Although corruption is ubiquitous, attitudes toward it differ among countries. Until the 1997 OECD Convention, the U.S. had been one of the only two countries with an explicit extraterritorial anti-bribery law, the Foreign Corrupt Practices Act (FCPA) of 1977. The FCPA employs a two-pronged approach to control the supply side of corruption: (1) anti-bribery provisions; and (2) accounting (books and record and internal controls) provisions. I offer evidence, albeit indirect, to show that the FCPA had limited success. The OECD Convention (...) adopts the same two-pronged approach, but, since it is a multilateral treaty, is likely to be more successful provided that enforcement is vigorous enough. The signatory nations effectively form a cartel to reduce the cost of doing business. As with any cartel, however, each multinational corporation has an incentive to deviate. Thus, the mutual enforcement of the agreement is crucial for its success. However, the two-pronged approach is not sufficient, since internal control does not adequately monitor decisions made at the top level. I argue that the two lessons drawn from the U.S. experience are: (1) law enforcement must be credible; and (2) internal controls alone are not sufficient. Stronger and more effective corporate governance within an appropriate regulatory framework is needed to ensure that multinational corporations conduct their business in an ethical manner. (shrink)

In Kagaku no Sekai to Kokoro no Tetsugaku, Mr.Michio Kobayashi features on Descartes' theory of minds as "subjecitive-active consciousness", and defends it against the materialist movement. I show that Kobayashi's method has a difficulty for defending existence of our minds because Descartes didn't allow the scientific investigation of our mental experience from outside,and so cannot appropriately grasp the significance of other minds.

By living together in a residential community, and by showing and sharing the process of art making, to what extent can aesthetic, cultural, and social issues and concerns expressed by artists be interpreted by local residents? These are the main issues addressed in this essay. 1 The artistic and aesthetic education provided in the community gradually opened up a dialogue not only between foreign artists as guests and Japanese spectators as hosts, but also between art and people, culture and culture, and people and people within the local community. Outline of the Project The Cultural Exchange House, situated in Yamaguchi prefecture, has accommodated about forty artists-in-residence from abroad for over ten years. The forty artists who have stayed there include painters, potters, sculptors, photographers, pianists, musicians, composers, poets, and writers. Artists are responsible for their travel and living expenses. The use of the house is provided without charge and the needs of the artists are met by volunteers. About half of the artists have been German and the rest from Britain, Belgium, United States, Holland, and Australia. Male and female artists have been nearly equally represented.Beginning with three, there are now sixteen volunteers who felt that the creation of a cultural environment, or more specifically the creation of access to the world of art was important for the community. They saw the need for the local community to provide children and adults with aesthetic experiences that could enrich their internal and external worlds. Increasing numbers of children were leaving the community to attend schools and get jobs, with little possibility of returning. The volunteers felt that one of their roles was to educate children and their parents so that they could encounter values different from their own, develop self-confidence, and take pride in the local community which had such cultural opportunities. They assumed that art could open people's minds to the world outside their existing cultural framework, and that it would be valuable to have artists from the outside world as their neighbors and friends. However, the people who came to Yamaguchi said that they were especially attracted to life in a rural community; they hoped to experience the "real life" of the Japanese. Since the projectcould offer no grants for travel and other daily expenses, the communitydecided that they had little hope of attracting well-known artists. Instead, they invited younger lesser-known artists with potential, who did not mind the limited conditions and who welcomed a new cultural experience which might stimulate or broaden their approach to art. The contract stated that the artists should participate in cultural exchange programs, such as visiting schools and community centers to hold art workshops, and also, at the end of their stay, to share their experiences of the residency in the form of an exhibition or a concert. The degree to which this contract was kept varied. In searching for an appropriate utility function in the expected utility framework, we formulate four properties that we want the utility function to satisfy. We conduct a search for such a function, and we identify Pareto utility as a function satisfying all four desired properties. Pareto utility is a flexible yet simple and parsimonious two-parameter family. It exhibits decreasing absolute risk aversion and increasing but bounded relative risk aversion. It is applicable irrespective of the probability distribution relevant to the prospect (...) to be evaluated. Pareto utility is therefore particularly suited for catastrophic risk analysis. A new and related class of generalized exponential (gexpo) utility functions is also studied. This class is particularly relevant in situations where absolute risk tolerance is thought to be concave rather than linear. (shrink)

We study how changes in unemployment risk affect firms’ productivity and whether firm-initiated policies can mitigate the moral hazard problem created by increases in unemployment insurance benefits that might decrease workers’ incentives to work hard. We focus on state-specific changes in UIB levels as a quasi-natural experiment. While a large body of research has examined UIBs, including their effect on unemployed workers, few studies investigate whether UIBs have any impact on a firm’s overall productivity. Using data on firm-level total factor (...) productivity and state-level UIBs, we find a negative association between productivity and UIBs. We also find that the negative association is weaker for firms with higher employee-welfare indices than for firms with lower indices, suggesting that the adverse effect of higher UIBs on productivity is mitigated by policies that benefit workers’ welfare. More specifically, we find that among policies that are under the umbrella of corporate social responsibility, a subset of employee-welfare policies are more effective in managing moral hazard problems than other policies. In recent years many essays have been made public and various opinions have been advanced on youth. I would like to conceive one of the salient characteristics in the consciousness and the behavior pattern of today's youth as “play-orientedness” and center my discussion on that particular inclination. “Play-orientedness” here is not intended to mean merely “activeness in sports and hobbies,” nor is it synonymous with “pleasure-orientedness.” It is a broader term and is rather close in meaning to what is commonly (...) called “the spirit of play.” We might perhaps define it as “play as a way of life,” or an inclination to introduce elements of “play” into one's daily life and make his actual life “play-like.”. A dialectical contradiction can be appropriately described within the framework of classical formal logic. It is in harmony with the law of noncontradiction. According to our definition, two theories make up a dialectical contradiction if each of them is consistent and their union is inconsistent. It can happen that each of these two theories has an intended model. Plenty of examples are to be found in the history of science.

The understanding of Buddhist concepts by Meiji philosophers was philosophical in its content, and those who devoted themselves to the study of Western philosophy were encouraged to describe Eastern thought in Western philosophical terms. This paper offers a new insight on the Condorcet Jury Theorem (CJT) in the theory of epistemic democracy. This theorem states that democratic decision-making leads us to correct outcomes under certain assumptions. One key assumption is the ‘independence condition’, which requires that voters form their beliefs independently when they vote. This paper examines the role of an opinion leader as an informational source, which potentially violates independence. We demonstrate that voters’ beliefs may be correlated in the presence of the leader, (...) and that the CJT can fail if the leader’s opinions are reliable. This leads us to the following paradoxical observation: for epistemic democracy, good leaders may be bad, while bad leaders may be good. (shrink)

It is often argued that relational egalitarianism has a fundamental problem with intergenerational justice when compared to other theories of justice such as utilitarianism, prioritarianism, and luck egalitarianism. Recently, Timothy Sommers argued that there is no such comparative disadvantage for relational egalitarianism. His argument is quite modest: it merely aims to reject the claim that there could be no way to extend relational egalitarianism to intergenerational justice. This may be called the ‘No Comparative Disadvantage Thesis’. The present article challenges Sommers’s (...) argument in two ways. First, I show that Sommers fails to provide a reasonable constraint on causal efficacy, which is crucial to his argument for our relation (not relationship) to future generations. Second, I show that the chain-relatedness problem casts a shadow over Sommers’s argument for the No Comparative Disadvantage Thesis. More specifically, compared to the other theories of justice, relational egalitarianism (as it stands) can less easily justify that present persons have duties to future others. This is because relational egalitarianism cannot appeal to a specific principle in regard to the duties in question, because its principle is sensitive to current context and practice. I conclude that the No Comparative Disadvantage Thesis does not hold much promise. (shrink)

This pilot study examines how a number of American and Japanese journalists make the tough calls regarding an escalating social problem: whether to identify juveniles who have been charged with serious capital crimes. Divergent societal and journalistic values of the two countries are explored via a survey of journalists from Honolulu and Hiroshima. Newsroom policies and practices are described regarding general and specific cases of juvenile crime. In general, Japanese journalists are far more likely than U.S. journalists to withhold names. ResumoEste artigo analisa o reendereçamento da obra Fita verde no cabelo: nova velha estória ao público infantojuvenil. Em 1992, o conto de Guimarães Rosa foi reeditado pela Nova Fronteira, contando com novo projeto gráfico e com as ilustrações de Roger Mello, em edição dedicada ao público jovem. Além de observar o modo como a obra busca o diálogo com esse público em níveis textuais e imagéticos, o estudo concentra-se na análise das ilustrações. Verifica-se a hipótese de que as imagens, em (...) vez de apenas facilitarem a leitura para um público específico, expandem o sentido da obra original contemplando todos os públicos. This study focuses not only on how the story is looking for dialogue with the young audience in written-text and visual-image levels, but also in the analysis of illustrations. We verify the hypothesis that the images do not facilitate the reading process for a specific audience, for they are in turn ways to expand the meanings of the original work. In this article, I argue that Powers and Faden’s non-ideal, comprehensive theory of justice cannot keep in line with the proposed moderateness of their essentialist approach. My argument is as follows: Powers and Faden’s comprehensive theory of justice contravenes the thrust of moderate essentialism, in claiming that their theory values health for its own sake. Why do they define their conception of justice as valuing health for its own sake when it is likely to be incongruous with their essentialist approach? (...) To understand this, we should examine their sufficientarian proposal. There are two requirements for plausible sufficientarianism. The first requirement is to specify the threshold below which people are seriously deprived and must be urgently benefited in a non-arbitrary manner. The second requirement is that sufficientarianism should be sensitive to certain inequalities above the threshold. Powers and Faden’s approach convincingly meets the first requirement. However, the non-ideal aspect of their approach, which is key to meeting the second requirement, makes it explicit that at least one of the listed dimensions of well-being must be valued for their own sake. This is not reconcilable with their own characterization of moderate essentialism. For this reason, we should conclude that Powers and Faden fail to argue for moderate essentialism. (shrink)

In this paper, we shall give another proof of the faithfulness of Blass translation of the propositional fragment \ of Leśniewski’s ontology in the modal logic \ by means of Hintikka formula. And we extend the result to von Wright-type deontic logics, i.e., ten Smiley-Hanson systems of monadic deontic logic. As a result of observing the proofs we shall give general theorems on the faithfulness of B-translation with respect to normal modal logics complete to certain sets of well-known accessibility relations (...) with a restriction that transitivity and symmetry are not set at the same time. As an application of the theorems, for example, B-translation is faithful for the provability logic \ ), that is, \ \ \ \supset \Box \phi \). This theoretical paper develops a conceptual framework that explains how companies can influence consumer behavior in terms of both social and business benefits through their corporate social marketing initiatives. Drawing from the source credibility literature, the article asserts that the effectiveness of CSM depends largely on the corporate credibility of a company in supporting a social cause. Based on this assertion, the framework identifies ten different antecedents of CSM credibility, which are organized into attributes of the company, attributes of the (...) CSM initiative, and attributes of the cause. Furthermore, this framework shows that CSM credibility affects the two examined consequences, intended prosocial behavior and consumer loyalty. Several research and managerial implications are developed based on the propositions specified in the framework. (shrink)
