In the evolution of criminally relevant action in modern crime theory, social action has assumed a particular significance as a dogmatic element that enables the effective protection of legal assets in a society beset by risks. In the vast array of theories regarding the role of the guarantor and its legal and doctrinal development, as well as the jurisprudential extension of equivalence clauses of improper omissions that serve as amplifier devices of the criminal statue through an indirect adaptation, there is (...) a need to identify the most effective means to shield legal assets, which allows for an imputation of passive conducts, despite having an active typical description. This introduces the controversial figure of the improper omission, which is used with the function of perfecting all of the structural elements of the criminal conduct. When an individual knows he is in a position of guarantor and is aware of the potential consequences, but fails to take action, having the means to prevent a foreseeable outcome, this device serves to enhance the criminal protection of legal assets, fostering social solidarity as the basis of the criminal justice system. This system, by satisfying the function of general prevention of the punishment, ideally dissuades the individual from committing crimes with the threat of penalty. These theories are fundamental to understanding criminal responsibility by improper omission in the context of the objective imputation theory. By guiding the evolution and delimitation of its application, they serve as a significant factor in criminal social control in Colombia. (shrink)

Libet’s timing experiments have resulted in some strong and unsavoury claims about human agency. These range from the idea that conscious intentions are epiphenomenal to the idea that we all lack free will. In this paper, I propose a new type of response to the various sceptical conclusions about our agency occasioned by both Libet’s work and other experiments in this testing paradigm. Indeed, my argument extends to such conclusions drawn from fMRI-based prediction experiments. In what follows, I will provide (...) a brief description of these experiments, sketch arguments one may be tempted to draw on their basis, and argue that such arguments rely on a questionable premise: that experimental subjects have relevant proximal intentions. Objectives: Recent legislative changes within the United Kingdom have stimulated professional debate about access to patient data within research. However, there is currently little awareness of public views about such research. The authors sought to explore attitudes of the public, and their lay representatives, towards the use of primary care medical record data for research when patient consent was not being sought.Methods: 49 members of the public and four non-medical members of local community health councils in South Wales, UK gave (...) their views on the value and acceptability of three current research scenarios, each describing access to data without patient consent.Results: Among focus group participants, awareness of research in primary care was low, and the appropriateness of general practitioners as researchers was questioned. There was general support for research but also concerns expressed about data collection without consent. These included lack of respect and patient control over the process. Unauthorised access to data by external agencies was a common fear. Current data collection practices, including population based disease registers elicited much anxiety. The key informants were equally critical of the scenarios and generally less accepting.Conclusions: This exploratory study has highlighted a number of areas of public concern when medical records are accessed for research without patient consent. Public acceptability regarding the use of medical records in research cannot simply be assumed. Further work is required to determine how widespread such views are and to inform those advising on confidentiality issues. (shrink)

The result of Hannah Arendt’s study of bourgeois revolutions reflects not only the contradictions and dichotomies of her thought, but is an important diagnosis of the impact of liberal policies, their contradictions and evolution within the history of democracy. Modern republicanism, although critical of liberalism, assimilated elements inherent to liberal democracy, for example, the importance of the law, always imputed based on ideological political precepts of its time. The relevance of this analysis allows us not only to understand the bases (...) of the philosopher’s political thought, but its development in what she calls: public space. This must be a place for the expression of opinions, and therefore, for Arendt, without plurality, politics and public freedom are compromised to the extent that they make it impossible to maintain a space for the realization of freedom. However, in an unequal world, who can exercise their citizenship freely in public space? Was the liberal promise capable of providing these guarantees? In dialogue with Habermas and beyond, we intend with this investigation to outline the weaknesses of a bourgeois notion of the public sphere and to enunciate the urgency of building an ideal of republicanism based on popular demands. En el presente trabajo examino la tesis de José María Sauca sobre la “liquidez constitucional” y las cláusulas de este tipo que identifica en la Constitución Española. Propondré analizarlas a la luz de la tesis de la cláusula alternativa tácita presentada por Kelsen.

En ellas, la apelación a una (...) existencia simulada es abordada a través de una risa desacralizadora del ideal humano que alumbró el temprano Renacimiento italiano. Far from the interpretation of Leon Battista Alberti as a prototype of the "universal man", GARIN has analyzed the contradictory nature of Alberti's thought. In fact, in the extensive and versatile work of the Genoese humanist two opposite visions of man and the world coexist: one believes in the power of reason, the other acknowledges the absurdity of life. It is in Momus and the Intercenales that this "somber Alberti" is present. In these texts the appeal to a simulated life is addressed through a form of laughter that demystifies the human ideal of the early Italian Renaissance. (shrink)

Situationism is, roughly, the thesis that normatively irrelevant environmental factors have a great impact on our behaviour without our being aware of this influence. Surprisingly, there has been little work done on the connection between situationism and moral luck. Given that it is often a matter of luck what situations we find ourselves in, and that we are greatly influenced by the circumstances we face, it seems also to be a matter of luck whether we are blameworthy or praiseworthy for (...) our actions in those circumstances. We argue that such situationist moral luck, as a variety of circumstantial moral luck, exemplifies a distinct and interesting type of moral luck. Further, there is a case to be made that situationist moral luck is perhaps more worrying than some other well-discussed cases of moral luck. (shrink)

In this paper, I argue for two main hypotheses. First, that self-control is not a natural mental kind and, second, that there is no dedicated mechanism of self-control. By the first claim, I simply mean that those behaviors we label as “self-controlled” are a somewhat arbitrarily selected hodgepodge that do not have anything in common that distinguishes them from other behaviors. In other words, self-control is a gerrymandered property that does not correspond to a natural mental or psychological kind. By (...) the second claim, I mean that self-controlled behaviors are not produced by a mechanism that is not utilized in the production of other behaviors. Not only is there no natural mental property of self-control, there is no mechanism that is dedicated to producing self-controlled behavior. I further evaluate whether this account of self-control has enough explanatory power to account for a range of phenomena related to self-control. I argue that my account does a better job of explaining these phenomena than accounts which appeal to a dedicated self-control mechanism. (shrink)

The aim of the present paper is to carry out a parallel investigation for all natural implicative expansions of Kleene's strong 3-valued matrix now with only one designated value.

As is well known, the variable-sharing property (vsp) is, according to Anderson and Belnap, a necessary property of any relevant logic. In this paper, we shall consider two versions of the vsp, what we label the "weak vsp" (wvsp) and the "strong vsp" (svsp). In addition, the "no loose pieces property," a property related to the wvsp and the svsp, will be defined. Each one of these properties shall generally be characterized by means of a class of logical matrices. In (...) this way, any logic verified by an actual matrix in one of these classes has the property the class generally represents. Particular matrices (and so, logics) in each class are provided. This paper analyzes Dolores's case of collective spirit possession as a paroxysmic form of possession idiom, serving as a powerful and creative internal mechanism that both safeguards and revitalizes the core structure of ancestor worship. Drawing on my ethnographic research in North Honduras since 2009, my study reveals that rather than leading to the erosion of possession rituals, entropic forces, such as resistance, modernity, and impiety serve as vital resources, reinforcing the foundations of ancestor worship. This paper explores possession idioms (...) and striking events, such as contagion, abduction, dramatization, illness, and death to highlight the resilience of a possession-based religion as a self-sustaining total social system rooted in “tradition,” yet shaped by a dynamic interplay of historical, cultural, and personal experiences. While traditional interpretations of spirit possession have viewed possession cults as forms of protest against hegemonic power—“a weapon of the weak” used to gain respect and process trauma—I suggest that spirit possession is multifaceted, ambiguous and underdetermined, operating within a social theater where critique, social irony, impiety, historical consciousness, and the carnivalesque intersect. Instituted in 2004, the Czech Republic research assessment has since changed on an annual basis. In this paper I examine how researchers in the Czech Republic negotiate research assessment. Using the concept of epistemic living spaces (Felt & Fochler, 2010; Felt, 2009), I first set in context the Czech research assessment system and second explore the micro-politics of resistance in which researchers engage in their daily conduct. Empirically, I draw on individual and group interviews carried out with Czech researchers in (...) the humanities, social sciences and natural sciences, analyses of science policy documents including the Methodology for Evaluating Research, Development and Innovation Results, as well as public debates relating to research assessment, such as blogs and newspaper articles. The interviews were carried out between 2007 and 2010. Additional sources of data include participant observation at public events and seminars on the research and development system reform, research assessment and audit of the Czech system of research, development and innovation gathered between 2009 and 2011. La escritura para la reflexión pedagógica es una competencia profesional docente que debe ser desarrollada durante la formación inicial para que, posteriormente, pueda ser aplicada en diversos contextos educativos, enriqueciendo así el proceso de enseñanza y aprendizaje tanto del propio profesor como de los estudiantes con los que este interactúa. El ámbito de formación práctica es un espacio curricular donde esta competencia asume mayor preponderancia, pues el futuro profesor debe transferir diversos conocimientos teóricos hacia el ejercicio de aula. Bajo este (...) contexto, es posible reconocer la producción y circulación de ciertos géneros escritos específicos que dan cuenta de esta competencia. Esta investigación tiene como objetivo principal caracterizar, desde una perspectiva socioretórica, los géneros de reflexión pedagógica que escriben los estudiantes de dos carreras de pedagogía de una universidad chilena durante su formación práctica. Desde un enfoque metodológico cualitativo y con un diseño de Estudios de Casos Múltiples, se aplicaron dos instrumentos de recolección de datos: entrevistas semiestructuradas y focus group a profesores y estudiantes de la carrera de Educación Especial y Educación Parvularia. Entre los principales resultados destacan el reconocimiento de la escritura como un recurso que recoge la reflexión pedagógica de los profesores en formación; la utilización de determinados géneros pedagógicos en cada carrera y además la existencia de una progresión en el uso de estos de acuerdo a la complejidad y avance en el recorrido formativo del Plan de Estudios. En este artículo, nos preguntamos si es pertinente un análisis del personaje de Medea de Eurípides, y más concretamente, de su filicidio, a la luz de la doctrina aristotélica de la acción. Resulta dudoso, y quizás equívoco, hablar de "responsabilidad" (en sentido aristotélico) en el caso de la heroína, ya que sus motivaciones, como las de todo héroe trágico, tienen un doble signo: enfrentado a una ἀνάγκη superior, también desea lo que está forzado a hacer. Además, Medea no es una (...) mujer común: es un personaje ontológicamente complejo que participa, más de lo que frecuentemente se ha enfatizado, del plano divino. In this article we wonder if it is pertinent to analyse the character of Euripides' Medea and, more precisely, her filicide, in the light of Aristotle's doctrine of action. With regard to the heroine, it is doubtful and perhaps confusing to talk about "responsibility" (in Aristotelian terms) because her motivations, as all tragic heroes', are two-sided: faced to a superior ἀνάγκη he wants what he is forced to do as well. In addition, Medea is not an ordinary woman: she is an ontologically complex character that has a share in the divine level, a share which is more crucial than what has usually been emphasized. The article deals with analyzing the historiographical debates that have arisen in recent years around Atlantic history, the crisis of the monarchy and the origins of liberalism in the Hispanic world. The essay focuses on the historiography dedicated to the Río de la Plata and on the displacements exhibited in the research agendas. The objective is to register these displacements within the framework of the double and simultaneous movement that occurred with the revision of the interpretive model based on the (...) national state: the one that concerns the internationalization of the approaches and the regionalization of the scales of analysis. In this paper, I argue that some intentional actions are not triggered by proximal intentions; i.e. there are actions which are intentional, but lack relevant proximal intentions in their immediate causal history. More specifically, I first introduce various properties of intentions. I then argue that some actions (such as some spontaneous actions) are triggered by mental states which lack properties typically ascribed to intentions, yet these actions are still intentional. The view that all intentional actions are triggered by proximal intentions (...) is thus false. (shrink)

Equivalent overdetermined and underdetermined bivalent Belnap–Dunn type semantics for the logics determined by all natural implicative expansions of Kleene’s strong 3-valued matrix with only one designated value are provided.

Situations are powerful: the evidence from experimental social psychology suggests that agents are hugely influenced by the situations they find themselves in, often without their knowing it. In our paper, we evaluate how situational factors affect our reasons-responsiveness, as conceived of by John Fischer and Mark Ravizza, and, through this, how they also affect moral responsibility. We argue that the situationist experiments suggest that situational factors impair, among other things, our moderate reasons-responsiveness, which is plausibly required for moral responsibility. However, (...) even though we argue that situational factors lower the degree of our reasons-responsiveness, we propose that agents remain moderately reasons-responsive to the degree required for moral responsibility. Nonetheless, those affected by situational factors are arguably less morally responsible than those who are not subject to similar situational factors. We further evaluate an understanding of reasons-responsiveness which relativizes reasons-responsiveness to agents’ circumstances. We argue that the situationist data do not warrant this kind of divergence from Fischer’s and Ravizza’s account. We conclude by discussing what situationist experiments tell us about our relationship to non-reasons. (shrink)

Este artículo reflexiona acerca de las especificidades de la constitución de los monumentos conmemorativos en vínculo con la historia reciente. Para ello, la mirada se centrará en la noción de contramonumentos, entendiendo a estos últimos como aquellas producciones que, inicialmente de la mano de un grupo de artistas alemanes, desafían las premisas del monumento tradicional. En base a esto, se expone, en primera instancia el desarrollo histórico del monumento, destacando determinados sucesos que se consideran significativos dentro de la extensa cronología (...) en la que éste se inscribe; en un segundo momento, se recuperan una serie de reflexiones y debates que problematizan y cuestionan la efectividad de estos objetos culturales en relación a la evocación del pasado; y finalmente, se presentan y analizan un conjunto de producciones artísticas que se enmarcan dentro de lo que se reconoce como contramonumentos. En este sentido, se considera que la revisión de los aspectos formales, conceptuales y funcionales a partir de las cuales James E. Young definió en la década de los noventa a los contramonumentos, ilumina y habilita nuevas reflexiones sobre las diversas intervenciones, acciones de resistencia y producciones artísticas que se llevan a cabo en la actualidad, muchas de las cuales pueden ser pensadas como contramonumentos. By analyzing themes of power differentials, language barriers, and vulnerability, this commentary highlights the critical role of interpreters in bridging communication gaps and advocating for patient needs. In addition, this commentary explores the personal and professional challenges faced by interpreters, emphasizing the impact of working conditions on interpretation quality. In this paper I try to clarify the central role that the concept of nature plays in the phenomenological task of criticism and ordination of scientific knowledge. This first goal implies a phenomenological definition of nature, which makes visible the performative stages of world experience. First, I expose the mean of fundamentation and its relationship with the ontological-material limitation of nature —following the course of Husserl’s 1927 Lecture—; next, I develop the theory of attitudes as experiential deconstruction of nature, as (...) exposed in Ideas II, and finally, I draw the basic elements of pre-given-world analytics in its link with nature as material basis of life, according to the descriptions in the xxxix volume of Husserliana. En este trabajo me propongo realizar una lectura en paralelo de las críticas al concepto de sujeto llevadas a cabo por Theodor Adorno y Louis Althusser, ambos autores pertenecientes a dos tradiciones teóricas muy distintas. Esto con el fin de mostrar que: 1) que ambos parten del desmoronamiento del marxismo hegeliano y su idea de un sujeto de la historia, 2) que ambos intentan develar la naturaleza ideológica de la categoría de sujeto y 3) que para tal fin utilizan herramientas (...) psicoanalíticas. Este recorrido me permitirá resaltar los puntos de encuentro y las enormes divergencias entre ambos autores. (shrink)
