Modern moral and political philosophy is in debt with natural law theory, both in its ancient and mediaeval elaborations. While the very notion of a natural law has proved highly controversial among 20th Century scholars, the last decades have witnessed a renewed interest in it. Indeed, the threats and challenges as result of multiculturalism, plural societies and global changes have generated a renewed attention to natural law theory. Clearly, it offers solid basis as possible framework to a better understanding of (...) human goods without contradictions and partial bias. The purpose of the present volume is to provide an overview of the history of this concept (Cicero, St. Paul, Aquinas, Melanchthon, Montaigne, Descartes, Leibniz, Hume, Burke, Kant, MacIntyre, etc.) as well as a deep understanding of ongoing research, both in Europe and in America. Furthermore, the specificity of these studies will be of particular value to philosophers, law-philosophers, historians, anthropologists, sociologists and theologians, and those concerned on such issues as the relation between law and moral norm, law and practical reason, and the presence of the idea of natural law in several prominent thinkers. It includes a selected bibliography on natural law. The book also provides an excellent introduction to several of the major topics in natural law theory making it useful both as a reference text and as a sourcebook for academics alike. Natural law is a rich, complex, and highly disputed term. Since its first appearances in the history of Western civilization, it has been used both to point to God as the source of the moral order and to assert that there is an objective order of justice in nature that men and their laws ought to respect. In modern times, natural law theory gave birth to what we usually call "human rights." Unlike the meaning of the term, the importance of an ongoing debate on natural law and on the theories related to it is undisputable. This is why I welcome today this new collection of essays edited by Alejandro Nèstor Garcìa Martìnez, Mario Å ilar and Josè M. Torralba. Natural Law: Historical, Systematic and Juridical Approaches includes a wide variety of studies, covering key authors and issues in natural law theory. Younger students will appreciate the clarity of the chapters, and more trained readers the detailed and accurate bibliographical references that each of them offers. The editors's choice to go from a historical approach to contemporary theories, and then to theoretical and more practical issues is also commendable. The ceremony of gathering twelve-year old children together in each parish for the first sacrament of the Eucharist is not an old custom. The primitive Church took Christ's word literally: “Except ye eat the flesh of the Son of man, and drink his blood, ye have no life in you.” (John, VI, 53), from which it was generally thought that children who died before having received communion were as damned as if they had not been baptised. The initiation of neophytes (...) required successively both sacraments and confirmation. When the custom was established of baptising the new born (2nd and 3rd centuries) they received communion at the same time. This paper examines contemporary developments in legal philosophy and in ethics with a view to a possibile reunification of moral philosophy on Kantian principles. With regard to legal philosophy, it notes the difficulty of an empiricist account of natural rights and relates it to the problem of obligation to apply with juridical laws. It then considers Kant's solution to problems regarding the concepts of obligation and of a right encountered by his predecessors in the natural rights tradition, whom he would (...) classify as empiricists. Turning form "The Droctrine of Right" to "The Doctrine of Virtue," it evaluates the assertion that Kant, as distinguished from "virtue ethics," has an "ethics of rules" modelled on law rather than an "ethics of character." Der Beitrag befaßt sich mit gegenwärtigen Entwicklungen im Bereich von Rechtsphilosophie und Ethik mit dem Ziel einer möglichen Wiedervereinigung der Moralphilosophie nach kantischen Prinzipien. In bezug auf die Rechtsphilosophie betont er die Schwierigkeit eines empiristischen Verständnisses von Naturrechten und bezieht diese Schwierigkeit auf das Problem der Verbindlichkeit juridischer Gesetze. St. Augustine of Hippo wrote the ’De Trinitate’ to explain to critics of the Nicene Creed how the Christian doctrine of the divinity and coequality of Father, Son, and Holy Spirit is present in Scripture. He also wanted to convince philosophers that Christ is the Wisdom they sought. Augustine’s third purpose was to correlate the biblical truth that all human persons are created to image God, a Trinity, a communion of love, with the first two Commandments of the Old and (...) New Testaments. Augustine succeeded in showing the need for combining faith and reason for a greater understanding of Scripture as well as for a greater understanding of the true nature and destiny of human persons. Augustine emphasized the scriptural revelation of God as Father, Son, and Holy Spirit, and used reason to convince philosophers that the one and three-Personed God is philosophically and logically defensible. We hypothesize that effective collaboration is facilitated when individuals and environmental components form a synergy where they work together and regulate one another to produce stable patterns of behavior, or regularity, as well as adaptively reorganize to form new behaviors, or irregularity. We tested this hypothesis in a study with 32 triads who collaboratively solved a challenging visual computer programming task for 20 min following an introductory warm‐up phase. Multidimensional recurrence quantification analysis was used to examine fine‐grained (i.e., every 10 (...) s) collective patterns of regularity across team members' speech rate, body movement, and team interaction with the shared user interface. We found that teams exhibited significant patterns of regularity as compared to shuffled baselines, but there were no systematic trends in regularity across time. We also found that periods of regularity were associated with a reduction in overall behavior. Notably, the production of irregular behavior predicted expert‐coded metrics of collaborative activity, such as teams' ability to construct shared knowledge and effectively negotiate and coordinate execution of solutions, net of overall behavioral production and behavioral self‐similarity. Our findings support the theory that groups can interact to form interpersonal synergies and indicate that information about system‐level dynamics is a viable way to understand and predict effective collaborative processes. This fourth and final volume of writings by Elizabeth Anscombe reprints her _ Introduction to Wittgenstein's Tractatus_, together with a number of later essays on thought and language in which she explores issues of reason, representation, truth and existence. As with previous volumes this gathers hitherto inaccessible publications and previously unpublished texts. Singly and collectively the four volumes provide for a broader and deeper understanding of the thought of one of the twentieth century's most important anglophone philosophers.

Logic, Methodology, and the Philosophy of Science, the Proceedings of the 1960 International Congress at Stanford, is heavily weighted towards technical problems of logic, foundations of mathematics, and the special sciences, especially psychology, economic models, and structural linguistics, with little discussion of general problems of the philosophy of science. Problems about the idealization involved in the relation of theories to the world become problems about probabilistic models at various levels of abstraction ; induction becomes a problem in decision theory ; (...) language becomes the subject-matter of formalized syntactics, and so on. There is nothing in the least undesirable about these inquiries in a Philosophy of Science Congress, but there is a danger that, if they are not balanced by more informal discussions, real points of dispute are missed, or decided over-hastily in the brief preliminaries of formalization. The philosopher's job ought sometimes to be the more irritating one of returning to these points of dispute; a job which is well done in some of the contributions to this volume, but one could wish to find it being done in more. In what follows I shall have to restrict myself to commenting on only a handful of these more philosophical papers. (shrink)

In _Michael Polanyi and His Generation_, Mary Jo Nye investigates the role that Michael Polanyi and several of his contemporaries played in the emergence of the social turn in the philosophy of science. This turn involved seeing science as a socially based enterprise that does not rely on empiricism and reason alone but on social communities, behavioral norms, and personal commitments. Nye argues that the roots of the social turn are to be found in the scientific culture and political (...) events of Europe in the 1930s, when scientific intellectuals struggled to defend the universal status of scientific knowledge and to justify public support for science in an era of economic catastrophe, Stalinism and Fascism, and increased demands for applications of science to industry and social welfare. At the center of this struggle was Polanyi, who Nye contends was one of the first advocates of this new conception of science. Nye reconstructs Polanyi’s scientific and political milieus in Budapest, Berlin, and Manchester from the 1910s to the 1950s and explains how he and other natural scientists and social scientists of his generation—including J. D. Bernal, Ludwik Fleck, Karl Mannheim, and Robert K. Merton—and the next, such as Thomas Kuhn, forged a politically charged philosophy of science, one that newly emphasized the social construction of science. (shrink)

Public health care interventions—regarding vaccination, obesity, and HIV, for example—standardly take the form of information dissemination across a community. But information networks can vary importantly between different ethnic communities, as can levels of trust in information from different sources. We use data from the Greater Pittsburgh Random Household Health Survey to construct models of information networks for White and Black communities--models which reflect the degree of information contact between individuals, with degrees of trust in information from various sources correlated with (...) positions in that social network. With simple assumptions regarding belief change and social reinforcement, we use those modeled networks to build dynamic agent-based models of how information can be expected to flow and how beliefs can be expected to change across each community. With contrasting information from governmental and religious sources, the results show importantly different dynamic patterns of belief polarization within the two communities. (shrink)

As the efficiency and reach of global fishing has grown, overfishing has unwittingly undermined the industry’s future while at the same time depriving poor people of a dietary staple. Several problems that most concern the critics of globalization come into play: undermining the power of governments to protect their environments and citizens, an economic system that robs the poor and future generations of basic necessities, and market developments that undercut long term economic and environmental stability. I examine how creative institutional (...) measures could avert total collapse of ocean ecosystems despite the complexity of enacting marine ethics in a globalized economy. I look at companies that work with the Marine Stewardship Council’s criteria as well as more creative measures including revamped marketing and changes in how members of the industry work together in order to encourage long term environmental and economic sustainability. Background: Clinical investigation is a growing field employing increasing numbers of nurses. This has created a new specialty practice defined by aspects unique to nursing in a clinical research context: the objectives (to implement research protocols and advance science), setting (research facilities), and nature of the nurse–participant relationship. The clinical research nurse role may give rise to feelings of ethical conflict between aspects of protocol implementation and the duty of patient advocacy, a primary nursing responsibility. Little is known about whether (...) research nurses experience unique ethical challenges distinct from those experienced by nurses in traditional patient-care settings. Research objectives: The purpose of the study was to describe the nature of ethical challenges experienced by clinical research nurses within the context of their practice. Research design: The study utilized a qualitative descriptive design with individual interviews. Participants and research context: Participating nurses (N = 12) self-identified as having experienced ethical challenges during screening. The majority were Caucasian (90%), female (83%), and worked in outpatient settings (67%). Approximately 50% had > 10 years of research experience. Ethical considerations: The human subjects review board approved the study. Written informed consent was obtained. Findings: Predominant themes were revealed: (1) the inability to provide a probable good, or/do no harm, and (2) dual obligations (identity as a nurse vs a research nurse). The following patterns and subthemes emerged: conflicted allegiances between protocol implementation, needs of the participant, desire to advance science, and tension between the nurse–patient therapeutic relationship versus the research relationship. Discussion: Participants described ethical challenges specific to the research role. The issues are central to the nurse–participant relationship, patient advocacy, the nurse’s role in implementing protocols, and/or advancing science. Conclusion: Ethical challenges related to the specialized role of clinical research nurses were identified. More research is warranted to fully understand their nature and frequency and to identify support systems for resolution. (shrink)

Question universities' increasing reliance on market-oriented metrics to determine their strategic directions and gauge faculty productivity.

This paper challenges contemporary portrayals in the nursing literature of the spaces within which care of patients in hospital settings is conducted. Within the wider discourse of fiscal restraint on health care spending, professional nursing has cast its disciplined eyes on details of the nurse‐patient relationship for the ostensible purpose of repairing that which is treated as individual failings of nurses to practise in ways prescribed by nursing theories. Set aside in this approach to the so‐called ‘problems’ of nursing practice (...) has been an examination of the conditions within which nurses come in contact with patients, and a critical recognition that such contacts represent skilled accomplishments of social action. In this paper, these conditions are treated as resources available to both nurses and patients to generate accounts for the nurse's presence as well as the nurse's absence. Examples from an ethnographic study of nursing practice are used to illustrate how the spaces operating between nurses and patients are not empty voids but aresocialspaces through which particular meanings about nursing care can be conveyed. A virtue ethics look at Dolly Parton's magnificence and greatness of soul. Dolly isn't an exemplar so much as the one who we must "bless rather than praise," and so becomes the focus of broad public honor and even love.

By a potential person I shall mean an entity which is not now a person but which is capable of developing into a person, given certain biologically and/or technologically possible conditions. This is admittedly a narrower sense than some would attach to the term ‘potential'. After all, people of the twenty-fifth century, if such there will be, are in some sense potential people now, even though the specific biological entities from which they will develop, i.e. the particular gametes or concepti, (...) do not yet exist. For there do exist, in the reproductive capacities of people now living and in the earth's resources, conditions adequate to produce these future people eventually, provided of course that various possible catastrophes are avoided. Indeed, in some sense of ‘potential’ there have been countless billions of potential people from the beginning of time. But I am concerned not with such remote potentialities but with currently existing entities that are capable of developing into people. (shrink)

This is the first modern edition of the works of Lady Mary Shepherd, one of the most important women philosophers of the early modern period. Shepherd has been widely neglected in the history of philosophy, but her work engaged with the dominant philosophers of the time - among them Hume, Berkeley, and Reid. In particular, her 1827 volume Essays on the Perception of an External Universe outlines a theory of causation, perception, and knowledge which Shepherd presents as an alternative (...) to what she sees as the mistaken views of Berkeley and Hume. What she ultimately presents is an original and systematic metaphysics and epistemology. Shepherd's Essays consists of two parts. The first is a theory of perception and knowledge of the external world, which is designed to rebut idealism and skepticism about the external world and show that our ordinary beliefs are based on reason. The second is a collection of essays on topics in metaphysics and epistemology, including the immateriality and eternity of the mind, the relationship between mind and body, the possibility of miracles, the association of ideas, the relationship between physical and mathematical reasoning, and the epistemology of testimony. Antonia LoLordo's edition of Shepherd's Essays includes scholarly notes throughout the text that provide historical and philosophical context and expand on the major concepts of Shepherd's system. Her extensive introduction to Shepherd's life and works surveys some of the major points of Shepherd's system, points out directions for future research, and offers guidance for readers planning to teach her work in their courses. It is, in fact, something of an excitation, a stimulation to further thought: what is this ACTION about?' What do Stéphane Mallarmé, Antonin Artaud, Meret Oppenheim, Asger Jorn, Yoko Ono, Tom Phillips and Martin Arnold have in common? Whereas a wealth of critics have diagnosed contemporary art's preoccupations with (...) madness, depression and self-abuse as well as its tendency to cultivate an (anti- )aesthetics of the negative, the excremental and the abject (say, from the Vienna Action Group to Serrano, McCarthy or Delvoye), much less attention has been paid to how modern and contemporary artists and public have thrived on the destruction, disfiguration and obliteration of work by the artists and/or by that of others. From Artaud's 'terminal' notebooks to the recent upsurge in 'erasure poetics', the history of 'undoing' art deserves to be recounted in a positive mode and rescued from popular narratives of the decline and death of the avant-garde. In Helen Bannerman’s Little Black Sambo, the text describes its main character as witty, brave, and resourceful. The drawings of the story’s main character which accompany this text, however, present a unique kind of harm that only becomes clear when the work is read as a collection of single-panel comics rather than an illustrated book. In this chapter, I show what happens when we read drawings in books as textless comics, and, based on how things turn out from this reading, (...) motivate why we have some substantive reason to read both Little Black Sambo and other books with drawings-as-comics. BackgroundDecision-making in initiating life-sustaining health technology is complex and often conducted at time-critical junctures in clinical care. Many of these decisions have profound, often irreversible, consequences for the child and family, as well as potential benefits for functioning, health and quality of life. Yet little is known about what influences these decisions. A systematic review of reasoning identified the range of reasons clinicians give in the literature when initiating technology dependence in a child, and as a result helps determine the (...) range of influences on these decisions.MethodsMedline, EMBASE, CINAHL, PsychINFO, Web of Science, ASSIA and Global Health Library databases were searched to identify all reasons given for the initiation of technology dependence in a child. Each reason was coded as a broad and narrow reason type, and whether it supported or rejected technology dependence.Results53 relevant papers were retained from 1604 publications, containing 116 broad reason types and 383 narrow reason types. These were grouped into broad thematic categories: clinical factors, quality of life factors, moral imperatives and duty and personal values; and whether they supported, rejected or described the initiation of technology dependence. The majority were conceptual or discussion papers, less than a third were empirical studies. Most discussed neonates and focused on end-of-life care.ConclusionsThere is a lack of empirical studies on this topic, scant knowledge about the experience of older children and their families in particular; and little written on choices made outside ‘end-of-life’ care. This review provides a sound basis for empirical research into the important influences on a child’s potential technology dependence. (shrink)

This should not need mentioning, but Richard Dawkins's book The Selfish Gene has succeeded in confusing a number of people about it, including Mr J. L. Mackie. What Mackie welcomes in Dawkins is a new, biological-looking kind of support for philosophic egoism. If this support came from Dawkins's producing important new facts, or good new interpretations of old facts, about animal life, this (...) could be very interesting. Dawkins, however, simply has a weakness for the old game of Brocken-spectre moralizing—the one where the player strikes attitudes on a peak at sunrise, gazes awe-struck at his gigantic shadow on the clouds, and reports his observations as cosmic truths. He is an uncritical philosophic egoist in the first place, and merely feeds the egoist assumption into his a priori biological speculations, only rarely glancing at the relevant facts of animal behaviour and genetics, and ignoring their failure to support him. There is nothing empirical about Dawkins. Critics have repeatedly pointed out that his notions of genetics are unworkable. I shall come to this point later, but I shall not begin with it, because, damning though it is, it may seem to some people irrelevant to his main contention. It is natural for a reader to suppose that his over-simplified drama about genes is just a convenient stylistic device, because it seems obvious that the personification of them must be just a metaphor. Indeed he himself sometimes says that it is so. But in fact this personification, in its literal sense, is essential for his whole contention; without it he is bankrupt. His central point is that the emotional nature of man is exclusively self-interested, and he argues this by claiming that all emotional nature is so. Since the emotional nature of animals clearly is not exclusively selfinterested, nor based on any long-term calculation at all, he resorts to arguing from speculations about the emotional nature of genes, which he treats as the source and archetype of all emotional nature. This strange convoluted drama must be untwisted before the full force of the objections from genetics can be understood. (shrink)
