Recent decades have seen a revived interest in super-substantivalism, the idea that spacetime is the only fundamental substance and matter some kind of aspect, property or consequence of spacetime structure. However, the metaphysical debate so far has misidentified a particular variant of super-substantivalism with the position per se. I distinguish between a super-substantival core commitment and different ways of fleshing it out. I then investigate how general relativity and alternative spacetime theories square with the different variants of super-substantivalism.

I argue that, contrary to folklore, Einstein never really cared for geometrizing the gravitational or the electromagnetic field; indeed, he thought that the very statement that General Relativity geometrizes gravity "is not saying anything at all". Instead, I shall show that Einstein saw the "unification" of inertia and gravity as one of the major achievements of General Relativity. Interestingly, Einstein did not locate this unification in the field equations but in his interpretation of the geodesic equation, the law of motion (...) of test particles. (shrink)

Kant's Radical Subjectivism. Perspectives on the Transcendental Deduction.

Moral imagination is a process that involves a thorough consideration of the ethical elements of a decision. We sought to explore what might distinguish moral imagination from other ethical approaches within a complex business simulation. Using a three-component model of moral imagination, we sought to discover whether organization cultures with a salient ethics theme activate moral imagination. Finding an effect, we sought an answer to whether some individuals were more prone to being influenced in this way by ethical cultures. In a recent comment on H.L.A. Hart’s ‘Postscript’ to The Concept of Law, Ronald Dworkin claims that the meaning of legal and political concepts may be understood by analogy to the meaning of natural kind concepts like ‘tiger’, ‘gold’ and ‘water’. This article questions the efficacy of Dworkin’s claims by challenging the use of natural kinds as the basis for a semantic theory of legal and political concepts. Additionally, in matters of value there is no methodological equivalent to the scientific (...) method. Thus, there is little hope of finding hidden essences to explain the meaning of legal and political concepts. Finally, even if there are natural kinds, Dworkin’s arguments for their efficacy in jurisprudence are problematic and unpersuasive. The problem for Dworkin is that his embrace of natural kinds undermines the ‘fit’ side of the fit/justification model of adjudication that lies at the heart of his theory of law. (shrink)

This study proposes a conceptual model to explain persistent, accepted-as-normal corporate wrongdoing (hereafter banality of wrongdoing), particularly for high performance organizations. The model describes five explanatory variables: the culture of competition, ends-biased leadership, missionary zeal, legitimizing myth, and the corporate cocoon. Our thesis is that the nature of competition drives both legitimate and illegitimate goal-seeking to adopt an iconoclastic (rule-breaking) orientation. High performance organizations are favorable hosts for wrongdoing because high performance requires aggressive behavior at the ethical margins of what (...) is acceptable. The way leadership reacts to competition sets the stage for ethical or unethical cultures to develop. Ends-biased leadership will project strong vision, using ideology and legitimizing myth as tools to inspire and motivate. The resulting missionary zeal justifies using questionable means because of the perceived value of the end. One critical method for building strong culture is creating a sense of being separate and apart from the ordinary. This cocoon effect may create a self-referential value system that is significantly at odds with mainstream culture and in which wrongdoing is banal. We in the accounting profession have long shown an interest in presenting an ethical image. But are accountants more ethical than others in the business world? In order to answer that question, a survey was mailed to 250 lower-level accounting professionals to determine their perceptions of the importance of nineteen head and heart trait items first identified by Maccoby. The results, based on 134 replies, indicate that accountants have a higher perception of the importance of the heart traits that have (...) been associated with ethical inclinations than both managers and business students surveyed previously. However, in that head trait items still dominate in terms of importance, if accountants are more ethical, it is not to an overwhelming degree. (shrink)

Zygmunt Bauman has used his `outsider' position to explore the defining boundaries of our world and help shape a discourse which allows communication across these boundaries. In this spirit he has investigated: sociology and culture; capitalism, socialism and class; and modernity and postmodernity. Bauman has argued for an emancipatory sociology which takes full account of what ought and ought not to be, what human beings hope for and fear, and the need to give people intellectual tools to make use of (...) their freedom. Applying the strategy of the `hermeneutic circle', he has examined capitalist and socialist regimes from a range of vantage points. He has also identified the challenges we all now face as inhabitants of the half-ruined structures created by modernity's failed ambitions. Bauman has confronted these challenges in the last decade by focusing on the evils of modern bureaucracy as epitomized by the Holocaust, the inescapability of each individual's responsibility for his or her own moral choices, and the potential for an open and self-critical dialogue between sociologists and their fellow citizens. Robert Alexy has built his original theory of law upon pervasive claims for “necessary” features of law. In this article, I show that Alexy's claims suffer from two difficulties. First, Alexy is never clear about what he means by “necessity.” Second, Alexy writes as if there have been no challenges to claims of conceptual necessity. There have been such challenges and Alexy needs to answer them if his project is to succeed.

The notion of an automaton, as it is employed in the natural philosophy of Descartes and his closest followers, has three main components. None of them is new; what is new in early modern philosophy is the uses to which this old notion is put, and the idiosyncrasies into which its components are combined by subsequent philosophers. The thaumaturgic element is never entirely suppressed; but the more down-to-earth usage exemplified in antiquity by Aristotle’s references predominates. The automaton is quite often (...) the opposite of wonderful: phenomena that might excited wonder are proved to be unworthy of it, just by showing that they are the productions of an automaton. The automaton is, first of all, a machine, and therefore an artifact, human or (if the metaphor becomes literal) divine. It offers a model of intelligibility—to use Peter Dear’s term—for a certain class of natural phenomena, namely those we find in living things. But Descartes wants from it something more. In Descartes’ usage, a machine is that which makes itself available not just to “mechanical” explanation, but to a complete explanation, an explanation that makes all others superfluous. Not all machines, of course, are automata. Two further components figure in the notion. One is that automata are typically imitative. From the automata thaumata of Aristotle’s De Motu animalium to the nymphs of Salomon de Caus’s fountains, many automata are likenesses, partaking both of the iconic (to use Peirce’s term) and the symbolic. Moving sculptures proceed moving pictures by over two thousand years. They succeeded if they convinced their audiences that they could do what their prototypes did—where the doing is typically restricted to some few sorts of act. Measuring a complex and theologically challenging concept like spiritual formation can be daunting. This article describes a multiyear process and methodology that was used in constructing a measure that demonstrated reasonably high levels of reliability, validity, and useability. The article also describes the many challenges in developing this type of measure and strategies for overcoming those challenges. Reflections on how a measure such as this might be helpful, as well as potentially challenging, to churches and pastors are provided in the (...) closing. (shrink)

Arguments for the importance of neuroscience reach across many disciplines. Advocates of neuroscience have made wide-ranging claims for neuroscience in the realms of ethics, value, and law. In law, for example, many scholars have argued for an increased role for neuroscientific evidence in the assessment of criminal responsibility. In this article, we take up claims for the explanatory role of neuroscience in matters of morals and law. Drawing on our previous work together, we assess the cogency of neuroscientific explanations of (...) three issues that arise in these domains: rule-following, interpretation, and knowledge. RESUMO Este artigo analisa a atuação das forças centrípetas e centrífugas em enunciados da esfera religiosa que evidenciam cosmovisões do segmento cristão evangélico acerca da deficiência. Para tanto, selecionamos um vídeo disponível na plataforma YouTube contendo enunciados dos apresentadores Tito Rocha e Leandro Quadros relativos à temática da deficiência, bem como a resposta de uma internauta acerca do posicionamento desses sujeitos. A reflexão teórico-metodológica fundamenta-se na orientação dialógica da linguagem, sobretudo nas considerações acerca das relações dialógicas, vozes e forças centrípetas (...) e centrífugas. Também recorremos a estudos sobre cosmovisão, inclusão da pessoa com deficiência, discurso religioso e teologia cristã. Os resultados indicam que os discursos dos apresentadores refletem e refratam uma cosmovisão cristã que unifica o entendimento da deficiência como resultado da condenação divina ocasionada pelo pecado. O comentário da internauta, por sua vez, apresenta movimentos de centralização e dispersão dessa perspectiva cristã. (shrink)

The severity of Kazakhstan's ecological problems impels civic activists and state agencies to build public support for ecological rehabilitation in the country, through a comprehensive national programme of environmental education. This paper is a qualitative analysis whose main focus is the relations of civic groups and NGOs with the national government, occurring in the delivery of programmes for environmental education during the post-glasnost era. Provisional successes of civic groups in establishing environmental education programmes, and useful steps by the government to (...) facilitate civic environmental activism, give reasons for optimism for improved environmental governance. This article aims to contribute to counteracting the negative perception of Descartes’ philosophical legacy. The article addresses a specific aspect of the supposed human dominance over nature, that of the animal question. Against the accusation of “speciesism,” a hierarchy that considers humans superior and justifies their domination and cruelty towards animals, it is argued that Descartes did not regard animals as completely insensible, that his position was not as categorical as often presented, and that he can be interpreted not as (...) a speciesist but as an environmental advocate. This paper critiques a recent article in this journal in terms of its use of persuasive techniques. The central issue of the original article by Miles, Munilla and Covin and this paper is whether there should be a change in intellectual property rights to address the needs of impoverished people who are HIV positive or have full blown AIDS and the countries that do not have the means to buy AIDS medication in the absence of subsidies. This paper argues that (...) patents are state sanctioned monopolies that worked effectively for nearly a century. However, new circumstances and a globally interdependent world represent a new environment calling for an adjustment in the conventional public policy premises underlying patents. Most of the meaning and complexity of this issue is lost to the persuasive techniques of the original article. (shrink)
