Abstract:Facial transplantation is emerging as a therapeutic option for self-inflicted gunshot wounds. The self-inflicted nature of this injury raises questions about the appropriate role of self-harm in determining patient eligibility. Potential candidates for facial transplantation undergo extensive psychosocial screening. The presence of a self-inflicted gunshot wound warrants special attention to ensure that a patient is prepared to undergo a demanding procedure that poses significant risk, as well as stringent lifelong management. Herein, we explore the ethics of considering mechanism of injury (...) in the patient selection process, referring to the precedent set forth in solid organ transplantation. We also consider the available evidence regarding outcomes of individuals transplanted for self-inflicted mechanisms of injury in both solid organ and facial transplantation. We conclude that while the presence of a self-inflicted gunshot wound is significant in the overall evaluation of the candidate, it does not on its own warrant exclusion from consideration for a facial transplantation. BackgroundClinical ethics support aims to support health care professionals in dealing with ethical issues in clinical practice. Although the prevalence of CES is increasing, it does meet challenges and pressing questions regarding implementation and organization. In this paper we present a specific way of organizing CES, which we have called integrative CES, and argue that this approach meets some of the challenges regarding implementation and organization.MethodsThis integrative approach was developed in an iterative process, combining actual experiences in a case study (...) in which we offered CES to a team that provides transgender health care and reflecting on the theoretical underpinnings of our work stemming from pragmatism, hermeneutics and organizational and educational sciences.ResultsIn this paper we describe five key characteristics of an integrative approach to CES; 1. Positioning CES more within care practices, 2. Involving new perspectives, 3. Creating co-ownership of CES, 4. Paying attention to follow up, and 5. Developing innovative CES activities through an emerging design.ConclusionsIn the discussion we compare this approach to the integrated approach to CES developed in the US and the hub and spokes strategy developed in Canada. Furthermore, we reflect on how an integrative approach to CES can help to handle some of the challenges of current CES. (shrink)

While no one seems to believe that business schools or their faculties bear entire responsibility for the ethical decision-making processes of their students, these same institutions do have some burden of accountability for educating students surrounding these skills. To that end, the standards promulgated by the Association to Advance Collegiate School of Business, their global accrediting body, require that students learn ethics as part of a business degree. However, since the AACSB does not require the inclusion of a specific course (...) to achieve this objective, it may be satisfied by establishing a stand-alone course in ethical decision-making, by integrating ethical decision-making into the existing curricula, by some combination of the two strategies, or through some alternative mechanism. Notwithstanding the choice of delivery process, though, the institution must ensure that it is able to demonstrate the students' achievement of learning with regard to ethics, a bar that was raised, or arguably simply modified, in 2003. With learning objectives designed precisely to measure the student delta based on content, process and engagement in a particular class, those programs that have opted for stand-alone ethics courses may be more prepared to respond to assessment-related inquiries regarding their programs or satisfaction of the standards. The relevance of the AACSB standards modification to the current efforts at ethics integration in business programs is instead a re-examination of how to create a program of integration that is designed to ensure the most effective learning results possible, while responding to the challenges presented by the integrated approach. The purpose of this article is to explore some of those challenges that may be somewhat universal to business school programs implementing the integrated approach, and to share one large university's response to those challenges, along with lessons learned. In recent years, business ethics and economic scholars have been paying greater attention to the development of commons organizing. The latter refers to the processes by which communities of people work in common in the pursuit of the common good. In turn, this promotes commons organizational designs based on collective forms of common goods production, distribution, management and ownership. In this paper, we build on two main literature streams: the ethical approach based on the theory of the common good of (...) the firm in virtue ethics and the economic approach based on the theory of institutions for collective action developed by Ostrom’s research on common-pool resources to avert the tragedy of the commons. The latter expands to include the novel concepts of new commons, “commoning” and polycentric governance. Drawing on the analysis of what is new in these forms of organizing, we propose a comprehensive model, highlighting the integration of two sets of organizing principles—common good and collective action – and five problem-solving processes to explain the main dimensions of commons organizing. We contribute to business ethics literature by exploring the convergence between the ethical and economic approaches in the development of a commons organizing view. (shrink)

Externalist representationalism is touted as a superior rival to naïve realism, and yet a careful analysis of the externalist representationalist's analysis of our ordinary perceptual experiences shows the view to be far closer to naïve realism than we might have expected. One of the central advertised benefits of representationalist views in general is that they are compatible with the idea that ordinary, illusory and hallucinatory perceptual experiences are of the same fundamental kind. Naïve realists are forced to deny the ‘common (...) fundamental kind claim’ and adopt disjunctivism. However, I argue that externalist representationalism is also a version of disjunctivism. Consequently, one of the main rivals to naïve realism turns out not to be a rival at all. (shrink)

Anger is often an appropriate reaction to harms and injustices, but is it a politically beneficial one? Martha Nussbaum (Journal of the American Philosophical Association 1 (1), 41–56, 2015, Anger and Forgiveness. Oxford University Press, 2016) has argued that, although anger is useful in initially recruiting agents for action, anger is typically counterproductive to securing the political aims of those harmed. After the initial shockwave of outrage, Nussbaum argues that to be effective at enacting positive social change, groups and individuals (...) alike, must move quickly out of the state of anger. Feminist theorists (Frye, The Politics of Reality. Crossing Press, 1983; Lorde, 1997; Narayan, Hypatia 3 (2): 31–48, 1988) on the other hand have for long highlighted the efficacy of anger, as well as its moral and epistemic value, in fighting against the oppressive status quo. It might be thought therefore that for political action to be effective, a continued state of anger is preferable. Protestors must after all create and sustain a sense of moral obligation and justice. A main way of doing so is to promote successive moral shocks that trigger outrage (Jasper, Emotion Review 6 (3): 208–213, 2014). I present a novel, empirically informed defense of anger’s efficacy in political action. Nussbaum holds a traditional view on the nature of anger, inherited from Aristotle and the Stoics, which holds that anger constitutively involves a desire for retribution. The view that anger is counterproductive falls out of this and is dominant in academic work as well as in our personal and political lives. Based on work in social psychology, I argue that we need to reconsider this. In doing so, I highlight anger’s aim for recognition, rather than retribution, as key. Furthermore, I uncover conditions for anger’s political efficacy, as well as reasons for why the traditional view of anger has been so pervasive. (shrink)

Moral disengagement is the process by which individuals mitigate the consequences of their own violations of moral standards. Although MD is understood to be co-determined by culture norms, no study has yet explored the extent to which MD applied to safety at work fosters safety violations, nor the role of organizational culture as a predictor of JS-MD. The current study seeks to address this gap in the literature by examining individual- and organizational-level factors that explain why employees fail to report (...) workplace accidents. We tested a latent variable structural model positing organizational culture typologies as predictors of JS-MD, which in turn is expected to mediate the relationship with accident underreporting. Using data from 1033 employees in 28 Italian organizations, findings suggest that bureaucratic safety culture was related to lower levels of JS-MD, whereas technocratic safety culture was related to greater JS-MD. In turn, JS-MD positively predicted employee accident underreporting and fully mediated the relationship between culture and underreporting. Theoretical and practical implications are discussed in light of the increasing focus on underreporting as well as the adverse individual and organizational consequences of failing to report workplace accidents. While committed to the view that Buddhist Reductionism offers the best account of the Abhidharma distinction of the two truths, Siderits (2009) argues that Buddhist Reductionism has the surprising consequence of making itself inexpressible. This inexpressibility follows from the semantic insulation between conventional and ultimate discourses that Siderits argues is required in order to preserve classical logic for both types of discourse, avoiding contradiction and bivalence failure. One of Mark Textor’s main aims in Brentano’s Mind is to refute Brentano’s claim that intentionality – the capacity our mental acts have for being of, about, or directed on something – is the mark of the mental. I defend the view that Brentano analysed intentionality in terms of intentional inexistence (and so wasn’t an intentionality primitivist as Textor suggests). And I argue that we can regard intentionality as being the mark of the mental, but only if we give a (...) non-relational analysis of the idea of intentional inexistence. Textor objects to an analysis of intentionality in terms of intentional inexistence for failing to account for the relationship between the object our mental act is directed on, and the ‘immanent’ or ‘inexistent’ object which all mental acts contain. I claim that this problem doesn’t arise if the object our mental act is directed on just is the immanent/ inexistent object. I argue that Brentano (at least sometimes) seems to identify the two. I then offer my own view of intentionality according to which our mental acts are directed on immanent/ inexistent objects, and that ‘directedness’ should be understood non-relationally. (shrink)

This article proposes an analysis of the use of emotions, in particular the shame, characterizing the elenctic method performed by Socrates in the dialogue with Callicles in the third part of Plato’s Gorgias. The elenchus aims at improving the interlocutor through a process of purification that is capable of changing his whole existence. However, Plato’s dialogues only rarely give testimony of a successful transformation occurring in the interlocutor. This is due to the interlocutor’s attitude towards shame : the feeling of (...) shame can be accepted as a mean for self-transformation or hidden to protect a social status. The article will explore the way in which this fundamental difference is delineated within the dialogue by providing appropriate textual examples. Arguably, by outlining the distinction between the types of shame, it is possible to notice how the purification of the interlocutor implies a turning point for the public. This is what I call „outreach elenchus”, a specific hermeneutic figure that allows to understand a form of purification of the audience and the spectators witnessing the debate. This type of elenchus steps in at the very moment in which the Socratic interlocutor attempts to protect his social image, concealing his shame. The audience, thanks to Plato’s literary strategy, realizes the failures of the interlocutor even as he refuses to accept them. As a result, his social image becomes tarnished. (shrink)

Locke's political theory centres on juridical matters of law, right, consent and legitimacy. Despite his concern to differentiate politics from family and posit a free and equal post-familial individual as political subject, this apparently abstract political theory is itself conveyed through a narrative of family. Locke rejects patriarchal absolutism that casts the king as a patriarchal father by thinking politics through alternative conceptions of father, sons and brothers. As such, Locke did not in fact help muster liberalism by instantiating a (...) vivid public-private divide that insulated the political imagination from ideas of family. (shrink)

Background: Essential for the help relation, empathy is the ability to understand, share, and perceive the subjective experience of other human beings. Objective: The objective in this non-experimental, exploratory, and descriptive research was to verify, observe, and document empathy in nursing professionals. Research design: Non-experimental, exploratory, and descriptive research. Participants and research context: the study was conducted at two large hospitals, one public and the other private, across all shifts. The sample included 159 individuals. A questionnaire was used to identify (...) sociodemographic characteristics and the empathy inventory was applied. Ethical considerations: This study received approval from the Research Ethics Committee at the University of São Paulo at Ribeirão Preto College of Nursing, opinion 1348/2011, and authorization from the health institutions involved. Findings: The association tests demonstrated that professionals working in the night shift and in a work scale rotation scheme, older professionals, and professionals with longer professional experience are less empathetic. On the other hand, professionals working in the day shift and in a single shift are more empathetic. Other influential factors are the time on the job, education, and work shift. Conclusion: There is a lack of empathy studies in professional practice contexts, in human resource development programs, and throughout the professional education process. (shrink)

In order to move towards an Ethic of Accounting, one must start by defining the function and role of the accountant. This in turn depends to a great extent on the identity of the client or whatever party the Accountant owes his loyal agency to. The issue is one of cardinal importance, and it is perceived as such by the accountants themselves. Loeb for instance says that the client-identity issue is overriding importance now, and will become even more crucial in (...) the immediate years ahead. The question of what constitutes ethical behaviour on the part of the accountant will depend then upon the relation within which such ethical behaviour will have to be deployed.The main question raised in this paper will therefore be, is the accountant primarily engaged by one client (whether an individual or a corporation) to act as their agent, deal with their problems by loyally advancing their interests to the best of his professional competence, although within the limits imposed by law and morality? Or is the public sector to be considered the principal target of the accountant's resolute professionalism and unswerving loyalty? (shrink)

Democratic decline in various Latin American countries has been accompanied by religious sectors growth. This article aims at interpreting the public presence of Christian churches and their political representatives based on translation as hermeneutical process in which the relationship between religion and public space is observed. Through bibliographical analysis, the text identifies in Ricoeurian translation based hermeneutic applied to religious studies the possibility of interpreting concrete intersubjective and intercontextual translation which are already present in the public space, mainly in two (...) ways: in an intralinguistic dynamics, i.e., the relationship between Christian groups that sufficiently converge onto programmatic actions regarding economic and moral agenda; and in an interlinguistic dimension in the relationship between religious groups and elitist democratic models which constant crisis situation is perhaps beneficial to some sectors. The metaphor of religions as languages also allows the identification of hermeneutic incompatibilities between distinguished theological discourses in the public space, even when they originate from the same tradition. Therefore, translation as hermeneutic process applied to the analysis of religious discourse may become another tool to the field of studies on religion and public space. (shrink)

Some feminist epistemologists make the radical claim that there are varieties of epistemically valid warrant that agents access only through having lived particular types of contingent history, varieties of epistemic warrant to which, moreover, the confirmation-theoretic accounts of warrant favored by some traditional epistemologists are inapplicable. I offer Aristotelian virtue as a model for warrant of this sort, and use loosely Aristotelian vocabulary to express, and begin to evaluate, a range of feminist epistemological positions.

The prevalence and negative impact of brain disorders are increasing. Clinical Neuropsychology is a specialty dedicated to understanding brain-behavior relationships, applying such knowledge to the assessment of cognitive, affective, and behavioral functioning associated with brain disorders, and designing and implementing effective treatments. The need for services goes beyond neurological diseases and has increased in areas of neurodevelopmental and psychiatric conditions, among others. In Europe, a great deal of variability exists in the education and training of Clinical Neuropsychologists. Training models include (...) master’s programs, continuing education courses, doctoral programs, and/or post-doctoral specialization depending on the country, with no common framework of requirements, although patients’ needs demand equal competencies across Europe. In the past five years, the Standing Committee on Clinical Neuropsychology of the European Federation of Psychologists’ Association has conducted a series of surveys and interviews with experts in the field representing 30 European countries. The information, along with information from the existing literature, is used in presenting an overview of current and relevant topics related to policy and guidelines in the training and competencies in Clinical Neuropsychology. An option for the way forward is the EuroPsy Specialist Certificate which is currently offered in Work- and Organizational psychology and Psychotherapy. It builds upon the Basic Certificate and complements national standards without overriding them. General principles can be found that can set the basis for a common, solid, and comprehensive specialty education/training, sharpening the Neuropsychologists’ competencies across Europe. The requirements in Clinical Neuropsychology should be comparable to those for the existing specialty areas in the EuroPsy model. Despite the perceived challenges, developing a Specialist Certificate appears a step forward for the development of Clinical Neuropsychology. Recommendations are proposed towards a shared framework of competencies by the means of a common level of education/training for the professionals in Europe. Benchmarking training standards and competencies across Europe has the potential of providing protection against unqualified and ethically questionable practice, creating transparency, raising the general European standard, and promoting mobility of both Clinical Neuropsychologists and patients in Europe, for the benefit of the professional field and the population. Este artigo pretende apresentar as principais ideias que circundam o problema da demarcação científica a partir da perspectiva do filósofo da ciência Karl Popper. Primeiramente, se buscará apresentar o problema ligado ao raciocínio indutivo, conhecido como o problema da indução. Posteriormente será apresentado o critério de demarcação de Popper, qual seja, a falseabilidade. Por fim, o tratamento que Popper dá à metafísica. Conclui-se que o critério de falseabilidade se caracteriza pela sua decidibilidade unilateral ad falsitatem, ou seja, a ciência deve (...) buscar falsear suas teorias e não as verificar. Através desse critério se possibilita uma justificação lógico-dedutiva da demarcação entre enunciados científicos e metafísicos. O conhecimento científico passa a ser compreendido como corolário oriundo de conjecturas e refutações. A metafísica é elevada à categoria de crítica racional, além de contribuidora do fazer científico através dos programas de pesquisa metafísicos. (shrink)

Este artículo tiene por objeto explicar cuándo en el estado de necesidad la distinción entre un mal mayor o menor responde al universo ético consecuencialista y desde qué consideraciones no lo haría; segundo, explicar por qué es posible desde el principio del doble efecto la ponderación de la vida humana, aceptando la objetivización de sus parámetros según los efectos de una acción. Por ello, a continuación trataremos en la primera sección el concepto de mal en clave consecuencialista y, posteriormente, moral (...) absolutista. Se trata de un análisis sobre la materia que reconoce, en la segunda sección, la importancia de la existencia de estos universos en la ponderación de males. Luego, contrastaremos nuestros razonamientos con las soluciones que, para casos semejantes, se proponen desde el doble efecto para algunas situaciones de estado de necesidad. Finalmente, en la tercera sección, entregaremos los criterios de una política criminal para distinguir y no encubrir exigencias deónticas en el estado de necesidad. (shrink)
