In this chapter, I shall be examining an argument for the language of thought hypothesis.

The World Bank and International Monetary Fund (IMF) have been criticised for their weak commitment to human rights, with the World Bank subject to greater scrutiny and criticism than the IMF and despite significant progress since 2015 in linking its policies and operations to international human rights law. In this light, we explore the extent to which the IMF meets its responsibilities under international human rights law. We focus on IMF conditionality, on the conditions attached to IMF loans to countries (...) in the global South. Using QDA Miner Lite, and a system of interpretive coding, we explore the extent to which international human rights standards are reflected in IMF loan conditions on the basis of inter-temporal and cross-country comparisons. We find that human rights are increasingly reflected in IMF conditionality, but also that it continues to undermine human rights, for instance, by unduly constraining the fiscal space available to sovereign governments. The IMF, we conclude, continues to compare unfavourably to other multilateral institutions, warranting enhanced scrutiny by organs of the UN Human Rights Council and by human rights NGOs. (shrink)

The popularity of films like Titanic betokens a massive shift in the nature of aesthetic spectatorship in our time. The contemplative, distanced viewer who is able to judge from afar the spectacle before him or her, has been replaced by a more proximate, involved "kinaesthetic" subject whose body is stimulated as much as his or her eye. This is evident not only in mass culture with amusement thrill rides and the return of what has been called the "cinema of attractions"; (...) this new spectator can also be discerned in avant-garde culture, as shown by the Sensation exhibition of Young British Artists which caused such a stir in London and New York. This spectator is especially attracted to simulacral scenes of destruction and catastrophe, in which he or she is virtually immersed. If aesthetic judgement is to be a model for its political counterpart, as has been argued by theorists like Lyotard and Arendt, it cannot do so on the basis of this aesthetics of violent immersion. It is a quotation from Horace’s Epistles I. 1, 60 dedicated to Johann Friedrich Lange (1760–1826), a preacher and former student of Kant’s at the Albertina University: “Let this be a man’s brazen wall (rule of life), to be conscious of no ill, to turn pale with no guilt.” Kant quoted the passage several times; one time in his MS. Tomás de Aquino comienza su síntesis teológica definitiva preguntándose por la legitimidad y necesidad de la teología. Inmediatamente después se plantea la pregunta por sus contenidos: ¿de qué trata la ciencia teológica? Si la teología es la ciencia de la Revelación y su fundamento está en la revelación que Dios en Cristo hace de sí mismo, parece que su contenido tiene que ser Dios mismo. Un contenido que solo es cognoscible si Dios se da a conocer, porque el ser humano, (...) con sus fuerzas, con su sola razón, solo puede alcanzarle de forma limitada y parcial, en suma, solo puede saber de su existencia, pero no de sus designios, de sus intenciones y mucho menos de su naturaleza.Para Sto. Tomás es claro que Dios es el sujeto, el contenido de la Teología. Esta ciencia es un “tratado sobre Dios”. Ahora bien, Tomás de Aquino es consciente de una dificultad: si el fundamento de la Teología es la Sagrada Escritura, que es el lugar en el que se contiene la Revelación de Dios, resulta que “en la Sagrada Escritura se trata de muchas cosas además de Dios, como son las criaturas y los actos humanos”. Tomás de Aquino resuelve la dificultad argumentando que Dios es el sujeto de la teología no exactamente por ser su único contenido o por ser el único sujeto del que trata esta ciencia, sino porque todo lo que ella trata “lo hace teniendo como punto de mira a Dios, bien porque se trata de Dios mismo, bien porque se trata de algo referido a él como principio y como fin”.Thomas Aquinas begins his definitive theological synthesis asking for legitimacy and need of theology. Immediately he asks for the contents: what is theological science about? If theology is the science of Revelation, and its foundation is the revelation that God makes of himself in Christ, it seems that its content must be God himself1. A content that can only be known, if God shows himself, because a human being, with its strength and its sole mind, only can get him in a limited and partial way, in short, it can only know of his existence, but not his plans, his intentions, and even less, his nature.For St Thomas it is clear that God is the subject, the content of theology. This science is a “treatise about God”. However, Thomas Aquinas is conscious of a difficulty: If Sacred Scripture that is the place where God’s revelation is contained, is the foundation of theology, “it turns out that Sacred Scripture deals with many more things besides God, that is, creatures and human acts”. Thomas Aquinas will solve this difficulty arguing that God is the subject of theology not because he is exactly the only content or subject of this science, but because all it deals with, “is done with reference to God himself either because it is about God or about something referred to God as beginning and end”. In this paper we discuss whether effective public health interventions and policies are environmentally sustainable. First, we suggest that the environmental impact from public health interventions and policies should be considered in the perspective of a human lifecycle. Second, we spell out in greater detail what we take it to mean for a public health intervention or policy to be environmentally sustainable. Third, environmental sustainability regards not only environmental impact, but also shares of our environmental “budgets”, also referred to as (...) environmentally safe operating spaces. Such budgets represent the limits of the sustainability of a group of individuals, e.g. a population. Each individual is assigned a share of the budget for each category of environmental impact, which represents how much the individual may impact the environmental category in question without doing so unsustainably. We discuss whether individuals ought to have a larger share of these budgets as a function of their ongoing life as this would make a better case for thinking that public health interventions and policies are environmentally sustainable. But we argue that this is incompatible with maximizing health within our environmental budgets and therefore mistaken. Instead, individuals ought to be ascribed a share of these budgets for life, a share that does not increase as individuals get older. We conclude that while some public health interventions and policies might be environmentally sustainable, we cannot merely assume that public health and sustainability are win-win; indeed, we have positive reason to think that some interventions and policies are not environmentally sustainable. Finally, we elaborate on how we ought to think about and react to this conclusion. (shrink)

Empirical legal research seeks to understand and explain how law works in the real world. Empirical research on law has become a recognized part of the social science research environment and the results of empirical research are central to an academic analysis of law. This article begins by offering some reflections on the relationship between research and government. It considers examples of empirical research on law influencing policy-making and reflects briefly on what these case studies suggest about the relationship between (...) empirical research on law and the policy-making process. Following this, it seeks to identify the factors that need to be addressed to ensure that the research and policy-making process is as strong and integrated as possible. In the end, the article argues that researchers and policy-makers should consciously work toward the development of a strategic program of empirical research on law, justified for its wider potential impact on society.
