This article provides a map of the UBI debate, structured into the main themes that guide and group the arguments on both sides. It finds that UBI’s supporters and opponents both draw on core principles of justice and freedom, focusing on need and poverty, discrimination and inequality, growth, social opportunity, individuality, and self-development. From an economic perspective, they both appeal to business concerns about efficiency, risk, flexibility, and consumption, as well as labour interests on work fulfilment, working conditions, remuneration, and (...) bargaining. Likewise, they focus on political questions around welfare state reforms, redistribution, taxation and funding sources, democratic citizenship, and the prospects for cross-party policy coalitions. By providing an overview of the thematic pillars of the UBI debate, this article helps researchers and activists locate and orient themselves within the wider spectrum of opinion on UBI. (shrink)

I argue that the key dynamical concepts and laws of Newton's Principia never gained a solid foothold in Germany before Kant in the 1750s. I explain this absence as due to Leibniz. Thus I make a case for a robust Leibnizian legacy for Enlightenment science, and I solve what Jonathan Israel called “a meaningful historical problem on its own,” viz. the slow and hesitant reception of Newton in pre-Kantian Germany.

This paper examines the origin, range and meaning of the Principle of Action and Reaction in Kant’s mechanics. On the received view, it is a version of Newton’s Third Law. I argue that Kant meant his principle as foundation for a Leibnizian mechanics. To find a ‘Newtonian’ law of action and reaction, we must look to Kant’s ‘dynamics,’ or theory of matter. I begin, in part I, by noting marked differences between Newton’s and Kant’s laws of action and reaction. I (...) argue that these are explainable by Kant’s allegiance to a Leibnizian mechanics. I show (in part II) that Leibniz too had a model of action and reaction, at odds with Newton’s. Then I reconstruct how Jakob Hermann and Christian Wolff received Leibniz’s model. I present (in Part III) Kant’s early law of action and reaction for mechanics. I show that he devised it so as to solve extant problems in the Hermann-Wolff account. I reconstruct Kant’s views on ‘mechanical’ action and reaction in the 1780s, and highlight strong continuities with his earlier, pre-Critical stance. I use these continuities, and Kant’s earlier engagement with post-Leibnizians, to explain the un-Newtonian features of his law of action and reaction. (shrink)

In the final volume of his Homo Sacer series, The use of bodies, Agamben claims that for Foucault ethics never escapes the horizon of governmentality and therefore his conception of ethics is ‘strategic.’ In light of this criticism, motivated by Agamben’s Pauline conception of ‘use,’ we reassess the status and function of ethics in Foucault’s late lectures. We investigate how Foucault’s approach to ethics develops from his treatment of liberal governmentality and also how its methodological foundation is developed in an (...) interpretation of truth-telling in Sophocles’ Oedipus Rex. Our interpretation emphasizes the ambiguous status of ethics in Foucault’s late work: on the one hand, Agamben is right that Foucault assigns an irreducible strategic function to ethics thereby connecting it intrinsically to governmentality. On the other hand, Agamben overlooks how Foucault’s interpretation of Sophocles implies a conception of governmentality which emphasizes how ethical practices cannot be captured solely in strategic terms. Foucault’s ‘anarcheological’ approach thus articulates a dimension of ethics that remains, using Agamben’s own terms, ‘ungovernable’ and therefore also genuinely creative. Even so, Foucault’s approach to ethics remains in Agamben’s perspective on the deepest level faced with an antinomy that Agamben seeks to mediate with his Pauline conception of ‘inoperativity.’. Much early modern metaphysics grew with an eye to the new science of its time, but few figures took it as seriously as Emilie du Châtelet. Happily, her oeuvre is now attracting close, renewed attention, and so the time is ripe for looking into her metaphysical foundation for empirical theory. Accordingly, I move here to do just that. I establish two conclusions. First, du Châtelet's basic metaphysics is a robust realism. Idealist strands, while they exist, are confined to non-basic regimes. (...) In his book Making the Social World, John Searle gives voice to an aspiration that is very popular in social ontology. This aspiration consists in the notion that social objects can be reduced to physical objects. From this perspective, social objects are nothing more than physical objects on which we impose functions that are merely subjective and therefore external to them. Now, my paper has two objectives. In the first part, I want to show that Searle’s account entails some sort (...) of interpretationism that gets into difficulties once we reflect on his essential notion of imposition. In the second part of my paper, I want to sketch a Wittgensteinian point of view that allows us to describe our relation to social objects without being committed to the flawed model of interpretationism and to its metaphysical assumptions. This paper examines the young Kant’s claim that all motion is relative, and argues that it is the core of a metaphysical dynamics of impact inspired by Leibniz and Wolff. I start with some background to Kant’s early dynamics, and show that he rejects Newton’s absolute space as a foundation for it. Then I reconstruct the exact meaning of Kant’s relativity, and the model of impact he wants it to support. I detail (in Section II and III) his polemic engagement (...) with Wolffian predecessors, and how he grounds collisions in a priori dynamics. I conclude that, for the young Kant, the philosophical problematic of Newton’s science takes a back seat to an agenda set by the Leibniz-Wolff tradition of rationalist dynamics. This results matters, because Kant’s views on motion survive well into the 1780s. In addition, his doctrine attests to the richness of early modern views of the relativity of motion. (shrink)

The classical controversy between Carl Schmitt and Eric Peterson goes directly to the heart of the matter: What is ‘political theology’ about? Is it a descriptive or normative endeavour, oriented towards history or political influence on contemporary issues? This article explores these questions with reference to Protestant theology, in particular the writings of Martin Luther. Protestant theology has often emphasised the basic difference between the spiritual and political spheres, but I question the validity of this distinction with respect to Luther’s (...) theology. When Luther enters the political scene, an apocalyptic understanding of friend and enemy tends to dominate his thinking. Furthermore, I discuss whether this is compatible with his metaphysical understanding of the ‘hidden God’ in his majesty, and hence, whether a metaphysical violence is deeply embedded in Luther’s theology, possibly even his understanding of ‘justification by faith’. Finally, I suggest a reconsideration of Luther’s political theology based on the questions raised by Schmitt and Peterson. (shrink)

Hardback, $99.90.Newton owes his high regard to the quantitative science he left us, but his overall picture of the world had some robustly metaphysical threads woven in as well. Posthumous judgment about the value of these threads has varied wildly. Christian Wolff thought him a metaphysical rustic, as did Hans (...) Reichenbach some two centuries later ("Die Bewegungslehre bei Newton, Leibniz und Huygens," Kant-Studien 29 [1924]: 416–38). In the 1960s, the tide would turn, as Howard Stein and James Edward McGuire separately began to show that Newton's metaphysics was not just sophisticated, but often more compelling than its early modern alternatives (see respectively "Newtonian Spacetime," Texas Quarterly 10 [1967]: 174–200; and Tradition and Innovation: Newton's Metaphysics of Nature [Dordrecht: Kluwer Academic Publishers, 1995]). Eric Schliesser's book unfolds in that same register of appreciative, high scholarship, and it attests to the enduring attraction of its subject.The book grew out of previous discrete papers, to which he added a few more for this occasion. Accordingly, it does not come with a master argument. Rather, it is an in-depth exploration of some key metaphysical themes in Newton. As such, it befits its subject figure, who reflected on themes and concepts while stopping short of working out systems.The first major theme is Newton and Spinozism. The latter does not denote Spinoza's metaphysics. In fact, Schliesser explains, Newton shared with Spinoza some weighty commitments, for example, to space being actually infinite, and to substance monism: "for Newton, there is strictly speaking only one genuine substance," namely, God (33). Rather, "Spinozism" is an interpreter's category for a bundle of three theses: identifying God and nature; denying final causation in the physical world; and the assumption of "blind" metaphysical necessity. Some counted Hobbes and John Toland as Spinozist in this sense, and even Epicurus, avant la lettre. Newton and his followers argued vehemently against this package, as Schliesser shows in chapters 4, 5, and 8. Their chief complaint was that Spinozism is unable to account for the "origin of motion," for a certain type of order, and for the stability of cosmological structure—and to do so in a way that "meets the standards of Newtonian mechanics" (122). This interpretive lens allows Schliesser to draw Kant in, by reading his youthful Theory of Heaven as a possible Spinozist reply to their objections (chapter 3). [End Page 157]A second theme is the metaphysics of mechanics, where Schliesser weaves together several strands. One is the ontology of gravity, for which he offers a novel construal: for Newton, gravity counts as real, but in a qualified sense. Namely, it is not essential and not intrinsic: "even after creation, a lonely partless particle of matter in the universe would not be said to gravitate." And gravity is relational: a "shared quality" of two or more bits of matter, which obtains in virtue of their sharing a nature (19). Another strand is Newton's ontology of time—really, a subtle, difficult topic long neglected. Famously, Newton in Principia defends absolute, true, and mathematical time. The question is what these three qualifiers denote, and whether Newton thought they were synonymous. Schliesser in chapter 7 argues for the provocative view that "absolute" and "true" time are not identical concepts; rather, they pick out different entities. These entities share a common structure, namely, metric and topological. That makes them species of "mathematical" time (179). But, Schliesser contends, Newton has unequal warrant for his two concepts of time.Yet another theme is formal causation. It comes to the fore in chapter 5, which grapples with Newton's opaque idea that space is an "emanative effect." The standardised randomised clinical trial (RCT) has been exceedingly popular in medical research, economics, and practical policy making. Recently, RCTs have faced criticism. First, it has been argued by John Worrall that we cannot be certain that our sample is not atypical with regard to possible confounding factors. I will argue that at least in the case of medical research, we know enough about the relevant causal mechanisms to be justified to ignore a number of factors we have good reason (...) not to expect to be disruptive. I will also argue against an argument provided by Nancy Cartwright and Eileen Munro that RCTs should not be taken to deductively infer probabilistic causal claims, but ampliatively. The paper will end on a discussion of evidence hierarchies and a defence of the stance of evidence-based medicine that RCTs are the best available method to assess a treatment’s efficacy. (shrink)

I examine here if Kant can explain our knowledge of duration by showing that time has metric structure. To do so, I spell out two possible solutions: time’s metric could be intrinsic or extrinsic. I argue that Kant’s resources are too weak to secure an intrinsic, transcendentally-based temporal metrics; but he can supply an extrinsic metric, based in a metaphysical fact about matter. I conclude that Transcendental Idealism is incomplete: it cannot account for the durative aspects of experience—or it can (...) do so only with help from a non-trivial metaphysics of material substance. Much scholarship has claimed the physics of Emilie du Châtelet’s treatise, Institutions de physique, is Newtonian. I argue against that idea. To do so, I distinguish three strands of meaning for the category ‘Newtonian science,’ and I examine her book against them. I conclude that her physics is not Newtonian in any useful or informative sense. To capture what is specific about it, we need better interpretive categories.

I uncover here a conflict in Kant’s natural philosophy. His matter theory and laws of mechanics are in tension. Kant’s laws are fit for particles but are too narrow to handle continuous bodies, which his doctrine of matter demands. To fix this defect, Kant ultimately must ground the Torque Law; that is, the impressed torque equals the change in angular momentum. But that grounding requires a premise—the symmetry of the stress tensor—that Kant denies himself. I argue that his problem would (...) not arise if he had kept his early theory of matter as made of mass points, or “physical monads.”. (shrink)

Right to life is an essential natural right protected and defended by law. The aim of this publication is to discuss the main issues regarding human right to life and its protection in the Roman law. Article deals with the problems of beginning and end of the human life and legal capacity in Rome, elements of legal protection of slaves and family members subject to pater familias life as well as the principle crimes attempting to human life. First of all, (...) the right to life as well as the right to liberty were held to be the institutes of natural law (ius naturale) meanwhile institutes that provided possibility to withdraw those rights (e. g. patria potestas that in the most ancient époque included right to decide on subject person’s right to life) are derived from the branches of positive law—civil (ius civile) and law of nations (ius gentium). Such attitude of the Roman jurisprudence had a solid impact on recognizing right of life to be an inherent law of every person, deriving immediately from the human nature and not conferred by the society and the state. Newton had a fivefold argument that true motion must be motion in absolute space, not relative to matter. Like Newton, Kant holds that bodies have true motions. Unlike him, though, Kant takes all motion to be relative to matter, not to space itself. Thus, he must respond to Newton’s argument above. I reconstruct here Kant’s answer in detail. I prove that Kant addresses just one part of Newton’s case, namely, his “argument from the effects” of rotation. And, to show that (...) rotation is relative to matter, Kant changes the meaning of ‘relative motion.’ However, that change puts Kant’s doctrine in deep tension with Newton’s science. Based on my construal, I correct earlier readings of Kant by John Earman and Martin Carrier. And, I argue that we need to revise Michael Friedman’s influential view of Kant. Kant’s struggle, I conclude, illustrate the difficulties that early modern relationists faced as they turned down Newtonian absolute space ; and it typifies their selective engagement with Newton’s case for it. The merit of the SINBAD model is to provide an explicit mechanism showing how the cortex may come to develop detectors responding to correlated properties and therefore corresponding to the sources of these correlations. Here I argue that, contrary to the article, SINBAD neurosemantics does not need to rely on teleofunctions to solve the problem of misrepresentation. A number of difficulties for the teleofunction theories of content are reviewed and an alternative theory based on categorization performance and statistical relations is (...) argued to provide a better account and to come closer to the practice in neuroscience and to powerful intuitions on swampkinds and on broad/narrow content. The narration in the music video to Celine Dion’s song All By Myself is a linearly organised construct or composition equipped with features of logicality, which organises specific linguistic or image-based material. It constructs a fiction based on the principles of dramatism. If one assumes that a music video can be analysed as a system which produces meaning, then the production occurs mainly within two dimensions. Firstly, as fiction, and secondly, as narration. The sequential editing adds significance to the entire (...) film. The specific connection points of individual scenes influence the interpretation of the images by viewers – they extract the significance of a portion of the music video. Surely this phenomenon could be defined as a production of sense. (shrink)

Newton rested his theory of mechanics on distinct metaphysical and epistemological foundations. After Leibniz's death in 1716, the Principia ran into sharp philosophical opposition from Christian Wolff and his disciples, who sought to subvert Newton's foundations or replace them with Leibnizian ideas. In what follows, I chronicle some of the Wolffians' reactions to Newton's notion of absolute space, his dynamical laws of motion, and his general theory of gravitation. I also touch on arguments advanced by Newton's Continental followers, such as (...) Leonhard Euler, who made novel attempts to defend his mechanical foundations against the pro-Leibnizian attack. This examination grants us deeper insight into the fate of Newton's mechanics on the Continent during the early eighteenth century and, more specifically, sheds needed light on the conflicts and tensions that characterized the reception of Newton's philosophy of mechanics among the Leibnizians. In The Lily in the Field and the Bird of the Air (1849), Kierkegaard presents a succinct critique of Romantic aesthetics, in line with contemporary critiques of ecocriticism and ecophilosophy, e.g. by Timothy Morton. Whereas Romantic poets see nature as a mirror of their inner thoughts and pathos, thereby divinising themselves and their creativity, Kierkegaard emphasises the authority of the Creator and the exteriority of nature. He identifies the consequences of such Romantic self-infatuation on all levels of discourse: aesthetics, ethics, (...) epistemology and ontology, and seeks to formulate an alternative. I argue that the discourses thus represent an alternative philosophy of nature, revealing an immediate joy for the gift of being-there. Being human thus means being dependent on and embedded in nature. This makes Kierkegaard a highly relevant interlocutor for contemporary ecophilosophy and ecocriticism, as revealed by Knausgård’s novel Morgenstjernen (2020). (shrink)

This book investigates the relationship between poetry and ontology in the works of Martin Heidegger. It explains the way in which Heidegger’s dialogue with poetry forms an essential step on the path of overcoming metaphysics and thinking the openness of presence. Heidegger’s engagement with poetry is an important moment in the development of his philosophy—or rather thinking of Being. Being speaks itself poetically in his view. Rather than a logician or a thinker, Being is the first poet.

From the perspective of Marek J. Siemek’s theory of modernity, one of the most important problem is to include conflicts into institutional framework of the modern society. He reinterprets Hegel’s dialectics of the struggle for recognition by conceptual tools of Hobbes and Marx in order to uncover hidden assumptions and conditions of possibility of the social rationality. For Siemek, law as purely formal, autopoetic social system or social subject, which produces individual subjects, is the first of the conditions of possibility (...) of modernity. The second one is the convergence of formal and material presuppositions of law—or, speaking generally—the convergence of form and content of the social reason. Form and content, facticity and normativity, instrumentality and communicativity are aspects of the process of rationalization andof the only one reason, self-generating in the history. So for Siemek, the Hegelian model of the struggle for recognition gains its theoretical power only when it is interpreted from the perspective of economical, technical and legal rationalization of modernity. Only such perspective is able to construct “the transcendental social philosophy” which starts from critique of “the non-instrumental reason”. (shrink)

The article presents an interpretive view on culture wars in America along with their echoes in the autobiographical works written by Barack Obama. Being either viewed as the manifestation of the “post-American” creed, looked down at as a mere product of popular culture, or being ignored as a marginal manifestation, culture wars flared before and after the presidential campaign of 2008, signaling the intensity of a yet unconsumed ideological combustion fuelling further cultural and political dissensions. One of the conspicuous consequences (...) of culture wars in America is that the definition of culture has been significantly altered and that nowadays culture warriors have outnumbered intellectuals. Another outcome of culture wars is that they are considered by many as a benchmark of democracy and democratization, when more probably they are the product of an ideological confrontation. Thirdly, culture wars are regarded either as a political stylization of politicization of culture setting up a new network of correspondences between culture and politics. A final relevant consequence may be found in the increasing awareness that civil society and political parties may deploy different strategies to convey democratic ideals into reality, but it remains to be clarified if this should be carried out into the trenches of a pugnacious media and from there into the beliefs and expectations of citizens. Civil society and political parties in America construed differently the meanings of democracy, providing with different images the promised future and the American creed. Therefore, while culture wars spread their belligerency in various sectors of the American society, it is harder and harder to figure out a democratic consensus. (shrink)

Pentecostals have their own ethos to bring to the theological table. Although they represent a diverse spectrum of beliefs, they share a basic preference for experience co-determining their theology, along with their interpretation of Scripture. Their hermeneutical viewpoint since the 1970s that links them with that of early Pentecostals allows them to regard the Bible as the inspired Word of God with authority for their lives although they qualify that statement by adding that encounters with God within the faith community (...) in ways similar to those recorded in the Bible is conditional for understanding and interpreting biblical accounts of God and God's faith community. It is proposed that Pentecostals need to develop a perspective on the all-inclusive difference made by their experience of God in all areas of their lives. Their experience of God through his Spirit shifts their loci communes and theological method. It is argued that Pentecostal theology should rethink every aspect of theological enterprise through the lens of the reality of God's encounter with human beings as experienced in the faith community. In the last section, this is demonstrated in terms of one subject, of God as the object of theology. (shrink)

The aim of our commentary is to strengthen Cowan's proposal for an inherent capacity limitation in STM by suggesting a neurobiological mechanism based on competitive networks and nonlinear oscillations that avoids some of the shortcomings of the scheme discussed in the target article (Lisman & Idiart 1995).

I outline a dilemma for Derek Parfit’s project to vindicate moral realism. In On What Matters, Parfit argues that the best versions of three of the main moral traditions agree on a set of moral principles, which should make us more confident about the prospects of truth in ethics. I show that the result of this Convergence Argument can be interpreted in two ways. Either there remain three separate and deontically equivalent theories or there remains just one theory, the Triple (...) Theory. Both interpretations fail to deliver what Parfit is looking for. The first interpretation leads to a situation of underdetermination of theory choice that gives rise to a skeptical challenge. The second interpretation jettisons Parfit’s Conciliatory Project, that is, the reconciliation of the three moral traditions. The dilemma, I contend, is the result of Parfit failing to resolve two antithetical lines of thought. His search for the Trinity of moral theorizing must thus fail. (shrink)

Morality and immorality is a complex issue in Martin Luther's thought and the complexity increases the more he unfolds the topic. In the course of his controversy with Erasmus, he meets a well founded criticism of his own moralization. In the first three sections of this article I discuss their respective positions and the consequences of a moral vs. an immoral interpretation of Scripture. In the last three sections I proceed to inquire whether immorality or rather a-morality may play a (...) more basic and principal role for the interpretation of scriptures in general. The distinction between Scripture as a particular text corpus and the scripturality of the scriptures thereby becomes critical. I suggest that the latter plays a crucial role in Luther's radical criticism and destruction of the moral subsumption of theology, with consequences for a current reassessment of the sola scriptura. A philosophical inquiry into politics, embodiment and religion takes us straight to some of contemporary culture's most notorious issues: suicide bombing, the veiled and the exposed body, and present-day biopolitics. Interpretations of the body have always been contested, both in the history of philosophy and in the history of religions. On the one hand, the body has been perceived as a prison, binding the soul to transience, darkness, and confusion. Yet on the other hand, it has itself been controlled and (...) disciplined by reason and will, law and culture. The ten contributors to The Body Unbound suggest that inquiries into the nature of human embodiment must take into account both context and history in order to scrutinize them and to uncover resources for unbinding a body which has been doubly bound. I emphasize two merits of Eric Watkins’ account in "Kant on Laws": the strong evidential support it has, and the central place it gives to Kant’s laws of mechanics. Then, I raise two questions for further research. 1. What kind of evidential reasoning confirms a Kantian law? 2. Do natures explain Kantian laws? If so, how?

This article aims to show the peculiarities of the legal status of advocates, patrons, rhetoricians and other assistants of the litigants in civil procedure, the concept of a bar, as a professional corporation, presumption of its origin and mission in ancient Rome, origins of state guaranteed (...) legal aid and the institute of obligatory participation of the advocate in the procedure, the conditions of the agreement between the advocate and the client (mandatum), the peculiarities of the advocate’s fees for legal services, the responsibility of the advocate for improper execution of duties and other issues. Rereading Randolph Bourne’s most known essay “Trans-National America” (1916) provides the nowadays reader with a more accurate view perception of the cultural transmutations occurring at the beginning of the last century in America. Reflecting on the contrast between the ideals of liberal republican America and the reality of the assimilation policies, Randolph Bourne disagreed along with other intellectuals of his time with nativist attitudes and policies disfavoring or slighting immigrants and their heritage in twentieth century America. Wrestling to establish a (...) more equitable meaning of the cultural heritage in the actual making of American citizenship, other than the Anglo-Saxon one, Bourne employed William James’s concept of ‘consciousness’, mapping a new cultural content for the idea of ‘nation’, contributing to the public debate on pluralism. Arguing that American idealism was imperiled by the consequences of melting pot policies, Bourne envisioned modernist America as a ‘trans-national’ entity holding together a variety of ethnic communities lead by the same lofty democratic goals, assuming that equality of individuals should be paralleled by the equality of ethnic communities. “Trans-National America” appears as a landmark in the further evolution of pluralism, combining reformism with the intellectual utopianism in an attempt to enrich the meanings of American exceptionalism in a newly fashioned form. One of the few direct solutions that Nietzsche gives for the overcoming of nihilism is the facing of the thought of eternal recurrence. Being the heaviest of all thoughts, it may seem that through Heidegger’s filter it will become a sort of metaphysical concept, but his analysis may at least help us see it as an axis around which thought can pivot, at least for a moment. Kundera sees the contradiction between lightness and weight as the most problematic of all, (...) as it is difficult to see the burden as something positive when emancipation seems to always be an attempt to achieve total freedom, a search for lightness. We argue that the heavy thought makes us confront fatalism and affirm freedom, while lightness makes freedom by becoming impossible. The eternal recurrence is the idea that offers motivation to intervene in the chain of determinations and to influence them decisively. (shrink)

Craig Callender, Jonathan Cohen and Markus Schrenk have recently argued for an amended version of the best system account of laws – the better best system account (BBSA). This account of lawhood is supposed to account for laws in the special sciences, among other desiderata. Unlike David Lewis's original best system account of laws, the BBSA does not rely on a privileged class of natural predicates, in terms of which the best system is formulated. According to the BBSA, a contingently (...) true generalization is a law of a special science S iff the generalization is an axiom (or a theorem) of the best system relative to the set of predicates used by special science S. We argue that the BBSA is, at best, an incomplete theory of special science laws, as it does not account for typical features of special science laws, such as attached ceteris paribus conditions and the idealized character of law statements in these disciplines.
