Every modern legal system is made up of two basic kinds of norms: rules and principles. These are applied by means of two different procedures: subsumption and balancing. While rules apply by means of subsumption, balancing is the means of applying principles. Balancing has therefore become an essential methodological criterion for adjudication, especially of constitutional rights. However, balancing is at the heart of many theoretical and practical discussions. One of the most important questions is whether balancing is a rational procedure (...) for applying norms. The aim of this paper is to consider whether this is the case. To achieve this aim, this paper reflects on why the rationality of balancing is in doubt, and to what extent balancing can be rational, and how this can be possible. The weight formula proposed by Robert Alexy is analysed as a model which, in spite of its limits, tries to solve the philosophical and constitutional problems about the rationality of balancing to the greatest extent possible. Cet article prétend expliquer l'invisibilité relative du conflit armé colombien par rapport à d'autres situations de crise internationale. Au lieu de présupposer que le problème repose sur une faible médiatisation des événements rapportés à la Colombie, il se penche sur les tentatives de mise en sens des événements effectuées par les journalistes au moment de leur médiatisation. L'argument central est que l'opacité du « problème colombien » sur la scène internationale est surtout liée à la difficulté de parvenir à élaborer (...) un récit capable de rendre intelligible ce qui se passe en Colombie.This article tries to explain the relative invisibility of the Colombian armed conflict in relation to other international crisis situations. Instead assume that the problem lies in a low media coverage of events reported to the British, it focuses on the attempts of making sense of the events conducted by journalists at media coverage. The central argument is that the opacity of the "Colombian problem" on the international scene is mainly due to the difficulty of reaching to develop a story that can make sense of what is happening in Colombia. Este artigo examina o papel desempenhado por Schafick Jorge Handal no processo de conversão política do Frente Farabundo Martí para a Libertação Nacional, no período de pós-guerra. Aqui são analisados os principais debates vinculados à redefinição política e ideológica do FMLN, à liderança do partido e à democracia interna. Este processo foi marcado por fortes disputas entre as lideranças das antigas organizações político-militares que compunham a FMLN. Handal foi o principal protagonista dessas lutas, nas quais que ganhou poder e reconhecimento (...) interno. No entanto, ele morreu subitamente em 2006, quando o processo de ‘unificação’ estava avançado, mas não consolidado. Porém, na memória oficial do partido, Handal tornou-se o principal referente identitario do FMLN de pós-guerra, apesar de que seu triunfo traduziu-se na saída de três das cinco organizações que integravam o FMLN. Las prioridades estratégicas que definió la Organización Mundial de la Salud para su labor en la década 2020-2030 son el sustrato de este trabajo. El mismo grupo interdisciplinario de profesionales de la salud que reflexionó en la primera entrega sobre las prioridades relacionadas con lograr poblaciones más sanas, continúa con otras prioridades orientadas a lograr una cobertura sanitaria universal y un mejor manejo de las emergencias sanitarias. En las conclusiones de la segunda entrega se destaca la importancia de desarrollar cada (...) una de las prioridades involucrando a la sociedad civil, la familia y los medios de comunicación. La manera de hacerlo será haciendo girar todas las iniciativas de ejecución alrededor de estrategias educativas adecuadamente planteadas en todos los niveles, sin que se admitan injerencias ni presiones, para recuperar así la confianza necesaria para conseguir las soluciones que son buenas para el ser humano, el ecosistema y las futuras generaciones. -/- . Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)

Based on the most recent metanalysis on the efficacy and safety of the human papilloma virus (HPV) vaccine, thevicissitudes in the gynecological, ethical, and bioethical fields are explored. A review of the bibliography on thesubject is made. As one of the justifications for the vaccine is the prevention of endocervical cancer, viable alter-natives for its early detection and treatment are shown and discussed. Some ethical limitations that this vaccinehas shown are analyzed. It is concluded that there is a need to (...) rethink the management of certain diseases withvaccines, achieve greater transparency in the pharmaceutical industry, resizing evidence-based medicine, anddesign educational strategies that promote behaviors that are in accordance with the nature of human sexuality -/- . Este ensayo ofrece una reconstrucción crítica del concepto de libertad de Norberto Bobbio. Un estudio histórico y analítico de su obra conduce a la identifi - cación de tres usos descriptivos del concepto de libertad: la libertad negativa o liberal, la libertad democrática o autonomía, y la libertad positiva, o de tipo socialista. En la segunda parte se analizan los alcances y las limitaciones de estos tres conceptos de libertad y se subrayan la insufi ciencia de la dicotomía entre libertad (...) negativa y positiva, la incompatibilidad del concepto del concepto de libertad negativa con la libertad reforzada de los derechos fundamentales y con la fundamentación independiente de los derechos sociales. En este artículo se presenta una revisión bibliográfica de la novela Terra nostra, de Carlos Fuentes, y propicia diálogos que evidencian su actualidad y su relación interdisciplinar con la filosofía, la historia, el arte, la sociedad y la cultura. En los criterios estructurales se distinguen estas temáticas: mito e identidad, relaciones con el otro, imagen y memoria, y la reconstrucción de lo que somos y seremos. Se tuvieron en cuenta franjas temporales de ocho años, desde el momento de su publicación, (...) 1975, hasta el año 2015. Los estudios destacan los problemas de la identidad latinoamericana, la intertextualidad, la multiculturalidad y la conquista; revelan su actualidad en el siglo XXI a través del mestizaje, las tradiciones culturales del Viejo y el Nuevo Mundo, y los otros mundos; y expresan, así, la necesidad de reconstruir un nuevo humanismo. Cacao cultivation is one of the most important livelihoods for rural households in Colombia, where it is promoted as a substitute for the illegal cultivation of coca. To strengthen Colombian cacao farming, it is important to understand the livelihood strategies associated with cacao cultivation and the impact of these different strategies on the well-being of Colombian rural households. We analyzed the impact of cacao cultivation on the livelihood strategies and well-being of rural households in western Colombia. Research with 92 rural (...) cacao-growing households produced a typology of household livelihood strategies derived from their approach to cacao production. Indicators of each household capital and level of well-being were identified for each type of households. Correlations between the capitals and the capitals of greater importance in shaping the well-being of rural households were analyzed. Three types of rural households were identified: Cacao Farmers, Diversified Farmers with Cacao, and New Cacao Farmers. Cacao farmers have the highest capitals endowments and level of well-being, followed by Diversified Farmers with Cacao, and New Cacao Farmers. The conditions of cacao cultivation in rural households result in differentiated access to resources from capitals; households with better development of the crop have consolidated greater well-being where human capital has been its major driving factor. Success of the cacao crop and its relationship with well-being of rural households depends on the convergence of different capital resources. Thus, institutional efforts to strengthen the cacao sector in Colombia must go beyond investment to establish new hectares and consider aspects such as: Strengthening the skills and knowledge of producers to improve crop management practices, Promoting the participation of household members in associations, Stimulating sensitivity to the rooting and sustainable management of the crop, and Promoting processes of technification and adaptation of the infrastructure of fermenters and dryers, which will make it possible to guarantee an adequate quality of the cacao bean. Este trabajo tiene como objetivo general examinar los elementos que conforman el no-positivismo inclusivo; postura epistemológica y filosófica desarrollada a través de los años por Robert Alexy. Los métodos empleados son el deductivo, analítico y dialéctico; la principal técnica utilizada ha sido la investigación documental. El presente documento, grosso modo, se encuentra dividido en tres apartados. Primero, son explicados los elementos que conforman el no-positivismo inclusivo de Robert Alexy. Segundo, se explican algunas críticas formuladas a los elementos constitutivos del no-positivismo (...) inclusivo con base en las ideas de Riccardo Guastini, Juan Antonio García Amado, Joseph Raz, Eugenio Bulygin, Matthias Klatt, Carlos Bernal Pulido; entre otros autores. Por último, en tanto objetivo particular, se expone una reflexión con el propósito de indicar uno de los múltiples caminos que los estudios jurídico-científicos sobre el no-positivismo inclusivo podrían seguir en el porvenir. The received view of dynamical explanation is that dynamical cognitive science seeks to provide covering law explanations of cognitive phenomena. By analyzing three prominent examples of dynamicist research, I show that the received view is misleading: some dynamical explanations are mechanistic explanations, and in this way resemble computational and connectionist explanations. Interestingly, these dynamical explanations invoke the mathematical framework of dynamical systems theory to describe mechanisms far more complex and distributed than the ones typically considered by philosophers. Models developed using machine learning are increasingly prevalent in scientific research. At the same time, these models are notoriously opaque. Explainable AI aims to mitigate the impact of opacity by rendering opaque models transparent. More than being just the solution to a problem, however, Explainable AI can also play an invaluable role in scientific exploration. This paper describes how post-hoc analytic techniques from Explainable AI can be used to refine target phenomena in medical science, to identify starting points for future (...) investigations of causal relationships, and to generate possible explanations of target phenomena in cognitive science. In this way, this paper describes how Explainable AI—over and above machine learning itself—contributes to the efficiency and scope of data-driven scientific research. (shrink)

Minding Time: A Philosophical and Theoretical Approach to the Psychology of Time offers an innovative philosophical account of the most fundamental kinds of time representation.

What are the limits of the use of artificial intelligence (AI) in the relational aspects of medical and nursing care? There has been a lot of recent work and applications showing the promise and efficiency of AI in clinical medicine, both at the research and treatment levels. Many of the obstacles discussed in the literature are technical in character, regarding how to improve and optimize current practices in clinical medicine and also how to develop better data bases for optimal parameter (...) adjustments and predictive algorithms. This paper argues that there are also in principle obstacles to the application of AI in clinical medicine and care where empathy is important, and that these problems cannot be solved with any of the technical and theoretical approaches that shape the current application of AI in specific areas of clinical medicine in which care for patients is fundamental. This is important, because it generates specific risks that may be overlooked otherwise, and it justifies the necessity of human monitoring and emotional intervention in clinical medicine. Consequently, difficult issues concerning moral and legal responsibility may ensue if these in principle problems are ignored. (shrink)

Esta investigación da cuenta de cómo ha sido expresada, interpretada y fundada poéticamente la ciudad colombiana durante el siglo XX en las obras de los poetas colombianos Luis Vidales (Suenan Timbres), Rogelio Echavarría (El Transeúnte) y Juan Manuel Roca (Luna de ciegos y Los ladrones nocturnos). Indaga cómo estos tres poetas colombianos han fundado ciudades como textos escriturales y levantado cartografías simbólicas citadinas; realiza una interpretación de los universos de sus poéticas, de las constelaciones simbólicas que asume el poema como (...) universo del lenguaje, el cual construye topologías imaginarias sobre la ciudad, revelando arquetipos fundamentales, presentes en la poesía urbana colombiana. The aim of this paper is to point out significant and meaningful overlapping between several styles of scientific thinking, as they were proposed by Crombie (1981) and discussed by Hacking (1985; 2009). This paper is divided in four sections. First, I examine an interpretation made by Barnes (2004) about the incompatibility among scientific styles. As explained by its author, this interpretation denies any possibility of similarities between styles of scientific reasoning. In opposition, the following sections of this paper include explanations (...) of relevant characteristics of Geometry, as stated in Euclid's Elements, which are also present in other three scientific styles: modeling, experimental exploration and taxonomic style (and some of the shared characteristics are even used to define such styles). By stressing out these characteristics I argue that these four styles discussed by Hacking are not so different from each other, in fact, they overlap and may even be abridged into one foundational style: geometric. El objetivo de este artículo consiste en explicar traslapes importantes y significativos entre varios estilos de pensamiento científico, tal como fueron propuestos por Crombie (1981) y discutidos por Hacking (1985; 2009). El presente artículo está dividido en cuatro secciones. Primero, se examina la interpretación de Barnes (2004) sobre la incompatibilidad entre diversos estilos. Según este autor, no existe posibilidad alguna de encontrar similitudes en los estilos de razonamiento científico. En oposición a esta interpretación, las siguientes secciones explican características relevantes de la Geometría, tal como fueron plasmadas en Los Elementos de Euclides, y que están presentes en otros tres estilos: de modelación, de experimentación y taxonómico (las características compartidas incluso definen algunos de estos estilos). Destacar estas características me permite argumentar que estos cuatro estilos discutidos por Hacking no son tan diferentes entre sí, de hecho, se traslapan e incluso pueden ser condensados en un estilo fundacional: el geométrico. A nossa situação atual, em termos de fé cristã, é muito semelhante à do cego de nascença de que nos fala o evangelho (Jo 9,1-41). A experiência de vinte séculos de cristianismo não impede que Jesus mesmo nos dirija também esta pergunta: “Crês no Filho do Homem?” (Jo 9,35). A questão é saber se teríamos a simplicidade do cego para responder: “Quem é ele, Senhor, para que eu creia?” (Jo 9,36). Porque equivaleria a reconhecer que o conhecemos sem conhecê-lo. E (...) só quando aceitamos isso, pode recomeçar o processo de crer. A situação atual do cristianismo repercute no modo de crer e o condiciona. Não podemos continuar a crer por inércia. Aderir à pessoa de Jesus Cristo deixou de ser algo “evidente”. Não só para as novas gerações ou para os que julgam a fé cristã incompatível com o mundo moderno. Também para nós. Queiramos ou não, somos afetados por essa situação de desamparo. E o problema não é só de linguagem . Trata-se de uma experiência , a experiência de uma vida desconcertante mas fascinante, humana como a nossa mas “diferente”. Podem ainda as mesmas e velhas palavras da fé desencadear em nós a experiência que aqueles primeiros seguidores – homens e mulheres – fizeram diante da existência concreta de Jesus de Nazaré? Aderir a essa vida com a mesma significação que tinha para os primeiros cristãos: isso seria crer em Jesus Cristo hoje. Mas para isso teríamos que sentir o mesmo desamparo do cego de nascença: “Quem é ele, Senhor, para que eu possa crer”? O nosso perigo é sabermos demais. Por isso, para podermos recuperar a “diferença” cristã no que ela tem de verdadeiramente original é necessário aceitar que sejam questionadas as nossas “evidências” e reconhecer que a nossa figura de Jesus foi muitas vezes deformada. Following González Vergara (2006a, 2009, 2012), the presence of the morpheme se in Spanish is explained by a lexical phenomenon that modifies the logical structure of sentences in which it appears. This phenomenon decreases the importance of the Actor and favors the Undergoer. According to this proposal, this phenomenon expresses itself, in most of the Spanish sesentences, as a lexical rule that makes unspecific the highest ranking argument. Taking the above as a basis, this paper explores and proposes explanations for (...) se alternating verbs of the type of matar(se), morir(se), dormir(se), despertar(se), terminar(se), adelgazar(se), engordar(se), envejecer(se), mejorar(se), controlar(se), crecer(se) y aparecer(se) in the framework of the Role and Reference Grammar. Se analiza el papel del pathos como condición de emergencia del logos y de la episteme , lo cual nos lleva a reconocer que a la par de una concepción “intelectualista” de la teoría platónica del conocimiento, en la que es necesaria la supresión de todos los elementos irracionales que nublan el juicio, existe otra perspectiva, sobre todo sustentada en el Fedro , en la cual el pathos , expresado sea como asombro, como sufrimiento o como manía amorosa, no es (...) solamente una etapa que se debe superar para acceder a la intuición de las Formas, sino que ella misma se convierte en una experiencia cognitiva que devuelve al conocimiento su carácter humano. The objective of the present review on the evolution of Green Chemistry, since its emergence until 2016, aimed an integrated vision of its progress along the three phases of its development: emergence, divulgation and consolidation. The methodology involved the analysis of a selection of bibliography on the evolution of GC collected from issues of the ACS symposia series; editorials in specialized GC journals; and commemorative birthday papers/editorials of these journals and of the GC itself. The analysis allowed to identify and (...) discuss the characteristics and conceptions of GC agents about fundamental concepts and procedures, in order to visualize and better understand the state of knowledge and the subject areas that make up the field. The main alterations identified in the evolution of GC were: it acquired a better defined identity, with more participation of academy and increased scope; was progressively framed in sustainability; has been aspiring to a holistic frame and to a change on the nature of the innovation for its implementation, from incremental to transformative. The analysis suggests that for supporting expansion and consolidation of GC the following aspects deserve attention: full validation of chemical greenness by metrics; better characterization of the frontiers of GC research areas/themes; increased integration between academy and industry; and penetration in chemistry curricula. Its basic philosophy being the practice of a chemistry more focused on the environment preservation, GC means a new stage in nature and in the history of Chemistry. (shrink)

Studies have suggested that metaphors (Lawyers are sharks) and similes (Lawyers are like sharks) have distinct representations: metaphors engender more figurative and abstract properties, whereas similes engender more literal properties. We investigated to what extent access to such representations occurs automatically, during on-line reading. In particular, we examined whether similes convey a more literal meaning by following the metaphors and similes with explanations that expressed either a figurative (dangerous) or a literal property (fish) of the vehicle. In a self-paced reading (...) with a moving window paradigm, we presented participants with negated simile and metaphor main clauses (Lawyers are not (like) sharks) followed by explanations that also negated either a figurative (because lawyers are not dangerous) or a literal property of the vehicle (because lawyers are not fish). We found that vehicles (sharks) in metaphors were read significantly faster than those in similes. In addition, explanations negating a figurative property were read faster after metaphors, whereas explanations negating a literal property were read faster after similes. These results support the hypothesis that metaphors and similes rely on different interpretive processes, suggesting that similes access literal representations while metaphor access figurative ones in real time. The purpose of the paper is to present a logical framework that allow to formalize a kind of prima facie duties, defeasible conditional duties, indefeasible conditional duties and actual (indefeasible) duties, as well as to show their logical interconnections.
