Recent accounts support the existence of two distinct feelings of guilt: altruistic guilt (AG), arising from the appraisal of not having been altruistic toward a victim and deontological guilt (DG), emerging from the appraisal of having violated an intuitive moral rule. Neuroimaging data has shown that the two guilt feelings trigger different neural networks, with DG selectively activating the insula, a brain area involved in the processing of disgust and self-reproach. Thus, insula activation could reflect the major involvement of self-reproach (...) in DG rather than in AG. However, only a few studies have empirically tested whether and how DG and AG differently affect decision making and none have compared enhanced self-worth. Here we asked three groups of participants, respectively, induced with either pride, DG or AG, to participate in a third-party version of the ultimatum game in which they were asked to decide on behalf of others to accept or reject economic offers with several degrees of fairness. Results revealed that only deontological participants had higher median acceptances of Moderately Unfair offers as compared to proud participants. However fairness judgments were not different between groups, suggesting that deontological participants’ moral standards had not decreased. Crucially, a higher increase in DG was associated with an increase in the odds of accepting 30:70 offers. The opposite effects that DG and pride exert on self-worth can account for these results. Specifically, proud participants felt entitled enough to take action in order to restore equity, while deontological participants followed the “Do not play God” principle, which limited their decisional autonomy, not allowing them to decide on behalf of others. The evidence-based turn in education reveals renewed consensus on empiricism and shared trust in science as if it were the allegedly value-free basis for decision-making: good, justifiable governance should be a non-discretional corollary of scientific knowledge. The article focuses on some risks implied in pursuing the de-moralization of educational decision-making, namely the realistic, the reductionist, and the perspective fallacies, as well as the minimization of individual responsibility in favor of the third-person perspective implied in following protocols and guidelines. In the (...) discussion I address some possible reasons for the appeal of the evidence-based turn despite these risks: the contemporary pressure for “accountability” and the need to justify social policies and practices with consensual criteria. In the conclusion, I claim that educational decision-making should deploy rather than conceal its moral bases despite their being potentially highly divisive. Consequently, I make a case for “moral accountability”: making publicly inspectable what evidence-based education tries to conceal, i.e. the unavoidable value-ladeness of educational policies and practices. After decades of epistemological inquiry on the social construction of science, we have observed a renewed consensus on empiricism in application-oriented social sciences and a growing trust in evidence-based practice and decision-making. Drawing on the long-standing debate on value-ladenness, evidence and normativity in sciences, this article theoretically discusses and empirically illustrates the Life-World origins of methods in a domain of inquiry strongly characterized by an empiricist epistemic culture and a normative stance: Children and Media Studies. Adopting a reflexive approach to (...) their own research in such an epistemologically underexplored field, the authors analyze a standard research instrument and two procedures. The analysis illustrates how background assumptions shape the research method and how the procedures routinely conceal this work of shaping. In the discussion the authors cast light on the role scientific procedures play in the naturalization of a given moral order, and put forward the question of whether and how this “morality-building” feature of methods should be taken into account in the assessment of their appropriateness. In the conclusion the authors advance that the situated nature of scientific knowledge, rather than discrediting its relevance, is what makes it relevant, here and now, for the larger community the research may impact on. The authors discuss the risks of such a pragmatic outcome and propose the adoption of an oscillating epistemic stance as a way to cope with them. (shrink)

Starting from the distinction between concept and conception, the author proposes a pluralistic view of toleration focussed on the equality of individuals and cultures and on legal‐rational control of social relationship. Analyzing the basic marks of toleration (toleration and power, the costs of toleration, toleration and value) the author shows how the option for toleration is a choice for subjecting social relations to reason and rules (law) instead of passions and violence (war).

the scholion to Lucan, “Bellum Civile” 8, 618 that is found in the “Adnotationes super Lucanum” is at first sight pointless, but it becomes immediately meaningful if we accept the idea that the scholiast commented the text by systematically comparing it with Livy’s narrative on those same events. This approach casts a new light on how these ancient commentators read Lucan and can be also useful to solve exegetical issues.

The author summarizes here the main theme of the papers gathered in the second part of this issue. It describes the dual identities they deal with (linguistic identities,métissages, masked exiles and social intermingling) and places them in the context of an ongoing seminar work carried out at the Maison des sciences de l’homme in Paris.

In the spring of 1784 the Marquis of Puységur, a great landowner and colonel in an artillery regiment, was called to the bedside of Victor, the son of his steward, who was suffering from pneumonia. Puységur was a follower of the new holistic medicine taught in an atmosphere of intense enthusiasm and scandal by Franz-Anton Mesmer, an Austrian doctor who had been living in Paris for several years. As a disciple of Mesmer, he intended to direct his ‘vital fluid’ onto (...) the young patient, by means of ‘magnetic passes’, to provoke ‘spasms’ which would lead to a calm state and an improvement in health. But things did not go as anticipated. Instead of displaying the anticipated spasms, the young Victor sank into a strange state of unconsciousness which, at first sight, resembled a deep sleep. Then he revived once more and came to life with a new personality. Freed from his inhibitions, he no longer spoke his habitual dialect, but the French of aristocrats, and he had no hesitation in berating his school teacher, whose secret thoughts he appeared to be able to read. Finally, he forecast the stages by which he would be cured and the remedies which would be suitable for him. Puységur wrote down all these strange facts and the following year he published a report which caused a sensation. Soon, throughout France, somnambulists appeared and observations about their subjects gathered. From that time onwards, the incomprehensible facts apparently evident in ‘provoked’ or ‘artificial somnambulism’ and also in ‘magnetic sleep’ - such expressions were used by Puységur and his followers for the state that he had just discovered - were to give rise to huge controversy. The Marquis of Puységur triggered the development nineteenth century of a movement of reflections and practices which have generally been referred to by the expression ‘animal magnetism’, invented by Mesmer. On the eve of the Revolution and throughout the nineteenth century this movement held a real fascination for philosophers, writers, and scholars. But there has been a tendency to overlook this episode in European culture, which has ultimately become a “lost continent” in our own period. (shrink)

Indeed Goethe is a milestone in the history of the themes inherited from ancient traditions and the Renaissance that have in common the project of integrating ‘the science of humankind, the science of nature and a study of the destiny of humanity through the adventure of existence’. Analisi di più aspetti dell’argomentazione giuridica, esposti in quattro saggi. 1. La ricerca della verità nella testimonianza della vittima dei processi per stupro, partendo dalla vicenda biblica di Susanna e i vecchioni, dal processo seicentesco per lo stupro di Artemisia Gentileschi, passando per il romanzo “A Passage to India”, fino all’esame della più recente giurisprudenza (Susanna, Artemisa, Adela … ovvero la semplice verità, di Emanuele Filograna). 2. La giustificazione dialogica e monologica delle argomentazioni: confronto tra le tesi di E. Tugendhat (...) e R. Alexy in merito alla teoria del consenso come giustificazione ultima non solo dell’argomentazione, ma anche della decisione giuridica (Giustificazione, argomentazione e decisione giuridica. In a previous paper, we discussed a model that considers abnormal eating behaviour epiphenomena of a more profound disorder of lived corporeality and identity (Stanghellini and Mancini, this issue). The core idea is that persons with FEDs experience their own body first and foremost as an object being looked at by another, rather than coenaesthetically or from a first-person perspective. In this paper, alienation from one’s own emotions, disgust and shame for one’s body of persons with FED, will be (...) discussed in the light of the embodiment and identity model of FED. (shrink)

Logical abductivism is the epistemic view about logic according to which logical theories are justified by abduction (or Inference to the Best Explanation), that is on how well they explain the relevant evidence, so that the correct logical theory turns out to be the one that explains it best. Arguably, this view should be equally applied to both deductive and non-deductive logics, abduction included. But while there seems to be nothing wrong in principle in using abduction to determine the correct (...) logical theories of deduction and induction, things might be more complicated regarding logical theories of abduction. We may wonder whether allowing for an abductive justification of a theory of abduction is an epistemically legitimate move, since here circularity casts its shadow and makes the situation darker. This is the issue to which this work is devoted. I will defend that, to be effective, an abductive justification for a theory of abduction calls for a justification of abduction in advance, which we do not yet have. (shrink)

This article reviews the outstanding and thought-provoking work by Roberta De Monticelli (2021), _Towards a Phenomenological Axiology. Discovering What Matters_. The article addresses the reasons why it should be read by everyone but especially by help professions practitioners. Although we all deal with morality and value judgments on on mundane, everyday bases, the professional life of education and care practitioners is namely a series of morally-loaded practices and decision-making informed by morally oriented (expert) knowledge. Beyond the thesis advanced in the (...) book, its major contribution consists in making the reader think the inescapability of morality in everyday thinking and acting and the need for a reflective positioning towards this issue. By aligning with “the hedgehog vs. the fox” struggle proposed by the author as the framework of her theoretical proposal, the article advances what would be the doubts and counterarguments of a fox-like scholar in education. It illustrates why her “professional vision” cannot but notice what appears to be under-thematized by the hedgehog, i.e., the unavoidable mediation of language and social interaction that _precedes_ and therefore impacts the constitution of what the hedgehog convincingly notices: the entanglement of fact and value. The conclusion is dedicated to the (underestimated?) place of social sciences in such a debate, their tension between implicit normativity and presumed descriptivity, as well the challenges of the increasingly explicit normativity of applied social sciences. In a passage of the Life of Nero concerning the emperor’s indecision over what to do after the revolt of the provincial armies, it can clearly be seen that there is an influence from an argumentative structure particular to a certain type of deliberative oratory, the suasoria triplex. This influence may be due simply to Suetonius’ familiarity with the declamatory exercises in vogue at the rhetorical schools, but some hints allow us to suppose the existence of a suasoria theme that (...) took as its subject this very episode in the life of the emperor. Si esaminano gli argomenti di Trasimaco (anche alla luce della posizione di Callicle) e, segnatamente, il rapporto tra la legge e il potere costituito: il raffronto con il pensiero di Carl Schmitt prende avvio dal nodo centrale del significato attribuito al νόμος. Si analizzano le argomentazione nei dialoghi platonici per ricostruire la concezione del νόμος e gli elementi che possono fornire risposte indirette alla questione posta da Trasimaco, al di là della ricerca della definizione del concetto di giustizia, con particolare (...) attenzione alla legge ed alle forme di governo. Si esamina la relazione tra le tesi sulla sovranità elaborate da Schmitt e le teorie sul potere rintracciabili nelle posizioni di Trasimaco e di Callicle in rapporto ai frammenti di Pindaro ed Eraclito. Considerata la centralità della relazione amico-nemico nel pensiero di Schmitt, posta a confronto con le posizioni platoniche, si esamina la distinzione tra la concezione della legge come atto cognitivo di scoperta della verità e la sua fondazione sul principio della decisione da parte di chi detenga il potere sovrano, punto di arrivo dello sviluppo delle tesi hobbesiane da parte di Schmitt.
