The dynamic of changes in the rules in team games materialize from research and debate between experts and coaches before being implemented by the International Federations. In Handball, the last changes occurred in 2016, and one of them was to substitute the goalkeeper with an additional field player allowing teams to play “empty goal” while using the additional field player.This study aimed to analyze and characterize the use of the 7 vs. 6 strategical-tactical option for the attack in the 2020 (...) Men’s European Championship. We also analyzed whether the game time and partial score influenced the use of 7 vs. 6 and its efficiency. Observational methodology and a mixed ad hoc instrument combining field format and category systems validated by experts were used. Data were taken from 28 matches involving teams in the first 12 positions in the 2020 Men’s European Championship. The total number of offensive sequences in an organized attack method in 7 vs. 6 with an empty goal were analyzed. Sequential analysis techniques with lags, prospective and retrospective, and polar coordinate analysis were used. The results showed that these solutions had poor efficiency, except for the Portuguese National Team; teams using the 7 vs. 6 tactic option had no negative consequences or increased risk with the opponent response; partial score influenced the decision to use 7 vs. 6 strategic option, and game time was associated with 7 vs. 6 play options and detected patterns. This paper questions the conventional wisdom that physicians must suppress anger in response to patient misbehaviour. It distinguishes the emotion of anger from its expression, which leans toward concerned frustration and disappointment for the sake of professionalism in patient care. Drawing on the framework of person-centred health care as a virtue ethic, the paper first suggests four reasons why and when physician anger toward patient behaviour may occasionally be appropriate: the inevitability of sometimes feeling angry, anger as a cognitive and (...) behavioural resource, physician well-being, and potential patient benefit. The paper then proposes five conditions under which physician anger displays may be prudent as a measured response that balances emotional expression with professional conduct: ethical intention, rational justification, proportionality, problem-focused constructive expression, and precision. Potential benefits of this conceptualization of prudent anger include improved physician wellbeing, enhanced communication, and patient education to address perceived patient misbehaviour. The paper advocates for a cultural shift in health care environments to help allow for more authentic expression of physician frustration, aiming to harness prudent anger as a catalyst for positive change in patient-physician relationships and systemic improvements in health care delivery. Much of the discussion surrounding freedom of speech relates to the importance of promoting speech. On this approach, the more speech the better, both for individuals and for democratic society. This line of thought, typically associated with the work of J. S. Mill, has obvious merit. Yet unrestrained speech also poses perils to individuals and society. In this paper, we argue for two theses: (1) Examination of On Liberty shows that Mill in fact supported the notion that forbearance in public (...) speech is ethically justified (albeit not legally enforceable), and (2) Anyone supporting utilitarian principles should give serious consideration to the possibility that prudent forbearance in public speech is a civic virtue. In other words, a reasonable concern for free speech as an integral part of social well-functioning should lead us to temper our manners of expression in circumstances when this is appropriate, and when a policy of complete license in public expression would likely undermine both the well-functioning of the society of which we are a part and the free exchange of ideas that free speech principles were intended to foster in the first place. The United States recognized intellectual property rights from its earliest days and included, in its constitution, a clause which expresses this, "To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries." These few words found in Article 1, Section 8, Clause 8 have grown into a massive body of laws that govern works that were unimaginable to Thomas Jefferson and his contemporaries. Our question (...) today is very simple: is the latest metamorphosis of copyright law, the Digital Millennial Copyright Act of 1998, prudent policy? Specifically, we are concerned with three issues which critics have raised regarding this act: chilling effects on fair use, suppression of innovation, and overreach. We will also touch on the criticism which stresses that the DMCA further expands a system which increasingly and unfairly favors the content industries. This will be limited to illustrating extant tensions between copyright owners and society and also the difficulties law faces in keeping pace with the current, rapid and overwhelming technological and cultural change. We rely primarily on leading cases to establish the impact on fair use and innovation or to demonstrate over reach. (shrink)

Romans 13:1-7, which commands subjection to governing authorities, can be given too much weight in the moral analysis of undocumented immigrants. This article considers Romans 13 in the broader context of Romans and of the biblical canon to show biblical reasons for permitting civil disobedience toward immigration law. Rather than viewing undocumented immigrants as universally immoral lawbreakers, these biblical factors combined with analysis of civil disobedience for the preservation of life, legal ambiguities arising from competing jurisdictions, and other socio-political factors (...) show that it may be a prudent action for undocumented immigrants to disobey immigration law. This article provides Catholic authorities with a useful framework for forming prudent and just policies to minimize clerical child sexual abuse, exploiting the 2011 John Jay College report Causes and Context while not ignoring its shortcomings. The framework is St. Thomas Aquinas’s treatment of prudence, and a “profile” of the clerical perpetrators is developed that uses their narcissism as a middle term to explain why these men behaved the way they did. The author concludes by recommending a deterrent policy similar (...) to the policy advocated by St. Paul, which does not unrealistically aim at an angelic clergy but aims to deter those who would enter the priesthood for its benefits. This contribution discusses the United Kingdom (UK) government’s regulatory activities related to nanotechnological development. The central question is what other prudent public regulation can learn from the UK government’s regulatory strategy, its regulatory attitude and its large variety of regulatory measures. Other public regulators can learn from the interactive and integrative UK regulatory approach. They can also draw lessons from the critique on the UK government’s regulatory attitude and its problems to cope with specific nanotechnological challenges. These lessons are based (...) on an evaluation of the UK government’s regulatory activities from the viewpoint of prudent regulation. The notion of responsive regulation, which provides basic ideas for the evaluation methodology, refers to a view on prudence that focuses on moral constitutional values. They combine this extreme semantic minimalism with an even more extreme speech-act pluralism, according to which a speaker has said anything that she can be reported as having said. I argue that because Lepore and Cappelen refuse to distinguish what is (...) said from what is claimed, their tests wrongly classify metaphor as semantically context-sensitive. I then argue that our ordinary linguistic practices support a distinction between what is said and what is claimed, and that underwrites a much more moderate form of speech act pluralism. (shrink)

Moral intuitionism, which claims that some moral seemings are justification-conferring, has become an increasingly popular account in moral epistemology. Defenses of the position have largely focused on the standard account, according to which the justification-conferring power of a moral seeming is determined by its phenomenal credentials alone. Unfortunately, the standard account is a less plausible version of moral intuitionism because it does not take etiology seriously. In this paper, I provide an outline and defense of a non-standard account of moral (...) intuitionism that I dub the “Prudent Conscience View.” According to this view, phenomenal credentials only partially determine the justification-conferring power of a moral seeming, for a seeming’s justification-conferring power is also determined by its etiology. In brief, a moral seeming is justification-conferring to the degree that the conscience that gave rise to it is functioning properly, and a person's conscience functions properly to the degree that the person is prudent. Adam Smith writes favorably about innovation inWealth of Nationswhile writing unfavorably about a figure associated with innovation: the projector. His criticism of projectors prompts many scholars to claim that Smith disapproves of entrepreneurship. But Smith criticizes the projector not because he acts as an entrepreneur but because he fails to meet Smith’s moral standards for entrepreneurship. InTheory of Moral Sentiments, Smith conceives of a framework for moral entrepreneurship based on prudence. The framework consists of two principles: first, approach everyday matters (...) with the general “tenor of conduct” that governs your life and trade, and second, approach life-changing matters with prudence and justice. Recognizing that Smith is concerned with the total effect that an entrepreneurial venture has on society beyond its immediate profits opens the door to engage with contemporary research that studies the ethical and moral externalities of entrepreneurship. Medical technologies, including nanomedicine products, are intended to improve health but in many cases may also create their own health risks. Medical products that create their own health risks differ from most other risk-creating technologies in that the very purpose of the medical technology is to prevent or treat health risks. This paradox of technologies intended to reduce existing risks that may have the effect of creating new risks has two conflicting implications. On one hand, we may be more tolerant (...) of health risks from medical technologies because these products are intended to, and often do, reduce overall health risks and improve our health. The health benefits of a medical technology may outweigh the unavoidable adverse effects of that same technology in an individual patient or in the overall treated population. (shrink)

In their shared works, Gilles Deleuze and Félix Guattari repeatedly advise that ethical practices of experimentation must be imbued with a large dose of prudence. Among commentators, this concept of prudence has primarily been read in cautionary terms, as that which merely enables ethical subjects to avoid the “many dangers” of experimentation. By contrast, this article develops a wider, more positive reading of Deleuzo-Guattarian prudence. Focussing specifically on A Thousand Plateaus, I show that, for Deleuze and Guattari, we must always (...) exercise prudence in ethics because prudence constitutes one positive means of maximizing the success of experimental ethical praxes. I will focus on Dworkin’s use of idealisation in his “Prudent Insurance” Ideal for healthcare. Dworkin identifies problems with the circumstances under which people make their insurance decisions in the current United States healthcare system and he sees these as being the cause of strange resource allocation outcomes. He therefore imagines idealising away these prima facie unjust circumstances to develop a hypothetical market in which people are able to make better decisions (Section “Idealisation of Circumstance”). I will identify two further (...) idealisations that Dworkin relies on in his theory. The first is to idealise people to be perfectly prudent (Section “Idealisation of Prudence”), which I consider to be justifiable, but difficult to actually apply in practise. The second is to idealise people to be perfectly self-interested (Section “Idealisation to Self-interest”). I do not see this as a justifiable idealization since it ignores principles of altruism and citizenship, which would seem to be deeply relevant to a theory of justice. (shrink)

This article conducts a normative evaluation of Operation Iraqi Freedom undertaken in 2003 by employing principles of prudence to enquire whether the use of force could be described as an action by a responsible great power. Along with relating the principles of prudence to the concept of great power responsibility, it highlights two pillars of prudent decision-making: circumspection and awareness of one's limits. This normative framework is then utilised to evaluate the invasion of Iraq from the perspective of these specific (...) aspects of prudence. The conclusion shows that on the basis of this normative yardstick, it is not possible to classify Operation Iraqi Freedom as a prudent action by a responsible great power. (shrink)

The purpose of this article is to draw a comparison between two models of sovereignty, embodied by Philip II of Spain and the Roman emperor Tiberius, as described in Cornelius Tacitus’ Annales. My analysis is based on Diez Libros de la Razón de Estado, the Castilian translation of Della Ragion di Stato by Giovanni Botero (1544–1617), made by the Spanish Court historian Antonio de Herrera y Tordesillas (1549–1625). Herrera’s translation plays an important role in the Spanish reception of the wider (...) debates on the relationship between ethics and politics in early modern Spain. I will first address the reliability of Herrera’s translation, highlighting the instances in which his translation was moulded to be applicable to the Spanish court. What emerges from this analysis is the concern with the notion of ‘prudence’ that enabled Philip II’s political style. Secondly, I intend to show how Herrera depicts Tiberius as acounterpart to Philip II and how the latter takes on the deeds of the prudent monarch. The comparison herein outlined stems from the use of quotations from the Tacitean oeuvre, which had become an important tool for policy-making at the time. (shrink)

In transplant medicine, the use of normothermic regional perfusion (NRP) in donation after circulatory determination of death raises ethical difficulties. NRP is objectionable because it restores the donor's circulation, thus invalidating a death declaration based on the permanent cessation of circulation. NRP's defenders respond with arguments that are tortuous and factually inaccurate and depend on introducing extraneous concepts into the law. However, results comparable to NRP's—more and higher‐quality organs and more efficient allocation—can be achieved by removing organs from deceased donors (...) and using normothermic machine perfusion (NMP) to support the organs outside the body, without jeopardizing confidence in transplantation's legal and ethical foundations. Given the controversy that NRP generates and the convoluted justifications made for it, we recommend a prudential approach we call “ethical parsimony,” which holds that, in the choice between competing means of achieving a result, the ethically simpler one is to be preferred. This approach makes clear that policy‐makers should favor NMP over NRP. (shrink)

Most agree that, in some special scenarios, prudence can speak against feeling a fitting emotion. Some go further, arguing that the tension between fittingness and prudence afflicts some emotions in a fairly general way. This paper goes even further: it argues that, when it comes to anxiety, the tension between fittingness and prudence is nearly inescapable. On any plausible theory, an enormous array of possible outcomes are both bad and epistemically uncertain in the right way to ground fitting anxiety. What’s (...) more, the fittingness of an emotion is a demanding, not a permissive, normative status. So the norms of fitting emotion demand a great deal of anxiety. For almost any realistic agent, it would be deeply imprudent to feel anxiety in a way that meets the demands set by norms of fitting emotion. (shrink)

De manera inmediata y tradicional pensamos que hablar sobre política exige forzosamente ligarla a la idea de conflicto. Si bien es cierto que el carácter político marca ciertos modos de habitar el mundo, también es relevante aclarar que, a partir del concepto que tengamos de política, podremos darnos cuenta de si la idea de conflicto es inherente a esta o si la política puede ser pensada desde otro horizonte. Hans-Georg Gadamer nos ofrece una serie de reflexiones hermenéuticas en torno al (...) lenguaje y al diálogo; a partir de allí, intentamos atisbar un concepto de política no solo inherente al conflicto, sino también a su parte medular como lo es el diálogo prudente. Pensar en una política dentro del marco de un horizonte dialógico nos permite arrojar luz a problemas particulares que nos aquejan hoy, los cuales nos interpelan a pensar y repensarlos para comprender por qué hemos llegado a ser lo que somos. L’article établit un contraste entre deux conceptions de la justice distributive (toutes deux libérales et égalitariennes), en vertu de leur attitude respective à l’égard des choix et de la responsabilité. Un premier type de théories établit la distribution des ressources en fonction de la distinction entre choix des agents et circonstances dans lesquelles ces choix s’opèrent : quiconque est responsable en vertu de ses choix de son manque de ressource est considéré avoir renoncé au droit à une compensation. Or cette (...) théorie part d’une conception erronée de la notion de responsabilité. Les considérations légitimes de réciprocité qui la sous-tendent doivent être envisagées dans le contexte d’une doctrine reposant également sur la notion de responsabilité, mais qui part d’une division des responsabilités entre institutions et individus. Cette seconde conception est développée dans le contexte de la distinction établie par Thomas Scanlon entre responsabilité attributive et responsabilité substantielle. Nous demandons ensuite si les principes de justice fondamentaux dont les institutions sont responsables devraient accorder la priorité à l’égalité équitable des chances et concluons en analysant les effets de la remarque de Rawls selon laquelle l’égalité des chances ne peut être réalisée sans abolir la famille. Background This study introduces an empirical approach for studying the role of prudence in physician treatment of end-of-life (EOL) decision making.Methods A mixed-methods analysis of transcripts from 88 simulated patient encounters in a multicenter study on EOL decision making. Physicians in internal medicine, emergency medicine, and critical care medicine were asked to evaluate a decompensating, end-stage cancer patient. Transcripts of the encounters were coded for actor, action, and content to capture the concept of Aristotelian prudence, and then quantitatively and qualitatively (...) analyzed to identify actions associated with preference-concordant treatment.Results Focusing on codes that describe characteristics of physician-patient interaction, the code for physicians restating patient preferences was associated with avoiding intubation. Multiple codes were associated with secondary measures of preference-concordant treatment.Conclusions Prudent actions can be identified empirically, and research focused on the virtue of prudence may provide a new avenue for assessment and training in EOL care. Huemer responds to Michael Young's argument that an ethical egoist should not embrace prudent predation because accepting a principle of prudent predation has serious negative consequences over and above the consequences of individual predatory acts. In addition, he addresses the advantages Young claims for an agent-relative conception of value over an agent-neutral one. He finds that the agent-relative conception does not clearly have any of the advantages Young names, and that some paradigmatic uses of the concept of value are agent-neutral.

The Prudent Investor Rule creates a potential ethical dilemma for investment advisors selling over-the-counter financial products issued by their firms. The "opportunity" to defraud investors using complex, over-the-counter derivative securities designed for client-specific risk management is much higher than for exchange traded securities. This paper emphasizes the ethical responsibility held by trustees and their organizations to eliminate potential conflict of interests through internal control and monitoring. Independent evaluations of the performance of investment advisors and independent appraisals of complex over-the-counter securities (...) are important in reducing the risks of conflicts of interest. Recent lessons learned from the corporate ethics crisis and requirements of the 2002 Sarbanes Oxley Act would suggest that conflict of interest must be eliminated with third party validation of derivative pricing. By performing due diligence and validation, the trustee is able to satisfy the requirements under the Prudent Investor Rule. (shrink)

The field of health promotions faces considerable ethical and programmatic challenge – and we believe opportunity – in addressing the relative normativity of the concept(s) of health and its professional handling. To date, distinctions of objective and subjective indicants of “health” have fostered normative tension(s) within the utilitarian ethics of health promotions, which we opine to be anathema to the ultimate goal(s) of attaining and sustaining healthy individuals and societies. Objective and subjective metrics and values should be reconciled, as reciprocal (...) and complementary on both idiosyncratic and systemic levels. In this light, we propose that a philosophical and ethical approach, based primarily upon Schmitz’s New Phenomenology and its specific understanding of subjectivity could afford epistemological bases for non-normative engagement of health promotion within a structural–functional framework of ethics. We dialectically address its potential benefit, limitations and value for health promotion and health care ethics and present an approach which points towards a more substantial encouragement of diversity through the legitimation of subjectivity.
