Moral or ethical questions are vital because they affect our daily lives: what is the best choice we can make, the best action to take in a given situation, and ultimately, the best way to live our lives? Health ethics has contributed to moving ethics toward a more experience-based and user-oriented theoretical and methodological stance but remains in our practice an incomplete lever for human development and flourishing. This context led us to envision and develop the stance of a “living (...) ethics”, described in this inaugural collective and programmatic paper as an effort to consolidate creative collaboration between a wide array of stakeholders. We engaged in a participatory discussion and collective writing process known as instrumentalist concept analysis. This process included initial local consultations, an exploratory literature review, the constitution of a working group of 21 co-authors, and 8 workshops supporting a collaborative thinking and writing process. First, a living ethics designates a stance attentive to human experience and the role played by morality in human existence. Second, a living ethics represents an ongoing effort to interrogate and scrutinize our moral experiences to facilitate adaptation of people and contexts. It promotes the active and inclusive engagement of both individuals and communities in envisioning and enacting scenarios which correspond to their flourishing as authentic ethical agents. Living ethics encourages meaningful participation of stakeholders because moral questions touch deeply upon who we are and who we want to be. We explain various aspects of a living ethics stance, including its theoretical, methodological, and practical implications as well as some barriers to its enactment based on the reflections resulting from the collaborative thinking and writing process. In a crisis, managers are confronted with a dilemma between their ethical responsibility to respond to victims and their fiduciary responsibility to protect shareholder value. In this study, we use a unique and comprehensive dataset of 223 non-financial crises between 1983 and 2013 to investigate how corporate apologies affect stock prices. Our empirical evidence shows that the stock price response from apologizing depends on the firm’s level of responsibility for the crisis. We find that to protect shareholder value, management needs (...) to match its formal response strategy with the degree of its responsibility for the crisis. Further, failing to match the proper response is harmful to shareholders: Both apologizing when the firm is not directly responsible for the crisis and failing to apologize when the firm is directly responsible reduce shareholder wealth. However, apologizing for a crisis when the firm is directly responsible mitigates losses to shareholder value that arise because of the crisis, as does refraining from apologizing when the firm is not directly responsible. Abstract:Vulnerability is an important criterion to assess the ethical justification of the inclusion of participants in research trials. Currently, vulnerability is often understood as an attribute inherent to a participant by nature of a diagnosed condition. Accordingly, a common ethical concern relates to the participant’s decisionmaking capacity and ability to provide free and informed consent. We propose an expanded view of vulnerability that moves beyond a focus on consent and the intrinsic attributes of participants. Pain, suffering and positive emotions in patients in vegetative state/unresponsive wakefulness syndrome (VS/uws) and minimally conscious states (MCS) pose clinical and ethical challenges. Clinically, we evaluate behavioural responses after painful stimulation and also emotionally-contingent behaviours (e.g., smiling). Using stimuli with emotional valence, neuroimaging and electrophysiology technologies can detect subclinical remnants of preserved capacities for pain which might influence decisions about treatment limitation. To date, no data exist as to how healthcare providers think about end-of-life options (e.g., withdrawal of artificial nutrition (...) and hydration) in the presence or absence of pain in non-communicative patients. Here, we aimed to better clarify this issue by re-analyzing previously published data on pain perception (Prog Brain Res 2009 177, 329–38) and end-of-life decisions (J Neurol 2010 258, 1058–65) in patients with disorders of consciousness. In a sample of 2259 European healthcare professionals we found that, for VS/uws more respondents agreed with treatment withdrawal when they considered that VS/uws patients did not feel pain (77%) as compared to those who thought VS/uws did feel pain (59%). This interaction was influenced by religiosity and professional background. For MCS, end-of-life attitudes were not influenced by opinions on pain perception. Within a contemporary ethical context we discuss (1) the evolving scientific understandings of pain perception and their relationship to existing clinical and ethical guidelines; (2) the discrepancies of attitudes within (and between) healthcare providers and their consequences for treatment approaches, and (3) the implicit but complex relationship between pain perception and attitudes toward life-sustaining treatments. ABSTRACT: The concept of the “banality of evil,” put forward by Hannah Arendt to describe the psychological profile of the Nazi criminal in Eichmann in Jerusalem, is intimately tied to her reading of Plato. In Arendt’s examination of the question of evil, she found some support in Kant’s philosophy. However, the problem of guilt under Nazism ultimately goes back to an inability to think. The two-in-one, a concept which describes the activity of thinking, is based on Plato’s dialogues. An examination (...) of these philosophical sources contributes to the understanding of the possibilities and the limits of Arendt’s reflection on evil. RÉSUMÉ : Le concept de banalité du mal, proposé par Hannah Arendt pour décrire le profil psychologique du criminel nazi dans Eichmann in Jerusalem, est intimement lié à ses lectures de Platon. Pour aborder la question du mal, elle a découvert des appuis chez Kant, mais le problème de la culpabilité sous le régime nazi renvoie ultimement au défaut de penser. Le deux-en-un, concept qui décrit la pensée, a été défini sur la base de l’oeuvre platonicienne. The concept of community of persons, which focuses on both persons and the whole, helps understand solidarity. The latter is based on the social nature of persons. Community of persons and solidarity seems to be able to move away from the individualist perspective or the individualism-collectivism dichotomy. Using autopraxeography in a pragmatic constructivism epistemological paradigm, this article aims to explore how organizations can develop solidarity in a workplace. The experience presented takes place in a bank. It shows that communities of (...) persons with employees and customers are both ethical and financially efficient. These communities build a dialogue between persons and organizations. Nevertheless, it is impossible to force solidarity because it could generate derision that is contrary to the wished goal. Finally, while this model is based on solidarity, it focuses solely on internal solidarity. (shrink)

Current controversies about the ordination of women have shown the need for a re‐examination of what the Christian Church means by priesthood. This article looks at the Epistle to the Hebrews’ contribution to our understanding. To that end it focuses on the institution of priesthood in its first‐century Jewish context and shows the use made of it by the author of Hebrews in his presentation of Christian faith.Section 1 emphasizes some all‐important differences between the NT’s use of the language of (...) priesthood and ours. Not least, it nowhere uses “priest” to designate Christian ministers. All the more striking, therefore, is Hebrews’ depiction of Jesus as “high priest”.Section 2 discusses Judaism’ Day of Atonement ceremonies – Hebrews’ dominant cultic model. In the comparison drawn between Christ’s death and exaltation with these rites, he becomes not only the high priest but also the expiatory victim.As far as Judaism’ cultic institutions are concerned, however, Jesus was not and never could be a priest, since he was of the tribe of Judah rather than Levi. Hence Hebrews appeals to Melchizedek. How this non‐Israelite model is used by Hebrews to subvert the whole notion of priesthood as caste is discussed in section 3.Finally, in section 4 Isaacs concludes that for Hebrews there is no longer a role for an ongoing priesthood, since Jesus has definitively achieved access to God, which was its raison d’être. Melchizedekian high priesthood is unique to Christ; neither inherited nor transmitted. Hence, unlike other NT authors, for Hebrews even the church as a corporate body is not a priesthood. As its closing chapters show, in this Epistle the cultic model gives way to the more inclusive one of pilgrimage. (shrink)

Discussion of Wittgenstein's Tractatus is currently dominated by two opposing interpretations of the work: a metaphysical or realist reading and the 'resolute' reading of Diamond and Conant. Marie McGinn's principal aim in this book is to develop an alternative interpretative line, which rejects the idea, central to the metaphysical reading, that Wittgenstein sets out to ground the logic of our language in features of an independently constituted reality, but which allows that he aims to provide positive philosophical insights into (...) how language functions. McGinn takes as a guiding principle the idea that we should see Wittgenstein's early work as an attempt to eschew philosophical theory and to allow language itself to reveal how it functions. By this account, the aim of the work is to elucidate what language itself makes clear, namely, what is essential to its capacity to express thoughts that are true or false. However, the early Wittgenstein undertakes this descriptive project in the grip of a set of preconceptions concerning the essence of language that determine both how he conceives the problem and the approach he takes to the task of clarification. Nevertheless, the Tractatus contains philosophical insights, achieved despite his early preconceptions, that form the foundation of his later philosophy. -/- The anti-metaphysical interpretation that is presented includes a novel reading of the problematic opening sections of the Tractatus, in which the apparently metaphysical status of Wittgenstein's remarks is shown to be an illusion. The book includes a discussion of the philosophical background to the Tractatus, a comprehensive interpretation of Wittgenstein's early views of logic and language, and an interpretation of the remarks on solipsism. The final chapter is a discussion of the relation between the early and the later philosophy that articulates the fundamental shift in Wittgenstein's approach to the task of understanding how language functions and reveal the still more fundamental continuity in his conception of his philosophical task. Patient self-disclosure is essential to the work of health professionals, and this is even more critical in mental health where speech is a reflection of the content of thought. Self-disclosure is then about invisible symptoms that are associated with health problems where discrimination and stigmatization are still very prevalent. This article explores the ethical issues of this phenomenon which has received very little study. Disclosure as a decision-making, interpersonal, dynamic and complex process will be defined and deepened with the help (...) of examples from research. Subsequently, the vulnerability of the person who discloses will be addressed, followed by issues of quality of care and related to the standards of professional practice associated with patient disclosure and their associated responsibility. These elements highlight many ethical issues and ultimately lead us to a proposal to situate the professionals involved. (shrink)

Brain-Computer Interface is a set of technologies that are of increasing interest to researchers. BCI has been proposed as assistive technology for individuals who are non-communicative or paralyzed, such as those with amyotrophic lateral sclerosis or spinal cord injury. The technology has also been suggested for enhancement and entertainment uses, and there are companies currently marketing BCI devices for those purposes as well as health-related purposes. The unprecedented direct connection created by BCI between human brains and computer hardware raises various (...) ethical, social, and legal challenges that merit further examination and discussion. To identify and characterize the key issues associated with BCI use, we performed a scoping review of biomedical ethics literature, analyzing the ethics concerns cited across multiple disciplines, including philosophy and medicine. Based on this investigation, we report that BCI research and its potential translation to therapeutic intervention generate significant ethical, legal, and social concerns, notably with regards to personhood, stigma, autonomy, privacy, research ethics, safety, responsibility, and justice. Our review of the literature determined, furthermore, that while these issues have been enumerated extensively, few concrete recommendations have been expressed. We conclude that future research should focus on remedying a lack of practical solutions to the ethical challenges of BCI, alongside the collection of empirical data on the perspectives of the public, BCI users, and BCI researchers. Through repetition and combinations of words and movements new expectations and new social roles are created. This shows not only how fragile interaction processes can be disturbed but also how we are prone to make sense out of interactions through observation.

Agonistic Democracy explores how theoretical concepts from agonistic democracy can inform institutional design in order to mediate conflict in multicultural, pluralist societies. Drawing on the work of Foucault, Nietzsche, Schmitt, and Arendt, Marie Paxton outlines the importance of their themes of public contestation, contingency and necessary interdependency for contemporary agonistic thinkers. Paxton delineates three distinct approaches to agonistic democracy: David Owen's perfectionist agonism, Mouffe's adversarial agonism, and William Connolly and James Tully's inclusive agonism. Maurice Blondel’s philosophy has had a decisive influence on the theology of Henri de Lubac, but more than an influence, it goes of an encounter and a dialogue between two great Catholic thinkers. This article proposes, over the course of successive encounters and collaborations between Blondel and Lubac, a presentation of Lubac’s reflection in that it extends Blondel’s critique of extrinsicity to the field of theology. This friendship between Lubac and Blondel testifies to the inherent character of the mystical question (...) to both philosophy and theology. This anchoring signifies the Mystery of Christ at work in the gesture of reason and in the understanding of faith. At the same time, Lubac promotes, in philosophy itself, an intelligence through faith. Friendship has not been an empty word with Lubac who openly defended Maurice Blondel on several occasions, and even after Blondel’s death, when Lubac continued to make the philosopher’s thought known by publishing and annotating a large part of his correspondence. Abstract:Adaptive architecture has been investigated in its functional as well as technological capacities and potentials to respond to changing environmental conditions as well as user interactions – from kinetic façades to variable interiors. Yet, its dynamic aesthetics of various spatial, visual, and auditive states require further exploration, especially in relation to occupant perception and experience. We propose the phenomenological concept of atmospheres as a lens through which the aesthetics of adaptive architecture can be observed as fundamentally relational: as co-constituted by (...) “ambient qualities and human condition.” As these ambient qualities are getting more dynamic and are becoming increasingly manipulable with adaptive architecture, their critical reflection and negotiation is urgent; it has to involve occupants. Jean-Luc Nancy is one of the leading contemporary thinkers in France today. Through an inventive reappropriation of the major figures in the continental tradition, Nancy has developed an original ontology that impacts the way we think about religion, politics, community, embodiment, and art. Drawing from a wide range of his writing, Marie-Eve Morin provides the first comprehensive and systematic account of Nancy’s thinking, all the way up to his most recent work on the deconstruction of Christianity. Without losing sight (...) of the heterogeneity of Nancy’s work, Morin presents a concise articulation of the organizing concepts, which structure Nancy’s body of work. The guiding thread is that of an essential rift at the heart of any “self” by which this self is exposed and relates to itself and other selves. Nancy’s ontology undercuts dichotomies between individual and community, interior and exterior, matter and spirit, thing and thought, not in the name of mere deconstruction, but in seeking to open a thinking of the “limit” or the “edge” as the locus of sense. While Nancy’s work has often been presented in relation to Heidegger or Derrida, Morin demonstrates the originality of Nancy’s work and argues that, despite the variety of its preoccupations and topics, it possesses its own rigorous internal logic. Gathering evidence across disciplines is a strength of interdisciplinary fields like neuroethics. However, conclusions can only be made if the evidence applies to the issue at hand. Libet and colleagues' Citation1983 experiment is an interesting case study in this problem. Despite ongoing critiques about the methods used and the replicability of its findings, many people consider Libet and colleagues' methodology a valid strategy to investigate free will and related topics. We reviewed studies using methods similar to those of Libet and (...) colleagues (N = 48) to identify its use and the evidence produced. Overall, we found substantial variation between studies. While the Libet paradigm may be useful for examining how stimuli affect temporal judgments, the link between this and free will or moral responsibility is not clear. Being aware and critical of the methods used to gather results is important when applying scientific experiments to complex, abstract phenomena. (shrink)

The classical theory of semantic information (ESI), as formulated by Bar-Hillel and Carnap in 1952, does not give a satisfactory account of the problem of what information, if any, analytically and/or logically true sentences have to offer. According to ESI, analytically true sentences lack informational content, and any two analytically equivalent sentences convey the same piece of information. This problem is connected with Cohen and Nagel's paradox of inference: Since the conclusion of a valid argument is contained in the premises, (...) it fails to provide any novel information. Again, ESI does not give a satisfactory account of the paradox. In this paper I propose a solution based on the distinction between empirical information and analytic information. Declarative sentences are informative due to their meanings. I construe meanings as structured hyperintensions, modelled in Transparent Intensional Logic as so-called constructions. These are abstract, algorithmically structured procedures whose constituents are sub-procedures. My main thesis is that constructions are the vehicles of information. Hence, although analytically true sentences provide no empirical information about the state of the world, they convey analytic information, in the shape of constructions prescribing how to arrive at the truths in question. Moreover, even though analytically equivalent sentences have equal empirical content, their analytic content may be different. Finally, though the empirical content of the conclusion of a valid argument is contained in the premises, its analytic content may be different from the analytic content of the premises and thus convey a new piece of information.
