It is often overlooked that, in addition to the integrity of protein‐coding sequences (PCSs), human health is crucially linked to the normal expression of genes by cis‐regulatory sequences (CRSs). These CRSs often lie at some considerable distance from the PCSs whose expression they control and often within other genes. The resulting gene interdigitation can make long‐range CRS identification and characterisation difficult. We propose that the need to conserve long‐range CRSs in cis with their target PCSs through evolution, in combination with (...) gene interdigitation and co‐regulation of many genes by individual CRSs, has contributed to the persistence of conserved synteny blocks between diverse species. We further hypothesise that examination of the varying extents of synteny blocks between multiple species in combination with phylogenetic footprinting to find CRSs might provide important clues to the existence of crucial functional CRS–PCS linkages. Identifying CRS–PCS linkages crucial to human health will lead to a better understanding of how their disruption by CRS mutation or chromosome translocation might contribute to many distressing human diseases. When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

This article contends that, although Luther does develop a fascinating concept of the human subject within his writings, he does not make this subjectivity methodologically basic. Instead, Luther locates human subjectivity within a more fundamental framework of “place”—a concept he develops over a span of thirty years, maturing from its earliest appearances, as a corollary of the theologia crucis, into a more expansive framework for his later thinking. After briefly sketching the concept of place within Luther's theology through to its (...) apex—the Genesisvorlesung delivered in the final ten years of Luther's life—the subsequent prominence of the doctrine of creation, particularly the language of creatio ex nihilo, is examined with a view to showing how Luther's theology might be re‐placed more constructively within contemporary thinking. FRÉDÉRICK ARMSTRONG | : It is common to see vulnerability as either “ontological” or broadly “circumstantial.” Both views capture something morally important about vulnerability. However, there is a puzzle: how can the same concept refer to a necessary ontological fact and to a contingent circumstance? I address two solutions to this puzzle. First, I argue that Mackenzie et al.’s taxonomy of vulnerability is not a real solution. Second, I address Martin et al.’s dispositional account of vulnerability. For them, (...) vulnerability is both an intrinsic property and a disposition. This supposedly solves the puzzle: vulnerability can be intrinsic and yet be manifest in only some circumstances—such is the nature of dispositions. However, I argue that if vulnerability is indeed a disposition, it is better conceived as an extrinsic disposition. Thus, vulnerability cannot be both intrinsic and dispositional; Martin et al. fail to resolve the puzzle. This, however, is no reason to fret. Indeed, an amended dispositional account of vulnerability, in which it is conceived as an extrinsic disposition, is metaphysically consistent and it satisfies our moral intuitions about human vulnerability, and more. Given these advantages, I argue the solution to this dilemma is to abandon the ontological conception of vulnerability. | : La vulnérabilité est souvent présentée comme une propriété « ontologique » ou comme une propriété « circonstancielle ». Une version amendée de l’approche dispositionnelle, où la vulnérabilité est conçue comme une disposition extrinsèque, est métaphysiquement cohérente, compatible avec l’ensemble de nos intuitions morales sur la vulnérabilité humaine et plus encore. Earlier in this century, many philosophers of science (for example, Rudolf Carnap) drew a fairly sharp distinction between theory and observation, between theoretical terms like 'mass' and 'electron', and observation terms like 'measures three meters in length' and 'is _2° Celsius'. By simply looking at our instruments we can ascertain what numbers our measurements yield. Creatures like mass are different: we determine mass by calculation; we never directly observe a mass. Nor an electron: this term is introduced in order to (...) explain what we observe. This (once standard) distinction between theory and observation was eventually found to be wanting. First, if the distinction holds, it is difficult to see what can characterize the relationship between theory :md observation. How can theoretical terms explain that which is itself in no way theorized? The second point leads out of the first: are not the instruments that provide us with observational material themselves creatures of theory? Is it really possible to have an observation language that is entirely barren of theory? The theory-Iadenness of observation languages is now an accept ed feature of the logic of science. Many regard such dependence of observation on theory as a virtue. If our instruments of observation do not derive their meaning from theories, whence comes that meaning? Surely - in science - we have nothing else but theories to tell us what to try to observe. (shrink)

The paper deals with such a modification of genuine modal realism as to accommodate impossible worlds into its ontology. First of all, the theory of modal realism is presented. Next, several motivations for the acceptance of impossible worlds are adduced. Further, Lewis’s argument against impossible worlds is presented. It is argued that the argument can be weakened by rejection of one of its premises. Finally, two objections against the proposal are countered. Although my strategy accounts for the Opinion concerning the (...) impossible, it allegedly violates another Opinion which conceives the reality classical. It seems, however, that there is no no-question-begging reason to think that reality is classical. How can we know, after all, which logic describes reality? Without a definite answer to the question, the incredibility objection then simply collapses into a statement of a possibilist dogma. (shrink)

Drosophila flies began to be used in the study of species evolution during the late 1930s. The geneticists Natasha Sivertzeva-Dobzhansky and Elizabeth Reed pioneered this work in the United States, and María Monclús conducted similar studies in Spain. The research they carried out with their husbands enabled Drosophila population genetics to take off and reveals a genealogy of women geneticists grounded in mutual inspiration. Their work also shows that women were present in population genetics from the beginning, although their contributions (...) have previously remained unacknowledged. The similarities between their research biographies also illustrate their position in a genealogy of partnerships working on Drosophila genetics. (shrink)

Abstract: Several critics of contextualism claim that this view cannot consistently maintain its advertised neutrality between skepticism and anti-skepticism. Some critics contend that contextualists are forced to side with the skeptic, since any defense of contextualism unavoidably puts in place the skeptic's high requirements for knowledge; others hold that the contextualists' claim to have knowledge of what their own view entails forces them to reject the skeptic's knowledge denial. I show that these arguments misconstrue the role of context in contextualism, (...) and explain how we are to understand the contextualist's proposed agreement with both the skeptic's knowledge denial and the anti-skeptic's knowledge attribution. From the early 1790s until after the turn of the century, a very productive but also controversial exchange took place between Reinhold and Fichte. Though many key aspects of post-Kantian philosophy were discussed, the philosophical confrontation between Reinhold and Fichte is most instructive for the understanding of post-Kantian philosophy. The exchange started when Fichte published his verdict on Reinhold's Elementarphilosophie and disapproved of its fundamental principle. In 1794 Fichte challenged Reinhold by presenting his Wissenschaftslehre. Reinhold was not convinced of Fichte's (...) foundation of philosophy at first, but announced that he accepted the Wissenschaftslehre in 1797. While Reinhold and Fichte officially collaborated in the following three years, tensions concerning fundamental questions were still present. When Reinhold adopted Rational Realism, his relation to Fichte deteriorated and the exchange between the two finally ended. The contributions in the present collection focus on the central systematic issues at the different stages of the confrontation between Fichte and Reinhold, thereby illuminating questions that are essential to the understanding of the evolution of post-Kantian German philosophy. By this is already expressed what the later moral philosopher Plutarch, who preserved the fragment for us, pointed to in his interpretation: in sleep each turns away from the common cosmos and turns to something which belongs to him alone, something thus which he does not and cannot share with any other. That Heracleitus himself, on the contrary, understood (...) this less as the sleep of an individual, including the sphere of dreams, than as a cosmos, one among numberless fleeting world-shapes, in no way corresponds to what we know of his teachings. The present analysis of the evolution of the concept of freedom in Ernst Tugendhat’s philosophy aims to highlight several interesting facts. First, Tugendhat attempts to describe the meaning of Kant’s statement “I could have acted otherwise” from a non-transcendental perspective. Second, he makes an effort to avoid the classical Kantian dilemma of the relation of free will and determinism by posing the question differently. Third, he situates the issue of the relation of freedom and causality in the framework of the (...) inner structure of freedom – examining it from the perspective of the human’s relation to him- or herself. Fourth, he attempts repeatedly to overcome the impossibility of considering freedom in the objective language of causality. The paper demonstrates why the issue of freedom remains a central problem of continental philosophy. (shrink)

In this paper I intend to discuss social decision-making involving extreme risks. By an extreme risk, I mean a potential outcome of an act for which the probability is low, but whose negative value is high. Extreme risks are often discussed when new technologies are introduced into society. Nuclear power and genetic engineering are two well-known examples.

In a letter to M. Coray, Thomas Jefferson distinguished two distinct notions of political authority. The first was that of ancient Greece, which was characterized by “slavery” and the subjection of the population. Jefferson’s characterization was astute insofar as Aristotle regarded some groups as privileged to rule “by nature,” while all other hereditary groups were fit only to be ruled. The second type, referring to governments of “the present age,” rejected that standard in favor of equality and the promotion of (...) the people’s “happiness.” Unexpectedly, the dichotomy between hereditary privilege systems and egalitarian service to the people maps onto the contrast between “feudal” and “bureaucratic” systems in late imperial Chinese theory. In other words, this insight into the nature of authority was known to theorists both in China and in the “West,” suggesting that it captures something fundamental about the nature of “authority.” This essay probes the dichotomy in two ways, theoretical and historical. In theory, “feudal” systems, east and west, seem to be informed by a substance metaphor, and so both Aristotle and his early modern followers conflated authority with social status, and imagined the latter as a hereditary, noble substance such as gold. In this model, social groups are necessarily ranked, with gold being nobler, for instance, than brass. Because authority inheres in the person as a substance, authority is personalistic. In other words, there is no clear, external standard for checking abuses of power. Classical Chinese bureaucratic theory imagined authority as a tally. In that case, an officer’s performance had to match the office’s public charge. Because the assignment of office is merit-based, tally systems tend to be more egalitarian. Moreover, they naturally provide an external standard for checking abuse, namely, the officer’s effect on the people’s “happiness.” Historically, these two paradigms clashed in England and Europe during the seventeenth and eighteenth centuries, when translations of Chinese texts became available. Using translingual analysis, this essay traces the transformation of authority from a substance model to a tally model in the thinking of several Enlightenment writers, culminating in the writings of Thomas Jefferson. A new explanation of the relation between schooling and work in the democratic, advanced industrial state emerges from this study that rejects both traditional views and the more recent Marxian perspective. Traditional views consider schools as autonomous institutions that are able to pursue the goals of equality and social mobility irrespective of the inequalities of capitalist society; the Marxian perspective views schools as serving the role of producing wage-labor for capitalistic exploitation. The authors suggest that the shortcomings of both views (...) are rooted in the fact that they do not recognize the true functions of the democratic, capitalist state. The state is seen as an arena for struggle between forces pushing for egalitarian, democratic reforms and those seeking to use the resources of the state for private capital accumulation. Depending on which side has primacy at the moment, schools will reflect one set of goals over the other. However, victory is never complete, and the tide of battle has shifted back and forth historically. The authors develop this theory through interpreting the dynamic relation between U.S. schools and the workplace. Based on this approach, they predict changes in both schooling and work as well as the forms that future conflicts between the contending forces are likely to take. (shrink)
