Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

A historical and philosophical reassessment of the impact of Aristotle and early-modern Aristotelianism on the development of Kant’s transcendental philosophy. Kant and Aristotle reassesses the prevailing understanding of Kant as an anti-Aristotelian philosopher. Taking epistemology, logic, and methodology to be the key disciplines through which Kant’s transcendental philosophy stood as an independent form of philosophy, Marco Sgarbi shows that Kant drew important elements of his logic and metaphysical doctrines from Aristotelian ideas that were absent in other philosophical traditions, such (...) as the distinction of matter and form of knowledge, the division of transcendental logic into analytic and dialectic, the theory of categories and schema, and the methodological issues of the architectonic. Drawing from unpublished documents including lectures, catalogues, academic programs, and the Aristotelian-Scholastic handbooks that were officially adopted at Königsberg University where Kant taught, Sgarbi further demonstrates the historical and philosophical importance of Aristotle and Aristotelianism to these disciplines from the late sixteenth century to the first half of the eighteenth century. S'inscrivant dans le domaine de la théorie critique, en particulier celle de l’école de Francfort, cet ouvrage propose une analyse de la pensée d’Axel Honneth visant à l’élaboration de modèles pour le diagnostic de « pathologies sociales » telles que la réification de nos interactions avec l’environnement non-humain (nature), dans la sphère du travail et encore dans les processus menant au déclenchement de violences extrêmes. La reprise des éléments mimétiques, pulsionnels et affectifs liés au corps (très présents chez la première (...) génération de théoriciens critiques et notamment chez Adorno) dans le cadre d’une théorie à teneur normative constitue le fil rouge d’une recherche proposant de repenser le concept de réification et d’aliénation au-delà de la reconnaissance, dans une perspective reliant théorie et pratique. Scientific properties come in degrees: elephants are more massive than mice. Are facts like these fundamental or can they be explained in other terms? This article argues that the structure of physical quantities like mass reduces to facts about the role that mass plays in the laws of nature. On this view elephants are more massive than mice partly in virtue of the fact that elephants are harder to throw around.

Cultured meat is a lab grown product that aims to tackle the cravings of omnivores who struggle to switch to a plant-based diet, while still being friendly to animals and the environment. Possibly, in time, the curiosity to apply this technology towards human meat production will emerge. However, when presented with the thought of eating cultured human meat potential consumers’ reaction greatly varies from pure disgust to indifference to excitement. This instinctive response indicates a lack of preformed judgements towards the (...) topic. Without a clear vision on the possibility of cultured human meat, scattered and uncertain regulations will fail to uphold paramount moral values. The risk is that we would either dig into this option out of excitement, or ban it without convincing motivations. The ethical theories of deontology and consequentialism can be followed to investigate this divisive issue. With an evaluation based on disgust I argue that the deontological perspective is mostly concerned with values of identity and humanness, while with a chain-reaction reasoning I argue that consequentialism would be concerned with health safety, privacy and equality. I conclude that cultured human meat is not acceptable. (shrink)

The aim of this comment is to discuss tentatively one way of understanding, for the study of legal phenomena, some of the implications of recognising the existence of peculiar entities which Celano calls pre-conventions. This comment speculates that, if Celano is right, then so-called paradigm cases of law lose some of their philosophical centrality. To study pre-conventions, one needs to collect accounts of situations in which relevant agents use criteria for identifying legal phenomena that only approximate valid sources of law. (...) To provide such accounts, the traditional informational focus of a philosophical analysis of law also needs, this comment further speculates, substantial broadening: if pre-conventions are in the body, then that is where we need to look if we want to study them. In this article, we discuss and analyse poverty in Germany from a longitudinal perspective. Using data from the German Socio-Economic Panel Study (SOEP), we first show that the general poverty rate in Germany has constantly increased since the late 1990s. Shifting to a life-course perspective, we show that not only socio-structural characteristics have a strong impact on the poverty risk, but also critical life-events. While focusing on dynamics of poverty within individual life-courses, it appears that incidents like formation of a (...) 'new household, birth of a child and separation from partner are associated with an immediate increase of the poverty risk. The event of becoming unemployed stands particularly out. Comparing longitudinal and fixed-effects approaches on the one hand with simple cross-sectional procedures on the other, our analyses finally emphasises that cross-sectional analyses are not sufficient to fully understand or to explain poverty. Therefore, our study can be interpreted as a claim to make stronger use of the benefits of longitudinal data in the context of poverty research. (shrink)

The paper analyses the significance of the modern concept of „symmetry“ for the understanding of the concept of „intuition“ in Kant's philosophy of geometry. A symmetry transformation or automorphism is a structure preserving mapping of the space into itself that leaves all relevant structure intact so that the result is always like the original, in all relevant respects. Hermann Weyl was the first to show that this idea can be drawn on Leibniz's definition of similarity: two figures are similar if (...) they are only distinguishable through the simultaneous perception of them ( comperceptio ): „an automorphism carries a figure into one that in Leibniz's words is ‚indiscernible from it if each of the two figures is considered by itself‘“. The author argues that, under the light of this definition, Leibniz's notion of „comperceptio“ turns out to play a similar role for the notion of „intuition“ in Kant's philosophy of space and time. Both cases are about the „difference between conceptual definition and intuitive exhibition“, as Weyl puts it. This result has on the one hand an exegetical significance: it frees Kant's notion of „intuition“ from every vague reference to the „visualisation“ of geometrical figures; on the other hand a theoretical one: it makes easy to compare Kant's philosophy of space and time with modern developments of sciences, in which as Weyl first showed, the concept of symmetry plays a fundamental role. The discovery that Einstein's celebrated argument for general covariance, the 'point-coincidence argument ', was actually a response to the ' hole argument ' has generated an intense philosophical debate in the last thirty years. Even if the philosophical consequences of Einstein's argument turned out to be highly controversial, the protagonists of such a debate seem to agree on considering Einstein's argument as an expression of 'Leibniz equivalence', a modern version of Leibniz's celebrated indiscernibility arguments against Newton's absolute space. The paper (...) attempts to show that the reference to Leibniz, however plausible at first sight, is actually in many respects misleading. In particular it is claimed that the Logical Empiricists offer a significant historical example of an attempt to interpret the point-coincidence argument as an indiscernibility argument in the sense of Leibniz, similar to those used in 19th century by Helmholtz, Hausdorff or Poincaré. However the logical empiricist account of General Relativity clearly failed to grasp the philosophical novelty of Einstein's theory. Thus, if Einstein's point coincidence/ hole argument can be regarded as an indiscernibility argument, it cannot be an indiscernibility argument in the sense of Leibniz. Einstein rather introduced a new form of indiscernibility argument, which might be better described as an expression of 'Einstein-equivalence'. Developing some ideas of Weyl it is argued that, whereas Leibniz's arguments introduced the notion of 'symmetry' in the history of science, Einstein's argument seems to anticipate what we now call 'gauge freedom'. If in the first case indiscernibility arises from a lack of mathematical structure, in the second case it is a consequence of a surplus of mathematical structure. _German_ Die Entdeckung, dass Einsteins berühmtes Punkt-Koinzidenz- Argument zur allgemeinen Kovarianz tatsächlich eine Reaktion auf die Lochbetrachtung war, hat in den vergangenen 30 Jahren zu einer intensiven philosophischen Debatte geführt. Auch wenn die philosophischen Konsequenzen äußerst kontrovers gesehen werden, stimmen die Protogonisten doch darin überein, das Argument als Ausdruck von Leibniz-Äquivalenz, mithin als eine moderne Version von Leibniz berühmten Ununterscheidbarkeitsargumenten gegen Newtons absoluten Raum aufzufassen. Ziel des Aufsatzes ist es zu zeigen, dass der Bezug zu Leibniz, wenn auch auf den ersten Blick plausibel, tatsächlich in vielerlei Hinsicht irreführend ist. Insbesondere wird dahingehend argumentiert, dass die Logischen Empiristen ein signifikantes historisches Beispiel für einen Versuch darstellen, das Punkt-Koinzidenz Argument als ein Ununterscheidbarkeitsargument im Sinne von Leibniz, ähnlich denen im 19. Jahrhundert von Helmholtz, Hausdorff und Poincaré vorgebrachten, zu deuten. Dieser Deutung der Allgemeinen Relativitätstheorie gelingt es aber nicht, das eigentlich philosophisch Neue von Einsteins Theorie plausibel zu interpretieren. Wenn Einsteins Punkt-Koinzidenz/Lochargument als ein Ununterscheidbarkeitsargument angesehen werden soll, kann dies kein Argument à la Leibniz sein. Vielmehr hat Einstein ein neuartiges Ununterscheidbarkeitsargument eingeführt, das vielleicht besser als,Einstein-Äquivalenz' charakterisiert werden sollte. Durch Aufnahme und Weiterentwicklung einiger Ideen von Weyl wird gezeigt, dass Leibniz' Argumente zwar das Konzept der,Symmetrie' in die Wissenschaftsgeschichte eingebracht haben, Einsteins Argument aber etwas antizipiert hat, was heute gewöhnlich,Eichfreiheit' genannt wird. Wird im ersten Fall die Ununterscheidbarkeit durch ein zu wenig an mathematischer Struktur erzeugt, so ist sie im zweiten Fall gerade die Folge eines Überschusses an mathematischer Struktur. Matthias Neuber’s book represents an important contribution to the relatively young discipline of the History of Philosophy of Science. Starting roughly in the 1980s, increasing attention has been devoted not only to the relationship between philosophy and the history of science, but to an accurate historical reconstruction of earlier projects within philosophy of science. One of the most outstanding results of these investigations has probably been the radical reshaping of the rather caricatural image of logical empiricism—for better or worse the (...) core of the philosophical heritage of many philosophers of science—summarized in the so-called ‘standard view’. By analyzing the historical, sociological, and philosophical questions surrounding logical empiricism new light has been shed on the sense of a cultural, social, and political mission that characterized it before its emigration from Europe to North America in the 1930s and 1940s. In the epistemological tradition, there are two main interpretations of the semantic relation that an empirical theory may bear to the real world. According to realism, the theory-world relationship should be conceived as truth; according to instrumentalism, instead, it should be limited to empirical adequacy. Then, depending on how empirical theories are conceived, either syntactically as a class of sentences, or semantically as a class of models, the concepts of truth and empirical adequacy assume different and specific forms. In this (...) paper, we review two main conceptions of truth (one sentence-based and one model-based) and two of empirical adequacy (one sentence-based and one model-based), we point out their respective difficulties, and we give a first formulation of a new general view of the theory-world relationship, which we call Methodological Constructive Realism (MCR). We then show how the content of MCR can be further specified and expressed in a definite and precise form. The bulk of the paper shows in detail how it is possible to accomplish this goal for the special case of deterministic dynamical phenomena and their correlated deterministic models. This special version of MCR is formulated as an axiomatic extension of set theory, whose specific axioms constitute a formal ontology that provides an adequate framework for analyzing the two semantic relations of truth and empirical correctness, as well as their connections. O presente artigo, a partir de uma abordagem prospectivo-reflexiva, apresenta aspectos pontuais de pressupostos teórico-conceituais de Michel Foucault e de Pierre Bourdieu, cujo objetivo é trazer a lume os conceitos de governamentalidade, biopoder, biopolítica, campo, habitus, capital e violência simbólica, para a compreensão do neoliberalismo e do seu impacto no Estado, na democracia e na liberdade individual. Tais conceitos servem aqui como ponto de partida à apresentação de perspectivas descendentes das primeiras, desenvolvidas pelos teóricos Giorgio Agamben, Wendy Brown e Achille (...) Mbembe, possibilitando uma constatação quanto ao não cumprimento das promessas do Estado Liberal e do Estado Democrático e suas transmutações no neoliberalismo, policêntrico quanto ao poder de domínio sobre os indivíduos, que junto com o mercado e o Estado formam a triangularização do poder derivado da governamentalidade do Estado Neoliberal. This chapter focuses on one of the common fallacies in Western philosophy, 'legalistic mistake'. The use of “legal‐like” terms abounds outside the legal domain. But sometimes the users of these terms commit the fallacy Joel Feinberg called the legalistic mistake. On widening the use of such legal‐like terms, we must be cautious, for we might find ourselves guilty of making inferential mistakes or even proffering pure nonsense. The error, according to Feinberg, is committed by “one who, in stating a moral (...) question using a legal‐like term, uncritically imports the precision of that term in its strict legal sense, while excluding appeal to the kinds of criteria which alone can decide its use”. In “On Being 'Morally Speaking a Murderer’” Feinberg introduced the idea that, sometimes, using legal notions outside legal contexts may lead to a peculiar kind of fallacy he called the legalistic mistake. Resumo: Este artigo pretende pontuar a relevância da presencia de Rousseau no pensamento de Fichte contra a imagem estereotipada da relação entre os dois pensadores. Trata-se, então, de desconstruir a crítica que Fichte dirige a Rousseau na última conferência do ciclo sobre a Vocação do sábio de 1794 a partir dos efeitos que Fichte pretende produzir na audiência. Pois, cabe ressaltar como o objeto dessa critica é um Rousseau caricatural, difundida na audiência alemã pelos trabalhos de Reimarius e Wieland sobre (...) os primeiros dois Discursos e os escritos autobiográficos do autor genebrino. O objetivo principal do trabalho é o de mostrar como por meio dessa diferenciação permite a Fichte integrar subterraneamente motivos rousseauanos destinados a marcar de maneira relevante sua filosofia prática. This article aims at highlighting the relevance of the presence of Rousseau in Fichte’s though against the stereotyped image of their relationship. We deconstruct Fichte’s critics against Rousseau during his last lecture of his Vocation of scholar in 1794. That deconstruction is lead by the effects Fichte aimed to produce on his audience. His goal was to defend himself by the accusation of being a Jacobinist. Then, it has to be showed how the object of his critic is a caricatural image of Rousseau, created and diffused by Wieland and Reimarius by their receptions of Rousseau’s first two Discourses and autobiographic works. The main goal of this work is then to show how Fichte’s differentiation from that caricatural image of Rousseau permits him to integrate Rousseau’s themes aimed to deeply mark his own philosophy. In the framework of contemporary cosmology, the age-old aspiration to inquire the outer limits of the universe translates into our effort to observe the initial stages of cosmic history. Thanks to a fortunate combination of astronomical circumstances, and pushing mm-wave technology to its limits, today we are able to image the early universe in great detail, back at a time when cosmic age was only 0.0027% of its present value. The state of the art in the field has been set (...) by the ESA Planck mission, launched in 2009, dedicated to precision measurements of the cosmic microwave background. Planck observed the full sky for 4 years in a wide frequency range, reaching μK sensitivity both in temperature and polarization. The latest results, published by the Planck Collaboration in 2018, are in exquisite agreement with the simplest 6-parameter ΛCDM model and constrain the main cosmological parameters with percent-level accuracy. Furthermore, the Planck data yield insight on the very early universe, opening the way to a new generation of experiments searching for the possible signatures of primordial gravitational waves in the CMB polarization pattern. Tanto frente al avance de los medios electrónicos y las teletransmisiones del siglo XX como frente a la digitalización cibernética del siglo XXI, los diversos campos epistémicos se han encargado de problematizar la relación entre lo perceptivo, lo estético (espacio-tiempo) y los cambios tecnológicos que imponen nuevas prácticas intersubjetivas, comportamientos y modos de subjetivación. En muchos autores surge el uso de un concepto puntual: el sensorium. Ya sea que se proponga un enfoque cultural o una perspectiva específicamente gnoseológica, suele repetirse (...) una referencia de dicha categoría en relación con los cambios de la velocidad y la aceleración de las imágenes, los textos y las comunicaciones; primero en la era de la electrónica analógica y luego en la época digital. El objetivo de este trabajo es exponer una breve sistematización del concepto de sensorium en vistas de una posible definición en tanto unidad de análisis estético-política. Dicha categoría permite, por un lado, pensar la disciplina Estética como pensamiento político; y por el otro, pensar lo político en clave estética. Para ello el texto repasa los diversos sentidos que ha tenido la categoría a lo largo de la historia, según su emergencia en diferentes epistemes. La primera parte recorre ciertos discursos puntuales identificando autores en los cuales se pueden encontrar usos específicos (Newton, Simmel, Benjamin, McLuhan, Kittler, etc.), delineando así una serie de sentidos relacionados con el espacio y el tiempo desde lo estético, lo perceptivo, lo gnoseológico, lo sociológico y lo técnico. A partir de dicho esquema, en la segunda parte se presenta la idea de un “giro sensorial” en los estudios sociopolíticos contemporáneos, donde la idea de sensorium cobra una nueva importancia. Por último, se hace foco en las relaciones conceptuales que se derivan del uso que propone Rancière en torno a la categoría. En base a dicho recorrido el texto busca delinear una serie de elementos para abrir la posibilidad de definir la Estética como el pensamiento del sensorium común; se trata de una unidad de análisis estético-política que funciona como marco teórico para una morfología de lo social en tanto analítica del orden de lo sensible. Recent studies demonstrated that 15-month-olds selectively respond to others’ beliefs. According to an epistemic mentalist interpretation, this attests that 15-month-olds possess a rudimentary capacity to attribute beliefs. Weaker interpretations suggest instead that infants are only sensitive to others’ beliefs because they can detect their proximal correlates. These two opposed interpretations often appeal to principled objections. In contrast, I argue that the dispute can be brought back to its empirical basis if we clearly explain what it means having ‘tacit’ or ‘implicit’ (...) knowledge of a theory. I introduce a definition of tacit knowledge based on the notion of structural similarity, and I discuss some crucial experiments that may be conducted to assess the validity of the epistemic mentalist interpretation. We investigated motor resonance in children using a priming paradigm. Participants were asked to judge the weight of an object shortly primed by a hand in an action-related posture or a non action-related one . The hand prime could belong to a child or to an adult. We found faster response times when the object was preceded by a grasp hand posture . More crucially, participants were faster when the prime was a child’s hand, suggesting that it could belong to (...) their body schema, particularly when the child’s hand was followed by a light object . A control experiment helped us to clarify the role of the hand prime. To our knowledge this is the first behavioral evidence of motor simulation and motor resonance in children. Implications of the results for the development of the sense of body ownership and for conceptual development are discussed. (shrink)
