The essential nature of legislative power is to make the laws; that of executive power is to execute those law. The difference between the two is both substantial and significant; it is the difference between the rule of arbitrary power and the rule of law. This paper will seek to trace the genesis of an independent judicial power, in both theory and practice, through an examination of sections of The Constitutions of Clarendon, The Assize of Clarendon, Hobbes’ Leviathan, Locke’s Second (...) Treatise, Montesquieu’s Spirit of the Laws, as well as The Federalist Papers. Moreover, it will seek to establish its executive nature and to explain why it is so often (at least presently) misunderstood to be akin to the legislative power. (shrink)

Consistent with Ruchkin and colleagues' proceduralist account, recent research on grouping and verbal-spatial binding in immediate memory shows continuity across short- and long-term retention, and activation of classes of information extending beyond those typically allowed in modular models. However, Ruchkin et al.'s account lacks well-specified mechanisms for the retention of serial order, binding, and the control of activation through attention.

This paper presents a computer model of cortical broadcast and competition based on spiking neurons and inspired by the hypothesis of a global neuronal workspace underlying conscious information processing in the human brain. In the model, the hypothesised workspace is realised by a collection of recurrently inter-connected regions capable of sustaining and disseminating a reverberating spatial pattern of activation. At the same time, the workspace remains susceptible to new patterns arriving from outlying cortical populations. In 2007, Massachusetts instituted a universal coverage health plan that requires all citizens to purchase insurance. I argue that there is nothing wrong in principle with the use of an individual mandate to force citizens to secure health insurance. I argue that state neutrality is not tenable on this issue. Then I proceed to show that even if state neutrality were viable, it is not a violation of state neutrality (thought of as neutrality of intent) to force citizens to insure (...) themselves with the primary purpose of securing the normative good of health. I adapt recent work on universal medical coverage to demonstrate that such a mandate is in keeping with several principles of fairness shared in liberal democratic societies. This argument not only applies to the Massachusetts plan but likely to any other health care coverage schemes using individual mandates in the US political context, including recently passed federal health care reform measures. However, even though the Massachusetts plan may provide increased access to health care for many, there are still legitimate worries that it currently places disproportionate financial burdens on the working poor and thus will need refinement. My discussion has four parts. In section 1, I reconstruct Leibniz’s early position on freedom and show how various problems motivated significant changes in Leibniz’s views over a short period of time. In section two, I outline a series of notes by Leibniz entitled “De Libertate a Necessitate in Eligendo,” where Leibniz develops a rudimentary theory of contingency that resembles the infinite analysis theory developed around 1686. In section three, I consider some reasons for why Leibniz dropped the “Eligendo” view. (...) In section four, I look at the link that Leibniz develops between an infinite series of reasons and indemonstrability and suggest how the rudimentary theory of “Eligendo” eventually became the infinite analysis theory of contingency. This article traces the development of major ideas about integration in Europe. It examines the historical development of, and competition between, ideas about the EU, exploring the clash of integration models and ideals. It draws on the visions of European unity that led to the creation and development of the EU. Regional integration in the EU is distinctive and not necessarily . The article examines governing norms, material interests, power, and security. It demonstrates that the narrative of shared experience and (...) history formed part of a need to both overcome hyper-nationalism and to share sovereignty, while also privileging some memories. EU norms are also enshrined in a distinctive institutionalized structure, based on a co-existence of national and EU interests and a balancing among often competing interests. (shrink)

Many defenders of libertarianism have, in recent years, come to endorse the idea that free agents are rarely able to choose otherwise than they do.1 These libertarians argue that it is often true that the beliefs and desires, or the character of a free agent are sufficient to render numerous possible choice-alternatives ineligible for the agent having them. In fact, they claim, it is frequently the case that beliefs, desires, character, etc. are sufficient to narrow the eligible alternatives to a (...) single one (I will henceforth refer to such choices as “single-option choices”). In these cases, such agents, even though they are unable to choose otherwise, are still morally responsible as long as certain conditions are met. In particular, it must be the case that the factors that narrow the available alternatives result from prior free choices of the agent (I will henceforth refer to such factors as “limiting factors”). In other words, limiting factors must be traceable to prior free choices. (shrink)

Ethics in Early China: An Anthology is a major contribution to the philosophical study of early Chinese ethics and comparative ethics by a collection of some of the most distinguished scholars in these fields. This anthology honors Professor Chad Hansen's many and important contributions to the study of Chinese philosophy, but the work is not a festschrift per se. At extreme altitude (>5,000 – 5,500 m), sustained hypoxia threatens human function and survival, and is associated with marked involuntary weight loss (cachexia). This seems to be a coordinated response: appetite and protein synthesis are suppressed, and muscle catabolism promoted. We hypothesise that, rather than simply being pathophysiological dysregulation, this cachexia is protective. Ketone bodies, synthesised during relative starvation, protect tissues such as the brain from reduced oxygen availability by mechanisms including the reduced generation of reactive oxygen species, improved mitochondrial (...) efficiency and activation of the ATP‐sensitive potassium (KATP) channel. Amino acids released from skeletal muscle also protect cells from hypoxia, and may interact synergistically with ketones to offer added protection. We thus propose that weight loss in hypoxia is an adaptive response: the amino acids and ketone bodies made available act not only as metabolic substrates, but as metabolic modulators, protecting cells from the hypoxic challenge.Also watch the Video Abstract. The problem of the person may be described as the crux of Descartes' philosophy in the fairly obvious literal sense that it is the point of intersection of the two chief axes of the system, the Philosophy of Nature and the Philosophy of Mind. The actual, if not professed aim of the former is the ousting of the occult powers and faculties of Scholastic-Aristotelian physics by the mechanical concept of force or action-by-contact. The chief tenet of the latter is that (...) mind, whose essence is thinking, is clearly and distinctly conceivable apart from matter, the essence of which is extension. From this, by an illicit inference which need not concern us further, Descartes concludes that the mind is “really distinct” from matter, that is, a substance capable of existing apart from body in its own right. Elicitation methods are known to influence second language speech production. For teachers and language assessors, awareness of such effects is essential to accurate interpretations of testing outcomes. For speech researchers, understanding why one method gives better performance than another may yield insights into how second-language phonological knowledge is acquired, stored, and retrieved. Given these concerns, this investigation compared L2 vowel intelligibility on two elicitation tasks and determined the degree to which differences generalized across vowels, vowels in context, lexical items, and (...) individual speakers. The dependent variable was the intelligibility of Cantonese speakers' productions of English /i I u ℧/ in varying phonetic environments. In a picture-naming task, the speakers produced responses without an auditory prompt. In a second task–interrupted repetition–they heard exemplars of the same targets without pictures, and repeated each one after counting aloud to 10, a step intended to disrupt their short-term auditory store and therefore prevent simple mimicry. For target words with scores below 80% on picture naming, mean intelligibility was more than 10 points higher on interrupted repetition. However, that difference did not generalize across conditions or across speakers. Thus, although it is technically accurate to say that, on average, interrupted repetition yielded better vowel intelligibility than did picture naming, that observation requires a great deal of qualification, particularly because of individual speaker differences. Plural reflexives and reciprocals are anaphoric not only to antecedent pluralities but also to relations between the members of those pluralities. In this paper, I utilize Dynamic Plural Logic (van den Berg 1996) to analyze reflexives and reciprocals as anaphors that elaborate on relations introduced by the verb, which can be collective, cumulative, or distributive. This analysis generalizes to languages like Cheyenne (Algonquian) where reflexivity and reciprocity are expressed by a single proform that I argue is underspecified, not ambiguous.
