Voluntary stopping of eating and drinking (VSED) is an increasingly popular method by which patients are choosing to hasten death when life feels unbearable. This formal act of suicide often leads to distressing symptoms, for which patients then seek palliation by medical professionals. The intentional act of hastening death is always an evil act. A Catholic physician must understand the moral implications of participating in any phase of the patient’s planning and execution of the VSED process, including cooperation in evil (...) and scandal. The Catholic physician must strive to develop a well-formed conscience and then be prepared to exercise his or her right to conscientious objection while offering an example of true compassion for the sick, the suffering, and the dying. This article explores the historicism of feminist constructivism. It focuses on the work of Judith Butler, and explores how the idea of history and elements of temporality are used in her theory of materialization. It argues that the radical historicism implied in the Jamesonian request ‘Historicize!’ can become a self-defeating enterprise. The hypothesis is that historicism has been used as a kind of ‘black box’ in feminist constructivism. The article points out the way in which constructivists rely much too easily (...) on history as evidence, and talk about history as if it stands outside construction. This ambivalence in constructivist thought is prevalent. The article proposes that feminist theorists of materiality recognize the predominance of self-evident notions of historicity in constructivist theories and start practising a strategic forgetting of history. By examining the relationship between international law and empire from early modernity to the present, this volume aims at deepening current understandings of the way international legal institutions, practices, and narratives have shaped specifically imperial ideas about and structures of world governance.

To the Uttermost Parts of the Earth shows the vital role played by legal imagination in the formation of the international order during 1300–1870. It discusses how European statehood arose during early modernity as a locally specific combination of ideas about sovereign power and property rights, and how those ideas expanded to structure the formation of European empires and consolidate modern international relations. By connecting the development of legal thinking with the history of political thought and by showing the gradual (...) rise of economic analysis into predominance, the author argues that legal ideas from different European legal systems - Spanish, French, English and German - have played a prominent role in the history of global power. This history has emerged in imaginative ways to combine public and private power, sovereignty and property. The book will appeal to readers crossing conventional limits between international law, international relations, history of political thought, jurisprudence and legal history. (shrink)

Globalization is a topic of some anxiety among international lawyers. On the one hand, its fluid dynamics — fragmentation, deformalization and empire — undermine traditional diplomatic rules and institutions. On the other hand, the effort to reimagine international law in purely managerial terms appears intellectually shallow and politically objectionable. To avoid marginalization and instrumentalization, many lawyers have begun to think about international problems through a constitutional vocabulary and have often cited Kant in that connection. This Article argues that, while it (...) is always possible to grasp the world through a constitutional vocabulary, this does not provide determinate answers to international problems. Instead of an institutional architecture or a set of legal rules, constitutionalism is best seen as a mindset — a tradition and a sensibility about how to act in a political world. Contrary to a widespread assumption, Kant’s political writings may also be read in this fashion and, if so, a meaningful international transformation might necessitate not only legislative or institutional intervention but a professional and perhaps spiritual regeneration. In the present paper Cohen's and Lee's theory of social conformity and Festinger's theory of cognitive dissonance are first reconstructed according to a revised form of the so-called “structuralist theory-conception” developed by Sneed and Stegmüller with their collaborators. Then the two theories are conceptually correlated in the sense of a technical notion of conceptual correlation which can be shown to be an essential generalization of the theory-relations handled by the structuralist. It will turn out that there is no unique way (...) to connect these theories with each other. However, it is shown that two ontologically and conceptually different theories can be correlated. This in turn gives in principle an opportunity to compare critically these two theories given that the constructed conceptual correlation is sufficiently sound and that the theories are empirically testable to a sufficient extent. The continuity thesis of the Poznań school threshold model of the growth of scientific knowledge is considered in the light of the example of Van der Waals' and Boyle-Mariotte's laws. It is argued - using both traditional logical means and the structuralist reconstruction of the example - that the continuity thesis does not hold. A distinction between 'a historical and a systematic point of view' is introduced and it is argued that the continuity thesis of the threshold model presupposes the (...) systematic point of view. However, looking at matters from the systematic point of view need not yield the original theory, looked at from the historical point of view. Applied to the case of Van der Waals/Boyle-Mariotte laws, it turns out that the latter law is not a true idealizing special case of the former, contrary to the continuity thesis. The structuralist analysis of the example indicates that Boyle-Mariotte's law is a false factual law from the historical point of view. However, viewed from the systematic point of view, Boyle-Mariotte's law turns out to be a law which is expandable, adding the relevant new concepts, to an idealized version of Van der Waals' law. This idealizing version of Van der Waal's law in turn is a structuralist specialization of the (general) Van der Waals' law. (shrink)

The article reviews Hauke Brunkhorst’s new book on the critical theory of revolutions.

This Article is based on a larger work that seeks to map the uses of different legal vocabularies by ambitious European legal and political thinkers in the period of c.1300-1800 in order to defend, explain and organize the exercise of power outside the domestic commonwealth. The Article examines the ways in which English legal languages were used to think about, propagate and defend English transatlantic expansion. For most of that time, in their relations public and private power remained closely interwoven. (...) The pluralism of English law also contributed to the appearance of arguments from property and sovereignty in different configurations so that it is often hard to figure out which precise connotation is being made. The uses also varied significantly from Continental practices. I am above all interested in the imperial or colonial significance of these arguments. The point that emerges here is that by 1800, a conception of British Empire had arisen where the exercise of sovereign power was clearly derivative from and supplementary to claims about private property. In this paper we shall show that structuralist constraints applied to moral idealizations, have applications in critical ethical argumentation. Moreover, we developed some systematic concepts which may be used to evaluate the relevance and adequacy of descriptions of moral problems relative to given idealizing moral perspectives. Finally, it is shown that any two moral perspectives are comparable via the Kemeny-Snell measure of distance of rankings.

Several case studies and theoretical reports indicate that the structuralist concept of a constraint has a central role in the reconstruction of physical theories. It is surprising that there is, in the literature, only little theoretical discussion on the relevance of constraints for the reconstruction of social scientific theories. Almost all structuralist reconstructions of social theorizing are vacuously constrained. Consequently, constraints are methodologically irrelevant.In this paper I try to show that there really exist constraint-type assumptions in mathematical modelling in the (...) social sciences. Methodologically constraints have exactly the same role in the context of social mathematical modelling as they have in physical theories. In typical cases of mathematical modelling in the social sciences, the related constraints work as empirical hypotheses and should be tested by statistical means. (shrink)

My thesis is that some methodological ideas of the Pozna school, i.e., the principles of idealization and concretization (factualization), and the correspondence principle can be represented rather successfully using the relations of theoretization and specialization of revised structuralism.Let n(i), t(j)> (i=1,...m, j=1,...k) denote the conceptual apparatus of a theory T, and a class M={} (i=1,...m, j=1,...k) the models of T. The n-components refer to the values of dependent variables and t-components to the values of independent variables of the theory. The (...) n- and t-components in turn represent appropriate concepts. Consider T * as a conceptual enrichment of T with concepts n(i *), t(j *)> (ii * or jj *) and models M *={D *, n(i *), t(j *)>}. If the classes M and M * are suitably related, then the situation illustrates both the case of the theoretization-relation of (revised) structuralism and of the factualization-principle of the Pozna school. Previous research shows that simultaneously executed grasp and vocalization responses are faster when the precision grip is performed with the vowel [i] and the power grip is performed with the vowel [ɑ]. Research also shows that observing an object that is graspable with a precision or power grip can activate the grip congruent with the object. Given the connection between vowel articulation and grasping, this study explores whether grasp‐related size of observed objects can influence not only grasp responses but also (...) vowel pronunciation. The participants had to categorize small and large objects into natural and manufactured categories by pronouncing the vowel [i] or [ɑ]. As predicted, [i] was produced faster when the object's grasp‐related size was congruent with the precision grip while [ɑ] was produced faster when the size was congruent with the power grip (Experiment 1). The effect was not, however, observed when the participants were presented with large objects that are not typically grasped by the power grip (Experiment 2). This study demonstrates that vowel production is systematically influenced by grasp‐related size of a viewed object, supporting the account that sensory‐motor processes related to grasp planning and representing grasp‐related properties of viewed objects interact with articulation processes. The paper discusses these findings in the context of size–sound symbolism, suggesting that mechanisms that transform size‐grasp affordances into corresponding grasp‐ and articulation‐related motor programs might provide a neural basis for size‐sound phenomena that links small objects with closed‐front vowels and large objects with open‐back vowels. It would be difficult to find a major figure in the history of European political thought who would not have attempted to say something about how authority emerges, or is justified and critiqued, in the world beyond the single polity. Quite frequently, that effort would have involved some idea about a legal order, or at least a set of rules or regularities applicable in that world. Thomas Hobbes was neither the first nor the last major thinker who believed that the (...) 'international' realm was characterised by the independence of states existing 'in the state and posture of gladiators', thus apparently denying that legal rules or practices or legal thinking could have much relevance therein. Yet others believed, as Immanuel Kant did, that without a constitutional vocabulary not much that was meaningful could be said about the human pursuit of freedom, and that silence about the latter would not only constitute a moral failure but an intellectual and perhaps political mistake. For a long time, the idiom of natural law claimed to offer a universally valid frame for thinking about the nature of the political, as well as providing authority for lawyers' speculations about the rules and principles governing the conduct of individuals and corporate bodies wherever they might move. The name of the relevant discipline at German universities from the late seventeenth century onwards-ius naturae et gentium, the law of nature and of nations-revealed the full scope of its ambition. That discipline may have died away (although that is a debatable proposition) but any political thinking worth its salt will today (perhaps especially in the twenty-first century) aim to say something about how authority emerges, is maintained or critiqued not only within but also outside the single state. The world of 'nations' or even 'humanity' is established as an important theme of political and legal speculation. (shrink)
