Mounting evidence documents the extraordinary toll on human health resulting from the consumption of unhealthy food products and physical inactivity. America’s increasing obesity problem requires federal, state, and local lawyers, policymakers, and public health practitioners to consider legal strategies to encourage healthy eating and physical activity. The complexity of the legal landscape as it affects obesity requires an analysis of coordination across multiple sectors and disciplines. Government jurisdictions can be viewed “vertically,” including the local, state, tribal, and federal levels, or “horizontally” as agencies or branches of government at the same vertical level. Inspired by the successful tobacco control movement, obesity (...) prevention advocates seek comprehensive strategies to “normalize” healthy behaviors by creating environmental and legal changes that ensure healthy choices are the default or easy choices. At a time when the practice of medicine is subject to technical and biopolitical imperatives that give rise to defensive bioethics, it is essential to revitalize the ethical dimensions of care at the very heart of the clinic, in order to give new meaning to the moral responsibility that inhabits it. This contribution seeks to meet this challenge by drawing on the ethical resources of the work of Emmanuel Levinas. In Levinas’ view, ethical responsibility is the response to the injunction, (...) the interpellation, of the other’s face, and humaneness is conceived entangled in the other’s face. Against this background, I suggest that Levinas’ philosophical insight constitutes a turning point from a traditional to a new conception of responsibility that may bear great significance to a renewed understanding of an hermeneutics and an ethics of care. By drawing on this aspect of Levinas’ thought, I would like to reveal the ethical core of an ethics of clinical care that shapes a new insight on medical judgment. (shrink)

The temple is a pivotal event in the religious life of the different cultures. In the article some aspects of the experience of the temple as sacred space are addressed. Qualitative dimensions of sacred space in Christianity and Islam as their directionality, hierarchy and dynamics are analyzed. Recent years have seen a resurgence of interest, among both philosophers, legal scholars, and military experts, on the ethics of war. Due in part due to post 9/11 events, this resurgence is also due to a growing theoretical sophistication among scholars in this area. Recently there has been very influential work published on the justificaton of killing in self-defense and war, and the topic of the ethics of war is now more important than ever as a discrete field. -/- The (...) 28 commissioned chapters in this Handbook will present a comprehensive overview of the field as well as make significant and novel contributions, and collectively they will set the terms of the debate for the next decade. Lazar and Frowe will invite the leading scholars in the field to write on topics that are new to them, making the volume a compilation of fresh ideas rather than a rehash of earlier work. The volume will be divided into five sections: Method, History, Resort, Conduct, and Aftermath. The contributors will be a mix of junior and senior figures, and will include well known scholars like Michael Walzer, Jeff McMahan, and David Rodin. (shrink)

In this paper, I ask how – and whether – the rectification of injury at which corrective justice aims is possible, and by whom it must be performed. I split the injury up into components of harm and wrong, and consider their rectification separately. First, I show that pecuniary compensation for the harm is practically plausible, because money acts as a mediator between the damaged interest and other interests. I then argue that this is also a morally plausible approach, because (...) it does not claim too much for compensation: neither can all harms be compensated, nor can it be said when compensation is paid that the status quo ante has been restored. I argue that there is no conceptual reason for any particular agent paying this compensation. I then turn to the wrong, and reject three proposed methods of rectification. The first aims to rectify the wrong by rectifying the harm; the second deploys punitive damages; the third, punishment. After undermining each proposal, I argue that the wrong can only be rectified by a full apology, which I disaggregate into the admission of causal and moral responsibility, repudiation of the act, reform, and, in some cases, disgorgement and reparations, which I define as a good faith effort to share the burden of the victim’s harm. I argue, further, that only the injurer herself can make a full apology, and it is not something that can be coerced by other members of society. As such, whether rectification of the wrong can be a matter of corrective justice is left an open question. (shrink)

In this article, we discuss the potential of wearable structures to provide effective social commentaries and address the political representation of refugees, migrants, and nomads. We take Lucy Orta’s Refuge Wear as an occasion to address a series of socio-political considerations around wearables, textiles, communication, and technology, as well as the role of urban and social environments in determining architectures of mobility. Finally, we provide a critique of framing concepts such as relational aesthetics, heterotopias, nomadology, or deterritorialization—to propose a rethinking (...) of wearables based on the idea of critical habitats and responsible resource-based philosophies. Originated from the sources of Aristotle, Kant and Habermas, this paper is first of all an effort of reconstruction-rehabilitation of the practice field with regard to the invasion of the technical rationality. On the basis of this reconstruction, this text attempts a transformation of the philosophy of technology which we may call praktische Philosophie der Technik. In consideration of what precedes, the paper intends to determine the works of praktische Philosophie der Technik that come to three main point: first, to propose a systematic definition of the technology which really takes into account the specificity of the contemporary technology, then to work out an approach method of the technical phenomenon and finally to evaluate the technoscience. Inquisitive logic is an extension of classical logic which can express questions. To enable this expressiveness, a possible world semantics is used. So, it is natural to combine inquisitive and modal logic, thus obtaining the inquisitive modal logic $$\textrm{InqML}$$. This paper contributes to the model theory of $$\textrm{InqML}$$. We show that the filtration technique can be adapted to the inquisitive logic semantics. Using filtrations, we prove that $$\textrm{InqML}$$ has the finite model property, i.e., every satisfiable formula is satisfiable in a (...) finite model. As a consequence, we obtain that $$\textrm{InqML}$$ is decidable. Finally, we study filtrations over particular model classes and we prove that some extensions of $$\textrm{InqML}$$ are also decidable. (shrink)

Recommender systems are artificial intelligence technologies, deployed by online platforms, that model our individual preferences and direct our attention to content we’re likely to engage with. As the digital world has become increasingly saturated with information, we’ve become ever more reliant on these tools to efficiently allocate our attention. And our reliance on algorithmic recommendation may, in turn, reshape us as moral agents. While recommender systems could in principle enhance our moral agency by enabling us to cut through the information (...) saturation of the internet and focus on things that matter, as they’re currently designed and implemented they’re apt to interfere with our ability to attend appropriately to morally relevant factors. In order to analyze the distinctive moral problems algorithmic recommendation poses, we develop a framework for the ethics of attention and an account of judicious attention allocation as a moral skill. We then discuss empirical evidence suggesting that attentional moral skill can be thwarted and undermined in various ways by algorithmic recommendation and related affordances of online platforms, as well as economic and technical considerations that support this concern. Finally, we consider how emerging technologies might overcome the problems we identify. (shrink)

The first part of this article approaches GoT from the standpoint of dialectical contradiction between Fantasy and Realism peculiar to GoT’s eclectic nature. The second part puts forward a hypothesis about the social basis of GoT horizons, taking into account the fragmented and niched state of contemporary TV audiences.

À l’heure où la pratique de la médecine est soumise à des impératifs techniques et biopolitiques qui suscitent une (bio)éthique défensive, il est essentiel de revivifier les dimensions éthiques du soin au cœur même de la clinique, pour redonner sens à la responsabilité morale qui l’habite. Cette contribution cherche à relever ce défi en puisant aux ressources anthropologiques, épistémologiques et éthiques des travaux de Viktor von Weizsäcker, de Georges Canguilhem, de Paul Ricœur et d’Emmanuel Lévinas, dont les recherches ont ouvert, (...) dès le milieu du XXe siècle, la voie d’une anthropologie clinique qui pose les jalons d’une éthique de responsabilité propre à l’exercice de la médecine. À la lumière de ces recherches, où médecine et philosophie se nourrissent mutuellement, cette étude propose une éthique du soin qui contribue à maintenir vivants les liens unissant éthique et médecine. Automated Influence is the use of Artificial Intelligence to collect, integrate, and analyse people’s data in order to deliver targeted interventions that shape their behaviour. We consider three central objections against Automated Influence, focusing on privacy, exploitation, and manipulation, showing in each case how a structural version of that objection has more purchase than its interactional counterpart. By rejecting the interactional focus of “AI Ethics” in favour of a more structural, political philosophy of AI, we show that the real problem (...) with Automated Influence is the crisis of legitimacy that it precipitates. In this paper we develop a hermeneutic approach to the concept of competence. Patient competence, according to a hermeneutic approach, is not primarily a matter of being able to reason, but of being able to interpret the world and respond to it. Capacity should then not be seen as theoretical, but as practical. From the perspective of practical rationality, competence and capacity are two sides of the same coin. If a person has the capacity to understand the world and give (...) meaning to the situation, he or she is able to make decisions, and is thus competent. People can fail in the area of practical rationality. They can feel ill at ease, uncomfortable or not at home in the situation. Under such conditions, they appear as incompetent, and urge caregivers to respond in such a way that their competence can be raised. The issue is not how to measure their incompetence, but how to help them to become more competent, that is to get a practical grip on their situation and to be able to live out their lives in such a way that they develop their identity in relations with others. From a hermeneutic point of view, assessing a patient's capacity implies focusing on the patient's way of meaning making and regarding her behavior from the perspective of practical rationality. The focus should not be on the assessment as a matter of fact, but on improving capacity. This requires allowing the patient to experience the world meaningfully and affording her, in the context of a supportive and trustful institutional environment, the possibility of developing a personal narrative where her choices are expressed verbally or non-verbally. Killing civilians is worse than killing soldiers. If any moral principle commands near universal assent, this one does. Few moral principles have been more widely and more viscerally affirmed. And yet, in recent years it has faced a rising tide of dissent. Political and military leaders seeking to slip the constraints of the laws of war have cavilled and qualified. Their complaints have been unwittingly aided by philosophers who, rebuilding just war theory from its foundations, have concluded that this principle (...) is at best a useful fiction.
