À nous d'y triompher de la pensée unique. Beaucoup ont déjà pris la plume, tels Jean Sévillia, Philippe de Villiers ou Mathieu Bock-Côté. Mais à cette aventure intellectuelle, le droit reste étranger. Chose curieuse, au regard de son immixtion dans nos vies, réglées comme des horloges suisses par ses (...) rouages. Mal interprété, il regorge d'idées fausses, parfois sciemment entretenues par nos législateurs à des fins politiques. Remettre le droit à l'endroit? C'est l'objet insolite de cet ouvrage. Les hommes naissent-ils réellement libres et égaux en droit? Nos élus nous coûtent-ils trop cher? La naissance d'un étranger en France le rend-elle nécessairement français? De nombreuses questions éthiques émergent depuis mi-mars 2020 en France à la suite de la crise du Covid-19. Les questions de la recherche sont éprouvées et questionnées malgré des résultats indiscutables depuis l’année 2021. Pendant cette pandémie, les bornes de la méthodologie de la recherche ont été rompues et beaucoup de traitements et vaccins ont été mis en valeur auprès des patients et par les autorités sans une intégrité scientifique maximale. Entre une course scientifique du côté des médecins-chercheurs et (...) la méthodologie de l’urgence du soin, il est intéressant de faire un point sur le respect de la méthodologie de recherche et de ses prétests, ses limites vis-à-vis de l’urgence et l’autonomie de l’éthique de la recherche. This article introduces a new model of the relationship between growth and learning and tests a set of hypotheses related to the development of adult competency using time allocation, anthropometric, and experimental task performance data collected between 1992 and 1997 in a multiethnic community in the Okavango Delta, Botswana. Building on seminal work in life history theory by Hawkes, Blurton Jones and associates, and Kaplan and associates, the punctuated development model presented here incorporates the effects of both growth and learning (...) constraints on age-specific task performance. In addition, the payoff to investment in two forms of embodied capital, growth-based and learning-based, are examined in relation to features of the socioecology, including subsistence economy and family composition.The three main findings are:The development of adult competency in specific tasks entails a steplike relationship between growth- and experience-based forms of embodied capital in the ontogeny of ability acquisition.There is a trade-off between the acquisition of experience-based embodied capital in the form of skills and knowledge and immediate productivity among children. Time allocation to these alternatives is primarily determined by the short- and long-term costs and benefits to parents of investment in children’s embodied capital.The availability of laborers and the overall labor requirements of the household are major determinants of investment in alternate forms of embodied capital and resulting variation in children’s time allocation. The value of children’s labor to their parents is dependent upon the opportunity costs to engaging in other activities not only for the child in question but also for potential substitute laborers.These results have important implications for our understanding of the role of growth and learning in the evolution of the human juvenile period, as well as for our understanding of cross-cultural variation in child growth and development and patterns of work and play. Although neuroscience is currently gaining wide acceptance in organization science and management studies, some important questions remain unanswered and may hinder the development of so-called organizational neuroscience. Specifically, it appears that the usefulness and the applications of neuroscience methods to organization science are still unclear. Hence, the paper addresses this by examining the role of psychophysiology in investigating implicit emotional experience in organizational behaviors and by discussing how concepts from affective sciences and psychophysiological methods could provide a more complete picture (...) of emotion in organization. The starting point of this conversation with philosopher Mathieu Triclot is the issue of the causal contribution of video game playing in school shootings. Triclot explains the limitations of current psychological approaches regarding video game violence. He further develops on the peculiar features of the video game medium and how they relate to the problem of violence. Triclot eventually shows that, although players may relate to virtual violence in very different ways, violence in video games is not merely a (...) subjective phenomenon. He highlights that some “regimes of experience,” which got stable in the video game culture, cultivate a toxic relation to violence. (shrink)

Variational evolutionary theory as advocated by Darwin is not a single theory, but a bundle of related but independent theories, namely: (a) variational evolution; (b) gradualism rather than large leaps; (c) processes of phyletic evolution and of speciation; (d) causes for the formation of varying individuals in populations and for the action of selective agents; and (e) all organisms evolved from a common ancestor. The first four are nomological-deductive explanations and the fifth is historical-narrative. Therefore evolutionary theory must be divided (...) into nomological and historical theories which are both testable against objective empirical observations. To be scientific, historical evolutionary theories must be based on well corroborated nomological theories, both evolutionary and functional. Nomological and general historical evolutionary theories are well tested and must be considered as strongly corroborated scientific theories. Opponents of evolutionary theory are concerned only with historical evolutionary theories, having little interest in nomological theory. Yet given a well corroborated nomological evolutionary theory, historical evolutionary theories follow automatically. If understood correctly, both forms of evolutionary theories stand on their own as corroborated scientific theories and should not be labeled as facts. (shrink)

What may we learn about the life of human beings with Evolutionary Biology? In order to answer this question, without taking a distrustful stance, I think that Daniel Dennett’s evolutionary cognitivism and Foucault s archaeological approach are not unreconciliable but complementary traditions. Indeed, Derrnett’s originality, thanks to his interpretation of the Baldwin Effect and his thesis of Self as a Narrative Center of Gravity, manages to present the human being’s world as the living fulfilment of a set of historical products, (...) without giving up the properly creative dimension of the individual . In this way, devices of domination and processes of « subjectivisation » belong to the broader transfornzative process of the evolution of life on Earth. In return, Dennett s philosophy, rightfully careful when it comes to political questions, should be complemented by a critical analysis. (shrink)

This dissertation explores conflicts between religion and medicine, cases in which cultural and religious beliefs motivate requests for inappropriate treatment or the cessation of treatment, requests that violate the standard of care. I call such requests M-requests (miracle or martyr requests). I argue that current approaches fail to accord proper respect to patients who make such requests. Sometimes they are too permissive, honoring M-requests when they should not; other times they are too strict. I propose a phronesis-based approach to decide (...) whether to honor an M-request or whether religious beliefs are medically valid. This approach is culturally sensitive, takes religious beliefs seriously, and holds them to a high ethical standard. This approach uses a principle of belief evaluation developed by Linda Zagzebski: The Principle of Rational Belief, which is founded upon Aristotelian virtue ethics. In addition to the Principle, I propose a concrete set of conditions to assist caregivers in clinical case evaluations. In the final chapters, I apply the phronesis-based approach to well-known adult cases such as the refusal of blood transfusions by Jehovah’s Witnesses and requests for continued (futile) care by Orthodox Jews at the end of life. Also, I consider cases involving children such as African female circumcision and cases of faith healing. I argue that The Principle of Rational Belief should define the threshold of the kinds of M-requests for children that can be honored, but I allow a lower threshold for M-requests made by competent adult patients. The dating of Islamic traditions has so far remained dependent on internal analyses of the hadith corpus. However, a comparison between this corpus and documentary sources appears possible. Invocations engraved on rocks during the first three centuries of Islam can be compared with those attributed to the earliest authorities of Islam. The new method I propose, based on an analysis of lexical convergences between inscriptions and hadith, allows to approach the time when traditions were first put into circulation and to (...) study the process whereby invocatory formulas were incorporated into the sunna and attributed to various authorities. In this way, it becomes possible to identify a historically plausible lexical nucleus in prophetic hadith and to understand how, by means of transmitters that I call “hubs,” ancient non-prophetic traditions became prophetic. An international team of scholars from a variety of disciplinary backgrounds (notably law, philosophy, history and the history of political thought) explore both the immediate Florentine context in which Machiavelli wrote, and the republican legacy to which he contributed.

This paper explores the scriptural and theological reasons given by Jehovah's Witnesses (JWs) to refuse blood transfusions. Julian Savulescu and Richard W Momeyer argue that informed consent should be based on rational beliefs and that the refusal of blood transfusions by JWs is irrational, but after examining the reasons given by JWs, I challenge the claim that JW beliefs are irrational. I also question whether we should give up the traditional notion of informed consent.

A Polish space is not always homeomorphic to a computably presented Polish space. In this article, we examine degrees of non-computability of presenting homeomorphic copies of compact Polish spaces. We show that there exists a $\mathbf {0}'$ -computable low $_3$ compact Polish space which is not homeomorphic to a computable one, and that, for any natural number $n\geq 2$, there exists a Polish space $X_n$ such that exactly the high $_{n}$ -degrees are required to present the homeomorphism type of $X_n$. Patient requests for “inappropriate” medical treatment based on religious beliefs should have special standing. Nevertheless, not all such requests should be honored, because some are morally disturbing. The trouble lies in deciding which ones count. This paper proposes criteria that would qualify a religious belief as medically valid to help physicians decide which requests to respect. The four conditions suggested are that the belief is shared by a community, is deeply held, would pass the test of a religious interpreter and (...) does not harm others. (shrink)

We present the inconsistency-adaptive deontic logic DP r , a nonmonotonic logic for dealing with conflicts between normative statements. On the one hand, this logic does not lead to explosion in view of normative conflicts such as O A ∧ O ∼A, O A ∧ P ∼A or even O A ∧ ∼O A. On the other hand, DP r still verifies all intuitively reliable inferences valid in Standard Deontic Logic (SDL). DP r interprets a given premise set ‘as normally (...) as possible’ with respect to SDL. Whereas some SDL-rules are verified unconditionally by DP r , others are verified conditionally. The latter are applicable unless they rely on formulas that turn out to behave inconsistently in view of the premises. This dynamic process is mirrored by the proof theory of DP r. (shrink)

According to Clifford Geertz, the purpose of anthropology is not to explain culture but to explicate it. That should cause us to rethink our relationship with machine learning. It is, we contend, perfectly possible that machine learning algorithms, which are unable to explain, and could even be unexplainable themselves, can still be of critical use in a process of explication. Thus, we report on an experiment with anthropological AI. From a dataset of 175K Facebook comments, we trained a neural network (...) to predict the emoji reaction associated with a comment and asked a group of human players to compete against the machine. We show that a) the machine can reach the same accuracy as the players, b) it fails in roughly the same ways as the players, and c) easily predictable emoji reactions tend to reflect unambiguous situations where interpretation is easy. We therefore repurpose the failures of the neural network to point us to deeper and more ambiguous situations where interpretation is hard and explication becomes both necessary and interesting. We use this experiment as a point of departure for discussing how experiences from anthropology, and in particular the tension between formalist ethnoscience and interpretive thick description, might contribute to debates about explainable AI. La base de données orales de français de Suisse romande (OFROM) contient des transcriptions d’enregistrements auxquels ont participé des locuteurs nés et vivant en Suisse. Elle a été créée par des linguistes soucieux de documenter les usages oraux du français en Suisse romande, et de combler ainsi le retard dans la description des usages oraux de la langue parlée dans cette partie de la francophonie, notamment sur le plan du lexique, de la syntaxe et de la phonologie. La base de (...) données OFROM a été mise en ligne en décembre 2012 ; elle est encore jeune et d’ampleur modeste (65 heures de parole pour près de 410 000 mots transcrits, au moment où nous écrivons), mais il est prévu de l’enrichir et de la diversifier régulièrement au cours des années à venir. La première partie de cet article présente les principes fondamentaux qui ont guidé la constitution de la base (choix des locuteurs, des supports et conventions de transcription, annotations, etc.). La seconde partie contient les résultats obtenus à l’issue d’études en cours ou de sondages prospectifs, portant sur la variation lexicale et la variation syntaxique. Ils permettront d’illustrer quelques-unes des potentialités qu’offrent la base et son moteur de recherche. (shrink)

Labeling, Recovering and Reactivating: The Role of Labels on Microscope Slides in the Finding System on the Basis of Alzheimer's Auguste D. Preparations. This study discusses the role of labels in the process of the reactivation of preparations. Labels on slides together with corresponding lists on cards or sheets build what is here called a specific finding system. In the sciences of the archive the disciplinary memory together with such a finding system are the basis to the ability of the (...) sciences today to reactivate preparations from the beginning of the last century as it occurs with the Auguste D. preparations. The case of Alzheimer's micropreparations of brain parts of Auguste D. – the case that he used to show that hers was a specific brain disease unknown before – serves to describe Alzheimer's writing on the labels. It is compared to slides and labels prepared by other medical researchers between the 1890s and 1920s and the respective finding systems. Being an epistemologicum, micropreparations, as they are data, in their hybrid status of both image and material in one, cross the boundaries between icon and index. This is proven by the reactivation of Auguste D. micropreparations in molecular biological studies over 100 years after their production. (shrink)

Ernst Mayr’s concept of dual causality in biology with the two forms of causes continues to provide an essential foundation for the philosophy of biology. They are equivalent to functional and evolutionary causes with both required for full biological explanations. The natural sciences can be classified into nomological, historical nomological and historical dual causality, the last including only biology. Because evolutionary causality is unique to biology and must be included for all complete biological explanations, biology is autonomous from the physical (...) sciences. (shrink)

High-fidelity cultural transmission, rather than brute intelligence, is the secret of our species’ success, or so many cultural evolutionists claim. It has been selected because it ensures the spread, stability and longevity of beneficial cultural traditions, and it supports cumulative cultural change. To play these roles, however, fidelity must be a causally-efficient property of cultural transmission. This is where the grain problem comes in and challenges the explanatory potency of fidelity. Assessing the degree of fidelity of any episode or mechanism (...) of cultural transmission always depends upon an investigator’s choice of grain of description at which cultural traditions are being studied. The fidelity of cultural transmission then appears to be relative to the granularity at which one approaches cultural variation, and since there is a multiplicity of grains of description by which the same tradition can be studied, there results a multiplicity of measures of fidelity for a same event or mechanism of cultural transmission. If this is correct, because fidelity is always relative to the grain of description dictated by the local and specific research interests of the investigator, then there seems to be no fact of the matter as to whether cultural transmission is faithful or not, independently from a researcher’s framework of analysis. The aims of this paper are to offer a conceptual clarification of the grain problem in cultural evolution, to assess its causes, to unpack its epistemological implications, and to examine its reach and consequences for a science of cultural evolution. In this article we assess the general claim that Durkheimian sociology has reactionary, fascist, or totalitarian affinities, and the specific claim that Marcel Déat’s Durkheimian background was a significant factor in his becoming a Nazi sympathizer. We do so by comparing the different trajectories of the interwar generation of young Durkheimians and find that only one, i.e. Déat, can be said to have become fascist. Indeed, what characterizes this generation of Durkheimians is the variety of the ways in which they (...) responded to the crises of the interwar years, both politically and scientifically. Nonetheless, most remained on the political left, and during the war many younger members of the Durkheimian group either fled the country or were involved in the French Resistance. As the only personal link between the Durkheimian group and fascism, Déat’s career is of particular interest. Instead of Déat’s being an orthodox Durkheimian, his successive engagements embody the intellectual fragmentation and heterodoxy characteristic of the interwar generation. We outline Déat’s career by foregrounding the conjunctural and dispositional factors that we believe point toward a more plausible explanation of Déat’s transformation than does an internalist history-of-ideas approach according to which his political evolution can be explained by reference to an underlying intellectual continuity. Déat’s fascism is better explained by the repeated frustration of his political and intellectual ambitions that ultimately led to a fateful accommodation with Nazi power than by any tendency inherent to Durkheimian sociology. In this article, three descriptive models are described and compared in an attempt to discover the minimum number of concepts and relations necessary to an abstract description of social structure. It is argued that a "situational model" which uses the concepts of social time, social space and social role together with the relations of internal structure and external distribution is both adequate to the task and superior to the two other models. We propose a logic of abduction that (i) provides an appropriate formalization of the explanatory conditional, and that (ii) captures the defeasible nature of abductive inference. For (i), we argue that explanatory conditionals are non-classical, and rely on Brian Chellas’s work on conditional logics for providing an alternative formalization of the explanatory conditional. For (ii), we make use of the adaptive logics framework for modeling defeasible reasoning. We show how our proposal allows for a more natural reading of explanatory relations, (...) and how it overcomes problems faced by other systems in the literature. (shrink)

Das Buch befasst sich mit bislang unbekannten Kontexten von Theodor W. Adornos Kritik der Psychoanalyse, darunter vor allem die versuchte „Arisierung“ durch die Neoanalyse im Göring-Institut der NS-Zeit. Wolfgang Bock nimmt dazu einen wichtigen Ausgangspunkt von Adornos Aufsatz „Die revidierte Psychoanalyse“, der 1952 in der Psyche veröffentlicht wird. Der Autor zeigt anhand einer genauen Lektüre eins bislang unveröffentlichten englischen Vortragsmanuskripts von 1946, dass Adornos sich zusammen mit den zur Emigration gezwungenen jüdischen Analytikern vor allem gegen die Zurichtung der freudschen (...) Triebtheorie durch Karen Horney richtet, gegen die er auch in Amerika argumentiert. Er steht damit keinesfalls allein da. Diese Motive werden von Adorno allerdings ab 1950 in Deutschland nicht mehr offen aufgenommen, da er sich mangels anderer Alternativen nun verstärkt um ein Auskommen mit den ehemaligen Nazis bemüht. Wolfgang Bock, der auch der bislang kaum erfolgte Aufarbeitung dieses faschistischen Erbes in der Psychologie im Nachkriegsdeutschland nachgeht, kann zeigen, dass diese Momente weiterhin in Adornos späterer Fassung der Psychoanalyse wirksam bleiben. Vor diesem Hintergrund unterzieht er so gut wie alle Texte Adornos zur Psychoanalyse einer gründlichen Revision, darunter auch kaum bekannte Forschungsprojekte. Es zeigt sich, dass Adorno in den englischen Texten sehr viel offener argumentiert und damit paradoxerweise späteren Kritikern näher ist, als diese annehmen: Das Bild seines Umgangs mit der Psychoanalyse muss von nun an gründlich revidiert werden. Das Buch veröffentlicht zum ersten Mal den englischen Vortragstext Adornos von 1946 und bietet u.a. eine neue deutsche Übersetzung. (shrink)

The recent rapprochement between Science and Technology Studies and Political Science is induced by the broadened understanding of political action. The debate concerning the nature of ``the political'' produces an important question concerning the possibilities of an issue- or object-oriented focus for understanding political action. The purpose of this article is to contribute to this debate through an analysis of how relations between material and social entities are continuously recontextualized and decontextualized in social and political interaction. The authors discuss established (...) approaches to explain the concept of virtualization. Virtualization is then used in a case study on the implementation of manure regulation in East Fryslân, the Netherlands, to illustrate how cases or issues are virtualized in political decision making, which produces initial presumptions that carry conclusive weight. The authors conclude that a broad understanding of the political in both STS and PS can only be sustained through an understanding of how relations between social and material entities are continuously decontextualized and recontextualized in political and social interaction.
