BackgroundEvolving medical technology, advancing biomedical and drug research, and changing laws and legislation impact patients’ healthcare options and influence healthcare practitioners’ (HCPs’) practices. Conscientious objection policy confusion and variability can arise as it may occasionally be unclear what underpins non-participation. Our objective was to identify, analyze, and synthesize the factors that influenced HCPs who did not participate in ethically complex, legally available healthcare.MethodsWe used Arksey and O’Malley’s framework while considering Levac et al.’s enhancements, and qualitatively synthesized the evidence. We searched (...) Medline, CINAHL, JSTOR, EMBASE, PsychINFO, Sociological Abstracts, and ProQuest Dissertations and Theses Global from January 1, 1998, to January 15, 2020, and reviewed the references of the final articles. We included articles written in English that discussed the factors that influenced physicians and registered nurses (RNs) who did not participate in end-of-life (EOL), reproductive technology and health, genetic testing, and organ or tissue donation healthcare areas. Using Covidence, we conducted title and abstract screening, followed by full-text screening against our eligibility criteria. We extracted the article’s data into a spreadsheet, analyzed the articles, and completed a qualitative content analysis using NVivo12.ResultsWe identified 10,664 articles through the search, and after the screening, 16 articles were included. The articles sampled RNs (n = 5) and physicians (n = 11) and encompassed qualitative (n = 7), quantitative (n = 7), and mixed (n = 2) methodologies. The care areas included reproductive technology and health (n = 11), EOL (n = 3), organ procurement (n = 1), and genetic testing (n = 1). One article included two care areas; EOL and reproductive health. The themed factors that influenced HCPs who did not participate in healthcare were: (1) HCPs’ characteristics, (2) personal beliefs, (3) professional ethos, 4) emotional labour considerations, and (5) system and clinical practice considerations.ConclusionThe factors that influenced HCPs’ who did not participate in ethically complex, legally available care are diverse. There is a need to recognize conscientious objection to healthcare as a separate construct from non-participation in healthcare for reasons other than conscience. Understanding these separate constructs will support HCPs’ specific to the underlying factors influencing their practice participation. (shrink)

Paul Guyer is well known for defending the claim that freedom, understood as the capacity to set ends, is Kant’s fundamental value. In contrast, I have developed a reading of Kant’s ethics that places autonomy and community at the heart of Kant’s ethics. At the heart of my account is a conception of autonomy understood as what I call the capacity for sovereignty. I argue that these two positions can be made compatible. To do this involves making a distinction between (...) the concepts of dignity and value and arguing that although autonomy, understood as the capacity for sovereignty, is the source of the dignity of humanity, this is compatible with the claim that the ultimate value for Kant is freedom understood as the capacity to set ends. To explain how this is possible I appeal to Wilfrid Sellars Kantian account of the moral point of view in Science and Metaphysics. (shrink)

ABSTRACT Pharmacogenetics is a rapidly expanding area of research exploring the relationship between inter‐individual genetic variation and drug response, with the goal of developing genetically optimised therapies. Slippery slope arguments claim that a particular action should be rejected (or supported) because it might be the first step onto a slippery slope leading to undesirable (or desirable) consequences. In this article, several slippery slope arguments relevant to the context of pharmacogenetics are evaluated under consideration of underlying reasons for their popularity. The (...) author concludes that although the examined arguments are unconvincing as slippery slope arguments, they do matter in this context. While positive slippery slope arguments serve as a driving force to fuel the development of pharmacogenetics, their negative counterparts play an important role to sensitise policy makers and the public to potential problems. In the Groundwork, we find three distinct conceptions of freedom: (i) A negative conception of freedom, understood as a capacity for spontaneous action independent of alien causes; (ii) a positive conception of freedom, understood as the capacity of giving law to oneself; and (iii) a second positive conception, understood as the capacity to give laws that bind others as well as oneself. The dominant interpretation of Kant ignores this third conception of freedom and interprets the second conception as a capacity (...) for self-determination or self-governance, which is seen as the most basic and important Kantian conception of autonomy. In this paper, we will focus mainly on explaining the distinction between the second and third conceptions of autonomy and will defend the claim that the third conception is morally the most basic. We will also explain briefly why Kant thinks that having the capacity for citizenship is necessary for having the capacity for self-governance. (shrink)

Thomas Reid argues that both perception and memory involve a conception of an object and usually cause a corresponding belief. According to defenders of the constitutive interpretation, such as Rebecca Copenhaver, the belief is constitutive of acts of perception and memory. I instead argue for a causal interpretation: although in normal circumstances perceiving and remembering cause a corresponding belief, the belief is not constitutive of perception or memory. Copenhaver's strongest argument for the constitutive interpretation is that perception essentially represents objects (...) as present, while memory essentially represents objects as past; since such tense markers can only occur within the beliefs, the beliefs must be an essential aspect of perception and memory. I argue, in contrast, that temporal markers are contained in our conceptions of objects, so beliefs do not play an essential role in distinguishing between perception and memory. Such a reading presupposes a “thick” interpretation of what Reid means by a conception, according to which a Reidian conception is a mode of presentation of the object apprehended. (shrink)

This paper presents a new formal model for D–N explanation that gives intuitive criteria of acceptability, avoids the known trivializations, and links explanation with confirmation theory. Although set in the twenty-five year tradition of attempts to formalize D–N explanation, it proposes a new direction for the model that is to be distinguished from the syntactical and informational approaches by its introduction of restrictions which derive from the use which the D–N model can have in hypothesis testing. This model, illustrating the (...) verificational approach, revises the classic H–O requirements and amends the notion of partial self-explanation to meet a criticism to which the H–O notion is vulnerable. Un concepto que solía pertenecer al mundo de la informática (hacking) ahora se combina con las ciencias de la vida (bio). Sin gran dificultad, hemos empezado a ver la vida como un conjunto de datos, el ADN como un código, el cuerpo como una máquina y la mente como un software... todos susceptibles de ser leídos, manipulados y ahora incluso hackeados. ¿Pero manipulados por quiénes? Las comunidades de biohackers y DYIbio (do-it-yourself biology) quieren la biotecnología disponible para todos y la (...) información compartida abiertamente. En este trabajo, propongo una reflexión sobre qué está pasando y el posible por qué. En la primera parte, presento el biohacking como un fenómeno social, dando algunos ejemplos de biohackers y diferenciando tipos de biohackers. En la segunda parte, hago un acercamiento al Transhumanismo. La existencia de biohackers sólo es posible gracias a la creciente disponibilidad de información y biotecnología combinada con una cierta mentalidad. El principal objetivo es profundizar en la reflexión sobre la relación entre biohacking y Transhumanismo. Analizo el biohacking como una de las expresiones de este movimiento y uno de los fenómenos que contribuyen a él. Al final, ofrezco una reflexión sobre la cultura, deseos y miedos de nuestra sociedad, reconociendo también algunas de las preguntas que ellos provocan. (shrink)

This chapter has two main sections. In the first section I briefly sketch Immanuel Kant’s moral theory as laid out in his Groundwork of the Metaphysics of Morals (1785). I explain Kant’s claim that morality must be grounded on what he calls a categorical imperative and examine his three formulations of this categorical imperative. In the second section I explain the distinction between “deontological” and “teleological” ethical theories. Kantian ethics is often presented as the paradigm example of a deontological ethical (...) theory, but I question whether Kant’s ethics should be understood as purely deontological. (shrink)

The central idea behind this paper is the claim that Kant's moral idea of a realm of ends is modeled on the category of community examined in his theoretical works, and that understanding Kant's account of the category of community helps us understand certain features of the idea of a realm of ends, and in particular the fact that a member of a realm of ends must be an autonomous agent. For Kant the idea of a community is essentially the (...) idea of a multitude of individuals in interaction and in this paper I will attempt to show why Kant believes that only autonomous individuals can interact. On the surface Kant himself seems quite clear about who is deserving of respect: The morally relevant others are all “rational, free beings” or all “human beings.” It is clear, however, that Kant does not want to identify “human beings” in this sense with members of a particular biological species, for he is explicitly open to the idea that there might be non-biologically human rational beings. Thus, for example he is explicitly open to the possibility of extraterrestrial rational beings, who (...) would not be members of the same biological species as us, but who would, presumably be worthy of respect. And it would seem possible that there are members of our biological species who are not “human” in the morally relevant sense. Given these facts, a Kantian needs to give some account of how we are to recognize who or what counts as “human” in the morally relevant sense. I argue that to be “human” in the morally relevant sense is to have the capacity for morality, and that this involves: (a) the capacity to recognize others as ends rather than merely as means and (b) the capacity to enter into relations of ethical community with us. I defend a position I name moral reliabilism. According to this position: (a) We have a quasi-perceptual capacity to directly ascribe moral status to various bits of the world around us. I will argue that this capacity is best thought of in Gibsonian terms as a capacity to pick up on certain types of social affordances; morally relevant others have the capacity to engage in ethical interaction with us, and recognizing the humanity of others involves picking up on this capacity. Those beings who are “human” in the morally relevant sense, then, afford interaction based on mutual respect. (b) We should assume as a postulate of practical reason that this capacity is reliable (although fallible). (shrink)

I discuss the role of translatability in philosophical justification. I begin by discussing and defending Thomas Reid’s account of the role that facts about comparative linguistics can play in philosophical justification. Reid believes that common sense offers a reliable but defeasible form of justification. We cannot know by introspection, however, which of our judgments belong to common sense. Judgments of common sense are universal, and so he argues that the strongest evidence that a judgment is a part of common sense (...) is that it is to be found in all languages. For Reid, then, evidence that a certain distinction is to be found in all languages is evidence that the distinction is part of common sense rather than being a common local prejudice. From such a perspective, empirical work in comparative linguistics can play a defeasible justificatory role in philosophical arguments. I contrast Reid’s position with the more radical position of defenders of the Natural Semantic Metalanguage approach, such as Anna Wierzbicka, who argues that only judgments that are translatable into all natural languages are justifiable. I show how such a position is rooted in an implausible view, although one common among cognitive scientists and linguistics, about the nature of concepts, which does not allow for novel concepts. Event concepts are unstructured atomic concepts that apply to event types. A paradigm example of such an event type would be that of diaper changing, and so a putative example of an atomic event concept would be DADDY'S-CHANGING-MY-DIAPER.1 I will defend two claims about such concepts. First, the conceptual claim that it is in principle possible to possess a concept such as DADDY'S-CHANGING-MY-DIAPER without possessing the concept DIAPER. Second, the empirical claim that we actually possess such concepts and that they (...) play an important role in our cognitive lives. The argument for the empirical claim has the form of an inference to the best explanation and is aimed at those who are already willing to attribute concepts and beliefs to infants and nonhuman animals. Many animals and prelinguistic infants seem capable of re-identifying event-types in the world, and they seem to store information about things happening at particular times and places. My account offers a plausible model of how such organisms are able to do this without attributing linguistically structured mental states to them. And although language allows adults to form linguistically structured mental representations of the world, there is no good reason to think that such structured representations necessarily replace the unstructured ones. There is also no good reason for a philosopher who is willing to explain the behavior of an organism by appealing to atomic concepts of individuals or kinds to not use a similar form of explanation when explaining the organism's capacity to recognize events. -/- We can form empirical concepts of individuals, kinds, properties, event-types, and states of affairs, among other things, and I assume that such concepts function like what François Recanati calls ‘mental files’ or what Ruth Millikan calls ‘substance concepts’ (Recanati 2012; Millikan 1999, 2000, 2017). To possess such a concept one must have a reliable capacity to re-identify the object in question, but this capacity of re-identification does not fix the reference of the concept. Such concepts allow us to collect and utilize useful information about things that we re-encounter in our environment. We can distinguish between a perception-action system and a perception-belief system, and I will argue that empirical concepts, including atomic event concepts, can play a role in both systems. The perception-action system involves the application of concepts in the service of (often skilled) action. We can think of the concept as a mental file containing motor-plans that can be activated once the individual recognizes that they are in a certain situation. In this way, recognizing something (whether an object or an event) as a token of a type, plays a role in guiding immediate action. The perception-belief system, in contrast, allows for the formation of beliefs that can play a role in deliberation and planning and in the formation of expectations. I distinguish between two particular types of belief which I call where-beliefs and when-beliefs, and I argue that we can model the formation of such perceptual beliefs in nonlinguistic animals and human infants in terms of the formation of a link between an empirical concept and a position on a cognitive map. According to the account offered, seemingly complex beliefs, such as a baby's belief that Daddy changed her diaper in the kitchen earlier, will not be linguistically structured. If we think that prelinguistic infants possess such concepts and are able to form such beliefs, it is likely that adults do too. The ability to form such beliefs does not require the capacity for public language, and we can model them in nonlinguistic terms; thus, we have no good reason to think of such beliefs as propositional attitudes. Of course, we can use sentences to refer to such beliefs, and thus it is possible to think of such beliefs as somehow relations to propositions. But it is not clear to me what is gained by this as we have a perfectly good way to think about the structure of such beliefs that does not involve any appeal to language. (shrink)

Ce document est la retranscription d’un débat entre trois prostituées et des étudiants, tenu à l’Université Lyon 2 le 27 avril 1976. Ce débat constitue une des dernières manifestations publiques du mouvement des prostituées lancé à Lyon un an plus tôt, et qui avait vu une centaine de femmes occuper pendant plus d’une semaine une église de la ville afin de protester contre la répression policière. Il apporte non seulement un éclairage sur les conditions du passage à l’action collective d’une (...) population aussi marginale et stigmatisée que les prostituées, mais offre également de riches informations sur les logiques sociales, économiques et familiales qui, au milieu des années 1970, pouvaient contraindre des femmes à se prostituer. El presente artículo se centra en el papel de los Derechos Humanos (DH) y Objetivos de Desarrollo Sostenible (ODS) en la gobernanza mundial de las nuevas tecnologías para la salud humana. La primera parte aborda la gobernanza: el proceso de gobernar diferentes asuntos de la vida colectiva, incluyendo múltiples actores y medios. La segunda parte trata de la gobernanza mundial de las nuevas tecnologías: la necesidad, la viabilidad y cómo debería ser. La tercera parte reflexiona sobre la gobernanza mundial de (...) las nuevas tecnologías para la salud humana, analizando los recientes planes de la Organización Mundial de la Salud (OMS) para la gobernanza mundial de la edición del genoma humano y de la inteligencia artificial (IA) para lasalud. Se concluye que un buen procedimiento es insuficiente para una buena gobernanza, el contenido ético es crucial. Se recomienda prestar especial atención al papel de los DH y los ODS. Se sugiere una ética proactiva a lo largo de todo el proceso (conceptualización, diseño, desarrollo, distribución y uso) de las nuevas tecnologías, implicando la educación ética de las diferentes partes interesadas. A general trend in recent philosophical and empirical work aims to undermine various traditional claims regarding the distinctive nature of self-knowledge. So far, however, this work has not seriously threatened the Cartesian claim that (at least some) self-knowledge is immune to the sort of sceptical problem that seems to afflict our knowledge of the external world. In this paper I carry this trend further by arguing that the Cartesian claim is false. This is done by showing that a familiar sceptical (...) argument that targets my knowledge of the external world can be adapted to target my belief that I exist, along with any of my self-knowledge that I know entails my own existence. Thus, my self-knowledge and my knowledge of the external world are subject to the same sort of sceptical problem. (shrink)

Americans from all walks of life are losing confidence in American higher education and their numbers are increasing at an alarming rate. Amidst this decline in public support, many American colleges and universities now must confront an unstainable business model. Holden Thorp and Buck Goldstein address these problems head on, articulating the real challenges facing higher education and describing in pragmatic terms what can and cannot change - and what should and should not change.

Putnam’s vat argument is intended to show that I am not a permanently envatted brain. The argument holds promise as a response to vat scepticism, which depends on the claim that I do not know that I am not a permanently envatted brain. However, there is a widespread idea that the vat argument cannot fulfil this promise, because to employ the argument as a response to vat scepticism I would have to make assumptions about the content of the premises and/or (...) conclusion of the argument that beg the question against the sceptic. In this paper, I show that this idea is mistaken. (shrink)

If it works, I can use Putnam’s vat argument to show that I have not always been a brain-in-a-vat. It is widely thought that the vat argument is of no use against closure scepticism – that is, scepticism motivated by arguments that appeal to a closure principle. This is because, even if I can use the vat argument to show that I have not always been a BIV, I cannot use it to show that I was not recently envatted, and (...) it is thought that the claim that I am not justified in thinking that I was not recently envatted is all that the closure sceptic requires. In this paper I first argue that scenarios in which I have been recently envatted are inadequate for the sceptic’s purposes, and so the standard argument that the vat argument is of no use against closure scepticism fails. I then argue that it is not possible to revise the standard argument to meet my objection. I conclude that, if it works, I can use the vat argument as a defence against closure scepticism. (shrink)

This paper is concerned with Michel Serres’s critique of property. Through the concept of ‘le propre,’ which in French can mean both ‘clean’ and ‘one’s own,’ and a naturalist reading of Rousseau, he proposes a ‘stercorian’ eco-criticism of property. Focusing on concepts of limits provides a fruitful angle from which to illuminate Serres’s critique of law and property. The first section will introduce Serres as a thinker of limits, borders, and boundaries. In the second and third parts, attention will be (...) drawn to his eco-criticism of law and property from a feminist and philosophy of science perspective, concluding with a fourth part, in which Serres’s approach will be contextualized in relation to other naturalisms. His work has far-reaching consequences for discourses of human agency in the context of the Anthropocene and makes a crucial contribution to how a new naturalist criticism of property might be conceived. Embora trate-se de materialidades diferentes e que ocorra, de certa forma, a quebra de expectativa do leitor quanto à representação literal da obra literária no filme, nosso interesse é por buscar nas personagens infantis (...) marcas da intertextualidade que as constituem como uma só enquanto ser criança e pensar em como esses elementos funcionam no texto para construir um saber sobre a infância, em diferentes épocas.Palavras-chave: O Pequeno Príncipe.
