Este artigo apresenta de modo bastante sucinto alguns lances da leitura barbarasiana de Merleau-Ponty e o tournant que, em face dessa obra, levou Barbaras a uma “fenomenologia da vida”.

O artigo sustenta que uma alternativa fecunda de leitura da obra de Lefort é tomá-la a partir de uma oposição entre filosofia da história e filosofia política. Pois, aparentemente, a filosofia política madura de Lefort só se constitui a partir do momento em que ele se liberta da possibilidade da filosofia da história.

Este artigo investiga o conceito sartriano de negação procurando mostrar o aspecto nuclear desse conceito na fenomenologia de Sartre.

Este texto pretende mostrar a crítica de Merleau-Ponty à ontologia do ser e do nada de Sartre. Contra o modelo da contradição, típica dessa ontologia, Merleau-Ponty retoma a noção kantiana de grandeza negativa e o seu modelo de oposição real.

Este texto investiga a passagem sartriana à filosofia primeira. O mérito maior da fenomenologia – a superação da querela entre realismo e idealismo – será comprometido pelo pensamento ulterior de Husserl, caracterizado como “idealista”. Recusando o conceito de noema irreal, Sartre procurará retomar os “verdadeiros princípios” da fenomenologia, reinaugurando o discurso da filosofia primeira.

Este artigo busca compreender qual o estatuto que a ideia de fundamento recebe na filosofia de Sartre enquanto uma ontologia existencial, isto é, enquanto uma filosofia que compreende o homem em sua finitude. Para isso, procura realizar uma análise da presença da Metafísica, sobretudo em O Ser e o Nada, com relação ao problema metafísico desenvolvido na obra: o surgimento do nada no ser. Por fim, procura, por meio desta análise, compreender o estatuto da finitude na mesma obra.

No ano de 2023, foi lançado, pela Editora Alameda, de São Paulo, Hume, a justiça e o pensamento político moderno. Esse volume da DoisPontos, dedicado a tema de mesma natureza, “Poder e Direito”, produziu pequeno dossiê sobre o livro, com considerações de diferentes leitores.

Uma investigação sobre "a judicialização da política e a politização do judiciário" restrita ao bom funcionamento do "Estado de Direito" se veria presa dos prejuízos que a própria ideia de "Estado" acarreta, consubstanciados na teoria que lhe dá suporte, a teoria da soberania. É preciso escapar ao "estadocentrismo" e um dos modos de fazê-lo é investigar as noções de "poder" e de "direito". Neste artigo, investigamos essas noções em Merleau-Ponty e Lefort.

Na edição passada da Kínesis enunciamos que uma das intenções desta revista era apresentar pesquisadores que tinham seu nome vinculado a pesquisas sobre temas filosóficos contemporâneos. Sendo assim, nesta edição entrevistaremos o Prof. Dr. Luiz Damon Santos Moutinho. Damon, como é conhecido, trata-se de um importante pesquisador da filosofia contemporânea francesa no Brasil. Seu foco de interesse é a Fenomenologia donde se preocupa em discutir temas como os da percepção, ontologia e mundo vivido. As provocações de Damon levaram Giannotti a acentuar ou corrigir algumas de suas ideias. Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Este artigo tem como objetivo elucidar as diversas formas de violência vivenciadas pela população transgênera no Brasil, centrando-se nos desafios e nas dificuldades que encontram no âmbito educacional. Estudos comprovam reiterados processos de discriminação, ódio, preconceito e abandono familiar e social envolvendo esse grupo, o que o expõe a situações degradantes de vida e viola a Declaração Universal dos Direitos Humanos, construída sob a premissa de que a sociedade deve ser capaz de garantir justiça, vida e liberdade. Contudo, na contramão (...) desse tratado, a violência contra a população trans tem se manifestado em todos os espaços da sociedade brasileira de modo implícito e/ou explícito, reproduzindo-se nas instituições educacionais. Em que pese a natureza dessa instituição – locus por excelência do estímulo à pluralidade de ideias, culturas, jeitos de ser e fazer, portanto, lugar de encontro, acolhimento e formação humana – a escola tem reproduzido a cisnormatividade, ou seja, validando normas, regras e valores considerados adequados e normais pela sociedade burguesa, infringindo, dessa forma, o respeito à diversidade sexual e de gênero, à transgeneridade. Esse cenário requer esforços contínuos dos movimentos sociais, das instituições e da sociedade civil para garantir os direitos sociais e o respeito à população transgênera, além de nos provocar a seguir questionando as hipocrisias, criando transgressões e filosofando, como sugere Noel Rosa em sua composição “Filosofia”. A proposta que se insere neste artigo é a de ampliar a discussão sobre a presença da Filosofia na Educação Básica, a partir das formulações propostas pela Base Nacional Comum Curricular, instituídas a partir do Parecer CNE n. 15/2017 e da Resolução CNE n. 2/2017 e suas relações com o Exame Nacional do Ensino Médio, realizado, anualmente, pelo Instituto Nacional de Estudos e Pesquisas Educacionais Anísio Teixeira, órgão vinculado ao Ministério da Educação e aplicado a estudantes e egressos do sistema (...) educacional brasileiro, ou seja, o exame é de adesão voluntária e se propõe a avaliar os conhecimentos que os inscritos indicam saber sobre os conteúdos apreendidos durante os anos finais de formação na Educação Básica. O estudo utiliza a investigação exploratória e tem como objetivo estudar os resultados do Enem entre os anos 2013 e 2018, seu histórico, suas dinâmicas e propor uma análise sobre a avaliação do desempenho escolar por meio de habilidades e competências. Busca-se, também, compreender as avaliações externas, seus aspectos históricos e sua evolução com base em autores como Borges e Rothen, Ferreira, Minhoto, Oliveira, Soares, Vieira, entre outros, além das normativas legais que impactam e regulam as ações do microespaço da sala de aula. As análises indicam que a disciplina de Filosofia, possivelmente, desaparecerá do currículo escolar, uma vez que seus conteúdos se encontram diluídos nos chamados itinerários formativos dentro das disciplinas de Ensino Religioso e de História, reforçando a afirmação de Soares de que as “demandas socialmente úteis ao sistema capitalista tendem a fortalecer ideias perigosas, como a possível extinção dos cursos de Ciências Humanas dos currículos, bem como afasta a educação de sua prerrogativa fundamental, que é educar para a emancipação”. Resumo: Neste artigo, pretendemos trabalhar, a partir de uma leitura de Zizek e Lacan, a perspectiva radical de liberdade como superação da dialética entre a Lei moral kantiana e o gozo sádico. Para isso, procuramos primeiramente mostrar como Lacan articula a relação de Kant com Sade, para, em seguida, pensar como, segundo Zizek, o psicanalista encontra uma saída para o princípio de liberdade kantiana, a partir da ética do desejo puro, o que nos permitirá pensar um Kant sem Sade.: In (...) this article, based on a reading of Zizek and Lacan, we discuss the radical perspective of freedom as an overcoming of the dialectic between the Kantian moral law and sadistic joy. We first try to show how Lacan articulates Kant's relationship with Sade, and then consider how, according to Zizek, the psychoanalyst finds an outlet for the Kantian principle of freedom based the ethics of pure desire, which allows us to think of a Kant without Sade. We, therefore, inquisitively direct sole attention to social spacetime in which, and by which, labour in totality takes place. And then consider the division of labour in natural spacetime as just the appearance of the alienation of labour in social spacetime by our Marxist renewal of the notion of labour - thus (...) manifesting its benefaction to an essential up-to-date explanation of human being, on which a labourer could struggle to survive as still a human being within social spacetime, to fight against the almighty empire of capitalism in the era of globalisation. RESUMO A compreensão da maioria dos estudiosos acerca do trabalho é ambígua em razão da variedade de contradições filosóficas embutidas no fato de suas teorias plausíveis não serem explicitamente declaradas, mas presumidas de modo irracional. Nós, assim, inquisitivamente, dirigimos nossa total atenção ao espaço-tempo social no qual, e através do qual, o trabalho ocorre, em sua totalidade. This study uses three audit-specific ethical dilemmas to assess the level of ethical reasoning between Chinese accounting students (as proxies for new entrants to the auditing profession) and experienced auditors. A sample of U.S. accounting students is used as a base for comparison. Consistent with expectations based on particularly salient aspects of Chinese national culture, we find the Chinese students’ levels of ethical reasoning to be significantly lower than those of their U.S. counterparts in the two cases that invoked these (...) cultural attributes. In contrast, the Chinese students’ level of ethical reasoning is slightly higher than that of the U.S. students in the third, control case. We further find that the Chinese auditors’ levels of ethical reasoning are even lower than those of the Chinese students in two cases, while not being significantly different in the third. Together, these findings suggest that cross-national differences in auditors’ ethical reasoning depend on the nature of the ethical dilemma and caution against wholesale inferences about ethical reasoning levels in China. Construal-level theory emphasizes that representing events at greater spatial, temporal, social, or hypothetical distance results in processing information at high construal levels (more conceptual, abstract). We posit that psychological distance and construal level are somewhat separable constructs, and can have different effects on emotion, and therefore, emotion regulation. We argue that psychological distance influences emotional appraisal, such that increasing distance results in lower emotion intensity, which can be leveraged to down-regulate emotions. However, we consider construal level a mindset, which can (...) occur with either high or low psychological distance. Furthermore, we argue that compared with psychological distance, construal level has a more nuanced relationship with emotion, and changing construal level for the purpose of changing emotion also requires considering the construal level of one's emotion-regulation goals. I examine communitarian social theory with an eye to suggesting that the form it most often takes contains resources insufficient to satisfy the aims of those who propose it. This is shown to be the case through an analysis of the writings of Johann Gottfried Herder , the first philosophically rigorous communitarian in the West. Herder's communitarianism, like that of so many of our contemporaries, combines a description of what he believes to be man's ineradicably communal nature with a normative (...) longing for an experience of community we have supposedly lost. But unlike today's communitarians, who usually propose ways for modern man to reattain primordial happiness in communal particularism, Herder became convinced that he could only satisfy his normative longing for community by supplementing his descriptive communitarianism with a radically universalistic theology that took the form of a providential philosophy of history. I conclude that Herder's attempt to fashion a new, humanistic religion as a means to making it possible for him to "live" his communitarianism has much to teach contemporary communitarians as well as their critics. MODERN GERMAN PHILOSOPHY PRESENTS A PECULIAR PUZZLE to the historian of ideas. For most of the early modern period, philosophers throughout Europe had allied themselves with the Enlightenment in its self-proclaimed struggle against dogma, superstition, and ignorance. Yet beginning in late eighteenth century Germany, this situation began to change—so much so that by the early decades of the twentieth century, Germany had become the undisputed home of the philosophical Counter-Enlightenment. If today the most celebrated Counter-Enlightenment figures hail from France or (...) Italy, that should not obscure the fact that the ideas of such authors as Derrida and Foucault, Vattimo and Virilio descend directly from the writings of Nietzsche and Heidegger. All of these theorists are united in their opposition to the Enlightenment and what they see as its detrimental social and political effects in the modern world. Moreover, all of them deny the core assumptions of the Enlightenment: the possibility and goodness of rational discourse dispelling darkness and mystery from human life. Hence, their writings tend to take the form of deconstructive commentaries on seminal texts from the Western philosophical and literary traditions or radically critical analyses of the social and intellectual practices common to the post-Enlightenment world. Above all, these works claim to show that what might superficially appear to be examples of disinterested argument and rational impartiality in those texts and practices are, instead, attempts at violating, marginalizing, delegitimizing, and dominating the “other”—with the “other” defined as the nonrational, unusual, different, or abnormal dimensions of human life and experience. The role of the Counter-Enlightenment theorist is to liberate the “other” from its subjugation at the hands of reason by exposing the myriad ways in which all supposedly enlightened discourses and practices are themselves permeated by the “other” and thus always one step away from collapsing under the weight of their own incoherence. In other words, Counter-Enlightenment philosophy seeks to expose reason’s own inevitable and fatal dependence upon unreason. (shrink)

The paper examines the emphasis on knowing the inner life of Jesus by a prominent 19th century Liberal Protestant, and Albert Schweitzer's decisive blow to the Life of Jesus movement at the beginning of the 20th century. It gives critiques to both the former and the latter, and identifies the approach of the Liberal Protestants as ‘subjective’ in two senses. While the subjectivity of an interpreter can pose problems in the interpretation of Jesus, it is maintained that the possibility of (...) knowing some aspects of the subjectivity of Jesus cannot be ruled out a priori. A method of correlation is suggested to give a more objective and connected interpretation of Jesus' outer words/actions and his mind. (shrink)
