L’article se propose d’explorer l’univers des facultés de droit sous la République de Weimar, que les contemporains jugent en « crise ». Cette perception renvoie tout d’abord aux difficultés d’adaptation d’un enseignement qui est de plus en plus écartelé entre les exigences de la science (transmettre une compréhension historique de l’évolution du droit) et celles de la pratique (préparer les étudiants au monde professionnel par une connaissance du droit en vigueur) : l’Université apparaît ainsi comme un lieu de confrontation entre (...) professeurs et autorités étatiques pour le contrôle du cursus juridique. Par ailleurs, dans un contexte de grande expansion des effectifs étudiants, les facultés de droit ne connaissent pas de démocratisation de leur public et restent le domaine des élites traditionnelles ; de ce fait, elles semblent en décalage avec leur époque et continuent de former un univers passéiste que conforte l’engagement des étudiants dans des corporations traditionnelles. Background The first COVID-19 wave started in February 2020 in France. The influx of patients requiring emergency care and high-level technicity led healthcare professionals to fear saturation of available care. In that context, the multidisciplinary Ethics- Support Cell (EST) was created to help medical teams consider the decisions that could potentially be sources of ethical dilemmas. Objectives The primary objective was to prospectively collect information on requests for EST assistance from 23 March to 9 May 2020. The secondary aim was (...) to describe the Cell’s functions during that period. Research design This observational, real-time study of requests for Cell consultations concerned ethical dilemmas arising during a public health crisis. The EST created a grid to collect relevant information (clinical, patient’s/designated representative’s preferences and ethical principles strained by the situation), thereby assuring that each EST asked the same questions, in the same order. Participants and research context Only our university hospital’s clinicians could request EST intervention. Ethical considerations The hospital Research Ethics Committee approved this study (no. CER-2020-107). The patient, his/her family, or designated representative was informed of this ethics consultation and most met with EST members, which enabled them to express their preferences and/or opposition. Findings/results 33 requests (patients’ mean age: 80.8 years; 29 had COVID-19: 24 with dyspnea, 30 with comorbidities). 17 Emergency Department solicitations concerned ICU admission, without reference to resource constraints; others addressed therapeutic proportionality dilemmas. Discussion Intervention-request motives concerned limited resources and treatment intensity. Management revolved around three axes: the treatment option most appropriate for the patient, the feasibility of implementation, and dignified care for the patient. Conclusions COVID-19 crisis forced hospitals to envisage prioritization of ICU access. Established decision-making criteria and protocols do not enable healthcare professionals to escape ethical dilemmas. That acknowledgement highlights ethical risks, enhances the added-value of nursing and encourages all players to be vigilant to pursue collective deliberations to achieve clear and transparent decisions. In vertebrates, single cell analyses of replication timing patterns brought to light a very well controlled program suggesting a tight regulation on initiation sites. Mapping of replication origins with different methods has revealed discrete preferential sites, enriched in promoters and potential G‐quadruplex motifs, which can aggregate into initiation zones spanning several tens of kilobases (kb). Another characteristic of replication origins is a nucleosome‐free region (NFR). A modified yeast strain containing a humanized origin recognition complex (ORC) fires new origins at NFRs (...) revealing their regulatory role. In cooperation with NFRs, the histone variant H2A.Z facilitates ORC loading through di‐methylation of lysine 20 of histone H4. Recent studies using genome editing methods show that efficient initiation sites associated with transcriptional activity can synergize over several tens of kb by establishing physical contacts and lead to the formation of early domains of DNA replication demonstrating a co‐regulation between replication initiation and transcription. Sacred Landscape and Visual Culture. The Paintings of the Lower Church of the Sacro Speco at Subiaco - The purpose of this article is to investigate the emergence of landscape in visual discourses. The subject of this research is the territory of Subiaco and - more specifically - the monastery of the Sacro Speco, built on the site of St Benedict’s hermitage. It is here, in the vast decorative cycle directed by Magister Conxolus at the end of the thirteenth century, (...) that the “sacred landscape” of Subiaco is bent by the monastic community to claim its possession. Benedict is always portrayed inside his Grotto - which becomes a veritable “attribute” of the saint - and the same discourse also includes the portrayal of Chelidonia, a Benedictine hermit nun who lived between the eleventh and twelfth centuries. Through the experiences of the two saints, the landscape becomes sacralised and acquires an identity value for the Benedictine community which lives there. In this context, the figures of Benedict and Chelidonia create a visual bridge to Francis and Clare, and the frescoes becomes a Benedictine response to the “Franciscan challenge”. (shrink)

INSPIRED by a dynamist Naturphilosophie and looking for a mathematics of the natura naturans, the founders of modern mathematics in Germany made some lasting contributions in the attempt to go beyond perceptible space. Hermann Grassmann’s extension theory, Johann Benedict Listing’s topology, Bernhard Riemann’s non-Euclidean manifold theory, Carl Gustav Jacob Jacobi’s approach to non-mechanistic theory and last but not least Georg Cantor’s transfinite set theory were all influenced by the tradition of Naturphilosophie. One central motivation for the new mathematics was to (...) decipher the so-called “inner side of nature” which was thought to be invisible but nonetheless physical. As a result, mathematics was understood not only in terms of quantity but of morphogenetic quality and as a tool to recognize the intrinsic possibilities of structuring and organizing nature. This essay focuses on the philosophical viewpoints of Christian Samuel Weiss, Justus and Hermann Grassmann, Bernhard Riemann and their reception of Schelling’s philosophy. Riemann deconstructed empiricist theories of space so as to glean the fundamental constitution of space. One result was that a given, fixed and static metric is not necessary for the understanding of space. The underlying topological substratum has no specific metric but is capable of exhibiting any possible metric. Riemann’s claims are compared with Schelling’s theory of space in his “Darstellung des Naturprocesses”. My thesis is that Schelling’s philosophy of the emergence of space can be read in Riemannian terms and that it is an interesting model in the context of modern questions. (shrink)

La diffusion des révisions hiéronymiennes des Bibles latines s’est faite notamment à travers les textes liturgiques latins. La présente communication s’intéresse à l’utilisation de l’oeuvre du moine de Bethléem dans les prières des livres liturgiques (missels, sacramentaires et bénédictions pontificales). Elle est centrée sur les citations des livres dits “des petits prophètes”. Si l’oeuvre de Jérôme s’impose progressivement dans la vie liturgique occidentale à partir de la deuxième moitié du VIIe et du VIIIe siècle, plusieurs missels et sacramentaires comportent aussi (...) bien des citations de la révision de Jérôme que de versions des Vieilles latines. C’est notamment le cas de sacramentaires irlandais de la fin du VIIe siècle et du missel gallican dit Missale Gothicum, datant des années 700. À cette époque, l’oeuvre de Jérôme n’est donc pas encore utilisée par la liturgie comme un ensemble unifié. La citation et l’allusion aux anciennes traductions latines persiste même dans la péninsule ibérique et la liturgie mozarabe jusqu’au XIIe siècle. Une étude détaillée des allusions au livre II de Jonas montre que des morceaux de versets issus des Vieilles latines se sont maintenus pendant tout le Moyen-Âge dans des livres ayant recours à la Vulgate, peut-être parce qu’ils étaient passés dans la culture biblique collective. Cet article souligne donc la nécessité d’une analyse détaillée, livre liturgique par livre liturgique, pour étudier les citations de la Bible dans la liturgie latine, car une même pièce liturgique peut emprunter à plusieurs traductions différentes. L'itinéraire singulier d'une femme que l'on pourrait, par bien des aspects, considérer comme appartenant à un passé déjà lointain, suscite pourtant chez nombre de nos contemporains un intérêt de plus en plus grand. Edith Stein - connue également sous le nom, qu'elle prit au Carmel, de Thérèse-Bénédicte de la Croix - reste aux yeux de beaucoup un témoin particulièrement saisissant des drames fondamentaux qui ont jalonné le XXe siècle européen et dont nous sommes, pour le meilleur comme peut-être pour le (...) pire, les héritiers. C'est à ce titre que sa vie et son message peuvent constituer pour notre avenir une lumière digne d'être interrogée. S'il est vrai que l'Europe doit d'abord et avant tout être un espace où vivent et se rencontrent des êtres humains capables de promouvoir une culture empreinte de dignité et de responsabilité, il était alors tout naturel de prendre comme fil conducteur de ce colloque le thème essentiel de la réflexion steinienne : la question de la personne humaine. Quatre approches complémentaires ont été choisies pour déployer quelques-unes des composantes de cette interrogation : L'enracinement philosophique d'Edith Stein dans le milieu phénoménologique de Göttingen, sa situation dans l'histoire de son temps, son activité d'éducatrice au service de la formation intégrale de la personne humaine, l'accomplissement de son engagement intellectuel dans la réflexion théologique et l'expérience du mystère de la Croix. Obligations to God must be taken to trump all others, and so one is confronted neither with a conflict in the natural law nor between specific divine commands. Nonetheless, one is left, as in the point made above, with the question of what responsibilities are (...) incurred both by God and by human agents when moral obligations are set aside, if indeed they are, for religious ones? These questions need to be addressed for reasons additional to comprehensiveness. They are central to the project Santurri has undertaken, which as I take it is to show that the moral life is coherent and not self-frustrating. Now, there are at least two ways in which the moral life can founder. The first is the one Santurri so ably discusses. It might he that the moral universe is structured in such a way that one cannot avoid doing wrong in doing right. The second is suggested by the questions asked immediately above which he does not address. It may he that, in setting aside one obligation for another, additional obligations are engendered which might possibly make the living of the moral life after either self-defeating or exhausting or both. Perhaps moral or religious/moral tensions do not contain genuine dilem· mas, hut suppose they generate fearful moral debts that simply con· tinue to pile up? It is the mark of a good book to leave its readers with questions they did not have when first they picked it up. To do justice to it in a short review is impossible, but I hope to call attention to the features that make it so exceptionally worthwhile and important. It is, first of all, a work of immense learning, packed with informa· tion and extensive documentation. The author's mastery of contem· BOOK REVIEWS 169 porary science and of the historical development of both philosophy and theology is amazing. But more than this, Ashley knows how to go to the heart of the matter, to sift the incidental from the essential. The goal of this chapter is to mount a critique of the claim that cognitive content (that is, the kind of content possessed by our concepts and thoughts) makes a constitutive contribution to the phenomenal properties of our mental lives. We therefore defend the view that phenomenal consciousness is exclusively experiential (or nonconceptual) in character. The main focus of the chapter is on the alleged contribution that concepts make to the phenomenology of visual experience. Is there such a sub-discipline as “sociology of valuation and evaluation”? Identifying the main focus, the topics, and the analytical designs, i.e., reflecting on a theoretical profile of such an investigation, is far from complete. The main question is indeed—where to start when addressing the sociology of valuation and evaluation? Is it a specific area of research, analysis, and inquiry, with specific objects? Should we confine it to the many important qualitative and quantitative studies dedicated to the measure of market (...) performance, the efficiency of public policy, profitability of private investment, or identification of best practices in various areas ? While researchers have examined the types of ethical issues that arise in long-term care, few studies have explored long-term care nurses’ experiences of moral distress and fewer still have examined responses to initial moral distress. Using an interpretive description approach, 15 nurses working in long-term care settings within one city in Canada were interviewed about their responses to experiences of initial moral distress, resources or supports they identified as helpful or potentially helpful in dealing with these situations, and factors that (...) hindered nurses in their responses. Using a thematic analysis process, three major themes were identified from the nurses’ experiences: (i) the context of the situation matters; (ii) the value of coming together as a team; and (iii) looking for outside direction. The work of responding to initial moral distress was more fruitful if opportunities existed to discuss conflicts with other team members and if managers supported nurses in moving their concerns forward through meetings or conversations with the team, physician, or family. Access to objective others and opportunities for education about ethics were also identified as important for dealing with value conflicts. (shrink)

Jean-Luc Nancy is one of the leading contemporary thinkers in France today. Through an inventive reappropriation of the major figures in the continental tradition, Nancy has developed an original ontology that impacts the way we think about religion, politics, community, embodiment, and art. Drawing from a wide range of his writing, Marie-Eve Morin provides the first comprehensive and systematic account of Nancy’s thinking, all the way up to his most recent work on the deconstruction of Christianity. Without losing sight (...) of the heterogeneity of Nancy’s work, Morin presents a concise articulation of the organizing concepts, which structure Nancy’s body of work. The guiding thread is that of an essential rift at the heart of any “self” by which this self is exposed and relates to itself and other selves. Nancy’s ontology undercuts dichotomies between individual and community, interior and exterior, matter and spirit, thing and thought, not in the name of mere deconstruction, but in seeking to open a thinking of the “limit” or the “edge” as the locus of sense. While Nancy’s work has often been presented in relation to Heidegger or Derrida, Morin demonstrates the originality of Nancy’s work and argues that, despite the variety of its preoccupations and topics, it possesses its own rigorous internal logic. Contributing to both ageing research and queer-feminist scholarship, this article introduces feminist philosopher Margrit Shildrick’s queer notion of the monstrous to the subject of ageing and the issue of dealing with frailty within ageing research. The monstrous, as a norm-critical notion, takes as its point of departure that we are always already monstrous, meaning that the western ideal of well-ordered, independent, unleaky, rational embodied subjects is impossible to achieve. From this starting point the normalizing and optimizing strategies of ageing research (...) – here exemplified through the concept of successful ageing and the treatment of Alzheimer’s disease – can be problematized. The notion of the monstrous instead suggests a view on ageing and ‘monstrous’ embodiment which provides room for other, different ways of being recognized as an embodied subject, and for dealing with difference, vulnerability and frailty. Motivation plays an important role in students’ school behavior, and research has established that students’ learning environment experiences such as teachers’ behavior toward them contribute to their motivation and behavior at school. Self-determination theory offers an interesting frame of reference in the study of the relationship between students’ learning experiences at school and their school behavior. Considering three basic psychological needs, the SDT points to the importance of nutriments and support in the social environment in order to allow growth in (...) motivation, engagement, and well-functioning. In addition, thwarting these needs is supposed to contribute to maladaptive functioning. Teachers can play an important role in the fulfillment of students’ basic psychological needs by delivering support ; however, controlling instructional behavior, chaos in the classroom, and teacher rejection and neglect are supposed to be a treat to the fulfillment of students’ basic psychological needs. In the current innovative longitudinal study, teachers’ need-supportive behavior as well as teachers’ thwarting of these needs are considered and their relationship with students’ academic engagement and procrastination behavior is studied. In addition, attention is paid to differential effects of teachers’ behavior with regard to boys and girls. Participants were 566 students belonging to 20 mathematics/English grade 1 secondary education classes in the Netherlands. Multilevel analyses revealed evidence for the importance of both teachers’ need-supportive and need-thwarting behaviors in relation to students’ academic engagement and procrastination behavior. In addition, the findings revealed that teachers’ need-supportive behavior is more important for students’ academic engagement, while teachers’ need-thwarting behavior has larger effects on students’ procrastination behavior. Furthermore, evidence was found that boys often seemed to be more sensitive to their teachers’ behavior than girls. The findings highlight the importance of both teachers’ need-supportive and need-thwarting behaviors in daily classrooms and contribute to deepen our insight into and understanding of factors leading to adaptive and maladaptive functioning of boys and girls in relation to learning tasks at school. This article presents, in a programmatic way, the histoire croisée approach, its methodological implications and its empirical developments. Histoire croisée draws on the debates about comparative history, transfer studies, and connected or shared history that have been carried out in the social sciences in recent years. It invites us to reconsider the interactions between different societies or cultures, erudite disciplines or traditions . Histoire croisée focuses on empirical intercrossings consubstantial with the object of study, as well as on the operations (...) by which researchers themselves cross scales, categories, and viewpoints. The article first shows how this approach differs from purely comparative or transfer studies. It then develops the principles of pragmatic and reflexive induction as a major methodological principle of histoire croisée. While underlining the need and the methods of a historicization of both the objects and categories of analysis, it calls for a reconsideration of the way history can combine empirical and reflexive concerns into a dynamic and flexible approach. This article addresses how bodily integrity has been mobilised in the context of genital cutting of male infants and the extent to which the concept is taken into account in legal decision-making in the United Kingdom. While bioethicists have debated whether interventions on children's bodies are more appropriately determined on the basis of hypothetical consent or in the child's best interest, it is clear that in law the relevant test is whether interventions are in the child's best interest. As the (...) issue of nonconsensual genital cutting of infants has become more contested, courts have been asked to adjudicate on the best interests of infants in situations where their caregivers disagree about procedures. Although this body of jurisprudence remains (surprisingly) small, in this article we argue that, while there are now discernible trends in such cases (e.g. deferring decision-making until the child has the requisite capacity to decide, engaging with certain human rights norms), too often judicial reasoning about a child's best interests remains largely empty of reasoned content, and in certain respects is regressing. Using the recent case of Re P to exemplify this logic, and drawing on our previous work advocating the value of embodied integrity, we argue that judges should adopt a more substantive framework of values in judging the child's corporeal and other interests in such cases. This would move best interests assessments beyond a mere formalistic exercise and lead to better reasoned legal judgements. (shrink)

This dissertation aims to construct a non-dogmatic defence of common sense. It tries to show why the absence of justification for the judgements of common sense, which the sceptic reveals, does not invalidate them.

The indexical word “I” has traditionally been assumed to be an overt analogue to the concept of self, and the best model for understanding it. This approach, I argue, overlooks the essential role of cognitive phenomenology in the mastery of the concept of self. I suggest that a better model is to be found in a different kind of representation: phenomenal concepts or more generally phenomenally grounded concepts. I start with what I take to be the defining feature of the (...) concept of self, namely its “super-reflexivity”: to use this concept is not just to think of oneself, but to think of oneself as the thinker of the present thought. I call this familiar observation the “Thinker Intuition”. I review some shortcomings of the indexical model of the concept of self, which is the classical account of the Thinker Intuition. I go on to propose a different account, the “phenomenal model”, according to which the concept of self is a phenomenally grounded concept, anchored in a generic kind of cognitive phenomenolog... This article examines how immigrant careworkers relate dynamically with the Norwegian gender regime. While the importation of careworkers contributes both to the practical maintenance and to the undermining on a more ideological level of the Norwegian gender regime, it also brings in new constellations and possibilities. In this article examples from two studies are discussed in the light of institutional and intersectional perspectives. It describes features of the Norwegian gender regime that are especially relevant to carework, and the highly gendered (...) distribution and sharing of carework across the public and private domains. One central Norwegian form of care institution, the nursing home, then comes into focus. Making use of empirical examples from fieldwork and interviews, the article discusses how, as immigrant careworkers increasingly staff these institutions, new light is thrown on existing power structures, while at the same time these structures may be challenged through the fluidity of situational and relational gendering processes. In recent years there has been an expansion of scientific work on consciousness. However, there is an increasing necessity to integrate evolutionary and interdisciplinary perspectives and to bring affective feelings more centrally into the overall discussion. Pursuant especially to the theorizing of Endel Tulving , Panksepp and Vandekerckhove we will look at the phenomena starting with primary-process consciousness, namely the rudimentary state of autonomic awareness or unknowing consciousness, with a fundamental form of first-person ‘self-experience’ which relies on affective experiential states (...) and raw sensory and perceptual mental existences, to higher forms of knowing and self-aware consciousness. Since current scientific approaches are most concerned with the understanding of higher declarative states of consciousness, we will focus on these vastly underestimated primary forms of consciousness which may be foundational for all forms of higher ‘knowing consciousness’. Background Levels of care deemed as inappropriate generate moral distress among nurses and other intensive care professionals. Inappropriate levels of care and related moral distress are frequently broached as individual and psychological phenomena, reduced to how individuals feel and think about specific cases. However, this tends to obscure the complex context in which these situations occur, and on which healthcare professionals can act. There is thus a need for a more contextual and team-level lens on inappropriate levels of care. Research (...) objective This study aims to explore and understand the issue of inappropriate levels of care in an intensive care unit (ICU) through a contextual and team-level lens. Research design Semi-structured interviews were conducted with nurses, respiratory therapists, and intensivists. Thematic analysis focused on understanding the causes and consequences of inappropriate levels of care, as well as potential avenues for improvement. This study is part of a 5-phase participatory living lab project on inappropriate levels of care conducted in the ICU of a Montreal (Quebec, Canada) hospital. This paper relates the initial phases of the project, focusing on understanding the issue, with reported events spanning from June 2022 to May 2023. Ethical considerations Ethics approval was sought and granted by the Research Ethics Board of the CIUSSS de l’Est-de-l’Île-de-Montréal. Findings/Discussion Five broad themes intrinsically related to the phenomenon of inappropriate levels of care were explored with and by participants: (1) the process of determining levels of care, (2) the distinction between appropriate and inappropriate levels of care, (3) causes of inappropriate levels of care, (4) consequences of inappropriate levels of care and (5) potential avenues for improvement. Conclusion This research provides a comprehensive understanding of inappropriate levels of care in the ICU and emphasizes the relevance of team-level explorations of complex ethical issues. (shrink)

Within recent years, an increasing number of people and researchers in the Global North have become interested in psychedelic substances and their therapeutic application. While much of the current media attention and research effort mainly concentrate on the therapeutic potential and actions of the individual's acute psychedelic experience, this article explores the user-perceived, therapeutic dynamics of psychedelics in a more long-term perspective by charting the lived experiences and practices of ‘integration’ among psychedelic users in Denmark. Based on ethnographic fieldwork from (...) November 2020 to June 2021, I offer a dual typology of self-related integration as narrative and experiential-somatic. Combining the two, I argue that psychedelic integration in contemporary Denmark can be viewed as a processual self-transformation of the users' experiential orientation where understandings and/or modes of being from the acute psychedelic experience are woven into, prolonged, and/or embodied in their everyday existence. This dissertation develops a Kantian philosophical framework for understanding our individual obligations under public law. Because we have a right to do anything that is not wrong, the best interpretation of Immanuel Kant's Universal Principle of Right tracks the two ways--material and formal--in which actions can be wrong. This interpretation yields surprising insights, most notably a novel formulation of Kant's standard for formal wrongdoing. Because the wrong-making property of a formally wrong action does not depend on whether or not the (...) action in question has been prohibited by statute, Kant's legal philosophy is consistent with a natural law theory of public crime. Moreover, because the law can obligate us only by establishing a universal external incentive to obey its commands, statutes that impose only fines on nominal violators do not constrain our lawful options. Instead, if they are otherwise just, such statutes must be regarded as rightful permissive laws, according to which we may incur liabilities through our voluntary choices. (shrink)
