Schlusslogische Letztbegründung is a collection of essays in honor of Kurt Walter Zeidler. Mr. Zeidler is a distinguished Kant- and Neo-Kantian-scholar who has reconstructed Kant's concept of transcendental logic in connection with the logic of the concept of Hegel and the logic of symbolization of Peirce. (cf. Zeidler: Grundriss der transzendentalen Logik, 3rd ed., Wien 2017) He has most notably inquired intensively into the relation of transcendental logic to philosophy of science (cf. Zeidler: Prolegomena zur Wissenschaftstheorie, Wien 2000) and to (...) phenomenology (cf. Zeidler: Vermittlungen. Zum antiken und neueren Idealismus, Wien 2016). He has also published several studies on Neo-Kantianism (cf. Zeidler: Provokationen. Zu Problemen des Neukantianismus, Wien 2018). This is refelected in the collection of essays by distinguished scholars who discuss and critically examine Zeidler's work. This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. The moral assessment of this trade-off is related to the context of application—to the consequences of inaccurate risk predictions in the insurance domain. (shrink)

This article presents critical psychology in some new light. First, it presents the history of US critical psychology in terms of the overall foundation of its critique (identity-based, ideologically-based, and epistemologically-based). Second, it broadens the population that can be called critical psychologists. The argument is made to include: (1) philosophers of language, science, and mind critical of psychology’s foundational assumptions, conceptions, and methods of inquiry; and (2) non-professional, ordinary people who live their lives critical of psychology by eschewing mainstream approaches (...) and taking alternative routes to getting help with their emotional and physical pain, or the education of their children. This article reconstructs the development of Kurt Walter Zeidler's argument for a reformulation of Kant's transcendental dialectic as a theory of the foundation of transcendental logic. It therefore examines his doctoral dissertation "Logik des Erkenntnisprozesses. Dedukton - Induktion - Abduktion" (1979), where he discusses Norwood Russell Hansons 'logic of discovery' and finds an analogy between Charls S. Peirce's definiton of 'abduction' and Hegel's defintion of 'analogy', as well as his early papers, collected in "Grundlegungen. Zur Theorie der Vernunft und Letztbegründung" (...) (2015), and his habilitation dissertation "Vernunft und Erfahrung. Untersuchungen zum Erkenntnisproblem in Philosophie und Wissenschaftstheorie" (1986), where he first seeks to verify the claim of Hegel and Peirce, that the synthetical unity of apperception is to be analyzed as a unity of three forms of syllogism corresponding to Aristotle's three figures of syllogism, through a close study of Kant's transcendental deduction of the categories as well as of the transcendental ideas, before he comes to reformulate these deductions in the light of the original unity of sensuality and understanding. The development of this argument is critically examined in three respects, first, in reference to Zeidler's reading of Peirce, Hegel and Schelling, second, with respect to Zeidler's analysis of scientific rationality as well as of the architectonic of the Critique of pure reason, and third, in view of the influence of Erhard Oeser and Erich Heintel on Zeidler's thought. Trust and monitoring are traditionally antithetical concepts. Describing trust as a property of a relationship of reliance, we introduce a theory of trust and monitoring, which uses mathematical models based on two classes of functions, including _q_-exponentials, and relates the levels of trust to the costs of monitoring. As opposed to several accounts of trust that attempt to identify the special ingredient of reliance and trust relationships, our theory characterizes trust as a quantitative property of certain relations of reliance that (...) can be quantified and expressed as a scalar quantity. Our theory is applicable to both human–human and human–artificial agent interactions, as it is agnostic with respect to the concrete realization of trustworthiness properties, and is compatible with many views differing on which properties contribute to trust and trustworthiness. Finally, as our mathematical models make the quantitative features of trust measurable, they provide empirical studies on trust with a rigorous methodology for its measurement. (shrink)

Luciano Floridi was not the first to discuss the idea of group privacy, but he was perhaps the first to discuss it in relation to the insights derived from big data analytics. He has argued that it is important to investigate the possibility that groups have rights to privacy that are not reducible to the privacy of individuals forming such groups. In this paper, we introduce a distinction between two concepts of group privacy. The first, the “what happens in Vegas (...) stays in Vegas” privacy (in the following: WHVSV privacy), deals with confidential information shared with the member of a group and inaccessible to (all or a specific group of) outsiders. The second, to which we shall refer as inferential privacy, deals with the inferences that can be made about a group of people defined by a feature, or combination thereof, shared by all individuals in the group. We show why we unreservedly agree with Floridi that groups can have a form of privacy that amounts to more than the mere fact of being sets of individuals each of whom has individual privacy; moreover, like Floridi, we find it plausible that at least some groups (those satisfying our definition of type-a groups) may have a right to a species of group privacy (that is, WHVSV privacy) as groups (and not just as individuals who belong to those groups). However, by turning our attention to the context of big data analytics, we show that the relevant, new notion of group privacy is one of inferential privacy. We argue that an absolute right (either of individuals or groups) to inferential privacy is implausible. We also show that many groups generated algorithmically (those satisfying our definition of type-b groups) cannot be right holders as groups (unless they become type-a groups). (shrink)

There has been a lively debate amongst political theorists about whether certain liberal concepts of democracy are so idealized that they lack relevance to ʹrealʹ politics. Echoing these debates, Lois McNay examines in this book some theories of radical democracy and argues that they too tend to rely on troubling abstractions - or what she terms ʹsocially weightlessʹ thinking. They often propose ideas of the political that are so far removed from the logic of everyday practice that, ultimately, their (...) supposed emancipatory potential is thrown into question. Radical democrats frequently maintain that what distinguishes their ideas of the political from others is the fundamental concern with unmasking and challenging unrecognized forms of inequality and domination that distort everyday life. But this supposed attentiveness to power is undermined by the invocation of rarefied models of political action that treat agency as an unproblematic given and overlook certain features of the embodied experience of oppression. The tendency of radical democrats to define democratic agency in terms of dynamics of perpetual flux, mobility and agonism passes over too swiftly the way in which objective structures of oppression are often taken into the body as subjective dispositions, leaving individuals with the feeling that they are unable to do little more than endure a state of affairs beyond their control. -- Back cover. Friedrich Adolf Trendelenburg war einer der akademischen Lehrer Hermann Cohens und die Debatte zwischen Trendelenburg und Kuno Fischer über die Interpretation der transzendentalen Ästhetik gilt gemeinhin als Anlass für Cohens Kantstudien und seine Abwendung von der Völkerpsychologie und damit als Geburtsstunde des Marburger Neukantianismus. Über die nähere persönliche Beziehung Cohens zu Trendelenburg ist allerdings wenig bekannt und auch die Frage, ob und inwiefern Cohen als „Schüler“ Trendelenburgs bezeichnet werden kann ist nicht eindeutig zu beantworten, zumindest scheint Cohens Verhältnis zu Trendelenburg (...) eher distanziert gewesen zu sein und es ist nicht klar, ob nicht Cohens Trendelenburg gegenüber teilweise auch kritische Haltung in seiner Stellungnahme zur Kontroverse zwischen Trendelenburg und Fischer auch zum Scheitern seiner Habilitationsversuche in Berlin beigetragen hat. Andererseits wurde darauf hingewiesen, dass sich Cohen durch die von Trendelenburg aufgeworfene Frage, ob Kant die ausschließliche Subjektivität von Raum und Zeit bewiesen habe, vor das für seine Philosophie und Kantkritik zentrale Problem einer nicht bloß „subjektiven“ Begründung des Idealismus gestellt sah und diesbezüglich (in Abgrenzung von Kuno Fischer und Friedrich Albert Lange) im wesentlichen Trendelenburgs Absicht, „das Ideale im Realen zu befestigen“, weiterverfolgte (Klaus Christian Köhnke). Kurt Walter Zeidler hat diese These vor kurzem insofern zugespitzt, als er zu dem Schluss kommt, dass Cohen „seine eigene systematische Position – und damit die Grunddoktrin der Marburger Schule – an dem Leitfaden einer Kantinterpretation entwickelt, die Trendelenburgs latenten Platonismus, seine Lehre von der ursprünglichen Tätigkeit und konstruktiven Bewegung sowie den wissenschaftstheoretischen Ansatz seiner Logischen Untersuchungen gleichsam als Hebel einsetzt, um Kants Lehre von allen Anmutungen eines empirischen oder subjektiven Idealismus zu befreien.“ Diese These wird mit Blick auf Cohens frühe Kant- und Platon-Interpretation überprüft und der historische und biographische Kontext von Cohens Berliner Studienzeit skizziert. The widespread use of algorithms for prediction-based decisions urges us to consider the question of what it means for a given act or practice to be discriminatory. Building upon work by Kusner and colleagues in the field of machine learning, we propose a counterfactual condition as a necessary requirement on discrimination. To demonstrate the philosophical relevance of the proposed condition, we consider two prominent accounts of discrimination in the recent literature, by Lippert-Rasmussen and Hellman respectively, that do not logically imply (...) our condition and show that they face important objections. Specifically, Lippert-Rasmussen’s definition proves to be over-inclusive, as it classifies some acts or practices as discriminatory when they are not, whereas Hellman’s account turns out to lack explanatory power precisely insofar as it does not countenance a counterfactual condition on discrimination. By defending the necessity of our counterfactual condition, we set the conceptual limits for justified claims about the occurrence of discriminatory acts or practices in society, with immediate applications to the ethics of algorithmic decision-making. Hermann Cohen hat mit seiner wissenschaftslogischen Kantinterpretation und programmatischen Orientierung der Erkenntnislehre am ‚Faktum der Wissenschaft‘ das Verständnis von transzendentaler Logik bis in die Gegenwart maßgeblich mitgeprägt. Der zentrale Punkt seiner Kantinterpretation ist die Identifikation der „transzendentalen Methode“ mit der „regressiven Lehrart“ der Prolegomena und damit die Ersetzung der metaphysischen Deduktion der Kategorien durch eine wissenschaftstheoretische Rekonstruktion der synthetischen Grundsätze der mathematischen Naturwissenschaft. Im vorliegenden Aufsatz wird versucht im Anschluss an grundlegende Arbeiten von Kurt Walter Zeidler, die von Cohen in (...) Kants Theorie der Erfahrung (1871, 2. Aufl. 1885) entwickelten Argumente für diese Interpretation und die ihr zugrundeliegenden Motive darzulegen und sowohl mit Blick auf Kants eigene methodologische Ausführungen in den Prolegomena und der Kritik der reinen Vernunft als auch mit Blick auf das von Cohen in der Logik der reinen Erkenntnis (21914) als „härtestes Problem der Logik“ bezeichnete Problem der Vermittlung von Einzelnem und Allgemeinem kritisch zu hinterfragen. My essay consists of three parts. In the first section, I review the historical context of Baroque aesthetics as it is developed during the late 16th and 17th centuries in Europe and then I track its development in Latin America into the third quarter of the 18th century. The principled excess of the Baroque, to adapt Cyrano de Bergerac’s formulation cited below, was designed for theological and imperial purposes. Secondly, I address more recent literature and literary theory. Why, in the (...) early 20th century, did Latin American poets, novelists, essayists and critics begin to rediscover, recover and reconstitute Baroque modes of expression? What was it about this Catholic, monarchical, colonizing aesthetic that now seemed suited to postcolonial purposes? I refer to several theorists and writers who pioneered and/or inspired the 20th-century idea of the New World Baroque as a rebellious retort to Europe rather than a passive reflection. My third section considers how to teach the politics of Baroque aesthetics, and why Baroque aesthetics remains relevant today. (shrink)

The concept of the digital phenotype has been used to refer to digital data prognostic or diagnostic of disease conditions. Medical conditions may be inferred from the time pattern in an insomniac’s tweets, the Facebook posts of a depressed individual, or the web searches of a hypochondriac. This paper conceptualizes digital data as an extended phenotype of humans, that is as digital information produced by humans and affecting human behavior and culture. It argues that there are ethical obligations to persons (...) affected by generalizable knowledge of a digital phenotype, not only those who are personally identifiable or involved in data generation. This claim is illustrated by considering the health-related digital phenotypes of precision medicine and digital epidemiology. (shrink)

This paper shows how the mythology surrounding rape enters into a criterion of reasonableness which operates through the legal system to make women vulnerable to unscrupulous victimization. It explores the possibility for changes in legal procedures and presumptions that would better serve women's interests and leave them less vulnerable to sexual violence. This requires that we reformulate the criterion of consent in terms of what is reasonable from a woman's point of view.

In today’s multi-cultural world and global economy, attention is often focused on the diversity of cultural values and practices and the need for management approaches to take these differing cultural environments into account. While there is much to be valued in this approach, the focus is often on how to navigate through distinct cultural practices in order to achieve a singular business aim, which falls within the current neoliberal paradigm of global trade. In addition, by focusing on differences in cultural (...) practices, rather than on similarities in underlying values, this approach fails to utilize an important way to achieve a greater degree of global integration in management. Despite striking cultural differences, it is possible to identify some enduring values that underlie what often appear to be quite discrete value paradigms, especially by looking at value paradigms that have endured for centuries, even millennia. This paper proposes to explore the values embedded in two such value paradigms or religious traditions, zen buddhism and Judaism, describing crucial core values in each and comparing and contrasting their ethical frameworks, in order to be able to evaluate their utility in today’s world and especially their significance for creating a more holistic, inclusive, and responsible management framework. The paper will begin by explicating the set of foundational values in each religious tradition. For example, zen buddhism, especially as expressed by Vietnamese monk Thich Nhan Hanh, utilizes the concepts of engaged mindfulness and inter-being to demonstrate the ways in which all global issues are linked together, and the collective responsibility that all humans bear for the state of our planet and the beings who live on it. This approach is inherently holistic and inclusive, and requires a management approach that takes into account the moral responsibility that we all carry. Likewise, the Jewish tradition, while using quite different terminology, also lays out a holistic and inclusive moral vision. Key concepts include the values of Tikkum Olam, to repair the world, and Tsedakah, which literally means justice or righteousness, but is commonly used to indicate charitable giving. The first value, to repair the world, emphasizes the collective moral responsibility to heal whatever damage has been done to the world in order to make the it a better place for all. It does not matter who has done the damage; what matters is each person’s obligation to improve the status quo, under the assumption that all our fates are linked together. The second value, justice and charity, is also considered to be a moral obligation, not simply a voluntary act of charity. The emphasis here is on anonymous giving, done in order to help others and without any expectation of receiving some benefit, such as positive publicity. As a moral obligation, it is not something that one should benefit from. Thus, the concept of tsekakah also emphasizes the inter-connectedness of all humanity. In addition, in the Torah, there are a series of rules about how to deal with others in business as well as the obligation, during harvest-time, to leave some grain in the fields for the less fortunate. In all, we see a focus on being mindful of others, on seeing our fates as interconnected, as in zen buddhism. The last section of the paper will explore some of the ways in which these moral imperatives can be utilized to undergird and buttress a more holistic, inclusive and responsible management approach. Some management models already include moral imperatives, such as corporal social responsibility, and this section will explore in greater detail how the above concepts have been more fully integrated into current management models. I conclude that it is more accurate to say that, rather than trying to make logic metaphysical, Leibniz tries, in the context of a theistic system, to make metaphysics logical. ;I begin with a study of the principle of identity of indiscernibles, and show how it is best thought of as a principle which follows from a metaphysical interpretation of the principle of sufficient reason. It has been traditional to interpret the principle of identity of indiscernibles as primarily a merely (...) logical principle, and thus as either trivially true, if Leibniz succeeds in proving it, or else false or contingently true. I argue that it is instead necessarily true in a non-trivial or metaphysical sense, because the principles on which it is based are themselves of this metaphysical character, contrary to what is often assumed. ;In the second chapter, I show how God's activity and a metaphysical interpretation of the principle of sufficient reason underlie Leibniz's account of space and time. ;In the third chapter, I discuss the principle of sufficient reason in detail, showing that it actually consists of three separate principles: the principle of grounds, that every true proposition has a proof a priori; the principle of reason, that God does nothing without a sufficient reason; and the principle of causation, that every event has a cause. That each of these is considered a principle of sufficient reason is explained by Leibniz's equivocal use of the term 'reason.' I show that, of the various versions of the principle of sufficient reason, only the principle of reasons provides an adequate foundation for Leibniz's principle of identity of indiscernibles and theory of space and time. Furthermore, since chapters one and two show how the activity of God is presupposed by Leibniz's metaphysics, for Leibniz to derive his metaphysics from his logic, as some would have us suppose, he would have to provide a satisfactory a priori demonstration of God's existence. But this, I argue, he cannot do. Thus God's existence and rationality, rather than subject-predicate logic, are the foundations of Leibniz's metaphysics. ;It is commonplace, when writing about Leibniz, to give primacy to his logic over his metaphysics, and indeed to try to assimilate the latter to the former. In this essay, however, I give priority to Leibniz's metaphysical pronouncements, apart, as much as possible, from logical and linguistic considerations. (shrink)

This paper focuses on the idea of exemplarity outlined by the Italian critical theorist Alessandro Ferrara that forms part of his general case for the centrality of disclosure to emancipatory political reasoning. Ferrara argues that “at its best” political thought should have the capacity to animate the democratic imagination by disclosing new political worlds and hence new possibilities for thought and action. I argue that Ferrara’s notion of exemplarity provides important conceptual resources for a re-grounding of critical theory in the (...) type of experientially based disclosing critique that has, post Habermas, been marginalized. Ferrara’s work is significant in two respects. First, exemplary universalism provides a much-needed alternative to the assimilative paradigms of normative reasoning that dominate contemporary political theory. The relation between leibniz's logical and his metaphysical views is the subject of much modern scholarship. Some commentators have argued that his metaphysics is based on his logic; others have taken the opposite position. However, Both sides pose the question in terms of 'priority'. On the contrary, I argue that it is likely that leibniz means the psr to play "both" a logical and a metaphysical role. The ambiguity of leibniz's psr indicates that he equates the metaphysical notion of causation (...) with the logical notion of deduction. The psr's ambiguity results less from any confusion on leibniz's part between the notions of cause and reason, Than from his desire to identify logic and metaphysics. That identity is achieved not by reducing one to the other, But by incorporating them on an equal basis into a single discipline. (shrink)

This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. Thinking with, against, and after Ernst Käsemann’s appropriation of the biblical metaphor of eschatological birth pangs, this article seeks to reassess our understanding of what it means to be a theologian of the cross. It does so by way of a depiction of Paul’s apostolic practice as a social and embodied—and yet cruciform—mode of epiphanic manifestation. Thinking with Käsemann, it brings to the fore the significance of this apocalyptic understanding of apostolic practice for contemporary theological reflection at the interface of (...) biblical studies, philosophy, and ethics. Thinking against Käsemann, it demonstrates ways in which this reading of Paul enables us to address more effectively major criticisms of a theology of the cross and Pauline theology in general. Finally, thinking after Käsemann, it discusses the ways that this portrayal of Paul’s practice funds resources for reconfiguring theological education ‘after whiteness’. (shrink)

This article aims to provide a comprehensive and systematic understanding of the awareness of both officials and the public regarding the government's people's mobilization work (PMW) in Dong Nai province today. People's mobilization efforts have garnered significant attention from multiple sectors, yet it is crucial to examine the perspectives of both government officials and ordinary citizens. The research focuses on identifying the levels of awareness, understanding, and engagement of these groups in relation to the government's PMW policies and strategies. By (...) doing so, the study will delve into how effectively these efforts have been communicated, understood, and applied by both officials who implement policies and the public who are the target of these efforts. In addition, the article explores the challenges and successes of PMW in the province, aiming to pinpoint areas where improvements are needed to enhance collaboration between the government and the people. By offering a multidimensional perspective, the study contributes to the academic discourse on PMW while addressing practical issues surrounding the implementation of these strategies. The findings are expected to not only shed light on the current state of public awareness but also to provide policymakers with insights to refine their approach, thereby strengthening the relationship between government efforts and public participation in Dong Nai province. Throughout much of Chinese history, Mencius (372-289 BC) was considered the greatest Confucian thinker after Confucius himself. Following the enshrinement of the Mencius (an edited compilation of his thought by disciples) as one of the Four Books by Sung neo-Confucianists, he was studied by all educated Chinese. This book begins a reassessment of Mencius by studying his ethical thinking in relation to that of other early Chinese thinkers, including Confucius, Mo Tzu, the Yangists, and Hsün Tzu.
