When a person finds herself in peril her right to be rescued is activated and a rescue duty is imposed on those who are in a position to help. In this article, I argue that the activation of the right to be rescued needs to be suitably constrained so that the rescuee is prevented from arbitrarily controlling the normative situation between herself and potential rescuers. Such control would be in conflict with the moral equality of persons. I argue that the (...) activation of the right to be rescued should be conditional on the person having a justification for the action that caused her peril. One implication of my view is that the right to be rescued cannot fulfill the function that Jonathan Quong ascribes to it. The right to be rescued turns out to be an unsuitable ground for the necessity condition which constrains the permissible use of defensive force. (shrink)

Although generative linguistics is predominantly a syntax‐focused program, the methodology is intended for use in all linguistic subfields. The discovery that the establishment of a nonlocal dependency rests on hierarchical relations between words and phrases rather than on linear relations represents a watershed moment for generative syntax. This article urges teachers of philosophy to “remember Meno’s slave boy.” In Plato’s Meno, Socrates famously uses a stick to draw figures in the dust, andMeno’s uneducated slave boy (with some prompting by Socrates) grasps geometry. Plato uses this interaction to show that all learning is, in fact, recollection. Regardless of the merits of that position, Socrates’ conversation with the slave boy is an excellent demonstration that understanding is aided by appealing to the different talents or “intelligences” of students. The destruction of an embryo must be justified in law. This is to prevent frivolous wastage and to show the respect afforded by the Warnock Report. For example, embryonic destruction during pregnancy is underpinned by the Abortion Act 1967, and embryonic destruction during fertility treatment is regulated by the Human Fertilisation and Embryology Act 1990. However, following the appeal decision in R v Human Fertilisation and Embryology Authority [2005] 2 A.C. 561, embryos can now be created for a bone marrow (...) tissue match to a sick sibling under the Human Fertility and Embryology Act 1990 according to the subjective desires of the mother. This opens the door to the first example of embryonic destruction on unique social-eugenic grounds with no clear lawful justification. It is argued that these embryos should be afforded a unique destruction provision under an amended version of section 1 of the Abortion Act 1967 in light of their ‘social-eugenic’ nature. This would protect the Human Fertilisation and Embryology Authority from accusations of undercover eugenic practices and reinstate the respect shown towards embryos in law. (shrink)

ABSTRACT One way of characterizing the ontological turn in anthropology is the effort to transform philosophical anthropology into anthropological philosophy—or anthropology into philosophy. This effort proceeds upon the premise that to critique philosophical representationalism is to critique the entire rationalist enterprise. It is as a result of this coupling that some OTers suggest that a permanently decolonized philosophy becomes indistinguishable from post-representationalist anthropology. Curiously, it is by thinking with Gilles Deleuze that they conclude, on the one hand, that to decolonize (...) anthropology is to de-representationalize it, and, on the other, that to decolonize philosophy is therefore to anthropologize it (since, on their logic, de-representationalizing means de-philosophizing). To turn to ontology means “thinking immanence” not, pace Deleuze, as philosophy, but beyond philosophy. This article argues that the supersessionist claim is incoherent precisely insofar as this coupling is unwarranted. To provide a counterinstance, the article suggests how thinking with Alfred North Whitehead decouples the critique of representationalism from the critique of rationalism. One implication of this work is to model a speculative philosophy that can be responsive to postcolonial concerns about representationalism without thereby becoming functionally indistinct from anthropological method. This paper asks whether Christianity has always been queer, is the very nature of it beyond what one might expect from reality? Does the core of Christianity destabilise the categories by which subsequent Christian leaders have created doctrine, developed ethics and controlled the faithful? Is this queer core located in the very notion of incarnation itself, an event that truly changes all we thought we knew about the nature of materiality? The paper is not attempting to find a queer past (...) in order to justify a queer present and solidify a queer future but rather to suggest that fluidity, rupture and unexpected outcomes should be at the heart of the Christian enterprise. There is little debate that there are important ethical questions that we must answer as we increase our reliance on social networking technologies such as Facebook, Instagram, Twitter and YouTube for our communications, interactions and connections. Social media is at the center of many of our greatest public policy challenges but the moral (or immoral) role it plays in relation to human behavior is far from settled. Part of the difficulty we face in addressing the unique challenges of social networking (...) technologies is discerning the significance of social networking on us. This is because we often begin with an erroneous assumption. The moral significance of technologies generally—not only social networking technologies—is hampered by the insistence that technologies are typically considered objects and we are human, and the province of morality has long been ours. Postphenomenological inquiries can help to fashion technological development in pursuit of understanding how our moral behavior takes shape, but we can also take a critical perspective on who we are and what we are becoming in light of what social networking technologies reveal about the state of our ontological Being. In his well-known critique of conceptual relativism, Donald Davidson declared that we are not worlds but “only words apart.” His interpretive principle of charity asserts that the transcendental condition of disagreement is agreement. Pragmatist philosophers of religion have relied upon the principle of charity to argue against a framework theory of religion. They use the notion of a scale of observationality to illustrate where broad-scale agreement lies and place disagreement (and specifically convictional difference qualifying as “religious”) at the higher reaches, (...) considering it interpretively parasitic. In this article, I problematize the ontological premises of construing difference in this way (specifically insofar as they betray traces of positivism) and the uses of ethnography to substantiate it. I draw on the work of contemporary anthropologists who identify with the so-called ontological turn in ethnography to help think differently about difference—about what it means to be “only words apart.”. This paper takes a social epistemology perspective on markets in general and trade deals in particular. Normatively, it is based on considerations of democratic accountability and contestation. Empirically, it is based on the assumption that all markets are embedded in institutional frameworks. Knowledge plays an important role in the institutional framework of markets: it matters both at the level of content – which knowledge has to be processed in what way, according to the market rules? – and at the level (...) of process – whose knowledge counts in setting the rules? While these considerations apply to both domestic and international markets, there are good reasons to allocate certain epistemic tasks to the frameworks of international markets, for example trade deals. While the TTIP and CETA negotiations fell short of democratic standards about transparency, the debate about them indicates growing public awareness of the importance of the institutional frameworks for international trade. Whitehead’s metaphysics provides resources for understanding a world in value-realist terms. Central to this value realism is an aesthetic conception of rationality that sees a hope implicit in our practices—the hope that our linguistic tools are suited to the task of getting things right in our fields of inquiry. This pragmatic hope entails an understanding of individual freedom and responsibility to participate in a patient restructuring of the world toward the highest retention of value. It also enables an understanding of (...) individual freedom as obstructive to this restructuring. One task of this article is to show that attunement in theory to the hope implicit in practice can ameliorate this obstructiveness. A subsequent task is to show that, insofar as this preliminary hope is not a metaphysical premise, but a regulative ideal seeking satisfaction, it can serve as a warrant for an implicit theology in linguistic pragmatism. In this way, I argue that we can come to see pragmatism as a method lending itself to a philosophical theology of the Whiteheadian variety. We can do this precisely insofar as rationalism is seen as predicated on an aesthetic ideal of harmony—a harmony between what is and what ought to be our matters of concern. We can come to see the structure of rationality in terms of an aestheticism corrective of analytic conceptions of meaning and truth. (shrink)

(wife of patient) and Jeanne KerwinMy husband suffered from sudden onset of heart failure with a very low ejection fraction and was on IV Milrinone at the age of 47. One of the most powerful things he told me was that he was not afraid to die and therefore did not want to move forward with Milrinone. He eventually “did it for the kids.” After (...) the Milrinone drip was no longer working, he was offered an LVAD (left ventricular assist device) to keep him alive. He refused, but the doctor again convinced him to “do it for your kids” and said, “we put these devices in 80-year-olds.” He did not have time to explore any other options and reluctantly accepted the LVAD. It was implanted in May of 2014 in a very long and complicated surgery with a long and difficult recovery. He was in the hospital for a long time, and then he refused to go to rehab upon discharge, making it difficult for our family to manage, as he was extremely weak and needed care of his wound dressing. He worried about the financial [End Page 7] impact of a heart transplant and the medications required, as we were already struggling with the medical bills. He refused to have more surgery with the potential complications and never agreed to get on the transplant waiting list.After the implanted LVAD, my husband was not able to do most of what he loved in life. He couldn’t work (he was a truck driver), he couldn’t go fishing or swimming in the ocean, he couldn’t go hunting and fishing, and his overall physical condition was so poor that he couldn’t cook, garden and, most aggravating to him, he could not take a regular hot shower. The LVAD had to be covered with plastic in order to avoid getting the drive-line area wet, so bathing was a complicated process. He had trouble with stairs, had neuropathic pain in his legs from diabetes, and because of the pain medications, he felt cloudy and dizzy and slept most of the day in his recliner. I took care of him, even after I had to go back to work, and at the same time, I managed our two children (ages 9 and 12 at the time of LVAD).After almost two years of living with the LVAD, multiple hospitalizations for GI bleeds then seizures, more medications, and weekly blood draws for INR1, my husband requested that the LVAD be de-activated and that he be allowed to die of his heart failure. He described his life as “miserable.” He watched as his misery impacted his children and me. He suffered daily and had none of the joys that made life worth living for him. When we approached the cardiac team that implanted and monitored his LVAD with his request, they said “no.” They would not de-activate the LVAD because it was working. It was keeping him alive and he had no other terminal illness. His palliative doctor, who was treating his pain, also heard his request and told us to call for an “ethics consult” to determine if he would be “allowed” to have the LVAD de-activated. We got the number and called on March 31, 2016.At the time of the call to Ethics, we had no idea what “Ethics” was, other than a general definition of the word ethics as in professional behaviors and such. We did not know what to expect but we called. We would never have known to call “Ethics” if the palliative doctor had not advised us to do so, and my husband might have suffered a longer, more painful life both mentally and physically prolonged by the LVAD.We explained the request to the ethics consultant. She listened to my husband describe his daily living and his dissatisfaction with the quality of his life, his physical and emotional suffering, and his wish to rid himself of the LVAD and allow nature to take its course. In this interesting and engaging book, Shabel offers an interpretation of Kant's philosophy of mathematics as expressed in his critical writings. Shabel's analysis is based on the insight that Kant's philosophical standpoint on mathematics cannot be understood without an investigation into his perception of mathematical practice in the seventeenth and eighteenth centuries. She aims to illuminate Kant's theory of the construction of concepts in pure intuition—the basis for his conclusion that mathematical knowledge is synthetic a priori. She does this through (...) a contextualized interpretation of his notion of mathematical construction, which she argues can be approached by looking at Euclid's Elements and Christian Wolff's mathematical textbooks. The importance of the former for her interpretation is justified by the fact that nearly all of Kant's mathematical examples in the Critique are Euclidean propositions. The importance of the latter is revealed through the fact that Wolff's textbooks were not only widely read and representative of the state of elementary mathematics during Kant's time; Kant was also intimately familiar with them. During the thirty years prior to the publication of the Critique, he used the textbooks in the college-level introductory courses in mathematics and physics that he taught.In the introduction to her book, Shabel helpfully distinguishes her approach to Kant's philosophy of mathematics from that of previous commentators. Cognitive science can help literary scholars formulate specific questions to be answered by archival research. This essay takes, as its starting point, embedded mental states (that is, mental states about mental states) and their role in generating literary subjectivity. It then follows the transformation of embedded mental states throughout several manuscripts of Christa Wolf’s autobiographical novel, Patterns of Childhood (Kindheitsmuster, 1976), available at the Berlin Academy of Arts. The author shows that later versions of Patterns of Childhood have more complex (...) embedments in the chapter describing the adolescent protagonist’s relationship with her schoolteacher. This textual development is integral to the process whereby the presumably authentic memories of the past are constructed to fit the present needs of the person who is doing the remembering.
