This paper defends that the both the Buddhist tradition and the Aristotelian allow us to think of the distinction between to reason with contradictions and to accept them, understanding ' accept a contradiction ' by taking it as consistent. From this viewpoint, none of two would disagree with most contemporary paraconsistent views. The conclusions are, thus, that, firstly, there is no compelling reason to endorse any kind of metaphysical dialetheism, and, second, that a coherent form of reasoning with contradictory statements (...) is neither opposed to the Aristotelian conception of logic, nor to certain texts in the Buddhist tradition, as the Madhyamikas. A pandemia de COVID suscitou diversas questões morais relacionadas, por exemplo, à vulnerabilidade de populações indígenas frente à nova doença, ou ao comportamento dos Estados mais ricos relativamente aos Estados mais pobres na distribuição de vacinas, ou relativamente à elaboração de protocolos para alocação de recursos escassos tomando-se como critério a idade dos pacientes. Consideradas isoladamente, essas questões dizem respeito a diferentes domínios de investigação da filosofia moral, a saber: o da justiça social, o da justiça internacional, e o da (...) justiça intergeneracional. Até o momento, no âmbito da bioética e da filosofia moral, pouco esforço tem sido feito na tentativa de se mostrar que essas e diversas outras questões moralmente relevantes, discutidas durante a pandemia de COVID, deveriam ser examinadas como pertinentes a um campo distinto de investigação filosófica, ao qual me refiro neste artigo como ética pandêmica. Neste artigo, procuro estabelecer uma estrutura conceitual para a ética pandêmica tendo especialmente em vista a discussão recente sobre atribuições de responsabilidade no âmbito da ética climática. There is a broad consensus amongst law firms and in-house legal departments that next generation "Legal Tech" - particularly in the form of Blockchain-based technologies and Smart Contracts - will have a profound impact on the future operations of all legal service providers. Legal Tech startups are already revolutionizing the legal industry by increasing the speed and efficiency of traditional legal services or replacing them altogether with new technologies. This on-going process of disruption within the legal profession offers significant opportunities (...) for all business. However, it also poses a number of challenges for practitioners, trade associations, technology vendors, and regulators who often struggle to keep up with the technologies, resulting in a widening regulatory "gap." Many uncertainties remain regarding the scope, direction, and effects of these new technologies and their integration with existing practices and legacy systems. Adding to the challenges is the growing need for easy-to-use contracting solutions, on the one hand, and for protecting the users of such solutions, on the other. To respond to the challenges and to provide better legal communications, systems, and services Legal Tech scholars and practitioners have found allies in the emerging field of Legal Design. This collection brings together leading scholars and practitioners working on these issues from diverse jurisdictions. In this paper, we argue that the Epicurean genealogy of justice and laws presuppose an analysis of the just as a modality of the useful, an approach that denies the conventional character of justice. This genealogical pattern differentiates the origin of justice from that of the law and refers to friendship as a relevant explanatory factor of the origin of justice. We maintain that the interpretations that underline the incoherence of this reference to friendship, in the framework of a hedonistic (...) theory, presuppose a non-Epicurean sharp distinction between altruism and selfishness. In this paper, we argue that the fact that there were prominent citizens of different Greek cities who adhered to Epicureanism, felt themselves Epicurean, and were recognized as such, shows that slogans such as “live unnoticed” and “do not participate in politics” (which suggest a complete apoliticism on Epicurus’ and the Epicureans’ part) misrepresent the true meaning of the Epicurean staying away from contingent politics. Our article shows the interaction between Epicurus and the Epicureans and the Greek cities through the (...) analysis of documents (some of them, well known -such as Epicurus’ Testament, which shows the connections of the philosopher with the political life of the city-, others less known of epigraphic character) related to different ancient cities. If what we argue is sound, the usual idea that Epicureanism recommends apoliticism must be discarded. (shrink)

In this paper we explore a generalization of traditional abduction which can simultaneously perform two different tasks: given an unprovable sequent Γ ⊢ G, find a sentence H such that Γ, H ⊢ G is provable ; given a provable sequent Γ ⊢ G, find a sentence H such that Γ ⊢ H and the proof of Γ, H ⊢ G is simpler than the proof of Γ ⊢ G . We argue that the two tasks should not be distinguished, (...) and present a general procedure for finding suitable hypotheses or lemmas. When the original sequent is provable, the abduced formula can be seen as a cut formula with respect to Gentzen's sequent calculus, so the abduction method is cut-based. Our method is based on the tableau-like system KE and we argue for its advantages over existing abduction methods based on traditional Smullyan-style Tableaux. (shrink)

Este artículo es una respuesta a la crítica de Noé Expósito Ropero —que se basa en gran medida en la visión de Javier San Martín— a mi interpretación de la filosofía de José Ortega y Gasset. El resultado del argumento de Expósito Ropero es que Ortega es más fenomenólogo de lo que yo considero, que me equivoco al pen-sar que existen los “objetos reales” más allá de los objetos intencionales de Edmund Husserl, y que ningún objeto inanimado puede ser tratado (...) como un “yo”. Como réplica, respondo a cada una de estas acusaciones.This article is a response to Noé Expósito Ropero’s critique—which draws heavily on the views of Javier San Martín—of my interpretation of the philosophy of José Ortega y Gasset. The upshot of Expósito Ropero’s argument is that Ortega is more of a phenomenologist than I realize, that I am wrong to think there is any such thing as “real objects” beyond Edmund Husserl’s intentional objects, and that no inanimate object can be treated as an “I.” In response, I answer each of these charges. This article studies preservation of certain algebraic properties of propositional logics when combined by fibring. The logics analyzed here are classified in protoalgebraic, equivalential and algebraizable. By introducing new categories of algebrizable logics and of deductivizable quasi-varieties, it is stated an isomorphism between these categories. This constitutes an alternative to a similar result found in the literature.

Much forensic inference based upon DNA evidence is made assuming Hardy-Weinberg Equilibrium (HWE) for the genetic loci being used. Several statistical tests to detect and measure deviation from HWE have been devised, and their limitations become more obvious when testing for deviation within multiallelic DNA loci. The most popular methods-Chi-square and Likelihood-ratio tests-are based on asymptotic results and cannot guarantee a good performance in the presence of low frequency genotypes. Since the parameter space dimension increases at a quadratic rate on (...) the number of alleles, some authors suggest applying sequential methods, where the multiallelic case is reformulated as a sequence of “biallelic” tests. However, in this approach it is not obvious how to assess the general evidence of the original hypothesis; nor is it clear how to establish the significance level for its acceptance/rejection. In this work, we introduce a straightforward method for the multiallelic HWE test, which overcomes the aforementioned issues of sequential methods. The core theory for the proposed method is given by the Full Bayesian Significance Test (FBST), an intuitive Bayesian approach which does not assign positive probabilities to zero measure sets when testing sharp hypotheses. We compare FBST performance to Chi-square, Likelihood-ratio and Markov chain tests, in three numerical experiments. The results suggest that FBST is a robust and high performance method for the HWE test, even in the presence of several alleles and small sample sizes. (shrink)

In this paper we address some central problems of combination of logics through the study of a very simple but highly informative case, the combination of the logics of disjunction and conjunction. At first it seems that it would be very easy to combine such logics, but the following problem arises: if we combine these logics in a straightforward way, distributivity holds. On the other hand, distributivity does not arise if we use the usual notion of extension between consequence relations. (...) Artificial intelligence and related technologies are changing both the law and the legal profession. In particular, technological advances in fields ranging from machine learning to more advanced robots, including sensors, virtual realities, algorithms, bots, drones, self-driving cars, and more sophisticated "human-like" robots are creating new and previously unimagined challenges for regulators. These advances also give rise to new opportunities for legal professionals to make efficiency gains in the delivery of legal services. With the exponential growth of such technologies, radical disruption (...) seems likely to accelerate in the near future. This collection brings together a series of contributions by leading scholars in the newly emerging field of artificial intelligence, robotics, and the law. The aim of the book is to enrich legal debates on the social meaning and impact of this type of technology. The distinctive feature of the contributions presented in this edition is that they address the impact of these technological developments in a number of different fields of law and from the perspective of diverse jurisdictions. Moreover, the authors utilize insights from multiple related disciplines, in particular social theory and philosophy, in order to better understand and address the legal challenges created by AI. Gene clustering is a useful exploratory technique to group together genes with similar expression levels under distinct cell cycle phases or distinct conditions. It helps the biologist to identify potentially meaningful relationships between genes. In this study, we propose a clustering method based on multivariate normal mixture models, where the number of clusters is predicted via sequential hypothesis tests: at each step, the method considers a mixture model of m components (m = 2 in the first step) and tests if (...) in fact it should be m - 1. If the hypothesis is rejected, m is increased and a new test is carried out. The method continues (increasing m) until the hypothesis is accepted. The theoretical core of the method is the full Bayesian significance test, an intuitive Bayesian approach, which needs no model complexity penalization nor positive probabilities for sharp hypotheses. Numerical experiments were based on a cDNA microarray dataset consisting of expression levels of 205 genes belonging to four functional categories, for 10 distinct strains of Saccharomyces cerevisiae. To analyze the method’s sensitivity to data dimension, we performed principal components analysis on the original dataset and predicted the number of classes using 2 to 10 principal components. Compared to Mclust (model-based clustering), our method shows more consistent results. (shrink)

Por ese motivo se decidió desarrollar un proyecto de trabajo con las estudiantes del profesorado de nivel inicial para que comprendieran su importancia y que, posteriormente, pudieron aplicar una serie de conocimientos y estrategias en el aula. Husserl desarrolla un enfoque genético que busca dar cuenta del origen de las formas lógico-categoriales a partir de las correspondientes preestructuraciones situadas en el nivel de la receptividad sensible. Para un enfoque de ese tipo, la explicación del origen de las modalidades del juicio, en general, y la negación, en particular, plantea peculiares desafíos. El presente trabajo discute el modo en el que Husserl trata la negación, en tanto forma básica de la modalidad, tanto en el enfoque estático de Ideen (...) I como en el enfoque genético de Erfahrung und Urteil. A fin de poner de relieve el al-cance histórico y sistemático de la concepción husserliana, se proporciona previamente una presentación general de su contexto polémico inmediato. Este viene dado por la oposición entre psicologismo y formalismo, dominante en la filosofía de la lógica alemana de fines del siglo XIX y comienzos del siglo XX.Husserl develops a genetic approach that seeks to account for the origin of the logical-categorical forms starting from the corresponding pre-structures located at the level of sensitive receptivity. For such an approach, the explanation of the origin of the modalities of judgment, in general, and negation, in particular, poses peculiar challenges. This paper discusses how Husserl treats negation as a basic form of modality, both in the static approach of Ideen I and the genetic approach of Erfahrung und Urteil. Previously, in order to highlight the historical and systematic significance of the Husserlian conception, a general presentation of its immediate polemic context is offered, especially with reference to the opposition between psychologism and formalism, dominant in the German philosophy of logic of the late nineteenth and early twentieth century. The idea that reasoning is a singular accomplishment of the human species has an ancient pedigree.Yet this idea remains as controversial as it is ancient. Those who would deny reasoning to nonhuman animals typically hold a language-based conception of inference which places it beyond the reach of languageless creatures. Others reject such an anthropocentric conception of reasoning on the basis of similar performance by humans and animals in some reasoning tasks, such as transitive inference. Here, building on the modal similarity (...) theory of Vigo [J Exp Theor Artif Intell, 2008 (in press)], we offer an account in which reasoning depends on a core suite of subsymbolic processes for similarity assessment, discrimination, and categorization. We argue that premise-based inference operates through these subsymbolic processes, even in humans. Given the robust discrimination and categorization abilities of some species of nonhuman animals, we believe that they should also be regarded as capable of simple forms of inference. Finally, we explain how this account of reasoning applies to the kinds of transitive inferences that many nonhuman animals display. (shrink)

El peculiar modo en el cual el ente signo es “a la mano” le permite a Heidegger poner de relieve aspectos básicos de la estructura de la mundanidad, el trato práctico-operativo con el ente intramundano y la compresión mundana a cuyo aseguramiento contribuye decisivamente el empleo de signos. _Ever since Descartes singled out the ability to use natural language appropriately in any given circumstance as the proof_ _that humans – unlike animals and machines – have minds, an idea that Turing transformed into his well-known test to_ _determine whether machines have intelligence, the close connection between language and cognition has been widely_ _acknowledged, although it was accounted for in quite different ways. Recent advances in natural language processing, as_ _well as attempts to create “embodied conversational agents” which couple (...) language processing with that of its natural_ _bodily correlates (gestures, facial expression and gaze direction), in the hope of developing human-computer interfaces_ _based on natural – rather than formal – language, have again brought to the fore the question of how far we can hope_ _machines to be able to master the cognitive abilities required for language use. In this paper, I approach this issue from a_ _different angle, inquiring whether language can be viewed as a “cognitive technology”, employed by humans as a tool_ _for the performance of certain cognitive tasks. I propose a definition of “cognitive technology” that encompasses both_ _external (or “prosthetic”) and internal cognitive devices. A number of parameters in terms of which a typology of_ _cognitive technologies of both kinds can be sketched is also set forth. It is then argued that inquiring about language’s_ _role in cognition allows us to re-frame the traditional debate about the relationship between language and thought, by_ _examining how specific aspects of language actually influence cognition – as an environment, a resource, or a tool. This_ _perspective helps bring together the contributions of the philosophical “linguistic turn” in epistemology and the incipient_ _“epistemology of cognitive technology” It also permits a more precise and fruitful discussion of the question whether, to_ _what extent, and which of the language-based cognitive technologies we naturally use can be emulated by the kinds of_ _technologies presently or in the foreseeable future available.shrink)

En el presente artículo se sostiene que la filosofía práctica de Aristóteles puede dar lugar a dos sentidos distintos de προαίρεσις, los cuales se encuentran relacionados a su vez con dos sentidos distintos de deliberación. El primer sentido de προαίρεσις hace referencia a las elecciones deliberadas particulares, en las que el fin que se busca alcanzar, el deseo relacionado y los medios empleados son de carácter particular y se encuentran circunscritos a la situación concreta en que se realiza la elección. (...) En cambio, el segundo sentido de προαίρεσις se refiere a las elecciones vinculadas con objetivos de mediano y largo plazo, que si bien pueden ser particulares, buscan fines que trascienden la particularidad de la situación dada. Al primer tipo de προαίρεσις le corresponde la "deliberación descendente", mientras que al segundo le corresponde la "deliberación ascendente". Finalmente se presenta un análisis de las características del silogismo práctico de acuerdo a los dos tipos de deliberación. (shrink)

El presente trabajo examina la crítica de Heidegger a la concepción kantiana de la libertad como un tipo peculiar de causa. Con ella Kant consuma tendencias operantes en una larga tradición, cuyos orígenes remontan a la ontología griega, que documenta la comprensión del ser como presencia. Pero el enfoque causal de la libertad no permite hacer justicia a sus raíces más profundas en la propia trascendencia del Dasein.
