This paper provides a revisionist account of the authority and power of the criminal mugshot. Dominant theories in the field have tended to focus on the ways in which mugshots have been used as a way of disciplining criminal bodies and rendering them docile. It is argued here that additional emphasis could usefully be placed on stories of resistance in which the monological production site of the prison or police station transforms into a dialogical site, in which the objects of (...) police photography can acquire agency. These issues are explored with particular reference to a set of photographs of English suffragettes acquired by the police for surveillance purposes. The suffragette’s refusal to comply with requests to have their photographs taken is used as a case study through which to examine the ways in which conventions about the form of the mugshot can be subverted, ideas about the types of people who were the object/subject of mugshots disrupted and the assumption of documentary neutrality undermined. This article considers the relationship between the interests of individual litigants and the facilitation of doctrine for the collective good. More specifically, it examines the extent to which the policy and rules governing the management of civil litigation reflect a genuine commitment to the development of the common law. It is argued that litigation models in England send out conflicting messages about the commitment our society has to nurturing precedents and that we remain ambivalent about whether resources should be directed (...) to identifying cases with precedent-setting potential. Contrary to recent policy statements that encourage disputants to resolve issues in private forums such as mediation, this article concludes that the time is ripe to turn our attention to the equally important issue of how to ensure that certain types of cases reach a public forum. While models of business ethics increasingly recognize that ethical behavior varies cross-culturally, scant attention has been given to understanding how culture affects the ethical reasoning process that predicates individuals' ethical actions. To address this gap, this paper illustrates how culture may affect the various components of individuals' ethical reasoning by integrating findings from the cross-cultural management literature with cognitive-developmental perspective. Implications for future research and transnational organizations are discussed.

Both experimental and ethnographic studies show that reciprocal exchanges (in which actors unilaterally provide benefits to each other without formal agreements) produce stronger trust than negotiated exchanges secured by binding agreements. We develop the theoretical role of risk and uncertainty as causal mechanisms that potentially explain these results, and then test their effects in two laboratory experiments that vary risk and uncertainty within negotiated and reciprocal forms of exchange. We increase risk in negotiated exchanges by making agreements nonbinding and decrease (...) uncertainty in reciprocal exchanges by having actors communicate their intentions. Our findings support three main theoretical conclusions. (1) Increasing risk in negotiated exchange produces levels of trust comparable to those in reciprocal exchange only if the partner's trustworthiness is near-absolute. (2) Decreasing uncertainty in reciprocal exchange either increases or decreases trust, depending on network structure. (3) Even when reciprocal and negotiated exchanges produce comparable levels of trust, their trust differs in kind, with reciprocal exchange partners developing trust that is more resilient and affect-based. In order to be held responsible, it is not enough that you’ve done something blameworthy, someone else must also have the standing to hold you responsible. But a number of critics have claimed that this concept of ‘standing’ doesn’t hold up to scrutiny and that we should excise it from our analyses of accountability practices. In this paper, I examine James Edwards’ (2019) attempt to define standing. I pose objections to some key features of Edwards’ account and defend an alternative. (...) Increasingly, philosophers who write about moral responsibility and accountability practices invoke the concept of “standing,” a term they claim to borrow from legal contexts. Yet critics point out that these philosophers have been maddeningly unclear about what standing is. Worse yet, no single account of the concept of “standing” seems to accommodate its current usage. This essay presents a thin account of standing, defends its usefulness in philosophical analyses of accountability practices, and develops further conceptual tools for thinking about standing.

Linda LeMoncheck introduces a new way of thinking and talking about women's sexual pleasures, preferences, and desires. Using the tools of contemporary analytic philosophy, she discusses methods for mediating the tensions among apparently irreconcilable feminist perspectives on women's sexuality and shows how a feminist epistemology and ethic can advance the dialogue in women's sexuality across a broad political spectrum. The term “gender” has played a key role in feminist theory and politics since the late 1960s. Debates over its meaning reflect major turning points within the women's movement of the past thirty years.

As in other fields, scholarly publication in sociology is not only the key to career success but also the route by which feminist analyses and perspectives become known to others in the discipline. A growing literature has analyzed women's and men's rates of publication, but the gender politics of the prepublication production of research and gender differences in reputation building after publication remain underexplored. This report reviews the current state of knowledge about sociological publishing at three phases: prepublication, the publication-seeking (...) phase, and postpublication. It concludes with critical questions to be addressed in developing a comprehensive model of gender effects on sociological publishing. (shrink)

This article draws on resource‐based theory and the literature on strategic intent to develop a theoretical model that explains the concept of mission drift in microfinance institutions . We argue that the differential strategic intents of commercially oriented, for‐profit, and socially oriented nonprofit organizations drive the acquisition of disparate resources and capabilities, which in turn drives distinct performance outcomes, including a focus on different markets within the overall base of the pyramid . The article suggests that it is the dynamic (...) aspects of changing strategic intent and the consequent timing delays in the development of associated resources and capabilities that lead to various issues of mission drift. Finally, we suggest that cross‐sector alliances between for‐profit and nonprofit MFIs may benefit from the unique capabilities of both types of organizations and deliver the most and broadest impact on poverty alleviation in BOP markets. This paper uses social capital theory to explain contemporary slavery in the context of American professional sports leagues. While traditional slavery was legallyabolished in the United States (US) during the nineteenth century, using the label slavery to describe professional athletes is often dismissed because these athletes are wellcompensated performers with access to incremental compensation through commercial endorsements. As active players, athletes have opportunities to build and leverage social capital, yet, after they retire from competition, these opportunities frequently diminish. We contend (...) contemporary slavery exists for professional athletes and during their careers they are bound to their owners via “gilded cage” slavery, which is attractive to enter yet difficult to exit. We also contend that during this “bondage,” athletes build and maintain social capital; yet upon retirement, athletes are limited in opportunities to leverage socialcapital to improve their own situations or those of their communities. In October 2012, the Loyola University Chicago Stritch School of Medicine amended its eligibility requirements for admission. In addition to U.S. citizens and permanent residents, persons who qualify for the Deferred Action for Childhood Arrivals program of the United States Citizenship and Immigration Service are now eligible for admission. Simply put, we extended the educational opportunity of medical school to people who are in a particular category of undocumented immigrants. We became the first medical school in the United States to (...) have an intentional, transparent policy of eligibility for persons eligible for the DACA program. This expanded admissions policy has gained some attention in the popular press and brought us many expressions of support. It has also dismayed a few members of our school's circle of faculty and alumni.We wish to walk you through the history of our policy's development. We believe that viewing it as it developed will make clear three pertinent ideas: this policy flows directly from the mission of medical schools, it suits a positive notion of social justice and is also compelled by a duty not to discriminate on arbitrary grounds, and educators who steward educational institutions must have the moral courage to place considerations of institutional mission and social justice above the political views and negative responses of some alumni and donors. Although tissue plasminogen activator (tPA) is the only medication approved by the United States Food and Drug Administration (FDA) for acute ischemic stroke, there is no consensus about the need for informed consent for its use. As a result, hospitals throughout the U.S. have varying requirements regarding obtaining informed consent from patients for the use of tPA, ranging from no requirement for informed consent to a requirement for verbal or written informed consent. We conducted a study to (1) determine current (...) beliefs about obtaining patients’ informed consent for tPA among a large group of stroke clinicians and (2) identify the ethical, clinical, and organizational factors that influence tPA consent practices. Semi-structured interviews were conducted by trained and experienced investigators and research staff to identify key barriers to implementing acute stroke services. Part of the interview explored current beliefs and practices around informed consent for tPA.This was a multicenter study that included 38 Veterans Health Administration (VHA) hospital locations. Participants were 68 stroke team clinicians, serving primarily on the neurology (35 percent) or emergency medicine (41 percent) service. We conducted thematic analysis based on principles of grounded theory to identify codes about consent for tPA. We used interpretive convergence to ensure consistency among the individual investigators’ codes and to ensure that all of the investigators agreed on coding and themes.We found that 38 percent of the stroke clinicians did not believe any form of consent was necessary for tPA, 47 percent thought that some form of consent was necessary, and 15 percent were unsure. Clinicians who believed tPA required informed consent were divided on whether consent should be written (40 percent) or verbal (60 percent). We identified three factors describing clinicians’ attitudes about consent: (1) legal and policy factors, (2) ethical factors, and (3) medical factors.The lack of consensus regarding consent for tPA creates the potential for delays in treatment, uneasiness among clinicians, and legal liability. The identified factors provide a potential framework to guide discussions about developing a standard of care for acquiring the informed consent of patients for the administration of tPA. (shrink)

Most of the world's religions hold a belief in some form of life after death. The editors of this major anthology seek a global perspective on the importance of these beliefs, based on religion, psychical research, and the natural sciences. Eleven chapters explore the afterlife teachings of religions around the world. In order to emphasize the diversity beliefs - even across particular belief systems - some contributors write from within the traditions, while others offer critical and alternate views. The chapters (...) cover afterlife beliefs in African religions, Judaism, Christianity, Islam, Hinduism, and Buddhism while raising a number of important questions. Is a belief in an afterlife necessary to provide meaning to the here and now? Can science provide the means of affirming such beliefs? A further four contributions address these questions directly, and critique the belief systems from the perspectives of philosophy and psychical research. The final chapter highlights the importance of research into states of consciousness during near-death and other mystical experiences. Taken as a whole, the book constitutes the most valuable resource on the subject to date. The editors conclude that in some respects, a global perspective does emerge - particularly that human beings are more than just our bodies, but are "composed of a physical and nonphysical element." Subtitling approaches are constantly changing based on the factors surrounding their implementation. This qualitative secondary study seeks to explore the factors that influence subtitlers’ decision in translating English to Arabic sensitive audiovisual material. This study adopts complexity theory to unveil the intricate interplay of factors that influence these decisions. We move beyond a linear cause-and-effect model, exploring how social media, Turkish movies, globalization and the Arab Spring influence subtitlers’ decision in translation. The results of this qualitative secondary investigation indicate that (...) many factors such as audience age and westernization among others influence subtitlers’ approaches in translation. Hence, it is essential for subtitlers to be dynamic and consistently review their subtitling approaches to ensure that they meet the needs of their target audiences, considering the presence of new and old target audiences of English to Arabic audiovisual translations. Polls show that 45% of the American public believes that humans were created about 10,000 years ago and that evolution is a fictitious myth. Another 25% believes that changes in the natural world are directed by a supernatural being with a particular goal in mind. This thinking clashes head on with scientific findings from the past 150 years, and there is a dearth of public critical thinking about the natural world within a scientific framework. Evolution and Religious Creation Myths seeks (...) to educate and arm the public on the differences between myth and science, fiction and theory. The book begins with a whirlwind tour of creation stories from several religions. The authors then explore how certain forms of religious fundamentalism clash with the science of evolution. They review how creationists and intelligent design proponents misuse and misrepresent scientific terminology and conclusions to further their own agendas. How do scientists respond to this threat? Modern science, which includes a level of indeterminacy, or chance, cannot support the premise that a supernatural designer engineered nature for a particular purpose in a deterministic fashion. This holds true for the creation of the universe, the appearance of the first biological molecules, chemical evolution, and the evolution of life forms through mutation, natural selection, and genetic drift. Instead, human biological and cultural evolution is described within a genetic framework. Scientists use a barrage of genetic tests and DNA phylogenies to support the scientific basis for evolution. For anyone who has ever needed to argue why evolution and creationism are not both valid theories that deserve equal attention, this book clearly defines the difference between theory and myth. We doubt that theory of mind can be sufficiently demonstrated without reliance on verbal tests. Where language is the major tool of social manipulation, an effective theory of mind must use language as an input. We suspect, therefore, that in this context, prelinguistic human and nonhuman minds are more alike than are human pre- and postlinguistic minds.

Wolfgang Pauli is known as one of the most famous physicists of the 20th century. Next to an intensive treatment of physics, his impressive correspondence with fellow physicists also demonstrates a vivid interest in psychology and biology. Reflections on the mind-brain problem and on topics such as causality and evolutionary theory are readily present. In this paper, some central passages in this correspondence are discussed and linked to more current debates in philosophy of science and philosophy of biology. It is (...) shown how Pauli speculatively explored how evolutionary theory can find inspiration in quantum theory and in its related concept of observer-dependency. Contra Kalervo Laurikainen's interpretation, it is argued that Pauli's criticism remains true to a naturalistic view on science and biology. (shrink)

Recent debates about supererogatory rescues have sought to explain how it can be wrong to perform a suboptimal rescue although it would be permissible not to rescue at all. This paper proposes a new solution to this puzzle. It argues that existing accounts have neglected two critical considerations. First, contrary to what is commonly assumed, a rescue’s supererogatory nature has no bearing on the duties that apply to agents who rescue in supererogatory fashion. Second, we cannot justify harms caused as (...) a side effect of supererogatory rescues by appealing to the fact that it would have been permissible not to rescue at all. Ultimately, the paper proposes, the same duties that apply in cases in which rescuing is required also apply in cases in which rescuing is supererogatory. A rescue’s supererogatory nature, it turns out, is not the game changer we thought it was. (shrink)

Epistemology was a central concern of Michel Foucault. By denying the conflation of knowledge with power, and consistently maintaining a dyadic relationship (“power/knowledge”) rather than a relationship in which power eclipses knowledge, Foucault maintains that knowledge requires its own analysis irreducible to the strategic maneuvers of power. “Epistemology,” by this caricature, has to approach the question of knowledge as a transcendent entity, akin to Plato's Ideal Forms. Foucault's work on knowledge is primarily critical rather than normatively reconstructive. The most important (...) and influential of his ideas was Foucault's claim that power and knowledge are co‐constituting: “that power and knowledge directly imply one another ”. The perennial interest in psychoanalysis shows no signs of abating and the longevity of psychoanalytic theory is seen in the varied extensions and elaborations of Freudian thinking in the fields of neuroscience and cognitive theory. Nevertheless, the scientific standing of psychoanalysis has long been questioned and developments in the fields of the philosophy of science and psychology require a fresh assessment of the scientific standing of psychoanalysis. While there are a range of views on the topic of whether psychoanalysis is (...) in fact scientific, any satisfactory approach to understanding mind and behaviour requires an approach that is at once both philosophic and scientific. Accordingly, to even approach the question regarding the scientific nature of psychoanalysis, a foundation comprising a sophisticated conceptual and philosophical framework is required.
