There is a vast literature on the meanings of legal penalties. However, we lack a theory that explains them according to the formation of the modern state. Oakeshott's theory can help explain this phenomenon, leading to an attempt of the individual to take over as many powers of the state as possible. Thus, Kant's and Smith's retributivism is the most consistent of all those theories. Nevertheless, the preventive and resocializing theory of Bentham succeeded eventually. But is this a liberal theory? (...) We contrast the explanations of H.L.A. Hart and Frederick Rosen in order to lay the groundwork for a liberal theory of the meaning of legal sanctions. (shrink)

Resumen: La imposibilidad del desarrollo para conciliar normativamente imparcialidad con pluralidad responde a un sesgo de carácter ontológico. Esta ruptura, que constituye la esencia misma de los estudios del desarrollo, supone aceptar que cualquier teoría del desarrollo que se precie se encuentra sustancialmente inacabada. De tal imposibilidad emerge, sin embargo, un perfeccionamiento que transcurre dialécticamente en términos de doble negación hegeliana por el cual las distintas teorías van perfeccionándose a partir de un mayor grado de concienciación normativa. Este perfeccionamiento alcanza (...) analíticamente un estado absoluto de desarrollo definido como libertad. Un concepto que perfecciona el presentado por Amartya Sen, facultado para reconciliar analíticamente el sesgo originario.: The impossibility of development to gather normatively impartiality and plurality makes itself to be ontologically incomplete. Nevertheless, the analytical that emerges in the very essence of development discipline implies to accept that any development theory is and will always be unfulfilled. Nevertheless, and beyond that substantive impossibility, an improvement occurs dialectically in terms of Hegelian double negation by which each theory is overcome by a higher grade of normative awareness by the following one. This improvement reaches analytically an absolute dimension of development as freedom. In this paper, we study the effects of using an algorithm-based risk assessment instrument (RAI) to support the prediction of risk of violent recidivism upon release. The instrument we used is a machine learning version of RiskCanvi used by the Justice Department of Catalonia, Spain. It was hypothesized that people can improve their performance on defining the risk of recidivism when assisted with a RAI. Also, that professionals can perform better than non-experts on the domain. Participants had to predict whether (...) a person who has been released from prison will commit a new crime leading to re-incarceration, within the next two years. This user study is done with (1) general participants from diverse backgrounds recruited through a crowdsourcing platform, (2) targeted participants who are students and practitioners of data science, criminology, or social work and professionals who work with RisCanvi. We also run focus groups with participants of the targeted study, including people who use RisCanvi in a professional capacity, to interpret the quantitative results. Among other findings, we observe that algorithmic support systematically leads to more accurate predictions from all participants, but that statistically significant gains are only seen in the performance of targeted participants with respect to that of crowdsourced participants. Among other comments, professional participants indicate that they would not foresee using a fully-automated system in criminal risk assessment, but do consider it valuable for training, standardization, and to fine-tune or double-check their predictions on particularly difficult cases. We found that the revised prediction by using a RAI increases the performance of all groups, while professionals show a better performance in general. And, a RAI can be considered for extending professional capacities and skills along their careers. (shrink)

El sistema de Cooperación Internacional al Desarrollo es epistemológica y operativamente ajeno a la complejidad reinante en su mundo de actuación. Su tradición académica ha venido históricamente determinada por dos reacciones antitéticas. Porun lado, restringe la realidad a un principio universalista donde el desarrollo es interpretado apriorísticamente. Por el otro, se somete a un empirismo extremo donde superando el carácter especulativo del anterior, se incapacita para forjar una teoría sobre lo que realmente funciona. En uno y en otro, el fetichismo (...) de la ayuda terminasiendo el precio que recurrentemente se paga ante la incapacidad para reconciliar ambas posiciones. Se probará cómo una alternativa epistémica, capaz de aunar lo positivo de ambas posturas, minimizaría el impacto negativo de la cooperación, favoreciendoun marco de acción tan eficaz como sostenible. The purpose of this paper aims to unravel the ideological strategy that rises from the well-celebrated epistemic rigor of neoclassical economic thought. From the Economics Nobel Price Paul Krugman’s popularized connotation naming to "freshwater" economists as those fervent followers of the most orthodox academic creed, we will expose the logical inconsistency and empirical implausibility of such thought’s underlying assumptions: perfect competence and equilibrium’s approaching. From a critical analysis that will be conducted from each of those mentioned assumptions, we will argued (...) that the neoclassical thought is an ideological strategy subverting reality’s principles, overcoming "artificially" those relevant deficiencies and limitations of its theoretical approach. A lo largo de este trabajo se intenta desvelar la estrategia ideológica que emana del celebrado rigorismo epistémico del pensamiento neoclásico de economía. Desde la connotación popularizada por el Nobel Paul Krugman a los economistas de "agua dulce" como aquellos fervientes seguidores del credo académico más ortodoxo, expondremos la incoherencia lógica e imposibilidad empírica de los supuestos fundamentales de su pensamiento: competencia perfecta y aproximación al equilibrio. Desde un examen crítico que irá conduciéndose por cada uno de tales supuestos, resolveremos cómo el marco neoclásico no es más que una estrategia ideológica que subvirtiendo los principios de lo real consigue superar solo "artificialmente" las importantes deficiencias y limitaciones de su marco teórico. Addressing the study of human action from Mises’s perspective of the praxeological method is in itself highly controversial. Particularly, if it attempts to identify the ultimate basis of human development, it will face unmanageable problems in analytical and normative terms. The incapability to withdraw from the socalled self-evident judgments comes together with the refusal of the elements that address its operability. Dependent of a soft well-being concept, it is unable to establish interpersonal comparisons, and this in turn frustrates any kind (...) of attempt to design a convincing social justice theory. A Hegelian perspective brings order to and improves both the moral and the operability dimension of the praxeological interpretation of economics. (shrink)

El propósito de este trabajo se enmarca en la necesidad de esclarecer la naturaleza última del capitalismo que cristaliza ideológicamente desde las bases fecundas de la modernidad. Desde el examen crítico de los trabajos de S. Žižek realizaremos una introspección analítica que nos permita arrojar luz no solo a cómo el capitalismo configura la realidad de esta época sino al modo en que gestiona sus límites y fija su devenir. Se concluirá que el capitalismo lejos de ser el resultado político (...) de un proceso socio-económico caprichoso resulta ser la materialización de un instante de la conciencia moral que destinada a emanciparse se encuentra todavía en su comienzo. El éxodo de más de 5,6 millones de venezolanos representa un fenómeno migratorio con múltiples facetas, cada una merecedora de atento análisis y profundización. Ante la dimensión del movimiento de millones de seres humanos, se corre el riesgo de subestimar tragedias que ocurren dentro del drama migratorio. Una de ellas, es el exilio de científicos y académicos. Bajo esta perspectiva, la investigación tiene como objetivo general mostrar la banalización frente al riesgo de pérdida de talento y avance científico de países (...) en vías de desarrollo. Tomamos como objeto de estudio el caso de la Diáspora Científica Venezolana. Se abordan de forma multidisciplinar tres ejes temáticos: 1) Causas y consecuencias de la Ciencia en Riesgo, 2) Instrumentalización de la Ciencia en Riesgo y 3) Efectividad de programas dirigidos a científicos en riesgo. El primer eje temático, está fundamentado en analizar las causas y consecuencias de la Diáspora científica venezolana, centrándonos en los estudios realizados, desde el ámbito sociológico, de Iván de la Vega, Francisco Kerdel-Vegas y Tomás Páez. El segundo eje establece, desde el marco filosófico habermasiano-marcusiano, la conveniente preservación del statu quo de la Ciencia en riesgo, a través de instrumentalización y unidimensionalidad del quehacer científico en países en vías de desarrollo por parte de programas internacionales financiados por organismos privados y gubernamentales. El tercer y último enfoque tiene como punto de partida la situación actual de la diáspora científica y la exposición de soluciones eficaces que rompan la inercia presente, enmarcando las ideas dentro de la actual crisis de la posmodernidad. Bernstein in his extensive and illuminating work span the stream of contemporary thought in several directions: ethics, politics, epistemology, philosophy of history, and social theory. In reflecting on them Bernstein has played an intermediary role between the most recognizable product of American philosophical tradition, i.e. Pragmatism, and such central trends in European 20th century thought as Marxism, Psychoanalysis, Critical Theory, and Hermeneutics. In this volume a host of prominent scholars from the United States, Europe, (...) and Latin America pays tribute to Bernstein's lifelong reflection on such present human problems as: the achievements and the dilemmas of modern societies, the legitimation crisis of democracy, the uses and abuses of public space, the role of scientific knowledge and technology in shaping the modern life, the ethical and political interplay between identity and community, and the preconditions and limits of understanding in multicultural contexts. Cognitive Science is a promising field of research that deals with one of the most fundamental questions ever: how do beings know? However, despite the long and extensive tradition of the field it has not yet become an area of knowledge with scientific identity. This is primarily due to three reasons: the lack of boundaries in defining the object of study, i.e. cognition, the lack of a precise, robust and consistent scientific methodology and results, and the inner problems derived from (...) its interdisciplinary nature. This paper presents a background review, a theoretical frame and a humble reflection on these topics in order to arouse the internal debate among readers once more. (shrink)

Background Neuroscientific approaches have historically triggered changes in the conception of creativity and artistic experience, which can be revealed by noting the intersection of these fields of study in terms of variables such as global trends, methodologies, objects of study, or application of new technologies; however, these neuroscientific approaches are still often considered as disciplines detached from the arts and humanities. In this light, the question arises as to what evidence the history of neurotechnologies provides at the intersection of creativity (...) and aesthetic experience. Methods We conducted a century-long bibliometric analysis of key parameters in multidisciplinary studies published in the Scopus database. Screening techniques based on the PRISMA method and advanced data analysis techniques were applied to 3612 documents metadata from the years 1922 to 2022. We made graphical representations of the results applying algorithmic and clusterization processes to keywords and authors relationships. Results From the analyses, we found a) a shift from a personality-focus quantitative analysis to a field-focus qualitative approach, considering topics such as art, perception, aesthetics and beauty; b) The locus of interest in fMRI-supported neuroanatomy has been shifting toward EEG technologies and models based on machine learning and deep learning in recent years; c) four main clusters were identified in the study approaches: humanistic, creative, neuroaesthetic and medical; d) the neuroaesthetics cluster is the most central and relevant, mediating between creativity and neuroscience; e) neuroaesthetics and neuroethics are two of the neologism that better characterizes the challenges that this convergence of studies will have in the next years. Conclusions Through a longitudinal analysis, we evidenced the great influence that neuroscience is having on the thematic direction of the arts and humanities. The perspective presented shows how this field is being consolidated and helps to define it as a new opportunity of great potential for future researchers. (shrink)

Background: Mental fatigue can impact physical demands and tactical behavior in sport-related contexts. Small-sided games are often used to develop a specific sport-related context. However, the effects of mental fatigue on physical demands and tactical behaviors during soccer SSGs have not been aggregated for systematical assessment.Objective: This systematic review was conducted to compare the effects of mental fatigue vs. control conditions in terms of the total running distance and tactical behavior of soccer players during SSGs.Methods: The data sources utilized were (...) PubMed, PsycINFO, Scielo, Scopus, SPORTDiscus, and Web of Science. The study eligibility criteria were established based on PICOS: Population: healthy youth and young adult men soccer players with regular training practice and belonging to teams with regular competitions; Intervention: exposed to mental fatigue-induced protocols only before SSGs; Comparator: control conditions before SSGs; Outcomes: physical demands and tactical behavior ; Study design: counterbalanced cross-over design; and only full-text and original articles written in English.Results: The database search initially identified 111 titles. From those, six articles were eligible for the systematic review and meta-analysis. Results showed no significant effect of fatigue on total running distance and tactical behavior.Conclusions: A non-significant effect of mental fatigue on total running distance and tactical behaviors performed by soccer players during SSGs was found in this systematic review. The origins of teacher training programs in Chile have not been addressed in depth apart from Vivanco’s studies. Even though these studies explore the development of these programs in Chile from a chronological perspective, there are no qualitative studies that consider senior academics’ narrations. This qualitative study reconstructs the trajectory of teacher training programs in Chile from a series of interviews with 25 academics in charge of these programs. Results were analyzed in three different periods: 1960-1973, 1973-1990, and 1990 to (...) 2019. Results, discussed in a political and academic context, reveal that these teacher training programs have evolved in a sociopolitical context, generating a series of tensions that substantially impact these training programs. The study finishes with the statement of a series of questions aimed at reflecting upon the state of the art in Chile’s training programs. (shrink)

Este artículo plantea la posibilidad de efectuar una renovación teórica en las ciencias sociales de corte constructivista a partir del giro realista surgido recientemente en el marco de la filosofía continental contemporánea. Para ello revisamos algunos aspectos básicos de la ontología orientada a objetos de G. Harman, de la teoría del ensamblaje de Manuel De Landa, y del materialismo especulativo de Q. Meillassoux. Nuestra hipótesis de partida sostiene que estas tres teorías poseen un amplio potencial teórico para reactivar el (...) debate en torno al tema de la realidad en el campo de la investigación social, al margen de cualquier subjetivismo, ya sea mediado por el lenguaje o la conciencia. Por último, pensamos y problematizamos los posibles cambios teóricos y metodológicos que podrían presentarse en este ámbito de investigación una vez asumido el giro ontológico realista de los filósofos aquí revisados. A principios del año 2005, Manuel Escamilla, por entonces editor de los ACFS, me sugirió que recopilara los trabajos publicados desde los comienzos de la revista. Se acercaba el Congreso Mundial de Filosofía del Derecho, que iba a celebrarse en Granada en mayo de 2005, y parecía una buena idea ofrecer un catálogo que incluyera noticia de todas las publicaciones contenidas en la revista desde su aparición, en 1961 hasta la fecha (por entonces, 2004)….

I first seriously contemplated writing a book on degree theory in 1976 while I was visiting the University of Illinois at Chicago Circle. There was, at that time, some interest in ann-series book about degree theory, and through the encouragement of Bob Soare, I decided to make a proposal to write such a book. Degree theory had, at that time, matured to the point where the local structure results which had been the mainstay of the earlier papers in the area (...) were finding a steadily increasing number of applications to global degree theory. Michael Yates was the first to realize that the time had come for a systematic study of the interaction between local and global degree theory, and his papers had a considerable influence on the content of this book. During the time that the book was being written and rewritten, there was an explosion in the number of global theorems about the degrees which were proved as applications of local theorems. The global results, in turn, pointed the way to new local theorems which were needed in order to make further progress. I have tried to update the book continuously, in order to be able to present some of the more recent results. It is my hope to introduce the reader to some of the fascinat ing combinatorial methods of Recursion Theory while simultaneously showing how to use these methods to prove some beautiful global theorems about the degrees. In recent years, there has been a substantial amount of work in reverse mathematics concerning natural mathematical principles that are provable from RT, Ramsey's Theorem for Pairs. These principles tend to fall outside of the "big five" systems of reverse mathematics and a complicated picture of subsystems below RT has emerged. In this paper, we answer two open questions concerning these subsystems, specifically that ADS is not equivalent to CAC and that EM is not equivalent to RT.

As the 21st century breaks upon us, no ethical issues in business appear as significant as those being created by the rapidglobalization of business. Globalization has created numerous ethical problems for the manager of the multinational corporation. What does justice demand, for example, in the relations between a multinational and its host country, particularly when that country is less developed? Should human rights principles govern the relations between a multinational and the workers of a host country, and if so, which (...) principles are the correct ones? How should a multinational deal with a government in which corruption is rife? What are the ethical considerations involved in determining whether and how to transfer a risky technology to a country whose people may not be able to safely absorb that technology? What kind of labor and environmental standards should a multinational adopt when operating in a country whose government legislates only very low standards? (shrink)
