More than a century ago, G. E. Moore famously attempted to refute all versions of moral naturalism by offering the open question argument (OQA) followed by the “naturalistic fallacy” charge (NF).1 Although there is consensus that this extended inference fails to undermine all varieties of moral naturalism, OQA is often vindicated as an argument against analytical moral naturalism. By contrast, NF usually finds no takers at all. ln this paper we argue that analytical naturalism of the sort recently proposed by (...) Frank Jackson and Michael Smith does after all rest on a mistake — though perhaps not the NF. Analytical moral naturalism is roughly the doctrine that some moral predicates and sentences are a priori equivalent to predicates and sentences framed in non-moral terms (Jackson 2003: 558). Given moral naturalism, it is at least possible that there are some such a priori or conceptual equivalences. But a properly construed OQA challenges this reductive strategy by showing that it is open to doubt on a priori grounds. We further contend that, in the dialectical context created by our OQA, a "digging in the heeis" defense of the strategy would beg the question. ll.. (shrink)

This paper focusses on our concerns about revelations about sexual harassment in universities and the inadequate responses whereby some universities seem more concerned about their own reputations than the care and protection of their students. Seldom do cases go to criminal court, instead they mostly fall within employment relations policies where the use of non-disclosure agreements are double edged, such that some perpetrators remain nameless even if the person offended against wants details made public. Of course if the staff member (...) does not resign or take retirement prior to potential dismissal, but remains in the institution, the grapevine still works. Universities too often become complicit in cover-ups at the expense of further potential victims of sexual misconduct. It has been with much dismay that we found that despite extensive training and writing about ethics some senior professors in philosophy fields have been accused and found wanting, disabusing us of the virtue assumption. Despite these recent instances where perpetrators have been named and been publicised in the media, we found that this is not in fact new, so not only does the paper look to the past, but also extensively it uses contemporary accounts, reports and documents from USA, UK, South America, Australia, and New Zealand. These seem to be the tip of the iceberg, so our hope is that all students and staff in universities (and in fact all institutions where there are inherent power imbalances) will not only feel safe, but that they will be safe as universities become genuinely ethical institutions. This chapter begins with an empirical analysis of attitudes towards the law, which, in turn, inspires a philosophical re-examination of the moral status of the rule of law. In Section 2, we empirically analyse relevant survey data from the US. Although the survey, and the completion of our study, preceded the recent anti-police brutality protests sparked by the killing of George Floyd, the relevance of our observations extends to this recent development and its likely reverberations. Consistently with prior studies, we (...) find that people’s ascriptions of legitimacy to the legal system are predicted strongly by their perceptions of the procedural justice and lawfulness of police and court officials’ action. Two factors emerge as significant predictors of people’s compliance with the law: (i) their belief that they have a (content-independent, moral) duty to obey the law (which is one element of legitimacy, as defined here); and (ii) their moral assessment of the content of specific legal requirements (‘perceived moral content of laws’). We also observe an interactive relationship between these two factors. At higher levels of perceived moral content of laws, felt duty to obey is a better predictor of compliance. And, similarly, perceived moral content of laws is a better predictor of compliance at higher levels of felt duty to obey. This suggests that the moral content incorporated in specific laws interacts with the normative force people ascribe to legal authorities by virtue of other qualities, specifically here procedural justice and lawfulness. In Section 3, the focus shifts to a philosophical analysis, whereby we identify a parallel (similarly interactive) modality in the way that form and content mutually affect the value of the rule of law. We advocate a distinctive alternative to two rival approaches in jurisprudential discourse, the first of which claims that Lon Fuller’s eight precepts of legality embody moral qualities not contingent on the law’s content, while the second denies any independent moral value in these eight precepts, viewing them as entirely subservient to the law’s substantive goals. In contrast, on the view put forward here, Fuller’s principles possess (inter alia) an expressive moral quality, but their expressive effect does not materialise in isolation from other, contextual factors. In particular, the extent to which it materialises is partly sensitive to the moral quality of the law’s content. (shrink)

One of the more polarizing policies proposed to alleviate the organ shortage is financial payment of donors in return for organs. A priori and empirical investigation concludes that such systems are ethically inadequate. A new methodological approach towards policy formation and implementation is proposed which places ethical concerns at its core. From a hypothetical secular origin, the optimal ethical policy structure concerning organ donation is derived. However, when applied universally, it does not yield ideal results for every culture and society (...) due to region-specific variation. Since religion holds significant influence in the organ donation debate, three religions-Catholicism, Islam, and Shinto-were examined in order to illustrate this variation. Although secular ethical concerns should rest at the core of policy construction, certain region-specific contexts require cultural and religious competence and necessitate the adjustment of the optimal template policy accordingly to yield the best moral and practical results. The COVID-19 pandemic forced us to reconsider our interactions with the world around us, shifting how we navigate public and private spaces every day. Most people in the United States previously thought nothing of touching railings or doorknobs, going to school or work while ill, or attending crowded events. Along with new health interventions and institutional practices, daily behaviors aimed at infection control, such as routine hand washing and wearing face masks when symptomatic, protected our communities from COVID-19. Many new (...) interventions and practices are here to stay, but it is unclear which personal behaviors to protect against COVID-19 and other infectious diseases we should continue. Intuitively plausible ethical arguments support individuals taking reasonable measures to avoid causing or propagating harm to other members of the community. As such, by failing to adopt easily implementable preventive behaviors, we live ethically suboptimal lives and violate our social contract to one another. As the world transitions from epidemic to endemic COVID-19, applying the lessons learned from the pandemic is crucial to mitigating old and new infectious disease threats. Along with the role of public health agencies to organize and communicate about communicable diseases, clinicians and public health workers have critical roles in establishing social norms for behaviors that prevent the spread of infectious diseases, given their professional responsibilities and statuses as trusted authority figures. Background: although cognitive behavioural therapy is the gold standard treatments for bulimia nervosa (BN) and binge eating disorder (BED), evidence for its long-term efficacy is weak. Empirical research support the efficacy of brief strategic therapy (BST) in treating BN and BED symptoms, but its statistical significance still need to be investigated. Objective: to statistically test the long-term efficacy of the BST treatment protocols for BN and BED through one-year post-treatment. Methods: a two-group longitudinal study will be conducted. Participants will be (...) sequentially recruited for inclusion in a state-funded community psychotherapy clinic. Multilevel growth curve modeling will be used to estimate the average growth trajectories from baseline to one year after treatment termination for the severity of the BN and BED features as measured by the Eating Disorder Examination Questionnaire. Discussion: findings from this study will clarify the impact of BST in treating BN and BED symtoms. Conclusions: translating research into practice may inform how to ensure high-quality patient care. This paper scrutinises the many ways in which ‘success’ is portrayed in representing assisted reproductive technology (ART) services and illuminates how these definitions differ from those held by participant couples. A qualitative approach informed by feminist perspectives guided this study and aimed to problematise the concept of ‘success’ by examining literature from ART clinics, government reports on ART, and by analysing narratives of couples who have accessed ART services. As many ART services have varying definitions of ‘success’ and as statistics (...) are manipulated to promote further patronage of ART services, the likelihood of ‘success’ is often overstated. This paper is concerned with the effects this promotion has on the participants. We suggest that this very mobilisation of statistical success changes the ability of those who access ART services to make productive decisions about themselves inside these treatment regimes, as the basis for decision‐making is hidden by the way numbers, objectivity and clinical reasoning operate to maintain participation in the program. In such an operation, the powerful mix of hope and technology kept participants enrolled far longer than they originally planned. Moreover, how success rates are manipulated raises ethical issues for all involved: clients, counsellors, and nursing and medical professionals. (shrink)

The literature on faith has largely focused on the relationship between faith and belief, specifically the question: does faith entail belief? At the same time, it’s also widely held that faith involves a desire or pro-attitude, but more attention has been paid to the specifics of faith’s doxastic component than to faith’s affective component. This paper focuses on the relationship between faith and desire. Frank Jackson champions the cause of conceptual analysis as central to philosophical inquiry. In recent years conceptual analysis has been undervalued and widely misunderstood, suggests Jackson. What are its main components or features? What are the different kinds of faith? Traditional theistic arguments conclude that God exists. Pragmatic theistic arguments, by contrast, conclude that you ought to believe in God. The two most famous pragmatic theistic arguments are put forth by Blaise Pascal (1662) and William James (1896). Pragmatic arguments for theism can be summarized as follows: believing in God has significant benefits, and these benefits aren’t available for the unbeliever. Thus, you should believe in, or ‘wager on’, God. This article distinguishes between various kinds of theistic wagers, including finite (...) vs. infinite wagers, premortem vs. postmortem wagers, and doxastic vs. acceptance wagers. Then, we’ll turn to the epistemic-pragmatic distinction, and discusses the nuances of James’ argument, and how views like epistemic permissivism and epistemic consequentialism provide unique “hybrid” wagers. We say, for example, that Jones feels cold, that Carlton might win, that there are quarks, that murder is wrong, that there are four fundamental forces, and that a certain level of neurological activity is necessary for thought. This paper examines whether atheists, who believe that God does not exist, can have faith. Of course, atheists have certain kinds of faith: faith in their friends, faith in certain ideals, and faith in themselves. However, the question we’ll examine is whether atheists can have theistic faith: faith that God exists. Philosophers tend to fall on one of two extremes on this question: some, like Dan Howard-Snyder (2019) and Imran Aijaz (2023), say unequivocally no; others, like Robert Whitaker (2019) and (...) Sam Lebens (2023), say unequivocally yes. Here, I take a middle position: I argue that atheists can have action-focused theistic faith (faith in how they act) but not attitude-focused theistic faith (faith in what attitudes they have).
