The present debate in legal theory is dominated by an unfruitful schism. On the one hand, analytical theories are concerned with the positivity of law, running the risk of missing the law's relation to society. On the other hand, sociological approaches analyze all sorts of social interactions of law, but have developed no conceptual tools to do justice to the autonomy of law. The theory of autopoiesis offers law a chance of getting round the falsely posed alternative between an autonomous (...) rule system or a socially conditioned decision-making process. It is a theory of law that sees the law's autonomy in the self-reproduction of a communication network and understands its relation to society as interference with other autonomous communication networks. Building on the ideas of Humberto Maturana, Heinz von Foerster and Niklas Luhmann, Gunther Teubner uses the concepts of self-organization and autopoiesis to develop a concept of law as a hypercyclically closed social system. This book will stand as a landmark in legal theory and become a standard point of departure in the sociology of law. (shrink)

Any satisfactory model of the emotions must at once recognize their place within intentional psychology and acknowledge their uniqueness as mental causes. In the first half of the century, the James-Lange model had considerable influence on reinforcing the idea that emotions are non-intentional (see Lange 1885 and James 1890). The uniqueness of emotions was therefore acknowledged at the price of denying them a place within intentional psychology proper. More recently, cognitive reductionists (including identity theorists) like Robert Solomon and Joel Marks (...) recognize that emotions are intentional but, by reducing them to judgments, beliefs, desires, etc., fail to capture their distinctiveness as mental causes (see Solomon 1976 and Marks 1982). In other words, their place within intentional psychology is acknowledged at the price of denying them their uniqueness. (shrink)

‘Language and End Time’ is a translation of Sections I, IV and V of ‘Sprache und Endzeit’, a substantial essay by Günther Anders that was published in eight instalments in the Austrian journal FORVM from 1989 to 1991 (the full essay consists of 38 sections). The original essay was planned for inclusion in the third (unrealised) volume of The Obsolescence of Human Beings. ‘Language and End Time’ builds on the diagnosis of ‘our blindness toward the apocalypse’ that was advanced in (...) the first volume of The Obsolescence in 1956. The essay asks if there is a language that is capable of making us fully comprehend the looming ‘man-made apocalypse’. In response to this, it offers a critique of philosophical jargon and of the putatively ‘objective’ language of (nuclear) science, which are both dismissed as unsuitable. Sections I, IV and V introduce this core problematic. The selection of this text for inclusion in this special journal issue responds to present-day realities that inscribe Anders’s reflections on nuclear science and the nuclear situation into new contexts. The critique that ‘Language and End Time’ advances resonates with the way in which the (undemocratic) decisions of a few companies and individuals are shaping the future of life on earth. At the same time, the wider stakes of Anders’s turn against the language employed by (weapons) scientists are newly laid bare by the realities and politics of climate change and fake news. In this new context, the language of science is all too readily dismissed as if it were a mere idiom that can be ignored without consequence. It is against the backdrop of a future that is, if anything, more uncertain than at the time of Anders’s writing, that the essay’s reflections on popularisation, the limits of language and the nature of truth gain added significance. Episodic representations can be entertained either as “remembered” or “imagined”—as outcomes of experience or as simulations of such experience. Here, we argue that this feature is the product of a dedicated cognitive function: the metacognitive capacity to determine the mnemicity of mental event simulations. We argue that mnemicity attribution should be distinguished from other metacognitive operations (such as reality monitoring) and propose that this attribution is a “cognitive gadget”—a distinctively human ability made possible by cultural learning. Cultural learning is a (...) type of social learning in which traits are inherited through social interaction. In the case of mnemicity, one culturally learns to discriminate metacognitive “feelings of remembering” from other perceptual, emotional, action-related, and metacognitive feelings; to interpret feelings of remembering as indicators of memory rather than imagination; and to broadcast the interpreted feelings in culture- and context-specific ways, such as “I was there” or “I witnessed it myself.” We review evidence from the literature on memory development and scaffolding, metacognitive learning and teaching, as well as cross-cultural psychology in support of this view before pointing out various open questions about the nature and development of mnemicity highlighted by our account. Do any nonhuman animals have hedonically valenced experiences not directly caused by stimuli in their current environment? Do they, like us humans, experience anticipated or previously experienced pains and pleasures as respectively painful and pleasurable? We review evidence from comparative neuroscience about hippocampus-dependent simulation in relation to this question. Hippocampal sharp-wave ripples and theta oscillations have been found to instantiate previous and anticipated experiences. These hippocampal activations coordinate with neural reward and fear centers as well as sensory and cortical areas (...) in ways that are associated with conscious episodic mental imagery in humans. Moreover, such hippocampal “re- and preplay” has been found to contribute to instrumental decision making, the learning of value representations, and the delay of rewards in rats. The functional and structural features of hippocampal simulation are highly conserved across mammals. This evidence makes it reasonable to assume that internally triggered experiences of hedonic valence (IHVs) are pervasive across (at least) all mammals. This conclusion has important welfare implications. Most prominently, IHVs act as a kind of “welfare multiplier” through which the welfare impacts of any given experience of pain or pleasure are increased through each future retrieval. However, IHVs also have practical implications for welfare assessment and cause prioritization. (shrink)

Composer, conductor, educator, jazz critic, and horn virtuoso, Gunther Schuller here brings together his writings on music. There are numerous articles about jazz, dealing with his favourite figures like Duke Ellington and Ornette Coleman, and also Schuller's concept of the 'Third Stream', the area where jazz and concert music intersect. Other sections deal with the composition and performance of contemporary music, musical education, and musical aesthetics.

Dominant forms of contemporary big-data based digital citizen science do not question the institutional divide between qualified experts and lay-persons. In our paper, we turn to the historical case of a large-scale amateur project on biogeographical birdwatching in the late nineteenth and early twentieth century to show that networked amateur research can operate in a more autonomous mode. This mode depends on certain cultural values, the constitution of specific knowledge objects, and the design of self-governed infrastructures. We conclude by arguing (...) that the contemporary quest for autonomous citizen science is part of a broader discourse on the autonomy of scientific research in general. Just as the actors in our historical case positioned themselves against the elitism of gentlemen scientists, avant-garde groups of the twenty first century like biohackers and civic tech enthusiasts position themselves against the system of professional science—while “digital citizen science” remains to oscillate between claims for autonomy and realities of heteronomy, constantly reaffirming the classic lay-expert divide. In this article, I share an anecdote about citizen science and use it to reflect on this rapidly growing field of scientific activity, its funding, and its governance. The paper focuses particularly on the epistemic and social challenges that accompany increasing demands for professionalization and institutionalization of the Citizen Sciences.

We propose that episodic thought (i.e., episodic memory and imagination) is a domain where the language-of-thought hypothesis (LoTH) could be fruitfully applied. On the one hand, LoTH could explain the structure of what is encoded into and retrieved from long-term memory. On the other, LoTH can help make sense of how episodic contents come to play such a large variety of different cognitive roles after they have been retrieved.

The paper draws attention to an important, but apparently neglected distinction relating to axiomatic theories of truth, viz. the distinction between weakly and strongly truth-compositional theories of truth. The paper argues that the distinction might be helpful in classifying weak axiomatic theories of truth and examines some of them with respect to it.

Should decision-making algorithms be held to higher standards of transparency than human beings? The way we answer this question directly impacts what we demand from explainable algorithms, how we govern them via regulatory proposals, and how explainable algorithms may help resolve the social problems associated with decision making supported by artificial intelligence. Some argue that algorithms and humans should be held to the same standards of transparency and that a double standard of transparency is hardly justified. We give two arguments (...) to the contrary and specify two kinds of situations for which higher standards of transparency are required from algorithmic decisions as compared to humans. Our arguments have direct implications on the demands from explainable algorithms in decision-making contexts such as automated transportation. (shrink)

Intuitive theories are sets of integrated concepts and causal laws that people adopt to comprehend, explain, and predict certain phenomena they encounter in the world. These theories are ‘intuitive’ because they are thought to drive our intuitions about how the physical and biological world, the mental life of people, and the society we live in work, without meeting the standards of explicit scientific theorizing. The proposal that people adopt such theories has been around at least since the 1970s. However, how (...) psychologists think about intuitive theories has been changing since they have been first proposed. In this chapter, we provide a short overview of the approaches to the function of intuitive theories and belief-forming systems more generally. While early characterization of intuitive theories emphasized their epistemic function, later attempts took an evolutionary view, claiming that they serve adaptive functions that are not always aligned with the goal of accurately tracking environmental states. A recent twist in this story is the proposal that shared intuitive theories may also serve social functions by providing a ‘theoretical common ground’ on which people interpret unobservable entities, such as memories, character traits, entitlements, and obligations. Such shared theories might be essential for social coordination via communication. (shrink)

Philosophers of mind have recently sought to establish a theoret- ical use for nonconceptual content. Although there is disagreement about what nonconceptual content is supposed to be, this much is clear. A state with nonconceptual content is mental. Hence, while one may deny that refrigerators and messy rooms have conceptual capacities, their states, as physical and not mental, do not have nonconceptual content. A state with nonconceptual content is also intentional, which is to say that it represents a feature of (...) the world for a subject. It may be tempting to think of qualitative states as having nonconceptual content since they can be experienced by indi- viduals independently of their possession of the requisite concepts, e.g. someone could experience pains, itches or tingles without possessing the concept pain, itch or tingle. But on such a view, one would have to assume that qualitative states are representational since mental states cannot be candidates for nonconceptuality unless they have intentional properties.2. When two or more people coordinate their actions in space and time to produce a joint outcome, they perform a joint action. The perceptual, cognitive, and motor processes that enable individuals to coordinate their actions with others have been receiving increasing attention during the last decade, complementing earlier work on shared intentionality and discourse. This chapter reviews current theoretical concepts and empirical findings in order to provide a structured overview of the state of the art in joint action research. We (...) distinguish between planned and emergent coordination. In planned coordination, agents' behavior is driven by representations that specify the desired outcomes of joint action and the agent's own part in achieving these outcomes. In emergent coordination, coordinated behavior occurs due to perception action couplings that make multiple individuals act in similar ways, independently of joint plans. We review evidence for the two types of coordination and discuss potential synergies between them. (shrink)

The Serial Endosymbiotic Theory explains the origin of nucleated eukaryotic cells by a merging of archaebacterial and eubacterial cells. The paradigmatic change is that the driving force behind evolution is not ramification but merging. Lynn Margulis describes the symbiogenetic processes in the language of mechanistic biology in such terms as “merging”, “fusion”, and “incorporation”. Biosemiotics argues that all cell-cell interactions are (rule-governed) sign-mediated interactions, i.e., communication processes. As the description of plant communication demonstrates, the biosemiotic approach is not limited to (...) the level of molecular biology, but is also helpful in examining all sign-mediated interactions between organisms on the phenotypic level. If biosemiotics also uses the notions of “language” and “communication” to describe non-human sign-mediated interactions, then the underlying scientific justification of such usage should be critically considered. Therefore, I summarize the history of this discussion held between 1920 and 1980 and present its result, the pragmatic turn. (shrink)

The paper is concerned with Quine's substitutional account of logical truth. The critique of Quine's definition tends to focus on miscellaneous odds and ends, such as problems with identity. However, in an appendix to his influential article On Second Order Logic, George Boolos offered an ingenious argument that seems to diminish Quine's account of logical truth on a deeper level. In the article he shows that Quine's substitutional account of logical truth cannot be generalized properly to the general concept of (...) logical consequence. The purpose of this paper is threefold: first, to introduce the reader to the metamathematics of Quine's substitutional definition of logical truth; second, to make Boolos' result accessible to a broader audience by giving a detailed and self-contained presentation of his proof; and, finally, to discuss some of the possible implications and how a defender of the Quinean concepts might react to the challenge posed by Boolos' result. Prior research suggests that the action system is responsible for creating an immediate sense of self by determining whether certain sensations and perceptions are the result of one's own actions. In addition, it is assumed that declarative, episodic, or autobiographical memories create a temporally extended sense of self or some form of identity. In the present article, we review recent evidence suggesting that action (procedural) knowledge also forms part of a person's identity, an action identity, so to speak. Experiments that (...) addressed self-recognition of past actions, prediction, and coordination provide ample evidence for this assumption. The phenomena observed in these experiments can be explained by the assumption that observing an action results in the activation of action representations, the more so, when the action observed corresponds to the way in which the observer would produce it. In recent years, several scholars have been investigating Frege’s mathematical background, especially in geometry, in order to put his general views on mathematics and logic into proper perspective. In this article I want to continue this line of research and study Frege’s views on geometry in their own right by focussing on his views on a field which occupied center stage in nineteenth century geometry, namely, projective geometry.

Mit seinem epochalen Werk »Idee und Grundriß einer nicht-Aristotelischen Logik« (1959) legte Gotthard Günther (1900–1984) den Grundstein für eine radikal neue Form der philosophischen Betrachtung der ontologischen Einheit des Universums, deren Richtigkeit heute (auch unabhängig von Günther und in der Regel auf ungleich niedrigerem Niveau) von den Wissenschaften bestätigt wird (so z.B. in der Chaos-Forschung). Gegen die klassische (aristotelische) Logik, die nur zweiwertige Entscheidungen für verbindlich hält (eine Behauptung ist entweder wahr oder falsch), zeigt Günther auf, daß die – mathematisch (...) widerspruchsfrei formulierbare – mehrwertige Logik auch auf dem Gebiet der Ontologie, d.i. der Erfassung der Grundstrukturen des natürlichen Universums und des gesellschaftlichen Dialogs zwischen dem Ich und dem Du, Erkenntnismöglichkeiten eröffnet, die das Limit des klassischen Denkens rational überwinden. In this paper, we propose a regularity theory of causation. The theory aims to be reductive and to align with our pre‐theoretic understanding of the causal relation. We show that our theory can account for a wide range of causal scenarios, including isomorphic scenarios, omissions, and scenarios which suggest that causation is not transitive.

In everyday conversation, messages are often communicated indirectly, implicitly. Why do we seem to communicate so inefficiently? How speakers choose to express a message (modulating confidence, using less explicit formulations) has been proposed to impact how committed they will appear to be to its content. This commitment can be assessed in terms of accountability – is the speaker held accountable for what they communicated? – and deniability – can the speaker plausibly deny they intended to communicate it? We investigated two (...) factors that may influence commitment to implicitly conveyed messages. In a preregistered online study, we tested the hypothesis that the degree of meaning strength (strongly or weakly communicated) and the level of meaning used by the speaker (an enrichment or a conversational implicature) modulate accountability and plausible deniability. Our results show that both meaning strength and level of meaning influence speaker accountability and plausible deniability. Participants perceived enrichments to be harder to deny than conversational implicatures, and strongly implied content as more difficult to deny than weakly implied content. Furthermore, participants held the speaker more accountable to content conveyed via an enrichment than to content conveyed via an implicature. These results corroborate previously found differences between levels of meaning (enrichment vs. implicature). They also highlight the largely understudied role of meaning strength as a cue to speaker commitment in communication. (shrink)

In response to the commentaries, we clarify and defend our characterization of both the nature and function of episodic memory. Regarding the nature of episodic memory, we extend the distinction between event and episodic memory and discuss the relational role of episodic memory. We also address arguments against our characterization of autonoesis and argue that, while self-referential, it needs to be distinguished from an agentive notion of self. Regarding the function of episodic memory, we review arguments about the relation between (...) future mental time travel and memory veridicality; clarify the relation between autonoesis, veridicality, and confidence; and finally discuss the role of episodic memory in diachronic commitments. The article investigates one of the key contributions to modern structural mathematics, namely Hilbert’sFoundations of Geometry(1899) and its mathematical roots in nineteenth-century projective geometry. A central innovation of Hilbert’s book was to provide semantically minded independence proofs for various fragments of Euclidean geometry, thereby contributing to the development of the model-theoretic point of view in logical theory. Though it is generally acknowledged that the development of model theory is intimately bound up with innovations in 19th century geometry (in particular, the (...) development of non-Euclidean geometries), so far, little has been said about how exactly model-theoretic concepts grew out of methodological investigations within projective geometry. This article is supposed to fill this lacuna and investigates this geometrical prehistory of modern model theory, eventually leading up to Hilbert’sFoundations. (shrink)

Niklas Luhmann and Jacques Derrida start with a common assumption in their analyses of the law and the economy - the foundational paradox of social institutions. But then autopoiesis and deconstruction move into opposite directions. Luhmann pursues the question of how de-paradoxification constructs the immanence of social institutions and builds a world of autopoietic social systems. By contrast, Derrida's thought aims at the transcendence of social institutions through their re-paradoxification. However, there is a hidden supplementarity of autopoiesis and deconstruction which (...) makes it worthwhile to relate the theories to each other. Derrida's distinction of writing/speech is necessarily blind toward Luhmann's distinction of consciousness/communication, but is, at the same time, continuously provoked by it. On another level, the opposite happens. Luhmann's autopoiesis is permanently irritated by Derrida's différance but is at the same time unable to conceptualize it. This complementary blindness of their distinctions directrices is a permanent source of mutual irritation which requires a reformulation of the social and of the possibility of justice. (shrink)

Following decades of neglect, the work of the German Jewish philosopher, literary author, cultural critic, and poet Günther Anders (1902–1992) is gaining increasing recognition in the English-speaking world. This translation of “Résistance heute” (Resistance Today) makes one of Anders’s most programmatic and polemical short texts available. Published at the height of his anti-nuclear activism, “Resistance Today” is the written version of a speech Anders delivered in November 1962 upon acceptance of the northwest Italian city of Omegna’s Resistance Prize (other notable (...) recipients included Jean-Paul Sartre and Frantz Fanon). It first appeared in print in the West German left-wing journal Das Argument in November 1963. Clearly written for the occasion, the text condenses (and often further radicalizes) key premises about the end of history, the amoral character of work, and the continuity between Nazi totalitarianism, the nuclear age and the world of consumerism that are developed in great nuance across a range of books that Anders had recently published. Key co-ordinates include: Die Antiquiertheit des Menschen 1 (The Obsolescence of Human Beings 1, 1956), his groundbreaking critique of technology; Der Mann auf der Brücke (The Man on the Bridge, 1959), a philosophical travel diary occasioned by Anders’s 1958 visit to Japan and his participation at the World Conference Against Atomic and Hydrogen Bombs in Tokyo; Burning Conscience (1961), a correspondence with the American reconnaissance pilot Claude Eatherly, who scouted the target area before the Enola Gay went on to drop the atom bomb on Hiroshima. It seems likely that Burning Conscience, which turned into an international bestseller, occasioned the award of the prize. (shrink)

Hoerl & McCormack discuss the benefits of temporal reasoning mainly with respect to future planning and decision making. I point out that, for humans, the ability to represent particular past times has distinct benefits, which are independent from contributing to future-directed cognition. Hence, the evolution of the temporal reasoning system was not necessarily driven primarily by its benefits for future-directed cognition.
