The article analyses legal preconditions for personal identification in physical and electronic space (hereinafter – cyberspace). Analysis of legal governing of identification in physical space is followed by the analysis of the same in cyberspace. Compulsory elements of identification in physical space and compulsory and non-compulsory elements of identification in cyberspace are provided which leads to conclusions about problem aspects concerning personal identification in cyberspace and related legal governing. This scientific article consists of four main chapters. The first chapter „Identity (...) and Personal Identification“ looks into identity, its content and elements alongside with personal identification. The second chapter „Personal Identification in Physical Space“ scrutinizes legal preconditions of identification in physical space in Lithuania. The third chapter „Personal Identification in Cyberspace“ looks into elements of legally regulated and non-regulated personal identification in cyberspace and discusses identity of a person in cyberspace. The fourth chapter „Electronic Identity of a Person and Legal Regulation“ analyzes and systematizes elements of electronic identity of the person and presumes their reliability and mandatory legal governing. We contrast two theoretical positions on the relation between phenomenal and access consciousness. First, we discuss previous data supporting a mild Overflow position, according to which transient visual awareness can overflow report. These data are open to two interpretations: (i) observers transiently experience specific visual elements outside attentional focus without encoding them into working memory; (ii) no specific visual elements but only statistical summaries are experienced in such conditions. We present new data showing that under data-limited conditions observers cannot discriminate (...) a simple relation (same versus different) without discriminating the elements themselves and, based on additional computational considerations, we argue that this supports the first interpretation: summary statistics (same/different) are grounded on the transient experience of elements. Second, we examine recent data from a variant of ‘inattention blindness’ and argue that contrary to widespread assumptions, it provides further support for Overflow by highlighting another factor, ‘task relevance’, which affects the ability to conceptualize and report (but not experience) visual element. This Element analyzes Kant’s metaphysics and epistemology of the exact science of nature. It explains his theory of true motion and ontology of matter. In addition, it reconstructs the patterns of evidential reasoning behind Kant’s foundational doctrines.

I argue that the key dynamical concepts and laws of Newton's Principia never gained a solid foothold in Germany before Kant in the 1750s. I explain this absence as due to Leibniz. Thus I make a case for a robust Leibnizian legacy for Enlightenment science, and I solve what Jonathan Israel called “a meaningful historical problem on its own,” viz. the slow and hesitant reception of Newton in pre-Kantian Germany.

In this paper, we revisit the debate surrounding the Unfolding Argument (UA) against causal structure theories of consciousness (as well as the hard-criteria research program it prescribes), using it as a platform for discussing theoretical and methodological issues in consciousness research. Causal structure theories assert that consciousness depends on a particular causal structure of the brain. Our claim is that some of the assumptions fueling the UA are not warranted, and therefore we should reject the methodology for consciousness science that (...) the UA prescribes. First, we briefly survey the most popular philosophical positions in consciousness science, namely physicalism and functionalism. We discuss the relations between these positions and the behaviorist methodology that the UA assumptions express, despite the contrary claim of its proponents. Second, we argue that the same reasoning that the UA applies against causal structure theories can be applied to functionalist approaches, thus proving too much and deeming as unscientific a whole range of (non-causal structure) theories. Since this is overly restrictive and fits poorly with common practice in cognitive neuroscience, we suggest that the reasoning of the UA must be flawed. Third, we assess its philosophical assumptions, which express a restrictive methodology, and conclude that there are reasons to reject them. Finally, we propose a more inclusive methodology for consciousness science, that includes neural, behavioral, and phenomenological evidence (provided by the first-person perspective) without which consciousness science could not even start. Then, we extend this discussion to the scope of consciousness science, and conclude that theories of consciousness should be tested and evaluated on humans, and not on systems considerably different from us. Rather than restricting the methodology of consciousness science, we should, at this point, restrict the range of systems upon which it is supposed to be built. (shrink)

Newton had a fivefold argument that true motion must be motion in absolute space, not relative to matter. Like Newton, Kant holds that bodies have true motions. Unlike him, though, Kant takes all motion to be relative to matter, not to space itself. Thus, he must respond to Newton’s argument above. I reconstruct here Kant’s answer in detail. I prove that Kant addresses just one part of Newton’s case, namely, his “argument from the effects” of rotation. And, to show that (...) rotation is relative to matter, Kant changes the meaning of ‘relative motion.’ However, that change puts Kant’s doctrine in deep tension with Newton’s science. Based on my construal, I correct earlier readings of Kant by John Earman and Martin Carrier. And, I argue that we need to revise Michael Friedman’s influential view of Kant. Kant’s struggle, I conclude, illustrate the difficulties that early modern relationists faced as they turned down Newtonian absolute space ; and it typifies their selective engagement with Newton’s case for it. Much scholarship has claimed the physics of Emilie du Châtelet’s treatise, Institutions de physique, is Newtonian. I argue against that idea. To do so, I distinguish three strands of meaning for the category ‘Newtonian science,’ and I examine her book against them. I conclude that her physics is not Newtonian in any useful or informative sense. To capture what is specific about it, we need better interpretive categories.

This chapter looks at Euler’s relation to Newton, and at his role in the rise of ‘Newtonian’ mechanics. It aims to give a sense of Newton’s complicated legacy for Enlightenment science, and to raise awareness that some key ‘Newtonian’ results really come from Euler.

The article presents an interpretive view on culture wars in America along with their echoes in the autobiographical works written by Barack Obama. Being either viewed as the manifestation of the “post-American” creed, looked down at as a mere product of popular culture, or being ignored as a marginal manifestation, culture wars flared before and after the presidential campaign of 2008, signaling the intensity of a yet unconsumed ideological combustion fuelling further cultural and political dissensions. One of the conspicuous consequences (...) of culture wars in America is that the definition of culture has been significantly altered and that nowadays culture warriors have outnumbered intellectuals. Another outcome of culture wars is that they are considered by many as a benchmark of democracy and democratization, when more probably they are the product of an ideological confrontation. Thirdly, culture wars are regarded either as a political stylization of politicization of culture setting up a new network of correspondences between culture and politics. A final relevant consequence may be found in the increasing awareness that civil society and political parties may deploy different strategies to convey democratic ideals into reality, but it remains to be clarified if this should be carried out into the trenches of a pugnacious media and from there into the beliefs and expectations of citizens. Civil society and political parties in America construed differently the meanings of democracy, providing with different images the promised future and the American creed. Therefore, while culture wars spread their belligerency in various sectors of the American society, it is harder and harder to figure out a democratic consensus. (shrink)

I examine here if Kant can explain our knowledge of duration by showing that time has metric structure. To do so, I spell out two possible solutions: time’s metric could be intrinsic or extrinsic. I argue that Kant’s resources are too weak to secure an intrinsic, transcendentally-based temporal metrics; but he can supply an extrinsic metric, based in a metaphysical fact about matter. I conclude that Transcendental Idealism is incomplete: it cannot account for the durative aspects of experience—or it can (...) do so only with help from a non-trivial metaphysics of material substance. On 3 June 2008 the National Family Policy Concept was adopted by Seimas that states the goals and principles of the state family policy and several times refers to historical and scientific experience. The present article aims to reveal the historical and legal experience of the ancient Rome that laid foundations of contemporary private law and to compare the goals of the National Family Policy Concept and the state policy of the ancient Rome regarding family issues. The concept of family (...) framed by the National Family Policy Concept is based on matrimony. This is why the authors of the article focus on Roman matrimony. Having discussed the ancient Roman concept of marriage and Roman state policy regarding issues of matrimony and family and comparing it with the aims of the National Family Policy concept it might be stated that policy of encouraging family and promoting family relations based on matrimony that is provided by the Lithuanian state is not a new invention but may also refer to legal resolutions of the ancient Rome. This article aims to show the peculiarities of the legal status of advocates, patrons, rhetoricians and other assistants of the litigants in civil procedure, the concept of a bar, as a professional corporation, presumption of its origin and mission in ancient Rome, origins of state guaranteed (...) legal aid and the institute of obligatory participation of the advocate in the procedure, the conditions of the agreement between the advocate and the client (mandatum), the peculiarities of the advocate’s fees for legal services, the responsibility of the advocate for improper execution of duties and other issues. The study is part of an ampler research focusing on the issue of the mentalities (collective imaginary), seculariza- tion and the theory of the cultural models. The interre- latedness of these theoretical topics is approached on the basis provided by the qualitative analysis data, and attempts to demonstrate the variety of the consequences in the secularization process within culture, regarding them as seminal premises of producing novelty and dif- ference. Cultural models face on- going revision, reflecting the changes going on within the frame of the mentalities or the collective imaginary. The author intends to look at Romanian cultural transition as an ongoing process which since 1989 has known an accelerated pace according to the fall of communism and the real perspectives of integration in the European Union. Seen within the cultural constraints of globalization, the impact of social and cultural change in Romanian society affected considerably the cultural behavior of the individual as well as the setting of new institutions, their functioning and implicitly the rhythm of democratization. In climate science, observational gridded climate datasets that are based on in situ measurements serve as evidence for scientific claims and they are used to both calibrate and evaluate models. However, datasets only represent selected aspects of the real world, so when they are used for a specific purpose they can be a source of uncertainty. Here, we present a framework for understanding this uncertainty of observational datasets which distinguishes three general sources of uncertainty: (1) uncertainty that arises during the (...) generation of the dataset; (2) uncertainty due to biased samples; and (3) uncertainty that arises due to the choice of abstract properties, such as resolution and metric. Based on this framework, we identify four different types of dataset ensembles — parametric, structural, resampling, and property ensembles—as tools to understand and assess uncertainties arising from the use of datasets for a specific purpose. We advocate for a more systematic generation of dataset ensembles by using these sorts of tools. Finally, we discuss the use of dataset ensembles in climate model evaluation. We argue that a more systematic understanding and assessment of dataset uncertainty is needed to allow for a more reliable uncertainty assessment in the context of model evaluation. The more systematic use of such a framework would be beneficial for both scientific reasoning and scientific policy advice based on climate datasets. (shrink)

The standardised randomised clinical trial (RCT) has been exceedingly popular in medical research, economics, and practical policy making. Recently, RCTs have faced criticism. First, it has been argued by John Worrall that we cannot be certain that our sample is not atypical with regard to possible confounding factors. I will argue that at least in the case of medical research, we know enough about the relevant causal mechanisms to be justified to ignore a number of factors we have good reason (...) not to expect to be disruptive. I will also argue against an argument provided by Nancy Cartwright and Eileen Munro that RCTs should not be taken to deductively infer probabilistic causal claims, but ampliatively. The paper will end on a discussion of evidence hierarchies and a defence of the stance of evidence-based medicine that RCTs are the best available method to assess a treatment’s efficacy. (shrink)

A naturalistic scheme of primitive conceptual representations is proposed using the statistical measure of mutual information. It is argued that a concept represents, not the class of objects that caused its tokening, but the class of objects that is most likely to have caused it (had it been tokened), as specified by the statistical measure of mutual information. This solves the problem of misrepresentation which plagues causal accounts, by taking the representation relation to be determined via ordinal relationships between conditional (...) probabilities. The scheme can deal with statistical biases and does not rely on arbitrary criteria. Implications for the theory of meaning and semantic content are addressed. (shrink)

Right to life is an essential natural right protected and defended by law. The aim of this publication is to discuss the main issues regarding human right to life and its protection in the Roman law. Article deals with the problems of beginning and end of the human life and legal capacity in Rome, elements of legal protection of slaves and family members subject to pater familias life as well as the principle crimes attempting to human life. First of all, (...) the right to life as well as the right to liberty were held to be the institutes of natural law (ius naturale) meanwhile institutes that provided possibility to withdraw those rights (e. g. patria potestas that in the most ancient époque included right to decide on subject person’s right to life) are derived from the branches of positive law—civil (ius civile) and law of nations (ius gentium). Such attitude of the Roman jurisprudence had a solid impact on recognizing right of life to be an inherent law of every person, deriving immediately from the human nature and not conferred by the society and the state.
