Se propone un método paradójico para el análisis del Derecho. Este método de conocimiento consiste en una mirada a la complejidad del fenómeno jurídico, presentando sus aspectos complejos en forma de aparentes contradicciones. No son contradicciones reales, sino elementos complejos que, al constatarlos como0 dándose conjuntamente, nos permite dotar de profundidad nuestra reflexión. Hay diferentes maneras de definir la paradoja, pero aquí nos centramos en las cualidades literarias, retóricas y filosóficas que ofrece el tipo o tipos de paradoja utilizados, de (...) forma magistral, por el escritor inglés G.K. Chesterton. De las funciones de las paradojas (desde esta perspectiva, pero no solamente) son especialmente útiles para el análisis jurídico: criticar el sistema de pensamiento y abrir a la realidad. La primera se relaciona con el Derecho porque este siempre está bajo la amenaza del formalismo. La segunda se relaciona con él porque el Derecho es un fenómeno humano, de forma que, cuando hablamos de Derecho, estamos analizando la realidad compleja de la persona humana. Esta nos e puede reducir a una sola de sus dimensiones, y por ello es necesaria la paradoja, para equilibrar los distintos enfoques del análisis. Tras explicar todo esto, se procede en el artículo a sugerir siete paradojas que muestran la complejidad del fenómeno jurídico y pretenden ser retos al pensamiento. (shrink)

Vivimos en una sociedad en la que lo digital lo ha invadido todo. Han se ha ocupado de analizar este cambio desde la perspectiva antropológica y social, con una posición radicalmente crítica. Para Han el medio digital es un medio que nos re-programa. El cambio principal consiste en que desaparece lo que Han llama la “negatividad”. La negatividad aparece como aquello que no es positivo, que no es puesto (positum) por el individuo, sino que le viene dado y se percibe (...) inicialmente como límite. Esa negatividad de lo dado tiene múltiples manifestaciones: es lo no-inmediato, lo extraño, lo otro, lo que produce pesar y resistencia. Esta transformación hacia la transparencia “es una coacción sistémica que se apodera de todos los sucesos sociales y los somete a un profundo cambio”. Esto afecta incluso al hombre mismo, que es convertido también en un elemento funcional del sistema. Han analiza esa coacción violenta de la transparencia digital, y su omnipresencia, desde distintos enfoques a lo largo de sus libros. De ellos hemos seleccionado cinco: las relaciones personales (respeto y confianza), las relaciones comerciales (el mercado), las relaciones políticas y las relaciones con la realidad, mediadas por nuestro entendimiento del espacio y el tiempo. En este artículo explico una parte de la labor de G. K. Chesterton como crítico económico: su crítica al sistema capitalista. Con la imagen de la locura (loco sería, no el incapacitado para razonar, sino el que vive fuera de la realidad), considera al capitalismo como una locura porque su discurso es coherente pero no ofrece una vida digna para el ser humano: el capitalismo quita la libertad al proletario, le obliga a desvincularse espiritualmente de su propiedad y le desalienta (...) cuando propone alternativas económicas. Desarrollo también cómo otros autores coinciden con Chesterton, con críticas parecidas. (shrink)

This is the introduction to the special issue of Crítica on the metaphysics of physics, featuring papers by Valia Allori, Tim Maudlin and Gustavo Esteban Romero.

This textbook presents the basics of philosophy that are necessary for the student and researcher in science in order to better understand scientific work. The approach is not historical but formative: tools for semantical analysis, ontology of science, epistemology, and scientific ethics are presented in a formal and direct way. The book has two parts: one with the general theory and a second part with application to some problems such as the interpretation of quantum mechanics, the nature of mathematics, and (...) the ontology of spacetime. The book addresses questions such as "What is meaning?", "What is truth?", "What are truth criteria in science?", "What is a theory?", "What is a model?" "What is a datum?", "What is information?", "What does it mean to understand something?", "What is space?", "What is time?", "How are these concepts articulated in science?" "What are values?" "What are the limits of science?", and many more. The philosophical views presented are "scientific" in the sense that they are informed by current science, they are relevant for scientific research, and the method adopted uses the hypothetical-deductive approach that is characteristic of science. The results and conclusions, as any scientific conclusion, are open to revision in the light of future advances. Hence, this philosophical approach opposes to dogmatic philosophy. Supported by end-of-chapter summaries and a list of special symbols used, the material will be of interest for students and researchers in both science and philosophy. This Introduction tells the story of intergerational justice and how it has influenced philosophers and political thinkers throughout history. The Introduction goes on to discuss the aims of the book, which is to offer a sustained discussion of intergenerational justice as seen by practical philosophers. The first part of the book focuses on the way in which various schools of thought in moral and political philosophy approach the domain of intergenerational justice, while the second part focuses on more specific aspects, (...) such as how these theories address the question of motivation, how they deal with demographic fluctuations, or how they can be applied to real-world issues such as climate change. BackgroundMoral distress (MD) is the psychological damage caused when people are forced to witness or carry out actions which go against their fundamental moral values. The main objective was to evaluate the prevalence and predictive factors associated with MD among health professionals during the pandemic and to determine its causes.MethodsA regional, observational and cross-sectional study in a sample of 566 professionals from the Public Health Service of Andalusia (68.7% female; 66.9% physicians) who completed the MMD-HP-SPA scale to determine the level (...) of MD (0-432 points). Five dimensions were used: i) Health care; ii) Therapeutic obstinacy-futility, iii) Interpersonal relations of the Healthcare Team, iv) External pressure; v) Covering up of medical malpractice.ResultsThe mean level of MD was 127.3 (SD=66.7; 95% CI 121.8-132.8), being higher in female (135 vs. 110.3; p<0.01), in nursing professionals (137.8 vs. 122; p<0.01) and in the community setting (136.2 vs. 118.3; p<0.001), with these variables showing statistical significance in the multiple linear regression model (p<0.001; r2=0.052). With similar results, the multiple logistic regression model showed being female was a higher risk factor (OR=2.27; 95% CI 1.5-3.4; p<0.001). 70% of the sources of MD belonged to the dimension "Health Care" and the cause "Having to attend to more patients than I can safely attend to" obtained the highest average value (Mean=9.8; SD=4.9).ConclusionsFemale, nursing professionals, and those from the community setting presented a higher risk of MD. The healthcare model needs to implement an ethical approach to public health issues to alleviate MD among its professionals. (shrink)

My aim in this note is to shed light on ways of interpreting Kant’s Formula of Universal Law (FUL), by looking at relevant similarities and differences between Pauline Kleingeld and Mark Timmons. I identify both their readings as a formal interpretation of Kant’s FUL, in contrast to the substantive interpretations that favor a robust conception of rational agency as a necessary requirement for moral deliberation. I highlight the benefits that arise from Kleingled’s interpretation in showing the immediacy involved in the (...) volitional self-contradiction when universalizing a maxim. Alongside Timmons, I address a question as to whether Kleingeld’s interpretation is completely free from at least a minimal set of assumptions about practical deliberation more broadly, that seem to play a role in generating the volitational self-contradiction she is defending. I close by raising some skeptical worries about the capacity of this kind of contradiction to translate into a moral judgment triggering action. (shrink)

The European Universities Initiative (EUI), created by the European Commission in 2017, is a recent novel phenomenon within the European Union policy toolkit that explicitly targets the development of transnational cooperation in higher education (HE). To date, the EUI counts 44 European university alliances, involving around 340 HE institutions. In this paper, we argue that the EUI can be seen as a case of a transnational institution building process representing a potentially significant structural reform for European higher education. Anchored in (...) new institutionalism, we explore the regulative, normative, and cultural-cognitive dimensions of the EUI. Methodologically, this study analyzes the perspectives of European policy actors (n = 4), a set of policy documents (n = 13) and the mission statements of the EUI’s partnerships funded before 2022 (n = 41). The results show that the EUI emerges as the ‘next level of cooperation’ in European HE since it aims to transform European cooperation (regulative dimension), to create and diffuse a new model for European HE following a challenge-based approach (normative dimension), and to work as a way to reinforce and institutionalize European and global scripts for European HE (cultural-cognitive dimension). This paper deals with the question of whether uncertainty regarding model structure, especially in climate modeling, exhibits a kind of “chaos.” Do small changes in model structure, in other words, lead to large variations in ensemble predictions? More specifically, does model error destroy forecast skill faster than the ordinary or “classical” chaos inherent in the real-world attractor? In some cases, the answer to this question seems to be “yes.” But how common is this state of affairs? Are there precise mathematical (...) results that can help us answer this question? And is dependence on model structure “sensitive” in that arbitrarily small errors can destroy forecast skill? We examine some efforts in the literature to answer this last question in the affirmative and find them to be unconvincing. (shrink)

This volume comprises a lively and thorough discussion between philosophers and Tyler Burge about Burge's recent, and already widely accepted, position in the theory of meaning, mind, and knowledge. This position is embodied by an externalist theory of meaning and an anti-individualist theory of mind and approach to self-knowledge. The authors of the eleven papers here expound their versions of this position and go on to critique Burge's version. In this paper, we explicate an underappreciated distinction between two conceptions of valuing. According to the first conception, which we call the surface-account, valuing something is exclusively a matter of having certain behavioral, cognitive, and emotional dispositions. In contrast, the second conception, which we call the layer-account, posits that valuing is constituted by the presence of certain representational mental states underlying those dispositions. In the first part of the paper, we introduce the distinction in proper detail and show that the (...) accounts have different implications regarding the valuings of agents. In the second part, we situate the accounts within the extant philosophical literature. First, we relate them to the recent debate between so-called dispositionalists and representationalists about the nature of beliefs and point out that this debate can help anticipate some of the main dialectical fault lines to be expected between surface- and layer-theorists. Second, we examine the contemporary meta-ethical debate on conceptualizing valuing, indicate that scholars have largely ignored the distinction introduced here, and outline that this oversight has substantial theoretical costs: as we show, key arguments within the meta-ethical debate require thorough re-evaluation in light of the proposed distinction. The third part of the paper illustrates the theoretical leverage of the distinction for practical research by exploring its implications for behavioral welfare economics. (shrink)

A supertask consists in the performance of an infinite number of actions in a finite time. I show that any attempt to carry out a supertask will produce a divergence of the curvature of spacetime, resulting in the formation of a black hole. I maintain that supertaks, contrarily to a popular view among philosophers, are physically impossible. Supertasks, literally, collapse under their own weight.

Die Existenz von Organismen wird allgemein in Form eines Lebenszyklus dargestellt: Sie führt vom Stadium der Zygote über die Fortpflanzungsfähigkeit und das Alter bis zum Tod. Das Leben eines Individuums wird daher wesentlich als irreversibel von der Geburt bzw. der Entstehung auf den Tod gerichtet verstanden. Die philosophische Tradition hat lange Zeit versucht, wenn nicht diese Irreversibilität zu erklären, so doch zumindest ihr einen Sinn zu geben.

Teaching and research are organised differently between subject domains: attempts to construct typologies of higher education institutions, however, often do not include quantitative indicators concerning subject mix which would allow systematic comparisons of large numbers of higher education institutions among different countries, as the availability of data for such indicators is limited. In this paper, we present an exploratory approach for the construction of such indicators. The database constructed in the AQUAMETH project, which includes also data disaggregated at the disciplinary (...) level, is explored with the aim of understanding patterns of subject mix. For six European countries, an exploratory and descriptive analysis of staff composition divided in four large domains (medical sciences, engineering and technology, natural sciences and social sciences and humanities) is performed, which leads to a classification distinguishing between specialist and generalist institutions. Among the latter, a further distinction is made based on the presence or absence of a medical department. Preliminary exploration of this classification and its comparison with other indicators show the influence of long term dynamics on the subject mix of individual higher education institutions, but also underline disciplinary differences, for example regarding student to staff ratios, as well as national patterns, for example regarding the number of PhD degrees per 100 undergraduate students. Despite its many limitations, this exploratory approach allows defining a classification of higher education institutions that accounts for a large share of differences between the analysed higher education institutions. The environment can have a long‐lasting influence on an individual's physiology and behavior. While some environmental conditions can be beneficial and result in adaptive responses, others can lead to pathological behaviors. Many studies have demonstrated that changes induced by the environment are expressed not only by the individuals directly exposed, but also by the offspring sometimes across multiple generations. Epigenetic alterations have been proposed as underlying mechanisms for such transmissible effects. Here, we review the most relevant literature on these changes (...) and the developmental stages they affect the most. We discuss current evidence for transgenerational effects of prenatal and postnatal factors on bodily functions and behavioral responses, and the potential epigenetic mechanisms involved. We also discuss the need for a careful evaluation of the evolutionary importance with respect to health and disease, and possible directions for future research in the field. (shrink)

Why do humans menstruate while most mammals do not? Here, we present our answer to this long‐debated question, arguing that (i) menstruation occurs as a mechanistic consequence of hormone‐induced differentiation of the endometrium (referred to as spontaneous decidualization, or SD); (ii) SD evolved because of maternal–fetal conflict; and (iii) SD evolved by genetic assimilation of the decidualization reaction, which is induced by the fetus in non‐menstruating species. The idea that menstruation occurs as a consequence of SD has been proposed in (...) the past, but here we present a novel hypothesis on how SD evolved. We argue that decidualization became genetically stabilized in menstruating lineages, allowing females to prepare for pregnancy without any signal from the fetus. We present three models for the evolution of SD by genetic assimilation, based on recent advances in our understanding of the mechanisms of endometrial differentiation and implantation. Testing these models will ultimately shed light on the evolutionary significance of menstruation, as well as on the etiology of human reproductive disorders like endometriosis and recurrent pregnancy loss. An exploration of the meaning and role of the concepts of empathy and sympathy in Herder’s thought, showing that the two concepts permeate his entire philosophy.

An axiomatization of the so-called Teleparallel Equivalent to General Relativity is presented. A set of formal and semantic postulates are elaborated from where the physical meaning of various key concepts of the theory are clarified. These concepts include those of inertia, Lorentz and diffeomorphism invariance, and reference frame. It is shown that Teleparallel Gravity admits a wider representation of space-time than General Relativity, allowing to define properties of the gravitational field such as energy and momentum that are usually considered problematic. (...) In this sense, although the dynamical equations of both theories are equivalent, their inequivalence from a physical point of view is demonstrated. Finally, the axiomatic formulation is used to compare Teleparallel Gravity with other theories of gravity based on absolute parallelism such as non-local and f(T) gravity. (shrink)

This special issue looks at some of the ways that images are adopted, co‐opted, and adapted in the life sciences and beyond. It brings together papers that investigate the role of visualization in scientific knowledge‐production with contributions that focus on the distribution and dissemination of knowledge to a broader audience. A commentary provides a critical perspective. In this editorial we introduce circulation as a practice to better understand scientific images. Along two themes, we highlight connections across the papers. First, the (...) social life of scientific representation follows the contexts, settings, and spaces through which images circulate. Second, authorship, expertise, and trust inform the capacity and the failure of images to circulate. Altogether, this volume raises a set of new questions about circulation as practice in the historiography of images in the life sciences. (shrink)

Para la estética, la creatividad es la emergencia del instante que la vuelve irrepetible o un transitar pendular que la hace resurgir como reminiscencia cegada por un ocaso repetitivo. Haciendo coincidir proceso y teleología, Peirce aglutina estas dos dimensiones, sin atisbar realmente un atisbo de humanidad para disfrutar de lo ínfimo. De ahí que propongamos un momento oportuno que nos dirija hacia una temporalidad más humana.

Psychosomatic medicine, with its prevailing biopsychosocial model, aims to integrate human and exact sciences with their divergent conceptual models. Therefore, its own conceptual foundations, which often remain implicit and unknown, may be critically relevant. We defend the thesis that choosing between different metaphysical views on the ‘mind–body problem’ may have important implications for the conceptual foundations of psychosomatic medicine, and therefore potentially also for its methods, scientific status and relationship with the scientific disciplines it aims to integrate: biomedical sciences, psychology (...) and social sciences. To make this point, we introduce three key positions in the philosophical ‘mind–body’ debate and investigate their consequences for the conceptual basis of the biopsychosocial model in general and its ‘psycho-biological’ part in particular. Despite the clinical merits of the biopsychosocial model, we submit that it is conceptually underdeveloped or even flawed, which may hamper its use as a proper scientific model. (shrink)

The paper discusses some of the poorly explored links between the conceptual systems of logic in Kurt Gödel, the theory of automata in Alan Turing, and the theory of self-reproducing automata in John von Neumann. Traditional controversies are left aside (especially the opposition of Gödel and Turing in the view of mind) and attention is focused on the similarities between all three authors. In individual chapters, the text deals with: the form of differentiation of syntax and semantics in formal system (...) in Gödel, Turing and von Neumann; von Neumann’s variant of Gödel’s theorem and von Neumann’s and Gödel’s conception of Turing machine; and finally the same basis of the view of the relation between mind and automaton in all three authors. I discuss the ontological assumptions and implications of General Relativity. I maintain that General Relativity is a theory about gravitational fields, not about space-time. The latter is a more basic ontological category, that emerges from physical relations among all existents. I also argue that there are no physical singularities in space-time. Singular space-time models do not belong to the ontology of the world: they are not things but concepts, i.e. defective solutions of Einstein’s field equations. I briefly discuss the actual (...) implication of the so-called singularity theorems in General Relativity and some problems related to ontological assumptions of Quantum Gravity. (shrink)

It is a remarkable fact that all processes occurring in the observable universe are irre- versible, whereas the equations through which the fundamental laws of physics are formu- lated are invariant under time reversal. The emergence of irreversibility from the funda- mental laws has been a topic of consideration by physicists, astronomers and philosophers since Boltzmann's formulation of his famous \H" theorem. In this paper we shall discuss some aspects of this problem and its connection with the dynamics of space-time, (...) within the framework of modern cosmology. We conclude that the existence of cosmological horizons allows a coupling of the global state of the universe with the local events deter- mined through electromagnetic processes. (shrink)

In a series of recent papers, two of which appeared in this journal, a group of philosophers, physicists, and climate scientists have argued that something they call the `hawkmoth effect' poses insurmountable difficulties for those who would use non-linear models, including climate simulation models, to make quantitative predictions or to produce `decision-relevant probabilites.' Such a claim, if it were true, would undermine much of climate science, among other things. Here, we examine the two lines of argument the group has used (...) to support their claims. The first comes from a set of results in dynamical systems theory associated with the concept of `structural stability.' The second relies on a mathematical demonstration of their own, using the logistic equation, that they present using a hypothetical scenario involving two apprentices of Laplace's omniscient demon. We prove two theorems that are relevant to their claims, and conclude that both of these lines of argument fail. There is nothing out there that comes close to matching the charac. (shrink)

(From editorial:) This volume aims to refute the disparaging image of scholastic philosophy as a rather homogeneous tradition of commentaries on Aristotle lacking in originality. Although Aristotelianism was, of course, a very important philosophical paradigm among the scholastics, their works also evince many features and tenets of Platonic or Augustinian origin. Several issues characteristic for Platonism and Augustinianism are discussed in this volume – for example, the role of attention in perception, the extramissionist theory of vision, the metaphysics of light, (...) the illumination theory, the fi rst-person perspective, and self-refl ection. The topics investigated primarily in Aristotelianism include the ontology of sensibles, their causal effi cacy, the role of the medium, and the distinction between the internal senses. (shrink)

The demand for meat and dairy products is expected to rise significantly in the current demographic and economic growth context. Concurrently, various factors, including financial crises and reduced profitability, have decreased the number of livestock farms. Consequently, the livestock industry is undergoing intensification, with an increased number of cows per farm. This shift makes the management of animals increasingly complex. Amid these challenges, the society’s growing concern for animal health and welfare and the quality of consumed products underscores the importance (...) of systems that aid in the individual and herd-level monitoring and control within livestock operations. In this scenario, precision livestock farming has become essential with the emergence of new sensors and technologies and the evolution of artificial intelligence. Against this backdrop, this paper reviews systems and techniques used in precision livestock farming to detect anomalies caused by reproductive processes and diseases in dairy and beef cattle. The article analyzes sensors and technologies employed, presents key studies conducted, and discusses the most commonly used artificial intelligence techniques in detecting prevalent anomalies. RESUMEN Nos adentramos en esos procesos de subjetivación en los que el músico de jazz experimenta en sí otras formas de corporalidad, que se dirimen entre sujeción a esquemas y ruptura de los corsés por una teatralidad en escena. Aparentemente, en la improvisación prima lo subversivo y la reificación del músico como autor libre; sin embargo, observamos empíricamente una corporalidad plural que trasciende el espacio de la escena y que facilita que todos los actores intervengan en el proceso de creación. (...) Hallamos una red de solidaridad que desplaza continuamente los puntos fijos por donde transita la música; así, cuando a un músico le falta el aire, su compañero le da el relevo. Si lo fundamental en la praxis de la música son las continuas alternativas que ofrece, concluimos con una reflexión ética sobre la naturaleza transitoria de la música y su temporalidad kairológica, en la que el músico, sintiendo la brevedad del instante de la nota que muere cuando nace, se reencuentra con lo insignificante de la que está hecha su condición humana. ABSTRACT We enter these processes of subjectivation in which the jazz musician experiences in himself other forms of corporeality, which are settled between subjection to schemes and breakup of the corsets by a theatricality on stage. Apparently, in improvisation what is subversive and the reification of the musician as a free author take priority; nevertheless, we empirically observe a plural corporeality that goes beyond the space of the scene and that facilitates that all the actors take part in the process of creation. We found a solidarity network that continuously displaces the fixed points where music circulates; thus, when a musician is short of breath, his partner takes over. If what is fundamental in the praxis of music is the continuous alternatives it offers, we conclude with an ethical reflection on the transitory nature of music and its kairological temporality, in which the musician, feeling the briefness of the instant of the note that dies when it is born, joins the insignificance of his human condition.
