Many epistemologists have argued that there is some degree of independence between individual and collective reliability (e.g., Kitcher 1990; Mayo-Wilson, Zollman, and Danks 2011; Dunn 2018). The question, then, is: To what extent are the two independent of each other? And in which contexts do they come apart? In this paper, I present a new case confirming the independence between individual and collective reliability optimization. I argue that, in voting groups, optimizing individual reliability can conflict with optimizing collective reliability. This (...) can happen even if various conditions are held constant, such as: the evidence jurors have access to, the voting system, the number of jurors, some independence conditions between voters, and so forth. This observation matters in many active debates on, e.g., epistemic dilemmas, the wisdom of crowds, independence theses, epistemic democracy, and the division of epistemic labour. (shrink)

Governments and companies are increasingly promoting and organizing Responsible Innovation. It is, however, unclear how the seemingly incompatible demands for responsibility, which is associated with care and caution, can be harmonized with demands for innovation, which is associated with risk-taking and speed. We turn to the tradition of virtue ethics and argue that it can be a strong accomplice to Responsible Innovation by focussing on the agential side of innovation. Virtue ethics offers an adequate response to the epistemic and moral (...) complexity in innovation and encourages moral behaviour. We enumerate a number of virtues that people involved in Responsible Innovation would need to cultivate both related to responsibility, such as justice, anticipation, civility and inclusion, and virtues related to innovation, such as courage, dedication, curiosity and creativity. We put forward practical wisdom as a key virtue to regulate relevant virtues and to deal with the tension between responsibility and innovation. Practical wisdom helps an agent to find an appropriate mean in exercising and expressing the other virtues—where the mean is relative to the specific context of action and the role and abilities of the agent. Some mathematical proofs explain why the theorems they prove hold. This paper identifies several challenges for any counterfactual account of explanation in mathematics (that is, any account according to which an explanatory proof reveals how the explanandum would have been different, had facts in the explanans been different). The paper presumes that countermathematicals can be nontrivial. It argues that nevertheless, a counterfactual account portrays explanatory power as too easy to achieve, does not capture explanatory asymmetry, and fails to specify why (...) certain proofs are explanatory and others are not. The goal of this essay is to put forward an original theory of artifact function, which takes on board the results of the debate on the notion of biological function and also accommodates the distinctive aspects of artifacts. More precisely, the paper develops and defends the Dual-Aspect Theory, which is a monist account according to which an artifact’s function depends on intentional and reproductive aspects. The practice around informed consent in clinical medicine is both inconsistent and inadequate. Indeed, in busy, contemporary health care settings, getting informed consent looks little like the formal process developed over the past sixty years and presented in medical textbooks, journal articles, and academic lectures. In this article, members of the Society of Teachers of Family Medicine (STFM) Collaborative on Ethics and Humanities review the conventional process of informed consent and its limitations, explore complementary and alternative approaches to doctor‐patient interactions, (...) and propose a new model of consent that integrates these approaches with each other and with clinical practice. The model assigns medical interventions to a consent continuum defined by the discrete categories of traditional informed consent, assent, and nondissent. Narrative descriptions and clinical exemplars are offered for each category. This paper is concerned with the problem of selfidentification in the domain of action. We claim that this problem can arise not just for the self as object, but also for the self as subject in the ascription of agency. We discuss and evaluate some proposals concerning the mechanisms involved in selfidentification and in agencyascription, and their possible impairments in pathological cases. We argue in favor of a simulation hypothesis that claims that actions, whether overt or covert, are centrally simulated (...) by the neural network, and that this simulation provides the basis for action recognition and attribution. Elle stipule que, dans certaines circonstances « imparfaites », l’approximation d’un idéal est sous-optimale. Dans cet article, nous tentons de déterminer si la théorie peut être utile aux conseillers œuvrant dans le secteur public. Nous présentons les conditions dans lesquelles la théorie pourrait s’avérer pertinente pour les conseillers du secteur public, et en particulier la condition d’inséparabilité entre différentes variables d’un (...) problème de politiques publiques. Nous tentons aussi de déterminer si ces conditions sont réunies dans différents documents produits par les conseillers en politiques publiques. Ceteris-paribus clauses are nothing to worry about; aceteris-paribus qualifier is not poisonously indeterminate in meaning. Ceteris-paribus laws teach us that a law need not be associated straightforwardly with a regularity in the manner demanded by regularity analyses of law and analyses of laws as relations among universals. This lesson enables us to understand the sense in which the laws of nature would have been no different under various counterfactual suppositions — a feature even of those laws that involve no ceteris-paribus (...) qualification and are actually associated with exceptionless regularities. Ceteris-paribus generalizations of an‘inexact science’ qualify as laws of that science in virtue of their distinctive relation to counterfactuals: they form a set that is stable for the purposes of that field. (Though an accident may possess tremendous resilience under counterfactual suppositions, the laws are sharply distinguished from the accidents in that the laws are collectively as resilient as they could logically possibly be.) The stability of an inexact science's laws may involve their remaining reliable even under certain counterfactual suppositions violating fundamental laws of physics. The ceteris-paribus laws of an inexact science may thus possess a kind of necessity lacking in the fundamental laws of physics. A nomological explanation supplied by an inexact science would then be irreducible to an explanation of the same phenomenon at the level of fundamental physics. Joseph Heath defends competitive markets and conceptualizes business ethics with reference to Pareto efficiency, which he takes to be the “implicit morality of the market.” His justification for markets is that they generate Pareto efficient outcomes, meaning that markets optimally satisfy consumer preferences. And, for Heath, business ethics is the set of normative constraints—regulation and beyond-compliance norms—needed to preserve that outcome. The present paper accepts Heath’s claim that the economic justification for markets is ethical, in that satisfying consumer preferences is (...) a good. But, contra Heath, the ethical consideration at work is a consequentialist one; and acknowledging this consequentialism exposes limitations of Heath’s “market failures” approach to business ethics. We suggest two limitations, and we expect many will accept our argument that Heath’s conception of business ethics is too narrow. The present paper outlines two broader implications. First, acknowledging that the justification for markets is ethical eliminates the apparent—and false—conflict between purportedly amoral economic activity on one hand and ethical considerations on the other; instead, business ethics is a matter of weighing the consequentialist ethical benefit of economic activity and markets against other moral arguments/other ethical considerations. Second, Heath restricts business ethics to the constraints needed to protect the market’s ability to efficiently satisfy consumer preferences, constraints he calls “efficiency imperatives”; this restriction supports the widespread tendency to think that all social problems are economic; and, a business ethics so-conceived diminishes the perceived importance of noneconomic values—this attitude is dangerous. Peirce and Husserl both realized that our habits and habitual conceptions, though vital to the success of most activities, nevertheless occlude large portions of the experiential canvass. So, unless preparatory work puts us in the right mindset, we risk perceiving the world—not as it is—but rather as we expect it to be. While Peirce and Husserl were predominantly concerned with supplying a better observational basis for inquiries like science, semiotics, and mathematics, I draw on their phaneroscopic/phenomenological tools to combat the (...) addictive and mind-narrowing effects of technology. I go over several examples to show how, when we (try to) rid ourselves of presuppositions and relax the pursuit of efficiency, we enable contemplative possibilities conducive to flourishing and the pursuit of meaning. My overall message is that, in an age when we increasingly depend on devices like Smartphones (and soon VR) to form flat and one-sided worldviews, re-establishing an unmediated contact with our everyday surroundings can have tangible existential benefits, nipping in the bud tyrannical trends as well as wasted lives. What are the brain and cognitive systems that allow humans to play baseball, compute square roots, cook soufflés, or navigate the Tokyo subways? It may seem that studies of human infants and of non-human animals will tell us little about these abilities, because only educated, enculturated human adults engage in organized games, formal mathematics, gourmet cooking, or map-reading. In this chapter, we argue against this seemingly sensible conclusion. When human adults exhibit complex, uniquely human, culture-specific skills, they draw on a (...) set of psychological and neural mechanisms with two distinctive properties: they evolved before humanity and thus are shared with other animals, and they emerge early in human development and thus are common to infants, children, and adults. These core knowledge systems form the building blocks for uniquely human skills. Without them we wouldn’t be able to learn about different kinds of games, mathematics, cooking, or maps. To understand what is special about human intelligence, therefore, we must study both the core knowledge systems on which it rests and the mechanisms by which these systems are orchestrated to permit new kinds of concepts and cognitive processes. What is core knowledge? A wealth of research on non-human primates and on human infants suggests that a system of core knowledge is characterized by four properties (Hauser, 2000; Spelke, 2000). First, it is domain-specific: each system functions to represent particular kinds of entities such as conspecific agents, manipulable objects, places in the environmental layout, and numerosities. Second, it is task-specific: each system uses its representations to address specific questions about the world, such as “who is this?” [face recognition], “what does this do?” [categorization of artifacts], “where am I?” [spatial orientation], and “how many are here?” [enumeration]. Third, it is relatively encapsulated: each uses only a subset of the information delivered by an animal’s input systems and sends information only to a subset of the animal’s output systems. Une des contributions phares de Luc Bégin à l’éthique publique est d’avoir bien documenté les obstacles auxquels les gardiens institutionnels québécois doivent porter une attention particulière. Bégin s’est notamment intéressé aux conditions dans lesquelles les ordres professionnels, comme l’Ordre des ingénieurs du Québec, sont moins susceptibles de protéger le public contre des pratiques répréhensibles (corruption, collusion, etc.). Je poursuis les réflexions de Bégin à partir d’un point de vue « épistémique ». Je montre d’abord comment les ordres professionnels ont tendance (...) à produire des connaissances sur l’état de la profession à partir des informations partagées par leurs propres membres. J’analyse comment cette pratique peut générer un biais du survivant, et obscurcir des problèmes centraux à une profession. The Food and Drug Administration authorizes the marketing of a drug only for uses that the manufacturer has demonstrated to be safe and effective, based on evidence from at least two clinical trials. However, the FDA does not regulate the practice of medicine, so physicians may prescribe drugs in any manner they choose. Prescribing drugs in ways that deviate from the uses specified in the FDA-approved drug label, package insert, and marketing authorization is referred to as off-label prescribing. This occurs (...) when physicians prescribe a drug for a therapeutic purpose other than the one approved by the FDA; treat patients in a different age cohort or gender than the population on which it was tested; or prescribe a different dose, for a different duration of use, or a different mode of administration than indicated on the label. The most recent restatements of stakeholder theory formulate that approach in terms of the distribution of value: “A stakeholder approach to business is about creating as much value as possible for stakeholders, without resorting to tradeoffs” (Freeman et al. 2010: 28). This formulation marks a shift from earlier work, which included a procedural dimension—a requirement that stakeholders participate in organization decision making. The present paper pushes back against this shift: it argues that orienting the stakeholder approach around the participation requirement (...) provides for a different moral logic, one not available to (now) conventional stakeholder theorizing (without that requirement), and one that may be more compelling to many. This argument requires critical re-examination of the moral arguments offered in the most recent restatements of the stakeholder approach. (shrink)

Anhand einer allgemeinen Strukturanalyse von Gedankenexperimenten wird dabei aufgezeigt, dass bei Gedankenexperimenten in der praktischen Philosophie zwar häufig die angemessene Bewertung eines zugrunde gelegten Szenarios im Zentrum steht und nicht, wie zum Beispiel in theoretischen Philosophie oft, dessen angemessene Beschreibung, dass dieser Unterschied aber kaum Auswirkungen (...) hat auf die prinzipielle Anwendbarkeit – abgesehen von einer bisher übersehenen Konsequenz: Man darf in einem Gedankenexperiment nicht annehmen, dass moralische, ästhetische oder entscheidungstheoretische Prinzipien in unterschiedlichen möglichen Welten verschieden sind. This article examines cave art in France, arguing that the images created at many sites, but particularly Chauvet, can be analysed in terms of animation, storytelling, lighting and sound. Through superimposition and juxtaposition, and using the contours of the rock face, Palaeolithic artists invented a form of narration based on images, often then animated by the flickering light of lamps and torches. Drawing on semiological work by Philippe Sohet and his terms ‘narrative image’ and ‘iconic narration’, the article sees panels (...) of cave art as constituting scenes and actions that can be discussed in relation to both bande dessinée and cinema. Finally, evidence suggests that the spectacles produced in these spaces, whatever their elusive meaning, also depended on sound and acoustics. (shrink)

This article reflects on the crisis of political reason in this heyday of populistic rhetoric, proposing to move beyond the erroneous dichotomy between?democratic reason? and?raging passions,? and the demo-phobia that often derives from it. We propose instead to follow Bourdieu?s footsteps in bringing our attention to the forms of impermeability that fracture our contemporary political and social life, establishing the conditions of possibility of the reasonable and the unreasonable. What marks contemporary political passions as particularly dangerous is their impermeability to (...) the lessons of our historical past, to the moral condemnation of the political instrumentalization of difference and to the sacred character of fundamental principles. This hermeneutical gap, however, is later explained by a more fundamental analysis of the problem of contemporary impermeability, one which operates as a reversal of the dichotomy between political reason and passion. It is no longer the electorate, seduced by the sirens of populism, which is impermeable to the voice of political reason; it is, instead, this very reason, embodied by the elites who claim to recognize themselves in its values and principles, which has become impermeable to the?conditions of non-existence? in which a considerable part of the population lives. If there is a problem of contemporary impermeability, or imperturbability, it is that of a political discourse that has lost touch with?all the misery of the world?. (shrink)

The proliferation of the use of Internet has led to speculations that the interactive possibilities offered by this technology will lead to a democratisation of political communication. It is argued that citizens will enjoy more opportunities to discuss polities with other citizens and to express their opinions toward the political system. In this casestudy, we examine the political use of internet at the time of the Belgian local elections of 8 October 2000. Building on the coding scheme developed by Pippa (...) Norris, we distinguish interactive and institutional communication through the Internet, in which we expect that interactive communication has a democratie potential, while the institutional communication shows atendency to strengthen existing power relations. The data show that during this election campaign the Internet has been used mainlyfor institutional purposes, not for interactive applications. Therefore our conclusion is that, especially in small languageareas, the democratic potential of Internet remains limited. (shrink)

The French philosopher, Gilles Deleuze, is emerging as one of the most important and influential philosophers of the 20th century, having published widely on philosophy, literature, language, psychoanalysis, art, politics, and cinema. However, because of the ‘experimental’ nature of certain works, combined with the manner in which he draws upon a variety of sources from various disciplines, his work can seem difficult, obscure, and even ‘willfully obstructive’. In an attempt to resist such impressions, this paper will seek to provide an (...) accessible introduction to Deleuze's work, and to begin to discuss how it can be employed to provide a significant critique and reconceptualization of the theoretical foundations and therapeutic practices of psychiatry, psychotherapy, and mental health nursing. In order to do this, the paper will focus upon Deleuze's masterwork, and the cornerstone to his philosophy as a whole, Difference and Repetition; in particular, it will discuss how his innovative and challenging account of time can be employed to provide a conception of human life as a ‘continuity’, rather than as a series of distinct ‘moments’ or ‘events’. As well as discussing the manner in which his work can provide us with an understanding of how life is different and significant for each human being, this paper will also highlight the potential importance of Deleuze's work for logotherapy, for the recent ‘turn’ to ‘narrative’ as a psychotherapeutic approach and for contemporary mental health care's growing interest in ‘social constructionism’. As such, this paper also seeks to stimulate further discussion and research into the importance and the relevance of Deleuze's work for the theory and practice of psychiatry, psychotherapy, and mental health nursing. Clinical Legal Education programmes now take place in most law schools in England and Wales. However, legal education continues to be predominantly focused on the analysis and application of rules, doctrines, and theories to hypothetical scenarios or essay questions. This form of pedagogy either minimises or ignores the role of the client in terms of supplying lawyers with knowledge pertinent to their case. In other words, it overlooks the fact that the lawyer’s acquisition of knowledge is not confined to technical (...) rationality. This article seeks to achieve three broad aims. First, to contribute to the debate concerning the epistemology of reflective practice. Second, to develop a theoretical reflective cycle, informed by Kant’s transcendental idealism, which seeks to maximise knowledge acquisition in legal education, namely knowledge supplied by the client. Third, to address implicit bias using the proposed reflective cycle. An optimal pedagogy for using this cycle is Clinical Legal Education, namely live client clinics. (shrink)

Many of our ideological, political, moral, religious, aesthetic, scientific beliefs, as well as those concerning everyday life, are controversial; other people do not share them. As a rule, that does not bother us much: we tend to retain our contestable beliefs even if we ascribe no less skill and well-informedness to those who represent other points of view than to ourselves. But is that really reasonable? Shouldn't we often admit that we might be as wrong as others? And if we (...) do, shouldn't this consequently lead us to give up many of our beliefs in favor of agnostic attitudes? Marc Andree Weber argues that in the face of disagreement with equally competent and well-informed interlocutors we should almost always refrain from insisting on our controversial beliefs – with the few exceptions being all the more remarkable. Current debates in Clinical Legal Education (CLE) exclude essay writing as a legitimate form of ‘clinical’ pedagogy. This article argues that essay writing should be classified as a form of CLE due to its potential to mirror legal practice and enhance students' reflective capacities. By incorporating Hegelian dialectical reasoning, the paper proposes a structured approach to legal essay writing that includes thesis, antithesis, and synthesis. This method encourages students to engage deeply with legal arguments, reflecting on their merits and counterarguments. (...) The dialectical approach aligns with constructivist teaching methodologies, promoting critical thinking and practical skills relevant to legal practice and beyond. The article outlines the theoretical basis of this model and provides a practical framework for its implementation in legal education. It further connects this pedagogical strategy to the development of transferable skills that prepare students for professional legal environments. Through this dialectical method, the paper advocates for a more holistic and nuanced understanding of legal concepts, bridging the gap between academic theory and practical application, and, thus, making the case for the incorporation of Hegel-inspired essay writing into the definition of CLE. This paper addresses the tactical question of how we ought to proceed in teachingbusiness ethics, taking as a starting point that business ethics should be concerned with cooperative,mutually beneficial outcomes, and in particular with fostering behavior that contributes to thoseoutcomes. This paper suggests that focus on moral reasoning as a tactical outcome—as a way ofachieving behavior in support of cooperative outcomes—is misplaced. Instead, we ought to focuson cultivating empathetic experiences. Intuitively, the problem we need to address in business ethicsis not (...) that our students (and that we ourselves) sometimes reason poorly, or that moral decisionmakingis subject to characteristic kinds of errors. The case "Caprica Energy and Its Choices" concerns a fictionalized energy corporation choosing between three potential drilling sites. According to the published Teaching Note, the case is an exercise in the stakeholder approach to business: it requires balancing profit considerations with potential harm to those who live near those drilling sites. Though unintended, the case raises a further question not addressed in the case or in the Teaching Note: what gives Caprica Energy the right to impose risk on members of (...) the communities surrounding its drilling sites? The first section of the present article argues that, in such cases, manage- ment can only justify imposing risk on the local community by securing those stakeholders' consent. The second section outlines the implications for stakeholder theory and stake- holder management. The third section outlines one con- nection between this material and recent literature on the imposition of risk and moral theory; that section offers an account of what make this particular instance of imposing risk morally problematic, with reference to the directedness of the imposition. In order to be able to provide informed, effective and responsive mental health care and to do so in an evidence‐based, collaborative and recovery‐focused way with those who use mental health services, there is a recognition of the need for mental health professionals to possess sophisticated critical thinking capabilities. This article will therefore propose that such capabilities can be productively situated within the context of the work of the French philosopher Michel Foucault, one of the most challenging, innovative and influential (...) thinkers of the 20th century. However, rather than focusing exclusively upon the content of Foucault's work, it will be suggested that it is possible to discern a general methodological approach across that work, a methodological approach that he refers to as “the history of the present.” In doing so, Foucault's history of the present can be understood as a productive, albeit provisional, framework in which to orientate the purpose and process of critical thinking for mental health professionals by emphasizing the need to both historicize and politicize the theoretical perspectives and therapeutic practices that characterize contemporary mental health care. First, the idea of Ur-intentionality is problematic. Second, Hutto and Satne have not provided us with a way of getting from Ur-intentionality to content intentionality.

Ces interrogations sont centrales, puisque d'elles depend l'intelligence de ce qui constitue l'essentiel de notre tradition speculative, les courants ontologique et henologique, respectivement rattaches aux noms d'Aristote et de Platon/Plotin, formant l'armature meme de notre heritage conceptuel. Et l'oubli meme de l'etre decrie par Heidegger, dans tout cela? Peut-il avoir le meme sens dans une philosophie de l'etre et dans une philosophie qui, expressement, methodiquement, choisit de se situer dans une perspective autre que celle de l'etre, etre que par la justement, elle n'oublie pas, mais qu'intentionnellement elle delaisse et maintient a distance? Bryan Norton proposes a "convergence hypothesis'* stating that anthropocentrists and nonanthropocentrists can arrive at common environmental policy goals if certain constraints are applied. Within his theory he does not, however, address the consideration ofnonconsequentualist issues, and, therefore, does not provide an argument for the convergence between consequentualist and nonconsequentualist ethical positions. In the case of biotechnology, nonconsequentualist issues can dominate the debate in both the fields of environmental ethics and bioethics. I argue that, the convergence hypothesis must be rejected when (...) tested against the case of biotechnology, and this limitation of convergence applies to any theory of reconciliation within the "health" concept because the achievement and preservation of "health "emphasizes a consequentualist outlook. I conclude that an inclusive ethics for ecosystem and human health should be explicit about this limitation. (shrink)

This publication contains reflections on Jacques Ranciáere's essay 'The Ignorant Master' by the artist Marc De Blieck and the art philosopher Volkmar Mèuhleis. The artist's practice is assuming an expanding variety of forms, the artist can leap from one method to another, and the media available to him, old and new, appear inexhaustible. Can and should art education prepare the artist for this? One possibility is to bring a never-ending abundance of experts into the art schools. Ranciáere offers us (...) a provocative alternative in the form of Jacotot, the ignorant master. In part, the book indirectly endorses present-day art education, but at the same time a number of the controversial arguments it contains challenge one to self-reflection. (shrink)

We care for our own future experiences. Most of us, trivially, would rather have them pleasurable than painful. When we care for our own future experiences we do so in a way that is different from the way we care for those of others (which is not to say that we necessarily care more about our own experience). Prereflectively, one would think this is because these experiences will be ours and no one else's. But then, of course, we need to (...) explain what it means to say that a future experience will be mine and how knowledge of this fact renders it rational for me to care for this experience in a special way. Indeed most philosophers take this route. But in doing so, they quickly stumble on insuperable problems. I shall argue that the problem of egocentric care, as it is sometimes called, can be solved by turning things upside down: it is much more fruitful to think that the special kind of care we feel for some future experiences (and not others) is part of what makes them ours should they occur. This requires an explanation of egocentric care for future experiences that does not draw in a theory of personal identity, but rather contributes to one. I will attempt to provide this explanation by making use of the idea of a diachronic mental holism. (shrink)

According to recent literature in philosophy and psychology, there is a set of basic emotions that were preserved over the course of evolution because they serve adaptive functions. However, the empirical evidence fails to support the claim that there are basic emotions because it fails to show that emotions can be identified with specific functions. Moreover, work on basic emotions lacks the conceptual space to take emotional experience into account and so fails to amount to an adequate theory of emotion: (...) in the literature basic emotions are identified with emotional responses, but these responses — even if they did exist as characterized — are not emotions or emotional. That said, recent empirical discoveries about the brain structures responsible for emotional responses, discoveries that are often cited in the basic emotions literature, nevertheless form the foundation for a comprehensive theory of emotion — a theory that is broadly Jamesian in that an emotion is the experience and interpretation of a prior, physiological response.
