One of the measures adopted by the government of Spain during the COVID-19 pandemic has been the elimination of face-to-face classes in all universities, requiring that all teachers had to conduct their classes in an online mode. The objective of this article is to study how this adaptation among university teachers affected their job performance due to the technostress (objective and subjective) that they may have suffered. Based on the person-environment misfit theory (P-E fit theory), the sample consisted of 239 (...) teachers from face-to-face and online universities in Spain who were asked to identify the type of technostress, feelings of technostress, and impact on job performance as a result of online teaching due to the COVID-19 pandemic. Results show that teachers who suffered the most from the negative consequences of technology have been female teachers from face-to-face universities who are older, have more years of experience, and consequently, hold a higher position. Despite previous results none of the above variables have been significant in explaining the decline in job performance during confinement. It was also observed that although the effect on job performance was similar for online teachers as well as face-to-face teachers, the variables that explained this effect were different. For the online teachers, there was a misfit between the demands and resources, which are explained based on the previous theory (P-E fit theory). Teachers from face-to-face universities pointed to the lack of instructions from their organization, along with subjective feelings of techno-inefficacy, as the reasons behind the decline in job performance during the lockdown period. Looking ahead to future research on the incorporation of information and communications technology in teaching work, it is necessary to consider variables associated with technostress, both objective and subjective, in order to increase the effectiveness of integrating emerging technology into teaching work. La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. The passage of time seems to be a fundamental aspect of experience. However, most descriptions of the passage of time itself are incompatible with the four-dimensional block universe model of space and time, in which time is extended like space, and all states of affairs exist equally and eternally in this varied tapestry of space and time. The tension between temporal passage and the block universe seems to leave one with the option of either abandoning the block universe in favor (...) of a metaphysics that can accommodate our experience, or holding that this experience of passage is illusory. I argue for a third option: that we have certain dynamic experiences, which lend themselves to the view that time passes, those dynamic experiences can be accounted for within the block universe model without any additional mechanism, and those dynamic experiences are not illusory, but veridical. This study explores the intra-organizational antecedents of sustainable governance by examining the impact of female presence at the corporate apex. Drawing upon the upper echelon theory, we investigate whether women in top positions influence sustainable governance practices. Our research focuses on a sample of companies operating within two distinct market economies: liberal market economies (LMEs) and coordinated market economies (CMEs). The United States, represented by the S&P100, and the United Kingdom, represented by the FTSE100, serve as examples of LMEs. Conversely, (...) Germany (DAX30), France (CAC40), Spain (IBEX35), and Switzerland (SMI) are illustrative of CMEs. Analyzing archival data spanning from 2010 to 2019, we confirm that the presence of a critical mass of women on the board of directors significantly increases the likelihood of establishing a sustainability committee within organizations. This relationship holds true across both LMEs and CMEs, highlighting the universal importance of gender diversity in driving sustainable governance initiatives. Interestingly, we observe that the impact of women with structural power on sustainability committee formation is specific to LMEs, suggesting the context-dependent nature of female leadership in sustainable governance. Combates pela História é, como se sabe, o título de um livro famoso de Lucien Febvre dos anos cinquenta. Através de uma recomposição, de novo se deu importância a todas as modalidades da História, mantendo, todavia, o sentido do rigor que era algo perseguido nos «combates pela História». Quer-se, pois, analisar o sentido da História, nas suas várias áreas. Contudo, ao propor-se este tema, não se desejou que os autores apresentassem tanto as suas investigações nas suas áreas próprias — embora elas estivessem subentendidas e devessem ser expressas —, mas que refletissem sobre o seu sentido no âmbito da História entendida como Ciência Social e Humana. Para tal, desejou-se que discutissem o objeto e o método da História das diversas áreas, equacionando os seus vários problemas. Foi isso que também sucedeu — estamos disso convencidos. El primero tiene que ver con cuestiones preliminares acerca de la verdad que el Prof. Puntel discute antes de presentar su posición. El segundo está relacionado con la posición particular que Puntel defiende y en concreto con su crítica a las (...) teorías pro-oracionales. El primer asunto tiene relevancia porque las cuestiones preliminares en teoría de la verdad constriñen el desarrollo posterior de la teoría de manera determinante; el segundo aspecto tiene relevancia porque la crítica de Puntel encierra ciertos malentendidos de fondo que desdibujan su propia posición y le impiden tener el alcance que el Prof. Puntel le atribuye. In this article, I will draw on my own work and related publications to present some intuitions and hypotheses about the nature of the self and the mechanisms that lead to the development of consciousness or self awareness in human infants during the first 6 months of life. My main purpose is to show that the origins of a concept of self include the physical and the mental selves. I believe that it is essential when trying to understand what a (...) mental state is, that one identifies the social and physical aspects of the person to whom the mental state belongs. How can one identify a mental state or thought without making reference to a subject who experiences it (Hobson, 1990)? The other important feature of the self is that it is distinguished from other people and inanimate objects. ‘One's concept of self is a concept of a person; one's concept of persons cannot be a concept applicable only to a single individual (oneself), for the reason that in this case it would no longer constitute a concept'(Hobson, 1990, p. 165). I would like to argue that infants must be able to represent their physical and social selves in order to recognize that they are similar and different from other people, and to develop expectations and predictions about the behaviour of others (theory of mind). Unlike Strawson, I do not believe that the social and physical aspects of the self are, or become redundant to the nature of the self. I posit that the mature conscious self is a unique mythical and constantly changing entity, the formation of which is created not by the individual alone, but through continuous dialectical inquiry with other people. El epistolario del filósofo argentino Francisco Romero (Sevilla, 1891 - Buenos Aires, 1962) con colegas y discípulos de Chile y con extranjeros afincados voluntariamente o no en ese país, constituyó una notable red intelectual en torno al conocimiento de América, entre 1934 y 1962. La construcción del americanismo filosófico fue una de las preocupaciones aglutinantes, y las reflexiones que se produjeron se entroncaron con las circunstancias políticas, ideológicas, sociales, culturales y económicas de cada uno de sus miembros. The correspondence of (...) the argentine philosopher Francisco Romero (Seville, 1891 - Buenos Aires, 1962) with colleagues and disciples of Chile and foreign voluntarily or not settled in that country, constituted a remarkable intellectual network in the knowledge of America, between 1934 and 1962. The construction of Philosophical Americanism was a central concern, and reflections that occurred were connected with political, ideological, social, cultural and economic circumstances of each member. El debate en torno a Aristipo de Cirene, cuya concepción de la felicidad coloca en el centro de la escena al placer, pone en tela de juicio las afirmaciones propias de aquellas éticas nucleadas bajo el epíteto de eudemonistas. Con el desplazamiento de la felicidad del sitial del fin, Aristipo reformula la dimensión ética tradicional: a través del ejercicio de la enkráteia, y lejos de caer en un relativismo subjetivista, intenta construir una ética que tenga como base un objetivismo gnoseológico. (...) Demostraremos, además, que al ejercicio de la enkráteia cirenaica subyace la noción de autosuficiencia ( autárkeia ) –entendida en términos aristotélicos– del individuo . Esto nos enfrentará, irremediablemente, a la noción aristotélica de felicidad (en estrecho vínculo con la noción de enkráteia ), la cual no comporta una noción de autosuficiencia individual sino que restringe la posibilidad de la autárkeia a la autosuficiencia de la pólis. IN THE LAST PART of the Theory of Moral Sentiments, Adam Smith puts his theory in a class with those of his contemporaries Francis Hutcheson and David Hume, namely, the systems that make sentiments the principle of approbation. Despite recognizing important differences with both of them, he thinks that since he has placed the origin of moral sentiments in sympathy, and in particular the fact that we are able to enter into the motives of the agent and get pleasure from (...) finding them appropriate to their cause, sentiments are the foundation of his theory of morals. Many of Smith’s commentators, in fact almost all of the most important studies over the last few years, reaffirm the author’s self-description. However, my aim in this paper is to challenge this view by showing that Smith’s system can also be plausibly seen as a theory of practical reasoning, and in some important aspects very similar to Aristotelian ethics. Surprisingly few scholars have seen this parallel. Laurence Berns, Samuel Fleischacker, Charles Griswold, and Gloria Vivenza are the latest exceptions, identifying several points of coincidence between Adam Smith and Aristotle’s ethics. None of them, however, has tied all these similarities under a unified interpretation, such as the one I propose here: The basic analogy between these theories, and the source of those particular coincidences, is the operation of practical reason. Moreover, and besides the common elements with Aristotle’s ethics, Smith’s reconstruction of practical reason simultaneously announces some of the main features of modern accounts of ethics, such as impartiality and universality as preconditions of moral judgment. The integration of these ancient and modern elements in a single coherent theory allows Smith’s TMS to overcome the insufficiencies and paradoxes of both these traditions, and it constitutes one of the most interesting and challenging proposals of modern ethics. This paper examines the position of international human rights law towards missionary or proselytizing activities with a special focus on the American context. By evaluating UN legal acts such as the 1948 Universal Declaration of Human Rights, the 1960 Arcot Krishnaswami Study and the 1981 Declaration on the Elimination of All Forms of Intolerance and Discrimination Based on Religion or Belief and the American Convention of Human Rights, it investigates the extent to which such activities fall within the scope of (...) the right to free speech and to freedom of religion for religious organizations. This is exemplified by looking at two Evangelical religious organizations founded for the purpose of luring away groups of believers from their original religious communities: “Mission to Amish People”, targeting the Amish People, and “Jews for Jesus”, aimed at the Jewish community. The clash of one religious community which considers mission a fundamental element of its religion with a religious community who is highly skeptical about mission constitute the extreme test case of the right to free speech and to corporate freedom of religion. Given the highly various importance which mission can play in different religions, the article suggests to solve each case individually by carefully examining the content of each religious doctrine. RESUMEN El texto explora, en mujeres mayores de 80 años, la experiencia vivida durante el pe ríodo conocido como La Violencia en Colombia. Se examina el "trauma" que, según la autora, se manifiesta como "rayones", lo que hace difícil traducirlo o interpretarlo, porque solo se percibe a través de la escucha. Se estudia lo que M. Heidegger exploró como "ser-ahí" y "ser-en-el-mundo", esto es, el estar lanzados al mundo en un de terminado contexto donde construimos nuestra subjetividad y aprendemos a (...) vivir, para entenderlo mediante estas experiencias femeninas singulares. ABSTRACT The text explores the experience lived during the period known as The Violence in Colombia by women now over 80. It examines the "trauma" that, according to the author, manifests itself in the form of "scratches", thus making it difficult to translate and interpret given that it is only perceptible through listening. The article discusses M. Heidegger's notions of Dasein and being-in-the-world, that is, our thrownness into the world in a specific context in which we construct our subjectivity and learn how to live, in order to understand them through these singular feminine experiences. This article explores some of the most significant questions in feminist epistemology: how do academics demarcate what constitutes ‘proper’ academic knowledge? And to what extent is feminist theory and research recognised as such? I draw on material from an ethnographic study of academia in Portugal to examine the claims that non-feminist scholars make in classrooms and conferences about the epistemic status of feminist scholarship. I observed that feminist work was very commonly described as capable of generating credible and valuable knowledge, (...) but only in some instances and in limited ways. I present examples of these adversative claims (i.e. propositions that express opposition or discrepancy through a ‘but’ or equivalent adversative conjunction) and analyse their structure, content and uses of caricature and humour, showing how epistemic boundaries are drawn in them and how feminist scholarship is positioned in relation to those boundaries. I argue that this boundary-work produces a representation of feminist scholarship as being located partly within, and partly outside, the realm of proper knowledge, a move which I designate as an epistemic splitting of that scholarship. I suggest that this splitting enables and legitimates a selective engagement with feminist work, because it provides non-feminist scholars with a recognised epistemological rationale for taking into account the feminist insights which broadly fit mainstream frameworks, while simultaneously rejecting as epistemologically unsound the feminist critiques of those frameworks. My aim in this paper is to investigate what epistemic role, if any, do appeals to representations play in cognitive neuroscience. I suggest that while at present they seem to play something in between a minimal and a substantive explanatory role, there is reason to believe that representations have a substantial contribution to the construction of neuroscientic explanations of cognitive phenomena.
