Objectives—While clinical practice is complicated by many ethical dilemmas, clinicians do not often request ethics consultations. We therefore investigated what triggers clinicians' requests for ethics consultation. Design—Cross-sectional telephone survey.Setting—Internal medicine practices throughout the United States.Participants—Randomly selected physicians practising in internal medicine, oncology and critical care.Main measurements—Socio-demographic characteristics, training in medicine and ethics, and practice characteristics; types of ethical problems that prompt requests for consultation, and factors triggering consultation requests. Results—One hundred and ninety of 344 responding physicians (55%) reported requesting ethics (...) consultations. Physicians most commonly reported requesting ethics consultations for ethical dilemmas related to end-of-life decision making, patient autonomy issues, and conflict. The most common triggers that led to consultation requests were: 1) wanting help resolving a conflict; 2) wanting assistance interacting with a difficult family, patient, or surrogate; 3) wanting help making a decision or planning care, and 4) emotional triggers. Physicians who were ethnically in the minority, practised in communities under 500,000 population, or who were trained in the US were more likely to request consultations prompted by conflict. Conclusions—Conflicts and other emotionally charged concerns trigger consultation requests more commonly than other cognitively based concerns. Ethicists need to be prepared to mediate conflicts and handle sometimes difficult emotional situations when consulting. The data suggest that ethics consultants might serve clinicians well by consulting on a more proactive basis to avoid conflicts and by educating clinicians to develop mediation skills. (shrink)

Many species rely on the three-dimensional surface layout of an environment to find a desired goal following disorientation. They generally do so to the exclusion of other important spatial cues. Two influential frameworks for explaining that phenomenon are provided by geometric-module theories and view-matching theories of reorientation respectively. The former posit a module that operates only on representations of the global geo- metry of three-dimensional surfaces to guide behavior. The latter place snapshots, stored representations of the subject’s two-dimensional retinal stimulation (...) at specific locations, at the heart of their accounts. In this paper, I take a fresh look at the debate between them. I begin by making a case that the empirical evidence we currently have does not clearly favor one framework over the other, and that the debate has reached something of an impasse. Then, I present a new explanatory problem—the representation selection problem—that offers the pro- spect of breaking the impasse by introducing a new type of explanatory consideration that both frameworks must address. The representation selection problem requires explaining how subjects can reliably select the relevant representation with which they initiate the reorientation process. I argue that the view-matching framework does not have the resources to address this problem, while a certain type of theory within the geometric-module framework can provide a natural response to it. The practice of nonphysician ethicist-consultants giving ethics advice concerning the appropriate medical treatment of patients in hospitals is a relatively recent development. Although only a minority of hospitals make substantial use of any formal ethics consulting service, the number is growing and apparently will continue to do so. Indeed, at least among urban teaching hospitals, some sort of ethics consulting service is increasingly commonplace.

Mathias Frisch provides the first sustained philosophical discussion of conceptual problems in classical particle-field theories. Part of the book focuses on the problem of a satisfactory equation of motion for charged particles interacting with electromagnetic fields. As Frisch shows, the standard equation of motion results in a mathematically inconsistent theory, yet there is no fully consistent and conceptually unproblematic alternative theory. Frisch describes in detail how the search for a fundamental equation of motion is partly driven by pragmatic considerations (...) (like simplicity and mathematical tractability) that can override the aim for full consistency. The book also offers a comprehensive review and criticism of both the physical and philosophical literature on the temporal asymmetry exhibited by electromagnetic radiation fields, including Einstein's discussion of the asymmetry and Wheeler and Feynman's influential absorber theory of radiation. Frisch argues that attempts to derive the asymmetry from thermodynamic or cosmological considerations fail and proposes that we should understand the asymmetry as due to a fundamental causal constraint. The book's overarching philosophical thesis is that standard philosophical accounts that strictly identify scientific theories with a mathematical formalism and a mapping function specifying the theory's ontology are inadequate, since they permit neither inconsistent yet genuinely successful theories nor thick causal notions to be part of fundamental physics. Deepfakes are a new form of synthetic media that broke upon the world in 2017. Bringing photoshopping to video, deepfakes replace people in existing videos with someone else’s likeness. Currently most of their reach is limited to pornography, and they are also used to discredit people. However, deepfake technology has many epistemic promises and perils, which concern how we fare as knowers. Our goal is to help set an agenda around these matters, to make sure this technology can help realize (...) epistemic rights and epistemic justice and unleash human creativity, rather than inflict epistemic wrongs of any sort. Our project is exploratory in nature, and we do not aim to offer conclusive answers at this early stage. There is a need to remain vigilant to make sure the downsides do not outweigh the upsides, and that will be a tall order. (shrink)

Les premiers travaux réalisés sur les effets du confinement du printemps 2020 sur les enfants ont établi que ceux qui étaient en résidence alternée l’avaient mieux vécu que les autres. L’objectif de cet article est de comprendre pourquoi. À partir de l’enquête Sapris et plus particulièrement du sous-échantillon des enfants âgés de 8-9 ans des cohortes Elfe et Epipage2, nous comparons les conséquences du confinement sur les enfants selon la structure familiale dans laquelle ils vivaient. Continu dans les familles nucléaires, (...) le temps familial est habituellement beaucoup plus fractionné entre les résidences des parents pour les enfants de familles séparées. Le confinement est venu transformer les expériences habituelles du temps familial pour les enfants, aussi bien dans son organisation que dans sa texture. Il a modifié leur cadre de vie ordinaire, en réorganisant leurs occupations au quotidien et en modifiant leurs relations avec leurs parents. En observant particulièrement les différences apparues entre les résidences alternées qui ont continué et celles qui ont été interrompues, nous montrons que si les mouvements réguliers des enfants ont pu constituer une respiration bienvenue pour les différents acteurs concernés, les alternances interrompues ont ouvert des espaces exceptionnels dans lesquels il a été possible de renouer avec des formes passées de continuité familiale. This paper provides a survey of several philosophical issues arising in classical electrodynamics arguing that there is a philosophically rich set of problems in theories of classical physics that have not yet received the attention by philosophers that they deserve. One issue, which is connected to the philosophy of causation, concerns the temporal asymmetry exhibited by radiation fields in the presence of wave sources. Physicists and philosophers disagree on whether this asymmetry reflects a fundamental causal asymmetry or is due to (...) statistical or thermodynamic considerations. I suggest that an explanation appealing to the asymmetry of causation is more promising. Another issue concerns the conceptual structure of the theory. Despite its empirical success, classical electrodynamics faces serious foundational problems. Models of charged particles involve what by the theory's own lights are idealizations, I maintain, and this is a feature that is not readily captured by traditional philosophical accounts of scientific theories. Other issues I discuss concern (i) the relation between Lorentz's theory of the electron and Einstein's Theory of Special Relativity; (ii) the notion of the domain of a theory, the question of theory reduction, and the relation between classical and more fundamental quantum theories; and (iii) the role of locality constraints, their relation to the concept of causation; and the status of locality conditions in the semi-classical theory of the Aharanov-Bohm effect. 1. Let me begin by distinguishing two conceptions of guilt. The first conceives of guilt as an experience of reprehensible failure in response to specific actions. I feel guilty if I break a promise for reasons that cannot justify this transgression. This conception of guilt as a responsive attitude, which I call locally- reactive guilt, captures a tension in one’s agency that arises from a local failure. The second conception understands guilt as a condition that shapes one’s whole existence. Guilt, (...) on this view, is a persistent feeling of imperfection. Such guilt, existential guilt, presupposes a reference point vis-à-vis which one’s life is so experienced. This reference is most plausibly a shared understanding of moral perfection within a community that is so demanding as to make it hard or impossible to live up to its standards. While the adoption of the Christian God offers one explanation for the emergence of such a shared understanding, other explanations of existential guilt are possible (see section 5 below). Existential guilt manifests itself especially in locally-reactive guilt, but there can be locallyreactive guilt without existential guilt. I submit that Nietzsche is not particularly interested in locally-reactive guilt, and that his vision of the future of humanity can accommodate such guilt. That conception of guilt, at any rate, is not tied to the Christian sittliche Weltordnung that Nietzsche attacks, or to other thick metaphysical or ethical views. Locallyreactive guilt merely presupposes that some set of expectations is in place and perceived as binding. What Nietzsche is interested in is existential guilt. As far as the Genealogy is concerned, this is to some extent a hermeneutical preconception based on my understanding of the German-speaking or otherwise European culture in which Nietzsche operated—a culture in which religious diversity generally amounted merely to the joint presence of Catholics and Lutherans (or, in some places, other Protestants) in the same area, interspersed with relatively small groups of Jews, and in which the Christian legacy was prevalent across all sections of culture.. Current debates surrounding Aristotle's Politics involve attempts to explain the role of political participation in the pursuit of Aristotle's human telos, eudaimonia. Many argue that political participation is crucial to eudaimonia, equating the good man with the good citizen. Often this argument is based on Aristotle's labelling of humans as zoon politikon, or ‘political animal’, and the misleading translation of eudaimonia as ‘happiness’. We provide supported explanations of eudaimonia and zoon politikon which do not force us to equate the good (...) man and the good citizen. We illustrate Aristotle's analogy between the eudaimon man and the eudaimon polis and emphasize the role political participation sometimes plays in the pursuit of eudaimonia. On the basis of this evidence, we argue that Aristotle did not equate the good man with the good citizen necessarily, nor did he find political participation essential to eudaimonia. We then demonstrate that even without political participation, the polis plays a unique role in the pursuit of eudaimonia. (shrink)

Much has been written on the role of causal notions and causal reasoning in the so-called 'special sciences' and in common sense. But does causal reasoning also play a role in physics? Mathias Frisch argues that, contrary to what influential philosophical arguments purport to show, the answer is yes. Time-asymmetric causal structures are as integral a part of the representational toolkit of physics as a theory's dynamical equations. Frisch develops his argument partly through a critique of anti-causal arguments and (...) partly through a detailed examination of actual examples of causal notions in physics, including causal principles invoked in linear response theory and in representations of radiation phenomena. Offering a new perspective on the nature of scientific theories and causal reasoning, this book will be of interest to professional philosophers, graduate students, and anyone interested in the role of causal thinking in science. ALTHOUGH majority rule finds ready acceptance whenever groups make decisions, there are surprisingly few philosophically interesting arguments in support of it.1 Jeremy Waldron’s The Dignity of Legislation contains the most interesting recent defense of majority rule. Waldron combines his own argument from respect with May’s influential characterization of majority rule, tying both to a reinterpretation of a well-known passage from Locke’s Second Treatise (“the body moves into the direction determined by the majority of forces”). Despite its impressive resourcefulness, Waldron’s defense (...) is deficient, and one goal of this essay is to show how. Yet our main concern is not to criticize Waldron, but to demonstrate general deficiencies of arguments for majority rule and to suggest a strategy for a more adequate and more complete defense. Such arguments tend to have one of two weaknesses: Either they assume that collective decisionmaking is done in terms of ranking options and thus neglect both aggregation methods using more information than the relative standing of options in rankings (such as so-called positional methods) and rules that are not aggregation methods at all (such as fair-division procedures); or they also constitute arguments for other decision rules. In the first case, the argument is too narrow, in the second it is too broad. The narrowness problem is bigger than stated so far because arguments for majority rule tend to assume not only that decisions are made by ranking options, but also that only two options are to be ranked. Both problems arise for Waldron’s defense and leave it incomplete. Yet such incompleteness also characterizes the state of the art in arguing for majority rule. So in addition to.. (shrink)

Mathias Albert versteht das Arbeitsgebiet der Internationalen Beziehungen (also der Lehre und Forschung über diesen Gegenstandsbereich) als jenen Teilbereich der Sozialwissenschaften, der sich mit der Weltordnung befaßt. In Frisch 2004 and 2005 I showed that the standard ways of modeling particle-field interactions in classical electrodynamics, which exclude the interactions of a particle with its own field, results in a formal inconsistency, and I argued that attempts to include the self-field lead to numerous conceptual problems. In this paper I respond to criticism of my account in Belot 2007 and Muller 2007. Clinical Study Agreements can have profound effects both on the protection of human subjects and on the independence of investigators to conduct research with scientific integrity. Sponsors, institutions, and even investigators may fail to give adequate attention to these issues in the negotiation of CSAs. Despite the key role of CSAs in structuring ethically important aspects of research, they remain largely unregulated and unreviewed for adherence to ethical norms. Academic institutions routinely enter into research contracts that fail to meet adequate (...) ethical standards. This is a failing that can have serious consequences.Accordingly, it is necessary that some independent body have the authority both to review research contracts for compliance with norms of subject protection and ethical integrity, and to reject studies that fail to meet ethical standards. Such review should take place prior to the start of research, not later. Because of its expertise and authority, the institutional ethics review board is the appropriate body to undertake such review. Much recent commentary has focused on contractual restrictions on the investigator’s freedom to publish research findings. The Olivieri experience, and that of other investigators, has brought freedom of publication issues into sharp focus. Clinical study agreements also raise a number of other ethical issues relating to human subjects and research integrity, however, including disclosures relating to patient safety, data analysis and reporting, budget, confidentiality, and premature termination of the study. This paper describes the ethical issues at stake in structuring such agreements and suggests ethical standards to guide institutional ethics review. (shrink)

According to a view widely held among philosophers of science, the notion of cause has no legitimate role to play in mature theories of physics. In this paper I investigate the role of what physicists themselves identify as causal principles in the derivation of dispersion relations. I argue that this case study constitutes a counterexample to the popular view and that causal principles can function as genuine factual constraints. 1. Introduction2. Concentrating on the formative periods for both philosophers, the work examines their early education, as well as the interlacing of the philosophy of art and history in their concept of art. The final section treats works by both philosophers on the philosophy of art from their early years. Le fondement theorique est l'approche de la periode de formation, encore peu etudiee, des deux philosophes. Many philosophers have adopted epistemic expressivism in recent years. The core commitment of epistemic expressivism is that epistemic claims express conative states. This paper assesses the plausibility of this commitment. First, we raise a new type of problem for epistemic expressivism, the epistemic motivation problem. The problem arises because epistemic expressivists must provide an account of the motivational force of epistemic judgment (the mental state expressed by an epistemic claim), yet various features of our mental economy seem to show that (...) they can’t do so. Second, we develop what we take to be the most promising response to that problem for expressivists. We end by noting that this response faces an important challenge pertaining to the psychology of epistemic criticism and praise. (shrink)

Evolution seems tobe a perfect example of a historical process: It began with the earliest “living” units, progressed to massive diversity and disparity, and resulted in our recent lifeworld, the subject-matter of the evolutionary biologist. Yet some irritation remains considering the logical grammar of “history”, as it seems to introduce non-functional aspects into evolutionary theory – which is often addressed as contingency in evolutionary biology. But even reducing the “historical” aspect of evolutionary biology to a functional understanding of lifeworld, we (...) have to consider the specific historicity of the epistemic situation of the evolutionary biologist. This paper argues for the relevance of the explication of this peculiar epistemic situation, taking into account the recent systemic transformations of evolutionary theory.The argument is developed in three steps: first, a revision of the use of temporal expressions in (bio-)sciences, revealing the prevalence of a non-modal understanding of time, which leads to “thin” temporal characterizations of biological processes. Second, based upon biology’s shift toward system paradigms, the formal structure of recent evolutionary approaches is shown to result in a “loss of historicity”. Finally, the consequences for the self-understanding of humans as evolutionary lifeforms are explicated.This reconstruction of the difference between historical and evolutionary judgment emphasizes the relevance of the modal aspects of temporality, which is demonstrated by considering a significant shift of the underlying temporal frames. Accordingly to human beings as historical entities, the differences between natural history, prehistory and history proper are relocated within the concept of history itself. (shrink)

Political philosophy is mostly what I do, and in one way or another, it’s organized around ideas about justice. Often, my work focuses on problems that are present in public political discourse, which then I try to approach by offering a solution to them that is tied to philosophically acceptable foundations. For a few years now, my work has been concerned with building a constructive theory of the “grounds of justice” at the global level. The book that is in the (...) process of emerging is called "The Grounds of Justice: An Inquiry about the State in Global Perspective," and is under contract with Princeton University Press. Since I've been working on this project for a while, and since I have been presenting bits and pieces of it at numerous conferences and colloquia, I'm putting the first thirteen chapters up here, so that people who are interested in this work can see how it all fits together. Many climate scientists have made claims that may suggest that evidence used in tuning or calibrating a climate model cannot be used to evaluate the model. By contrast, the philosophers Katie Steele and Charlotte Werndl have argued that, at least within the context of Bayesian confirmation theory, tuning is simply an instance of hypothesis testing. In this paper I argue for a weak predictivism and in support of a nuanced reading of climate scientists’ concerns about tuning: there are cases, model-tuning (...) among them, in which predictive successes are more highly confirmatory of a model than accommodation of evidence. This study examined possible ways to ensure that participants provide fully informed consent for online surveys. Participants were randomly assigned to read either a traditional informed consent or one of three modified versions: enhanced, consent for each key element, or a combination of these two. Those who read the combination version scored higher on a comprehension quiz, guessed at fewer questions, and were more likely to read all of the informed consent than those who received the traditional version. These findings (...) suggest that comprehension can be improved by adopting alternatives to the traditional informed consent. (shrink)

in Dirac's classical theory of the electron—is causally non-local. I distinguish two distinct causal locality principles and argue, using Dirac's theory as my main case study, that neither can be reduced to a non-causal principle of local determinism.

Classical dispersion relations are derived from a time-asymmetric constraint. I argue that the standard causal interpretation of this constraint plays a scientifically legitimate role in dispersion theory, and hence provides a counterexample to the causal skepticism advanced by John Norton and others. Norton ([2009]) argues that the causal interpretation of the time-asymmetric constraint is an empty honorific and that the constraint can be motivated by purely non-causal considerations. In this paper I respond to Norton's criticisms and argue that Norton's skepticism (...) derives its force partly by holding causal principles to a standard too high to be met by other scientifically legitimate constraints. Though much attention has been paid to different principles of justice, far less has been done reflecting on what the larger concern behind the notion is. In this work, Mathias Risse proposes that the perennial quest for justice is about ensuring that each individual has an appropriate place in what our uniquely human capacities permit us to build, produce, and maintain, and is appropriately respected for the capacity to hold such a place to begin with. Risse begins by investigating (...) the role of political philosophers and exploring how to think about the global context where philosophical inquiry occurs. Next, he offers a quasi-historical narrative about how the notion of distributive justice identifies a genuinely human concern that arises independently of cultural context and has developed into the one we should adopt now. Finally, he investigates the core terms of this view, including stringency, moral value, ground and duties of justice. (shrink)
