readers understand their world, challenges, and joys. Thirteen stories are found in the print version of the journal and an additional five supplemental stories are published online only through Project MUSE. The stories are complemented by four commentary articles by Elizabeth R. Schiltz; Lorna Hallahan; Nicole Matthews, Kathleen Ellem, and Lesley Chenoweth; and Jeffery Bishop, Rachelle Barina, and Devan Stahl. These scholars come from the disciplines of law, social work, media studies, medicine, and bioethics from Australia and the United States. Television medical dramas frequently depict the practice of medicine and bioethical issues in a strikingly realistic but sometimes inaccurate fashion. Because these shows depict medicine so vividly and are so relevant to the career interests of medical and nursing students, they may affect these students' beliefs, attitudes, and perceptions regarding the practice of medicine and bioethical issues. We conducted a web-based survey of medical and nursing students to determine the medical drama viewing habits and impressions of bioethical issues depicted in (...) them. More than 80% of medical and nursing students watch television medical dramas. Students with more clinical experience tended to have impressions that were more negative than those of students without clinical experience. Furthermore, viewing of television medical dramas is a social event and many students discuss the bioethical issues they observe with friends and family. Television medical dramas may stimulate students to think about and discuss bioethical issues. (shrink)

There are three broad ethical issues related to handling public health emergencies. They are the three R's - rationing, restrictions and responsibilities. Recently, a severe shortage of annual influenza vaccine in the US, combined with the threat of pandemic flu, has provided an opportunity for policy makers to think about rationing in very concrete terms. Some lessons from annual flu vaccination likely will apply to pandemic vaccine distribution, but many preparatory decisions must be based on very rough estimates. What ethical (...) principles should guide rationing decisions, what data should inform these decisions, how to revise decisions as new data emerge, and how to implement rationing decisions on the ground are all important considerations. In addition, ethicists might be able to help policy makers think through the importance of international cooperation in surmounting global rationing dilemmas and to accept the inevitable responsibilities of government in making and implementing rationing decisions. Recent discussions in critical social epistemology have raised the idea that the concept 'knower' is not only an epistemological concept, but an ethical concept as well. Though this idea plays a central role in these discussions, the theoretical underpinnings of the claim have not received extended scrutiny. This paper explores the idea that 'knower' is an irreducibly ethical concept in an effort to defend its use as a critical concept. In Section 1, I begin with the claim that 'knower' is (...) an irreducibly normative and social concept, drawing from some ideas in Wilfrid Sellars. In Section 2, I argue that one's being a knower involves demands for various sorts of ethically-laden recognition. I develop this thought by arguing that Axel Honneth's threefold typology of recognition—love, respect, and esteem—finds clear expression within the context of socio-epistemic practice. I conclude in Section 3 by arguing that Miranda Fricker's proposed " analogy " between epistemic and moral perception should be modified to indicate a closer relationship than mere analogy. (shrink)

Cappelen and Dever challenge the widely accepted idea that some key aspect of intentional action is essentially indexical. They argue that the classical arguments for this coming from Perry are in fact arguments for a different phenomenon: the opacity of explanatory contexts. I agree with Cappelen and Dever that what Perry says about the ineliminability of indexical terms from explanations of intentional action fails to amount to an argument for this indexicality being essential. But this should not lead us to (...) be sceptics. In this paper, I present a different argument for the essential indexicality of intentional actions. The key premise of this argument is that intentions themselves are essentially indexical. I provide evidence for this premise and defend it against potential criticism. I also show how the essential indexicality of intentions can be used to vindicate Perry's original claims about the essential indexicality of certain beliefs and desires. (shrink)

This paper explores the relationship between disability and quality of life and some of its implications for bioethics and healthcare. It focuses on the neglected perfectionist approach that ties well-being to the flourishing of human nature, which provides the strongest support for the common view of disability as a harm. After critiquing the traditional Aristotelian version of perfectionism, which excludes the disabled from flourishing by prioritizing rationalistic goods, I defend a new version that prioritizes the social capacities of human nature (...) and the goods of personal relationship. This relationship-centered perfectionism is able to accommodate and explain disabled thriving. I also show how these issues have important implications for specific bioethical debates and clinical practices, using a cluster of issues related to Down syndrome as timely illustrations. My goal is to sketch a perfectionist theory that gives a more plausible account of the relationship between disability and well-being, and that provides better practical guidance in cases involving judgments about the quality of disabled lives. In recent decades, scholars of Buddhist philosophy have frequently treated the Trisvabhāvanirdeśa, or “Teaching of the Three Natures,” attributed to Vasubandhu, as an authentic and authoritative representation of that celebrated thinker’s mature work within the Yogācāra tradition. However, serious questions may be posed concerning the status and authority of the TSN within Yogācāra, its true authorship, and the relation of its contents to trends in early Yogācāra thought. In the present article, we review the actual state of our knowledge of (...) the TSN’s possible origins, considering, too, the implications this may have for contemporary treatments thereof. Ideal theory has been extensively contested on the grounds that it is ideology: namely, that it performs the distorting social role of reifying and enforcing unjust features of the status quo. Indeed, a growing number of philosophers adopt a nonideal methodology—which dispenses with ideal theory—because of this ideology critique. I argue, however, that such philosophers are confused about the ultimate dialectical upshot of this critique even if it succeeds. I do so by constructing a parallel—equally plausible—ideology critique of nonideal methodology; (...) specifically, I argue that capitalist and managerial social attitudes have commodified people’s conception of justice and induced suspicion of ideal theory, which is not construed as having direct practical value. Consequently, nonideal methodology performs the distorting role of reifying and enforcing the hegemonies of capitalism and managerialism. Ideal theory and nonideal methodology are, therefore, in symmetrically bad positions. (shrink)

It has been argued that nonreductive physicalism’s problems with mental causation disappear if we abandon the intuitive but naïve production-based conception of causation in favor of one based on counterfactual dependence and difference-making. In recent years, this response has been thoroughly developed and defended by James Woodward, who contends that Kim’s causal exclusion argument, widely thought to be the most serious threat to nonreductive mental causation, cannot even be given a coherent formulation within Woodward’s preferred interventionist framework. But Woodward has, (...) even more recently, defended a pair of necessary conditions on mental causation and higher-order causation more generally, and it is here that the interventionist framework proves less friendly to nonreductive mental causation. Functionalism is arguably the most important species of nonreductive physicalism concerning specifically mental properties, but, as I argue, functional properties fail both of Woodward’s tests of causal relevance, one of them in two different ways. The problem, moreover, seems unique to functionalism, for other types of higher-order properties appear to pass Woodward’s tests. If functionalism faces defeat even in such friendly territory, its problems with mental causation are not an artifact of naïve metaphysics. They run deep. (shrink)

Emotional clarity and attention to emotions represent the extent to which people understand and attend to their own emotions, respectively, and are broad facets of emotional awareness, alexithymia, and emotional intelligence. To examine the extent to which these two constructs are associated, we conducted a meta-analysis of studies including well-validated self-report measures of trait clarity and attention to emotion. Clarity and attention were moderately, positively associated. Assessment instrument, but not sample gender or age, moderated the association between clarity and attention. (...) Analyses of between-study heterogeneity and publication bias suggested that results were valid and generalizable. We discuss potential causes of the association between clarity and attention, and elaborate on the implications of our results for emotion regulation, well-being, and psychopathology. (shrink)

Au cours des deux dernières décennies, les études sur Stanley Milgram ont connu une véritable renaissance interdisciplinaire, qui a conduit à modifier profondément le débat sur ces expériences de psychologie sociale parmi les plus controversées du xxe siècle. L’intérêt considérable pour les conditions expérimentales de ses travaux constitue une nouvelle perspective, qui a des implications pour la philosophie de la psychologie sociale. L’ontologie sociale (ou ontologie historique), de différents styles, peut mettre en lumière les caractéristiques contingentes de l’« obéissance à (...) l’autorité» et d’autres expériences classiques de la psychologie sociale nord-américaine. Dans ce numéro de Philosophia Scientiæ consacré à Milgram, ma contribution consiste à montrer comment une approche empirique de l’interaction sociale peut aider à éclairer – « à partir de la base» -– les relations de pouvoir dans le laboratoire de Milgram, ainsi que les résistances à la poursuite de l’expérience. Tout d’abord, je présente le pouvoir comme une caractéristique multidimensionnelle de la sociabilité humaine, en soulignant son aspect performatif. Dans le laboratoire, les sujets jouant le rôle des Enseignants sont contraints à exercer leur pouvoir de différentes façons très contrastées, soit en exerçant ce pouvoir sur l’Apprenant (en se conformant à la volonté de l’expérimentateur), soit contre l’expérimentateur (c’est-à-dire en lui résistant). Deuxièmement, je propose que, comme la moralité, le pouvoir au sens performatif peut être compris à l’aide de la distinction entre premier-plan et arrière-plan (dans le vocabulaire Gestaltiste, la distinction figure/fond), les deux aspects du phénomène étant empiriquement fondés, et orientés vers les pratiques concrètes des agents en interaction. Troisièmement, je précise la notion de pouvoir performatif, en relation avec la pratique de ceux qui, parmi les sujets en position d’Enseignants, s’opposent à la continuation de l’expérience. En conclusion, l’article illustre la valeur de l’analyse éthnométhodologique conversationnelle, en tant que style d’ontologie sociale adapté tant à l’étude des relations de pouvoirs, à celle des prétentions à la connaissance en psychologie sociale, qu’à la reconstruction des présupposés de la psychologie sociale nord-américaine classique. We defend a scalar theory of the relationship between material scarcity and justice. As scarcity increases beyond a specified threshold, we argue that deontological egalitarian constraints should be gradually relaxed and consequentialist considerations should increasingly determine distributions. We construct this theory by taking a bottom-up approach that is guided by principles of medical triage. Armed with this theory, we consider the range of conditions under which justice applies. We argue that there are compelling reasons for thinking that justice applies under (...) a far broader range of conditions than is standardly supposed, including those that could sensibly be labelled as conditions of extreme rather than moderate scarcity. Public pressure is essential for providing multinational enterprises (MNEs) with motivation to follow the standards of human rights conduct set in soft-law instruments, such as the United Nations Guiding Principles on Business and Human Rights. But how does the public judge MNE involvement in human rights violations? We empirically answer this question drawing on an original survey of American adults. We asked respondents to judge over 12,000 randomly generated scenarios in which MNEs may be considered to have been involved in (...) human rights violations. Our findings reveal substantial gaps between public judgments and the standards set in soft law and the normative literature. We identify the attributes of episodes of human rights violations involving MNEs that influence public judgments, including the relationship between the MNE and the perpetrator, the practice of due diligence, and the type of abuse. These results provide insights as to when we might expect public pressure to drive MNE compliance with soft-law instruments, and they direct attention to specific standards that will likely require stronger, ‘hard’ law approaches or broader efforts to shift the public’s view. Michael Ghiselin and David Hull’s individuality thesis is that biological species are individuals. Philosophers often treat the term “individual” as synonymous with “mereological sum” and characterize it in terms of mereology. It is easy to see how the biological project has been interpreted as a mereological one. This chapter argues that this is a mistake, that biological part/whole relations often violate the axioms of mereology. Conflating these projects confuses the central issues at stake in both, and makes the job of (...) evaluating either unnecessarily burdensome. Clarifying this helps identify the genuine metaphysical implications of the individuality thesis, which serves as an exemplar of scientifically informed metaphysics. (shrink)

In this article, we review genetic determinism and highlight how our earlier research on the philosophy of place can contribute to a better understanding of genomics and ongoing debates about genetic modification. We show how place can undermine any philosophy of genetic determinism. By using our philosophy of place, our investigation contributes to a call for a turn for humanity toward a “collective being-at-home-in-the-world”, instead of being estranged from place which genetic determinism actively promotes. We also utilise cinema studies research (...) of the film GATTACA to conceptualise how place and genetic determinism contrast. Our examination is intended to contribute to ongoing discussions about genetic determinism as they play out in the media, in education and influence discrimination. Fundamentally, we show why scholars in this area should consider place alongside genetic determinism in their future investigations. (shrink)

While many political theorists have focused on the question of whether states have a duty to grant citizenship to noncitizens, this article examines the issues associated with the state’s withdrawal of citizenship. Denationalization powers have recently emerged as a controversial political issue in a number of liberal states, making their ethical scrutiny important. I begin by considering the historical practice of banishment and how denationalization power emerged and became consolidated in the United Kingdom and the United States in the first (...) half of the twentieth century. I then discuss the nature of liberal objections to the power. My focus next shifts to the United Kingdom’s Nationality, Immigration and Asylum Act of 2002, which attempted to create a “liberal” denationalization power. In the final section of the article, I discuss whether the Act successfully addresses liberal concerns and in so doing shed light on the possibility of reconciling liberal principles with conditional citizenship. "Notes toward a metaphysic of wonder" is the outcome of a "Reciprocal Inquiry" in which Leoni Henning and I participated. In our correspondence, we moved very fast: I thought each of us surprised the other. As a result, I found myself writing about astonishment more elaborately than I'd intended to. Before long I was involved not only with wondering but with awe and bewilderment and amazement, and eager to connect it all with philosophy in Latin America. So these "Notes..." are (...) just a foretaste of what I hope will someday be a more extensive article, but which is only hinted at in the present version. Leoni Maria Padillha Henning’s thoughtful and informative paper, “Pragmatism in Matthew Lipman and its influence in Latin America” is singularly helpful in showing the relevance of Philosophy for Children to Latin-American education. Indeed, the intellectual momentum it generates is a powerful invitation to other educators and scholars to take up the issues where she leaves off. I’d like to take up just one of these issues, one that, on the surface at least, seems to be particularly unpromising. I’m referring to the near-unanimity that exists among scholars with regard to the tradition, descended from Aristotle, that philosophy begins in wonder. My intention is not to attempt to refute this claim, but to show its complicity in defending the traditional non-reflective paradigm of education, which has sturdily resisted the introduction of philosophy into the schools, just as it resists the conversion of the classroom into a community of inquiry. With the proper pedagogy, philosophy can readily be taught to children, and the teaching of philosophy for children can readily be taught to teachers. It is not essential that wonder precede philosophy: it can just as well follow it. (shrink)
