This Element analyzes Kant’s metaphysics and epistemology of the exact science of nature. It explains his theory of true motion and ontology of matter. In addition, it reconstructs the patterns of evidential reasoning behind Kant’s foundational doctrines.

The article presents an interpretive view on culture wars in America along with their echoes in the autobiographical works written by Barack Obama. Being either viewed as the manifestation of the “post-American” creed, looked down at as a mere product of popular culture, or being ignored as a marginal manifestation, culture wars flared before and after the presidential campaign of 2008, signaling the intensity of a yet unconsumed ideological combustion fuelling further cultural and political dissensions. One of the conspicuous consequences (...) of culture wars in America is that the definition of culture has been significantly altered and that nowadays culture warriors have outnumbered intellectuals. Another outcome of culture wars is that they are considered by many as a benchmark of democracy and democratization, when more probably they are the product of an ideological confrontation. Thirdly, culture wars are regarded either as a political stylization of politicization of culture setting up a new network of correspondences between culture and politics. A final relevant consequence may be found in the increasing awareness that civil society and political parties may deploy different strategies to convey democratic ideals into reality, but it remains to be clarified if this should be carried out into the trenches of a pugnacious media and from there into the beliefs and expectations of citizens. Civil society and political parties in America construed differently the meanings of democracy, providing with different images the promised future and the American creed. Therefore, while culture wars spread their belligerency in various sectors of the American society, it is harder and harder to figure out a democratic consensus. (shrink)

In this paper, we revisit the debate surrounding the Unfolding Argument (UA) against causal structure theories of consciousness (as well as the hard-criteria research program it prescribes), using it as a platform for discussing theoretical and methodological issues in consciousness research. Causal structure theories assert that consciousness depends on a particular causal structure of the brain. Our claim is that some of the assumptions fueling the UA are not warranted, and therefore we should reject the methodology for consciousness science that (...) the UA prescribes. First, we briefly survey the most popular philosophical positions in consciousness science, namely physicalism and functionalism. We discuss the relations between these positions and the behaviorist methodology that the UA assumptions express, despite the contrary claim of its proponents. Second, we argue that the same reasoning that the UA applies against causal structure theories can be applied to functionalist approaches, thus proving too much and deeming as unscientific a whole range of (non-causal structure) theories. Since this is overly restrictive and fits poorly with common practice in cognitive neuroscience, we suggest that the reasoning of the UA must be flawed. Third, we assess its philosophical assumptions, which express a restrictive methodology, and conclude that there are reasons to reject them. Finally, we propose a more inclusive methodology for consciousness science, that includes neural, behavioral, and phenomenological evidence (provided by the first-person perspective) without which consciousness science could not even start. Then, we extend this discussion to the scope of consciousness science, and conclude that theories of consciousness should be tested and evaluated on humans, and not on systems considerably different from us. Rather than restricting the methodology of consciousness science, we should, at this point, restrict the range of systems upon which it is supposed to be built. (shrink)

Les traditions intellectuelles de la gauche semblent souvent impuissantes à apporter des réponses. Pire, n'ont-elles pas contribué, par leur culte des "forces productives", à l'impasse actuelle? La généalogie intellectuelle proposée par Serge Audier revient sur des évidences trompeuses, notamment celle qui voudrait que les mouvements émancipateurs n'aient abordé que très tardivement (...) les enjeux écologiques. On redécouvre certes peu à peu des voix minoritaires qui, de Henry D. Thoreau à William Morris, avaient manifesté très tôt un souci inédit de la nature. Mais en les érigeant en héros solitaires, on contribue à occulter une nébuleuse beaucoup plus large et méconnue qui, entre socialisme et anarchisme, a esquissé les traits d'une "société écologique". L'objectif de ce livre est d'exhumer et de reconstituer une pensée sociale de la nature et de l'émancipation, construite aux marges du "grand récit" socialiste et républicain. De fait, cette tendance dissidente a été ignorée, marginalisée, voire combattue par les courants hégémoniques, qui ont souvent vu dans l'écologie un conservatisme traditionaliste ou un romantisme réactionnaire... While every music lover senses the power and truth that reside in music, very few actually approach music as a path to cosmic knowledge. But the idea that the universe is created out of sound is an ancient one. This book brings together three contemporary German thinkers who exemplify this tradition: Marius Schneider, Rudolf Haase, and Hans Erhard Lauer.

We contrast two theoretical positions on the relation between phenomenal and access consciousness. First, we discuss previous data supporting a mild Overflow position, according to which transient visual awareness can overflow report. These data are open to two interpretations: (i) observers transiently experience specific visual elements outside attentional focus without encoding them into working memory; (ii) no specific visual elements but only statistical summaries are experienced in such conditions. We present new data showing that under data-limited conditions observers cannot discriminate (...) a simple relation (same versus different) without discriminating the elements themselves and, based on additional computational considerations, we argue that this supports the first interpretation: summary statistics (same/different) are grounded on the transient experience of elements. Second, we examine recent data from a variant of ‘inattention blindness’ and argue that contrary to widespread assumptions, it provides further support for Overflow by highlighting another factor, ‘task relevance’, which affects the ability to conceptualize and report (but not experience) visual element. I outline a dilemma for Derek Parfit’s project to vindicate moral realism. In On What Matters, Parfit argues that the best versions of three of the main moral traditions agree on a set of moral principles, which should make us more confident about the prospects of truth in ethics. I show that the result of this Convergence Argument can be interpreted in two ways. Either there remain three separate and deontically equivalent theories or there remains just one theory, the Triple (...) Theory. Both interpretations fail to deliver what Parfit is looking for. The first interpretation leads to a situation of underdetermination of theory choice that gives rise to a skeptical challenge. The second interpretation jettisons Parfit’s Conciliatory Project, that is, the reconciliation of the three moral traditions. The dilemma, I contend, is the result of Parfit failing to resolve two antithetical lines of thought. His search for the Trinity of moral theorizing must thus fail. (shrink)

The standardised randomised clinical trial (RCT) has been exceedingly popular in medical research, economics, and practical policy making. Recently, RCTs have faced criticism. First, it has been argued by John Worrall that we cannot be certain that our sample is not atypical with regard to possible confounding factors. I will argue that at least in the case of medical research, we know enough about the relevant causal mechanisms to be justified to ignore a number of factors we have good reason (...) not to expect to be disruptive. I will also argue against an argument provided by Nancy Cartwright and Eileen Munro that RCTs should not be taken to deductively infer probabilistic causal claims, but ampliatively. The paper will end on a discussion of evidence hierarchies and a defence of the stance of evidence-based medicine that RCTs are the best available method to assess a treatment’s efficacy. (shrink)

On 3 June 2008 the National Family Policy Concept was adopted by Seimas that states the goals and principles of the state family policy and several times refers to historical and scientific experience. The present article aims to reveal the historical and legal experience of the ancient Rome that laid foundations of contemporary private law and to compare the goals of the National Family Policy Concept and the state policy of the ancient Rome regarding family issues. The concept of family (...) framed by the National Family Policy Concept is based on matrimony. This is why the authors of the article focus on Roman matrimony. Having discussed the ancient Roman concept of marriage and Roman state policy regarding issues of matrimony and family and comparing it with the aims of the National Family Policy concept it might be stated that policy of encouraging family and promoting family relations based on matrimony that is provided by the Lithuanian state is not a new invention but may also refer to legal resolutions of the ancient Rome. This article aims to show the peculiarities of the legal status of advocates, patrons, rhetoricians and other assistants of the litigants in civil procedure, the concept of a bar, as a professional corporation, presumption of its origin and mission in ancient Rome, origins of state guaranteed (...) legal aid and the institute of obligatory participation of the advocate in the procedure, the conditions of the agreement between the advocate and the client (mandatum), the peculiarities of the advocate’s fees for legal services, the responsibility of the advocate for improper execution of duties and other issues. The study is part of an ampler research focusing on the issue of the mentalities (collective imaginary), seculariza- tion and the theory of the cultural models. The interre- latedness of these theoretical topics is approached on the basis provided by the qualitative analysis data, and attempts to demonstrate the variety of the consequences in the secularization process within culture, regarding them as seminal premises of producing novelty and dif- ference. However, secularization is assessed on a com- parative basis, in accordance (...) with the rise and develop- ment of present-day religiosity. Cultural models face on- going revision, reflecting the changes going on within the frame of the mentalities or the collective imaginary. Though the cultural model tends to embody the most feasible (pragmatic) representation of the imaginary, contextuality, contingency and historicity are part in the ultimate shaping of the model. The author intends to look at Romanian cultural transition as an ongoing process which since 1989 has known an accelerated pace according to the fall of communism and the real perspectives of integration in the European Union. Seen within the cultural constraints of globalization, the impact of social and cultural change in Romanian society affected considerably the cultural behavior of the individual as well as the setting of new institutions, their functioning and implicitly the rhythm of democratization. Both groups, according to Kant, were mistaken in believing that there is but one ultimate source or faculty of knowledge. Discuss critically Kant’s attack on these two positions with particular reference to the distinction between analytic and synthetic judgements and Kant’s notion of synthetic a priori judgements. In climate science, observational gridded climate datasets that are based on in situ measurements serve as evidence for scientific claims and they are used to both calibrate and evaluate models. However, datasets only represent selected aspects of the real world, so when they are used for a specific purpose they can be a source of uncertainty. Here, we present a framework for understanding this uncertainty of observational datasets which distinguishes three general sources of uncertainty: (1) uncertainty that arises during the (...) generation of the dataset; (2) uncertainty due to biased samples; and (3) uncertainty that arises due to the choice of abstract properties, such as resolution and metric. Based on this framework, we identify four different types of dataset ensembles — parametric, structural, resampling, and property ensembles—as tools to understand and assess uncertainties arising from the use of datasets for a specific purpose. We advocate for a more systematic generation of dataset ensembles by using these sorts of tools. Finally, we discuss the use of dataset ensembles in climate model evaluation. We argue that a more systematic understanding and assessment of dataset uncertainty is needed to allow for a more reliable uncertainty assessment in the context of model evaluation. The more systematic use of such a framework would be beneficial for both scientific reasoning and scientific policy advice based on climate datasets. (shrink)

Much early modern metaphysics grew with an eye to the new science of its time, but few figures took it as seriously as Emilie du Châtelet. Happily, her oeuvre is now attracting close, renewed attention, and so the time is ripe for looking into her metaphysical foundation for empirical theory. Accordingly, I move here to do just that. I establish two conclusions. First, du Châtelet's basic metaphysics is a robust realism. Idealist strands, while they exist, are confined to non-basic regimes. (...) Linguistic competence is, among other things, the cognitive ability of using words appropriately. Following this notion, being a competent language user cannot be merely simulated because pretending to use words appropriately already is using words appropriately. Since current AI already can use words appropriately it may be that AI already has linguistic competence instead of merely simulating it. However, in this article I argue that there is at least one domain of linguistic competence that can be simulated: grasping lexical effects. (...) Since grasping lexical effects presupposes an ability which AI lacks, namely feeling emotions, I argue that AI can only grasp the cognitive part of words but not their lexical effects. AI can only simulate to grasp lexical effects. Hence, lexical effects are a domain of linguistic competence AI cannot grasp. (shrink)

Right to life is an essential natural right protected and defended by law. The aim of this publication is to discuss the main issues regarding human right to life and its protection in the Roman law. Article deals with the problems of beginning and end of the human life and legal capacity in Rome, elements of legal protection of slaves and family members subject to pater familias life as well as the principle crimes attempting to human life. First of all, (...) the right to life as well as the right to liberty were held to be the institutes of natural law (ius naturale) meanwhile institutes that provided possibility to withdraw those rights (e. g. patria potestas that in the most ancient époque included right to decide on subject person’s right to life) are derived from the branches of positive law—civil (ius civile) and law of nations (ius gentium). Such attitude of the Roman jurisprudence had a solid impact on recognizing right of life to be an inherent law of every person, deriving immediately from the human nature and not conferred by the society and the state. ABSTRACT In this paper, I propose a variant of a Humean account of laws called "Open Future Humeanism", which holds that since the laws supervene partly on future events, there are at any instant infinitely many possible future courses of events. I argue that if one wants to take the openness of the future that OFH proposes ontologically serious, then OFH is best represented within a growing block view of time. I further discuss some of OFH's problems which stem from (...) the fact that in this view, there are no laws as long as time progresses. These problems can be solved by adding a temporal operator to the laws, so that at any instant, we get a set of tensed laws which held up to and including that instant. (shrink)
