Quality and service improvement (QSI) research employs a broad range of methods to enhance the efficiency of healthcare delivery. QSI research differs from traditional healthcare research and poses unique ethical questions. Since QSI research aims to generate knowledge to enhance quality improvement efforts, should it be considered research for regulatory purposes? Is review by a research ethics committee required? Should healthcare providers be considered research participants? If participation in QSI research entails no more than minimal risk, is consent required? The (...) lack of consensus on answers to these questions highlights the need for ethical guidance. Three distinct approaches to classifying QSI research in accordance with existing ethical principles and regulations can be found in the literature. In the first approach, QSI research is viewed as distinct from other types of healthcare research and does not require regulation. In the second approach, QSI research falls within regulatory guidelines but is exempt from research ethics committee review. In the third approach, QSI research is deemed to be part of the learning healthcare system and, as such, is subject to a different set of ethical principles entirely. In this paper, we critically assess each of these views. While none of these approaches is entirely satisfactory, we argue that use of the ethical principles governing research provides the best means of addressing the numerous questions posed by QSI research. We report our efforts to assess the skill of contemplating and evaluating argumentation. An adaptive forced-choice instrument was developed and administered to 6th grade students, 7th grade students who had participated in a year-long intervention that successfully strengthened their argumentation production skills, and expert arguers. The instrument was sensitive enough to detect differences in skill level across these groups. Despite their gains in production skill, however, 7th graders showed only modest superiority over the untrained 6th graders and performance well below (...) that of experts. Meta-level demands involved in evaluation but not present in production, we propose, may make evaluation more difficult. (shrink)

Patients and family members (N = 671) were surveyed in five Mid-Atlantic U.S. hospitals to ascertain the number and kinds of ethical concerns they are presently experiencing or have previously experienced while being sick or receiving medical care. Seventy percent of participants had at least one (range 0–14) type of ethical concern or question. The most commonly experienced concerns pertained to being unsure how to plan ahead or complete an advance directive (29.4%), being unsure whether someone in the family was (...) able to make their own decisions (29.2%), deciding about limiting life-sustaining treatments (28.6%), wondering about disclosing personal medical information to others in the family (26.4%) and not being sure whether to undergo treatment because of cost (26.2%). Most were interested to some degree in getting help from ethics consultants in the future (76.6%). Given this prevalence, common concerns might usefully be addressed systematically, rather than exclusively on a case-by-case basis. (shrink)

Randomized controlled trial trial designs exist on an explanatory-pragmatic spectrum, depending on the degree to which a study aims to address a question of efficacy or effectiveness. As conceptualized by Schwartz and Lellouch in 1967, an explanatory approach to trial design emphasizes hypothesis testing about the mechanisms of action of treatments under ideal conditions, whereas a pragmatic approach emphasizes testing effectiveness of two or more available treatments in real-world conditions. Interest in, and the number of, pragmatic trials has grown substantially (...) in recent years, with increased recognition by funders and stakeholders worldwide of the need for credible evidence to inform clinical decision-making. This increase has been accompanied by the onset of learning healthcare systems, as well as an increasing focus on patient-oriented research. However, pragmatic trials have ethical challenges that have not yet been identified or adequately characterized. The present study aims to explore the views of key stakeholders with respect to ethical issues raised by the design and conduct of pragmatic trials. It is embedded within a large, four-year project that seeks to develop guidance for the ethical design and conduct of pragmatic trials. As a first step, this study will address important gaps in the current empirical literature with respect to identifying a comprehensive range of ethical issues arising from the design and conduct of pragmatic trials. By opening up a broad range of topics for consideration within our parallel ethical analysis, we will extend the current debate, which has largely emphasized issues of consent, to the range of ethical considerations that may flow from specific design choices. Semi-structured interviews with key stakeholders, across multiple jurisdictions, identified based on their known experience and/or expertise with pragmatic trials. We expect that the study outputs will be of interest to a wide range of knowledge users including trialists, ethicists, research ethics committees, journal editors, regulators, healthcare policymakers, research funders and patient groups. The Ghirardi–Rimini–Weber (GRW) theory of spontaneous wave function collapse is known to provide a quantum theory without observers, in fact two different ones by using either the matter density ontology (GRWm) or the flash ontology (GRWf). Both theories are known to make predictions different from those of quantum mechanics, but the difference is so small that no decisive experiment can as yet be performed. While some testable deviations from quantum mechanics have long been known, we provide here something that has (...) until now been missing: a formalism that succinctly summarizes the empirical predictions of GRWm and GRWf. We call it the GRW formalism. Its structure is similar to that of the quantum formalism but involves different operators. In other words, we establish the validity of a general algorithm for directly computing the testable predictions of GRWm and GRWf. We further show that some well-defined quantities cannot be measured in a GRWm or GRWf world. (shrink)

Along with Husserl's Ideas and Heidegger's Being and Time, Being Given is one of the classic works of phenomenology in the twentieth century. Through readings of Kant, Husserl, Heidegger, Derrida, and twentieth-century French phenomenology (e.g., Merleau-Ponty, Levinas, and Henry), it ventures a bold and decisive reappraisal of phenomenology and its possibilities. This pioneering book demonstrates the crucial importance of Wittgenstein's philosophy of mathematics to his philosophy as a whole. Marion traces the development of Wittgenstein's thinking in the context of the mathematical and philosophical work of the times, to make coherent sense of ideas that have too often been misunderstood because they have been presented in a disjointed and incomplete way. In particular, he illuminates the work of the neglected 'transitional period' between the Tractatus and the Investigations.

A source of much difficulty and confusion in the interpretation of quantum mechanics is a naive realism about operators. By this we refer to various ways of taking too seriously the notion of operator-as-observable, and in particular to the all too casual talk about measuring operators that occurs when the subject is quantum mechanics. Without a specification of what should be meant by measuring a quantum observable, such an expression can have no clear meaning. A definite specification is provided by (...) Bohmian mechanics, a theory that emerges from Schrödinger's equation for a system of particles when we merely insist that particles means particles. Bohmian mechanics clarifies the status and the role of operators as observables in quantum mechanics by providing the operational details absent from standard quantum mechanics. It thereby allows us to readily dismiss all the radical claims traditionally enveloping the transition from the classical to the quantum realm — for example, that we must abandon classical logic or classical probability. In this paper we provide an interpretation of Aristotle's rule for the universal quantifier in Topics Θ 157a34–37 and 160b1–6 in terms of Paul Lorenzen's dialogical logic. This is meant as a contribution to the rehabilitation of the role of dialectic within the Organon. After a review of earlier views of Aristotle on quantification, we argue that this rule is related to the dictum de omni in Prior Analytics A 24b28–29. This would be an indication of the dictum’s origin in (...) the context of dialectical games. One consequence of our approach is a novel explanation of the doctrine of the existential import of the quantifiers in dialectical terms. After a brief survey of Lorenzen's dialogical logic, we offer a set of rules for dialectical games based on previous work by Castelnérac and Marion, to which we add here the rule for the universal quantifier, as interpreted in terms of its counterpart in dialogical logic. Theories of deliberative democracy presume too narrow an understanding of political communication. Several forms of communication additional to argument are important for political debate, especially between members of more dominant and more marginalized groups. Greeting, rhetoric, and narrative each have important functions for public acknowledgement of interlocutors and communication when premises are not shared.

According to the realist, the meaning of a declarative, non-indexical sentence is the condition under which it is true and the truth-condition of an undecidable sentence can obtain or fail to obtain independently of our capacity, even in principle, to recognize that it obtains or that fails to do so.1 In a series of papers, beginning with “Truth” in 1959, Michael Dummett challenged the position that the classical notion of truth-condition occupied as the central notion of a theory of meaning, (...) and proposed that it should be replaced by the anti-realist (and intuitionistic) notion of assertability-condition. Taken together with normalization results obtained by Dag Prawitz, Dummett’s work truly opened up the anti-realist challenge at the level of proof-theoretical semantics.2 There has been since numerous rejoinders from partisans of classical logic, which were at times met with by attempts at watering down the anti-realist challenge, e.g., by arguing that anti-realism does not necessarily entail the adoption of intuitionistic logic. Only a few anti-realists, such as Crispin Wright and Neil Tennant, tried to look instead in the other direction, towards a more radical version of anti-realism which would entail deeper revisions of classical logic than those recommended by intuitionists.3 In this paper, which is largely programmatic, we shall also argue in favour of a radical anti-realism which would be a genuine alternative to the traditional anti-realism of Dummett and Prawitz. The debate about anti-realism has by now more or less run out of breath and we wish to provide it with a new lease on life, by taking into account the profound changes that took place in proof theory during the intervening years. We have in mind in particular the considerable development within Gentzen-style proof theory of non-classical, substructural logics other than intuitionistic logic, which seriously opens up the possibility that anti-realism, when properly understood, might end up justifying another logic, and the development of closer links between proof theory and computational complexity theory that has renewed interest in a radical form of anti-realism, namely strict finitism. Der kürzlich verstorbene US-amerikanische Soziologe Robert K. Merton war der prominenteste und einflußreichste Anomie-Theoretiker nach Emile Durkheim. Seine Typologie der Arten individueller Anpassung an anomische gesellschaftliche Situationen bietet heute noch eine wertvolle Grundlage zur Analyse von Gesellschaften. Dieser Beitrag konzentriert sich auf einen dieser Anpassungstypen, den Ritualismus, der Merton zufolge beinhaltet, daß einerseits die kulturellen Ziele, allen voran das des wirtschaftlichen Wohlstands, heruntergeschraubt oder aufgegeben und andererseits die institutionellen Normen zur Erreichung dieser Ziele beinahe zwanghaft befolgt werden. Diese Definition überdenkend (...) versucht der vorliegende Beitrag herauszuarbeiten, daß innerhalb des Systems der Anpassungsformen das Herunterschrauben der kulturellen Ziele nicht das Hauptcharakteristikum ritualistischen, sondern konformen Verhaltens darstellt. Ritualisten haben den Prozeß des Herunterschraubens vielmehr bereits beendet, indem sie jegliche kulturellen Ziele aufgegeben haben, bis auf den einen Wert an sich, nämlich die institutionellen Regeln einzuhalten.Ritualistische Anpassung ist aus Merton`s Sicht für die Soziologie abweichenden Verhaltens, ganz zu schweigen von den Kriminalwissenschaften, nicht von Interesse. Im Gegensatz zu dieser Einschätzung versucht dieser Artikel die verschiedenen soziologischen und sogar kriminologischen Implikationen ritualistischen Verhaltens darzustellen, mit dem Ergebnis, daß Ritualismus sehr wohl ein soziales Problem darstellt. Der Ritualist unterwirft sich nicht nur selbst den institutionellen Normen, sondern fühlt sich auch dazu berufen, andere ständig an die Einhaltung der Regeln zu gemahnen und sie zu überwachen. Deshalb gibt es viele typisch ritualistische Formen abweichenden Verhaltens, wie Denunziation, erzieherischer Tadel oder Mobbing, die sogar in kriminelles Verhalten wie falsche Verdächtigung, Nötigung oder Beleidigung kulminieren können.Am schillerndsten ist die Rolle des Ritualisten in der Kriminalpolitik, nicht zuletzt heute in der Bundesrepublik. Repression jeglicher Art ist seine Antwort auf Regelverstöße und die Kriminalpolitik macht zunehmend Zugeständnisse an ritualistische Forderungen nach härterer und schnellerer Bestrafung oder umfassender Überwachung des öffentlichen Raumes. Ritualisten dominieren den sozialen Diskurs und die allgemeine Wahrnehmung von Kriminalität nicht nur, weil sie wichtige Nutzer und damit Zielgruppe gewisser Massenmedien sind und gerne Leserbriefe schreiben. Sie sind so dominant, weil ihre Art der Anpassung bei zunehmender wirtschaftlicher Krise die Konformität der Wirtschaftswunderzeit zurückgedrängt hat und heute die am weitesten verbreitete in der deutschen Gesellschaft ist. Daher ist auch die schon seit Jahrzehnten zu beobachtende Verschiebung der theoretischen Strafzweckbegründung hin zur Positiven Generalprävention alles andere als ein Zufall. The recently deceased US-sociologist Robert K. Merton has been the most prominent and influential anomie theorist since Emile Durkheim. His typology of modes of adaptation to anomic social situations still constitutes a valuable basis for analyzing society. This contribution focuses on one of these types of adaptation, ritualism, which according to Merton, involves the scaling down or abandoning of the cultural goals, above all economic wealth, on the one hand and to abide almost compulsively by institutional norms to attain these goals on the other. In reconsidering this definition, this contribution attempts to elaborate that within the system of adaptive modes scaling down does not describe the main characteristic of ritualistic behaviour, but first of all characterizes conformity. Ritualists, on the contrary, have already completed the process of scaling down by finally abandoning any cultural goal except the one end-in-itself, that is to comply with the institutional rules.Ritualistic adaptation, in Merton`s view, is of no interest to the sociology of deviant behaviour, not to mention criminal sciences. In contrast to this evaluation this contribution tries to delineate the various sociological and even criminological implications of ritualistic behaviour, leading to the conclusion that Ritualism does indeed present a social problem. The ritualist does not only surrender himself to the institutional means but feels competent to constantly reminding others of abiding by the institutional norms and supervising them. Hence there are many typically ritualistic forms of deviant behaviour like denunciation, disciplinary reproof or mobbing that may even culminate in criminal behaviour like false suspicion, duress or insult.Most ambiguous is the ritualist`s part in criminal policy, not at least in contemporary Germany. Repression of any kind is his answer to breaches of the rules and criminal policy more and more concedes to ritualistic demands for more severe and rapid punishment or extensive supervision of public facilities. Ritualists dominate the social discourse and general perception of criminality, not only because they are important users and therefore the target group of certain mass media, and like to write letters to the editor. They do dominate because in times of increasing economic crisis their mode of adaptation has forced back the conformity of the German economic miracle era and is now the most common one in contemporary German society. Thus, the shift in the theoretical justification of punishment towards a theory of positive general prevention, noticeable for decades, is anything but accidental. (shrink)

He asks an astonishingly simple—but profoundly provocative—question in order to open up an entirely new way of thinking about knowledge: Isn’t our uncertainty, our finitude, and rational (...) limitations, one of the few things we can be certain about? Marion shows how the assumption of knowledge as positive demands a reductive epistemology that disregards immeasurable or disorderly phenomena. He shows that we have experiences every day that have no identifiable causes or predictable reasons and that these constitute a very real knowledge—a knowledge of the limits of what can be known. Establishing this “negative certainty,” Marion applies it to four aporias, or issues of certain uncertainty: the definition of man; the nature of God; the unconditionality of the gift; and the unpredictability of events. On Descartes’ Passive Thought is the culmination of a life-long reflection on the philosophy of Descartes by one of the most important living French philosophers. In it, Jean-Luc Marion examines anew some of the questions left unresolved in his previous books about Descartes, with a particular focus on Descartes’s theory of morals and the passions. Descartes has long been associated with mind-body dualism, but Marion argues here that this is a historical misattribution, popularized by Malebranche and popular ever (...) since both within the academy and with the general public. Actually, Marion shows, Descartes held a holistic conception of body and mind. He called it the meum corpus, a passive mode of thinking, which implies far more than just pure mind—rather, it signifies a mind directly connected to the body: the human being that I am. Understood in this new light, the Descartes Marion uncovers through close readings of works such as Passions of the Soul resists prominent criticisms leveled at him by twentieth-century figures like Husserl and Heidegger, and even anticipates the non-dualistic, phenomenological concepts of human being discussed today. The aim of J.-L. Marion’s article is to revisit the important debate on the place of Augustine in the history of metaphysics. Often, quibbles arise upon considering the use of substance (substantia) by Augustine, not only as approximative of essentia and as synonymous with ousia, but in deciding whether in so doing Augustine effectuates a ‘metaphysical turn’. While he elsewhere argues that Augustine is a pre-metaphysical thinker, in this article Marion focuses on showing the diverse range of usages (...) of the term substance in the Augustinian corpus. Marion observes: first, whenever substance seems a fixed definition, the term allows for equivocity; second, God is substance in an indeterminate sense or by negation; third, human beings are substances fundamentally to capture the mutability of human existence. As such, Marion concludes, the Augustinian use of substance is insufficient to inelude Augustine in the history of metaphysics. (shrink)

The COVID-19 pandemic has forced developmental researchers to rethink their traditional research practices. The growing need to study infant development at a distance has shifted our research paradigm to online and digital monitoring of infants and families, using electronic devices, such as smartphones. In this practical guide, we introduce the Experience Sampling Method – a research method to collect data, in the moment, on multiple occasions over time – for examining infant development at a distance. ESM is highly suited for (...) assessing dynamic processes of infant development and family dynamics, such as parent-infant interactions and parenting practices. It can also be used to track highly fluctuating family dynamics and routines. The aim of the current paper was to provide an overview by explaining what ESM is and for what types of research ESM is best suited. Next, we provide a brief step-by-step guide on how to start and run an ESM study, including preregistration, development of a questionnaire, using wearables and other hardware, planning and design considerations, and examples of possible analysis techniques. Finally, we discuss common pitfalls of ESM research and how to avoid them. (shrink)

The question of responsibility plays a critical role not only in our attempts to resolve social and political problems, but in our very conceptions of what those problems are. Who, for example, is to blame for apartheid in South Africa? Is the South African government responsible? What about multinational corporations that do business there? Will uncovering the "true facts of the matter" lead us to the right answer? In an argument both compelling and provocative, Marion Smiley demonstrates how attributions (...) of blame—far from being based on an objective process of factual discovery—are instead judgments that we ourselves make on the basis of our own political and social points of view. She argues that our conception of responsibility is a singularly modern one that locates the source of blameworthiness in an individual's free will. After exploring the flaws inherent in this conception, she shows how our judgments of blame evolve out of our configuration of social roles, our conception of communal boundaries, and the distribution of power upon which both are based. The great strength of Smiley's study lies in the way in which it brings together both rigorous philosophical analysis and an appreciation of the dynamics of social and political practice. By developing a pragmatic conception of moral responsibility, this work illustrates both how moral philosophy can enhance our understanding of social and political practices and why reflection on these practices is necessary to the reconstruction of our moral concepts.
