Our intuitive assumption that only organisms are the real individuals in the natural world is at odds with developments in cell biology, ecology, genetics, evolutionary biology, and other fields. Although organisms have served for centuries as nature’s paradigmatic individuals, science suggests that organisms are only one of the many ways in which the natural world could be organized. When living beings work together—as in ant colonies, beehives, and bacteria-metazoan symbiosis—new collective individuals can emerge. In this book, leading scholars consider the (...) biological and philosophical implications of the emergence of these new collective individuals from associations of living beings. According to moral error theorists, moral claims necessarily represent categorically or robustly normative facts. But since there are no such facts, moral thought and discourse are systematically mistaken. One widely discussed objection to the moral error theory is that it cannot be true because it leads to an epistemic error theory. We argue that this objection is mistaken. Objectors may be right that the epistemic error theory is untenable. We also agree with epistemic realists that our epistemological claims are not (...) systematically in error. However, this is not because there are robustly normative facts, but rather because the truth of our epistemic claims doesn’t turn on whether there are such facts. Epistemic facts, we argue, are not robustly or categorically normative. Moral error theorists should therefore respond to the objection that their view does not commit them to the epistemic error theory. (shrink)

Is the Miranda warning, which lets an accused know of the right to remain silent, more about procedural fairness or about the conventions of speech acts and silences? Do U.S. laws about Native Americans violate the preferred or traditional "silence" of the peoples whose religions and languages they aim to "protect" and "preserve"? In Just Silences, Marianne Constable draws on such examples to explore what is at stake in modern law: a potentially new silence as to justice.Grounding her claims (...) about modern law in rhetorical analyses of U.S. law and legal texts and locating those claims within the tradition of Nietzsche, Heidegger, and Foucault, Constable asks what we are to make of silences in modern law and justice. She shows how what she calls "sociolegal positivism" is more important than the natural law/positive law distinction for understanding modern law. Modern law is a social and sociological phenomenon, whose instrumental, power-oriented, sometimes violent nature raises serious doubts about the continued possibility of justice. She shows how particular views of language and speech are implicated in such law.But law--like language--has not always been positivist, empirical, or sociological, nor need it be. Constable examines possibilities of silence and proposes an alternative understanding of law--one that emerges in the calling, however silently, of words to justice. Epistemology is widely seen as a normative discipline like ethics. Just like moral facts, epistemic facts – i.e. facts about our beliefs’ epistemic justification, rationality, reasonableness, correctness, warrant, and the like – are standardly viewed as normative facts. Yet, whereas many philosophers have rejected the existence of moral facts, few have raised similar doubts about the existence of epistemic facts. In recent years however, several metaethicists and epistemologists have rejected this Janus-faced or dual stance towards the existence of moral and (...) epistemic facts. As recent developments in metaethics and normativity theory have made clear, objections to the existence of moral facts really are metanormative objections that target the existence of normative facts more generally. But since epistemic facts are no less normative than moral facts, the argument goes, the existence of the former is equally threatened by metaethical objections. In this thesis, I argue that this rejection of the dual stance fails because epistemic facts are not normative facts. Although they imply norms, they do not imply genuine normativity since the epistemic norms of belief that they imply lack necessary normative authority or force. Unlike moral norms and just like e.g. norms of etiquette and the law, there is not automatically a normative reason to conform to epistemic norms. Therefore, even if metaethical objections target all normative facts, it does not follow that they also target epistemic facts. I offer a two-part abductive argument in favour of that conclusion. First, I argue that epistemic facts lack five commonly cited features of normative facts (but not of merely norm-implying facts). Then, I argue that this is best explained by the thesis that epistemic facts are merely norm-implying and not genuinely normative. I end by exploring the potential consequences of this conclusion for epistemology and metaethics. (shrink)

It would be easy enough to support the claim that the man who introduced post-Kantian idealism into the French universities did so primarily because he found in this system a way to demonstrate the Spiritualist doctrine which came from Biran, the Eclectics, and particularly from Ravaisson. Idealism, in effect, was to Jules Lachelier more of a premise than a conclusion. Now although it might be true that post-Kantianism had been able to provide the right kind of support for the main (...) Spiritualist beliefs, notably the thesis of the reality of Spirit, its presence in nature, and indeed its primacy over nature, the fact remains, and this is what I shall attempt to show, that this idealism is incompatible with a notion that plays a prominent role in the Spiritualist doctrine: that of the existence of a transcendent God. Here, then, is what I should like to claim: that the same principles which were used to prove the Spiritual nature of both thought and matter should render impossible not only the proof of a transcendent God, but also the mere entertaining of the hypothesis of such a being. According to the deontological conception of epistemic justification, a belief is justified when it is our obligation or duty as rational creatures to believe it. However, this view faces an important objection according to which we cannot have such epistemic obligations since our beliefs are never under our voluntary control. One possible strategy against this argument is to show that we do have voluntary control over some of our beliefs, and that we therefore have epistemic obligations. This is what I (...) call the voluntarist strategy. I examine it and argue that it is not promising. I show how the voluntarist attempts of Carl Ginet and Brian Weatherson fail, and conclude that it would be more fruitful for deontologists to look for a different strategy. (shrink)

French cultural theorist and urbanist Paul Virilio is best known for his writings on media, technology, and architecture. Gathered here in _A Winter’s Journey _are four remarkable conversations in which Virilio and architectural writer Marianne Brausch look at a twentieth century characterized by enormous technological acceleration and by technocultural accidents of barbarism and horror. The dialogues in _A Winter_’_s Journey—_structured loosely around the dates 1940, 1950, 1960, and 1980—chart Virilio’s intimate intellectual biography, from his childhood lived against the unstable (...) backdrop of a heavily bombed, wartime Nantes to maturity in a crisis space that is neither entirely militarized nor yet fully civilian, but somewhere between the two. In the course of these conversations, Virilio and Brausch ultimately find hope that in understanding the events of the last century and the cultural responses spawned by them, we can create a more humane era that is more adept at handling the transformations of its technology and culture. _A Winter’s Journey _is a revealing and engaging look into the intellectual life and ideas of one of the most influential theorists of contemporary civilization. This article addresses the conditions that are necessary for non-Indigenous people to learn from Indigenous people, more specifically from women and feminists. As non-Indigenous scholars, we first explore the challenges of epistemic dialogue through the example of Traditional Ecological Knowledge. From there, through the concept of mastery, we examine the social and ontological conditions under which settler subjectivities develop. As demonstrated by Julietta Singh and Val Plumwood, the logic of mastery—which has legitimated the oppression and exploitation of Indigenous peoples—has been (...) reproduced in academia, leaving almost no room for Indigenous knowledge and epistemes. In the same vein, Sámi scholar Rauna Kuokkanen reclaims and suggests the logic of the gift as a means to render academia more hospitable to Indigenous peoples and epistemes. In our view, reclaim as a concept-practice is a promising way to disrupt colonial, racist, and sexist power relations. Thus, we in turn propose to reclaim vulnerability as defined by Judith Butler in order to deconstruct masterful settler subjectivities and reconstruct relational ones instead. As theorized by Erinn Gilson, we propose epistemic vulnerability to imagine the conditions of our learning from Indigenous peoples and philosophies. (shrink)

Background Since the enactment of the euthanasia law in the Netherlands, there has been a lively public debate on assisted dying that may influence the way patients talk about euthanasia and physician-assisted suicide with their physicians and the way physicians experience the practice of EAS. Aim To show what developments physicians see in practice and how they perceive the influence of the public debate on the practice of EAS. Methods We conducted a secondary analysis of in-depth interviews with 28 Dutch (...) physicians who had experience with a complex case of EAS. Respondents were recruited both by the network of physicians working for SCEN as well as via a national questionnaire, wherein participating physicians could indicate their willingness to be interviewed. Results Three themes came up in analysing the interviews. First, the interviewed physicians experienced a change in what patients would expect from them: from a role as an involved caregiver to being the mere performer of EAS. Second, interviewees said that requests for EAS based on non-medical reasons came up more frequently and wondered if EAS was the right solution for these requests. Last, respondents had the impression that the standards of EAS are shifting and that the boundaries of the EAS regulation were stretched. Conclusions The perceived developments could make physicians less willing to consider a request for EAS. Our results also raise questions about the role of physicians and of EAS in society. (shrink)

For many epistemologists and normativity theorists, epistemic norms necessarily entail normative reasons. Why or in virtue of what do epistemic norms have this necessary normative authority? According to what I call epistemic constitutivism, it is ultimately because belief constitutively aims at truth. In this paper, I examine various versions of the aim of belief thesis and argue that none of them can plausibly ground the normative authority of epistemic norms. I conclude that epistemic constitutivism is not a promising strategy for (...) grounding epistemic normativity. (shrink)

According to epistemic instrumentalism, epistemic normativity arises from and depends on facts about our ends. On that view, a consideration C is an epistemic reason for a subject S to Φ only if Φ-ing would promote an end that S has. However, according to the Too Few Epistemic Reasons objection, this cannot be correct since there are cases in which, intuitively, C is an epistemic reason for S to Φ even though Φ-ing would not promote any of S’s ends. After (...) clarifying both EI and the Too Few Epistemic Reasons objection, I examine three major instrumentalist replies and argue that none of them is satisfactory. Or, les deux modèles sous-jacents à cette évolution de l'humanité sont susceptibles de deux évaluations, l'une positive, l'autre négative, ce qui permet d'engendrer quatre types de civilisation: complémentarité positive ; complémentarité négative ; ressemblance positive ; (...) ressemblance négative. Ce dernier type n'a pas été identifié par l'auteure, d'où son absence de nom et d'ancrage historique. L'article soutient que le non-lieu et le non-temps de cette option renvoient à un imaginaire qui commande également la description du premier et du troisième modèles :seule réalité attestable, le patriarcat s'insère entre un mythe de l'âge d'or et une gémellité hétéropolitique dont la reconnaissance confère à l'ouvrage de Badinter une nouvelle dimension: au lieu d'enter l'androgynie sur un socle scientifique vacillant la concevoir comme une nouvelle façon de vivre la condition humaine dans une société meilleure. Epistemic instrumentalism views epistemic norms and epistemic normativity as essentially involving the instrumental relation between means and ends. It construes notions like epistemic normativity, norms, and rationality, as forms of instrumental or means-end normativity, norms, and rationality. I do two main things in this paper. In part 1, I argue that there is an under-appreciated distinction between two independent types of epistemic instrumentalism. These are instrumentalism about epistemic norms and instrumentalism about epistemic normativity. In part 2, I argue that this (...) under-appreciated distinction matters for the debate surrounding the plausibility of EI. Specifically, whether we interpret EI as norm-EI or as source-EI matters for the widely discussed universality or categoricity objection to EI, and for two important motivations for adopting EI, namely naturalism and the practical utility of epistemic norms. I will then conclude by drawing some lessons for epistemic instrumentalism going forward. (shrink)

During the first decades of the 20th century, many anthropologists who had previously adhered to a linear view of human evolution, from an ape via Pithecanthropus erectus and Neanderthal to modern humans, began to change their outlook. A shift towards a branching model of human evolution began to take hold. Among the scientific factors motivating this trend was the insight that mammalian evolution in general was best represented by a branching tree, rather than by a straight line, and that several (...) new fossil hominids were discovered that differed significantly in their morphology but seemed to date from about the same period. The ideological and practical implications of imperialism and WWI have also been identified as formative of the new evolutionary scenarios in which racial conflict played a crucial role. The paper will illustrate this general shift in anthropological theory for one particular scientist, William Sollas. Sollas achieved a synthesis of human morphological and cultural evolution in what I will refer to as an imperialist model. In this theoretical framework, migration, conflict, and replacement became the main mechanisms for progress spurred by 'nature's tyrant,' natural selection. (shrink)

In this article, I am concerned with the public engagements of Julian Huxley, Lancelot Hogben, and J. B. S. Haldane. I analyze how they used the new insights into the genetics of heredity to argue against any biological foundations for antidemocratic ideologies, be it Nazism, Stalinism, or the British laissez-faire and class system. The most striking fact—considering the abuse of biological knowledge they contested—is that these biologists presented genetics itself as inherently democratic. Arguing from genetics, they developed an understanding of (...) diversity that cuts across divisions of race, class, or gender. Human diversity rightly understood was advantageous for societal progress. Huxley, Hogben, and Haldane did not hold identical political ideals, but they all argued for democratic reforms and increased planning geared toward greater social equality, and they did so under the label of scientific humanism. Huxley took issue with the notion that evolutionary history does not carry any moral lessons for human societies. Rather than being its antithesis, evolution was the basis of human sociality. In fact, the entire future progress of individuals and communities toward a democratic world order needed to be founded on the cosmic principles of evolution—a process that had to be guided by the biological expert with a strong sense of social responsibility. What is the source of epistemic normativity? In virtue of what do epistemic norms have categorical normative authority? According to epistemic teleologism, epistemic normativity comes from value. Epistemic norms have categorical authority because conforming to them is necessarily good in some relevant sense. In this article, I argue that epistemic teleologism should be rejected. The problem, I argue, is that there is no relevant sense in which it is always good to believe in accordance with epistemic norms, including in cases (...) where the matter at hand is completely trivial. Therefore, if epistemology is normative, its normativity won't come from value. (shrink)

ABSTRACT According to G.E. Moore’s ‘Open Question’ argument, moral facts cannot be reduced or analyzed in non-normative natural terms. Does the OQA apply equally in the epistemic domain? Does Moore’s argument have the same force against reductionist accounts of epistemic facts and concepts? In a recent article, Daniel Greco has argued that it does. According to Greco, an epistemological version of the OQA is just as promising as its moral cousin, because the relevant questions in epistemology are just as ‘open’ (...) as those in ethics. In this paper, I offer a two-part reply to Greco. First, I argue that his argument in favor of the openness of epistemology is not persuasive. Second, I offer a case against the openness of epistemology. Unlike claims linking natural and moral properties, claims linking natural and epistemological properties do give rise to closed questions. An epistemological OQA is therefore not as promising as its moral cousin. (shrink)

We argue that ecology in general and biodiversity and ecosystem function research in particular need an understanding of functions which is both ahistorical and evolutionarily grounded. A natural candidate in this context is Bigelow and Pargetter’s evolutionary forward-looking account which, like the causal role account, assigns functions to parts of integrated systems regardless of their past history, but supplements this with an evolutionary dimension that relates functions to their bearers’ ability to thrive and perpetuate themselves. While Bigelow and Pargetter’s account (...) focused on functional organization at the level of organisms, we argue that such an account can be extended to functional organization at the community and ecosystem levels in a way that broadens the scope of the reconciliation between ecosystem ecology and evolutionary biology envisioned by many BEF researchers. By linking an evolutionary forward-looking account of functions to the persistence-based understanding of evolution defended by Bouchard and others, and to the theoretical research on complex adaptive systems, we argue that ecosystems, by forming more or less resilient assemblages, can evolve even while they do not reproduce and form lineages. We thus propose a Persistence Enhancing Propensity account of role functions in ecology to account for this overlap of evolutionary and ecological processes. (shrink)

From the 1960s, mathematical and computational tools have been developed to arrive at human population trees from various kinds of serological and molecular data. Focusing on the work of the Italian-born population geneticist Luigi Luca Cavalli-Sforza, I follow the practices of tree-building and mapping from the early blood-group studies to the current genetic admixture research. I argue that the visual language of the tree is paralleled in the narrative of the human diasporas, and I show how the tree was actually (...) mapped onto the surface of the earth. This visual and textual structure is mirrored in the liberal discourse of unity in diversity that has been criticized as running counter to the socio-political effects of human population genetics. From this perspective, one may ask how far the phylogenetic diagram in its various forms is a manifestation of the physics of power that according to Michel Foucault consists in mechanisms that analyse distributions, movements, series, combinations, and that uses instruments to render visible, to register, to differentiate and to compare. It is one among other disciplinary technologies that ensure the ordering of human diversity. In the case of intra-human phylogenetic trees, population samples and labels are one issue. Another is that the separated branches seem to show groups of people, who have in reality been interacting and converging, as isolated. Often based on so-called isolated peoples, molecular tree diagrams freeze a hierarchical kinship system that is meant to represent a state before the great historical population movements. (shrink)

Between the last decades of the 18th century and the middle of the 19th century, something of paramount importance happened in the history of anthropology. This was the advent of a physical anthropology that was about the classification of ‘human races’ through comparative measurement. A central tool of the new trade was diagrams. Being inherently about relations in and between objects, diagrams became the means of defining human groups and their relations to each other – the last point being disputed (...) between the monogenists and the polygenists. James Cowles Prichard, a proponent of the comparative historical approach, was able to do without images in his pioneering Researches Into the Physical History of Man of 1813, but the third edition, which appeared in five volumes between 1836 and 1847, was richly illustrated with ‘ethnic types’ and skulls, including diagrams. What was happening is a process I engage with in detail for Samuel George Morton, who collected and distributed human skulls as lithographs in Crania americana (1839) and Crania aegyptiaca (1844). Along with the paper skulls travelled detailed instructions of how to look at them through a set of lines and to set their individual parts in relation to each other as well as to those of other types. Drawing on Johann Friedrich Blumenbach and Peter Camper, the Crania thus played a pivotal role in establishing what I call a diagrammatics of race – a diagrammatics that became overtly political with Types of Mankind (1854), which was written in Morton's honour by Josiah Nott and George Gliddon. Medieval chroniclers frequently reworked the glorious memory of their past in order to meet the new needs of a new generation. To write the history of those who had come before was more than an exercise in antiquarianism, more than an effort to sort out long-ago events and put them in order. The creation of such a work grew out of a conversation with the records left by earlier generations and was intended to make a statement about the present as (...) well as about the past. The chronicle of a church's history, the vitae of the saints associated with that church, and the documents stored in the church's archives, although often treated separately by modern scholars, formed a single corpus for medieval authors. Their efforts to create a useful past out of this material led in the ninth century to a new historical genre, that of gesta. These recounted the lives and deeds of great ecclesiastical leaders over the centuries. The creation of this genre grew from a need to make a strange and distant past more comprehensible and to prepare a hortatory “mirror” for the authors' contemporaries; it thus demonstrates vividly the historical process of remembering and forgetting. Le second se concentre sur le débat avec Heidegger, sur la tradition philosophique occidentale et sur l'influence de la pensée grecque. Cet ouvrage offre aux lecteurs francophones un accès (pu un complément) à l'oeuvre d'un éminent philosophe du XXe siècle.

Au regard de l'analyse de discours, le déclin économique de la France n'existe pas. L'analyse des controverses médiatiques qui ont suivi la parution en 2003 de l'essai de Nicolas Baverez, La France qui tombe, montre en effet que ni l'histoire, ni la statistique, ni la comparaison géographique ne mènent à la conclusion définitive du déclin et qu'autour de celles-ci s'opposent « déclinophiles » et «déclinophobes». L'analyse de discours révèle la multiplicité des histoires ou des récits économiques autour du déclin, relativisant (...) ainsi l'apparente neutralité des discours sur le déclin économique de la France.In view of discourse analysis, the economic decline of France does not exist. The analysis of media controversies that followed the publication in 2003 of trying to Nicolas Baverez, France falls, shows that neither history nor the statistical or geographical comparisons lead to the conclusion of the final decline and that around them oppose "déclinophiles" and "déclinophobes". The discourse analysis reveals the multiple stories or stories about economic decline, thus relativizing the apparent neutrality of discourse on the economic decline of France. (shrink)

This article addresses questions of fundamental values of business ethics scholars. By tracing the evolution of debates on stakeholder theory and political corporate social responsibility (PCSR) from their beginnings in 1984 and 2006 until the present day, the article demonstrates how these scholarly debates have followed a similar pattern. In both cases, the initial positions, which are more tolerant toward business interests, face critique through theoretical developments and are ultimately surpassed by arguments favouring the reduction of managerial power and the (...) enhancement of decision-making authority among stakeholders and various non-corporate organisations and agents. Referring to the moral psychological theory of Social Intuitionism, the article suggests that a shared moral intuition of scepticism toward managerial elites is characteristic of scholars in the business ethics community. This intuition, however, appears to hinder a fully articulated and genuine debate between perspectives that confer legitimacy on corporations, managerial elites, and market-based economic systems, and those which advocate for stakeholder influence in managerial decisions and a more inclusive economical democracy. Consequently, this tendency contributes to the stagnation of these debates both within academic circles and in public discussions. (shrink)

Phenomenology has been adapted for use in qualitative health research, where it’s often used as a method for conducting interviews and analyzing interview data. But how can phenomenologists study subjects who cannot accurately reflect upon or report their own experiences, for instance, because of a psychiatric or neurological disorder? For conditions like these, qualitative researchers may gain more insight by conducting observational studies in lieu of, or in conjunction with, interviews. In this article, we introduce a phenomenological approach to conducting (...) this kind of observational research. The approach relies on conceptual grounding to focus a study on specific aspects of the participants’ experiences. Moreover, the approach maintains the openness to novel discoveries that qualitative research requires while also providing a structured framework for data collection and analysis. To illustrate its practical application, we use examples of hemispatial neglect—a neurologic disorder in which patients characteristically lack awareness of their own illness and bodily capacities. However, the approach that we describe can be applied more broadly to the study of complex illness experiences and other experiential alterations. (shrink)

This paper discusses the definition of argumentation as a means for persuading an audience on the acceptability of a thesis. It is argued that persuasion is a goal that relates more to the communicative situation, the type of interaction or the type of discourse, rather than to the argumentative nature of it. Departing from the analysis of a short conversational sequence between people who agree on an issue and nevertheless argue, I suggest that a definition of argumentation in terms of (...) persuasion fails to account for what people are actually doing in these situations. I propose instead that several functions may be assigned to argumentation when considering the context in which it is produced: a cognitive function (which helps participants to elaborate a position on the discussed issue), and an identifying function (which enables them to portray themselves through the expression and the justification of their opinion). In the case analyzed here, a third function to which the argumentative activity contributes can also be identified, namely the enhancing of the emotional tonality of the relationship between the participants. While it becomes clear from the discussion of this argumentative sequence that the participants do not seek to persuade each other or some third party, it is not suggested that argumentation never aims at persuading an audience, but rather that persuasion cannot be considered as a defining feature of argumentation. Deliberative processes provide an important alternative input to environmental politics as they may, in contrast to often used market simulations, provide an arena for 1) discussion of lay participants’ values, 2) articulating arguments grounded in other values than consequentialistic, and 3) capturing weakly comparable values. A case study of a Citizens’ Jury (CJ) on genetically modified plants was used to investigate how the framing of the process affected the attitude formation among the citizens. The formal set up of this specific (...) CJ made value discussions less relevant. While it opened for value plurality, it failed to facilitate the articulation of weakly comparable values. (shrink)
