La presente investigación pretende analizar someramente el derecho a la verdad haciendo hincapié en su acepción extrajudicial y, en particular, en la memoria histórica que ha sido abordada mediante la sentencia T - 281 del 2021, en la que en consecuencia al proceso instaurado por el general Marcos Evangelista Pinto Lizarazo en contra del mural urbano ¿Quién dio la orden? Se evidencia la protección constitucional del derecho a la memoria histórica en virtud del pronunciamiento de la Corte Constitucional.

Based on the concept of interactional competence, our study analyzes how learners of Spanish as a foreign language in a B2 level manage repair in oral interaction in language classrooms. We understand repair as “the treatment of trouble in talk-in-interaction”. A corpus of eleven interactions between students in the classroom is analyzed through the perspective of Conversation Analysis. The interactions were collected in different kinds of tasks in the language classroom. In our analysis we compare interactions produced in practice activities (...) and interactions collected during assessment. The findings in this study show a tendency to manage repair in classroom oral interaction as it would be done in normal conversation. Regarding the different contexts of our corpus, we observe that, in interactions produced in assessment contexts, speakers try to protect their interlocutor’s face and their own face by avoiding to make repairs. How does violence shape citizens’ preferences for conflict termination? The existing literature has argued that violence either begets sympathy for more violence or drives support for making peace. Focusing on the 2016 Colombian Peace Agreement, this article finds that victimhood dissociation strongly shapes these preferences. With victimhood dissociation, a discrepancy exists between objective and subjective victimization, and the effect of violence on peace attitudes depends on citizens’ subjective interpretations of their personal experiences of violence. Citizens who do not experience violence (...) often see themselves as victims of the conflict and vice versa. Victimhood dissociation is linked to cultural stereotypes of victimhood as portrayed in elite narratives concerning the conflict. In Colombia, political leaders framed victimhood around rurality, business entrepreneurship, kidnapping, extortion, and disappearance. In 2016, this widespread narrative was instrumental for politicians opposing the peace agreement. Citizens who disassociated their personal experiences of violence from their self-understanding as victims were instrumental to the failure of the peace plebiscite. (shrink)

El problema del maltrato de las personas mayores o del comportamiento negligente hacia ellos ha llevado que sea abordado en diferentes instrumentos de derechos humanos; entre ellos, el Consenso de Montevideo sobre Población y Desarrollo y la Convención Interamericana sobre la Protección de los Derechos Humanos de las Personas Mayores. Teniendo en cuenta este marco jurídico, y como primer paso para abordar la problemática de la mortalidad como consecuencia del maltrato o del comportamiento negligente hacia las personas mayores en nuestro (...) país, el objetivo de este estudio es analizar las tendencias en la mortalidad por causas externas en personas mayores (60 años y más) en Argentina entre 2000 y 2014. Se calcularon tasas de mortalidad por estas causas (por 100.000 habitantes) entre personas de 60 años y más, por sexo, ajustadas por edad por el método directo, utilizando la población estándar de la Organización Mundial de la Salud. Para explorar las tendencias en las tasas de mortalidad por causas externas estandarizadas por edad, utilizaremos modelos de regresión de Jointpoint. Los análisis de Joinpoint se realizan utilizando el Programa de Regresión de Joinpoint v. 4.0.4 del US National Cancer Institute. Se espera que los resultados de este estudio permitan establecer una primera visibilización de la problemática de las causas externas en este grupo poblacional. (shrink)

RESUMEN Cuando se mira la masacre de El Salado, es difícil no preguntarse por los factores que llevaron a esta comunidad de los Montes de María, en el contexto de la guerra rural que vivía Colombia a finales del siglo XX, a volverse un objetivo militar por parte de las A.U.C. (Autodefensas Unidas de Colombia), es decir, a recibir la marca o estigma de 'pueblo guerrillero'; en otras palabras, a convertirse en un pueblo masacrable. El presente artículo intenta abordar esta (...) cuestión y para ello analiza las consecuencias de la ocupación de las FARC desde su ingreso a la región en los noventa. Los modos como este poder fareano dispuso de lógicas guerreristas y dejó poco margen de maniobra y libertad para los pobladores de El Salado; los saladeros no tuvieron opción ni libertad, y la cohabitación se confundió con la colaboración, la pasividad con la pertenencia. En una segunda parte, revisa los efectos de la arremetida brutal de las FARC contra cierto grupo de pobladores (en especial, ganaderos y fuerza pública); de algún modo, la masacre del 2000, ejecutada por las AUC, fue una respuesta impulsada por un odio desmedido frente a una violencia también excesiva por parte de las FARC en los años anteriores a la masacre. En este apartado, se habla acerca del odio y la venganza que se constituyen en afectos que contribuyeron decisivamente -entre otros más- a la masacre del año 2000. Las elaboraciones sobre la economía del odio de Sara Ahmed (2015) y las de Laura Quintana sobre los afectos (2020 y 2021) serán fundamentales. ABSTRACT When looking at the El Salado massacre, we wonder about the factors that led this town of los Montes de María, in the context of the rural war in Colombia at the end of the 20th century, to become a military objective by the A.U.C (Autodefensas Unidas de Colombia), that is, to receive the brand or stigma of 'guerrilla people'; that is, to become a massacrable town. This article tries to address this issue, thus analyzing the consequences of the FARC occupation since its entry into the region in the nineties. Ways like this Farean power had warmer logic and left little room for maneuver and freedom for the residents of El Salado; The saladeros had no choice or freedom, and cohabitation was confused with collaboration, passivity with belonging. in a second part, it reviews the effects of the brutal attack by the FARC against a certain group of residents (especially, ranchers and the military); in a way, the 2000 massacre, carried out by the AUC, was an inordinately hateful response to excessive violence by the FARC in the years before the massacre. In this section, we talk about the hatred and revenge that constitute elements that contributed decisively -among others- to the 2000 massacre. The elaborations on the economy of hate by Sara Ahmed (2015) and the elaborations of Laura Quintana on affects (2020 and 2021) will be fundamental. (shrink)

Over the last decade, Corporate Social Responsibility (CSR) has been defined first as a concept whereby companies decide voluntarily to contribute to a better society and cleaner environment and, second, as a process by which companies manage their relationship␣with stakeholders (European Commission, 2001. Nowadays, CSR has become a priority issue on governments’ agendas. This has changed governments’ capacity to act and impact on social and environmental issues in their relationship with companies, but has also affected the framework in which CSR (...) public policies are designed: governments are incorporating multi-stakeholder strategies. This article analyzes the CSR public policies in European advanced democracies, and more specifically the EU-15 countries, and provides explanatory keys on how governments have understood, designed and implemented their CSR public policies. The analysis has entailed the classification of CSR public policies taking into consideration the actor to which the governments’ policies were addressed. This approach to the analysis of CSR public policies in the EU-15 countries leads us to observe coinciding lines of action among the different countries analyzed, which has enabled us to propose a ‹four ideal’ typology model for governmental action on CSR in Europe: Partnership, Business in the Community, Sustainability, and Citizenship, and Agora. The main contribution of this article is to propose an analytical framework to analyze CSR public policies, which provide a perspective on the relationships between governments, businesses, and civil society stakeholders, and enable us to incorporate the analysis of CSR public policies into a broader approach focused on social governance. This paper proposes to reflect self-critically on an ongoing research project entitled “Grammars of listening,” which started as a philosophical approach to the question of listening at the site of trauma and the challenges this kind of listening poses to our conceptions of memory and history, and has recently shifted to asking about the possible limitations to such a reflection when confronted with a decolonial perspective on temporality. I start by presenting a conceptual background for my inquiry, and asking what (...) kind of listening is required when trauma is considered as a colonizing form of violence – that is, when its effects are not only understood as an assault on life but on the conditions of production of sense that make life legible. Following the kind of challenges that such an understanding of trauma poses to the responsibility to listen to its testimony, the paper moves on to propose that only a decolonial approach to listening can truly do justice to the task of rendering testimonies of traumatic violence audible. By decolonizing the frameworks that organize and determine colonial and colonizing distributions of sense, I propose that grammars of lo inaudito understood as decolonial grammars contribute to resisting and disorganizing the criteria for legibility and audibility that colonizing forms of violence not only institute but constantly actualize in their attempt to perpetuate their silencing power.1. In recent years, discussion around memory modification interventions has gained attention. However, discussion around the use of memory interventions in the criminal justice system has been mostly absent. In this paper we start by highlighting the importance memory has for human well-being and personal identity, as well as its role within the criminal forensic setting; in particular, for claiming and accepting legal responsibility, for moral learning, and for retribution. We provide examples of memory interventions that are currently available for medical (...) purposes, but that in the future could be used in the forensic setting to modify criminal offenders’ memories. In this section we contrast the cases of dampening and enhancing memories of criminal offenders. We then present from a pragmatic approach some pressing ethical issues associated with these types of memory interventions. The paper ends up highlighting how these pragmatic considerations can help establish ethically justified criteria regarding the possibility of interventions aimed at modifying criminal offenders’ memories. Se busca presentar y analizar estos retos desde las consecuencias conceptuales que los contextos traumáticos le plantean a los procesos de elaboración de memoria y a la práctica de escucha de testimonios provenientes de experiencias traumáticas. The digital public forum has challenged many of our normative intuitions and assumptions. Many scholars have argued against the idea of free speech as a suitable guide for digital platforms’ content policies. This paper has two goals. Firstly, it suggests that there is a version of the free speech principle which is suitable for platforms that have adopted a commitment to free speech to guide their content curation strategies. I call it the Principle of Epistemic Resilience. Secondly, it aims to (...) analyze some of the practical implications of the principle. It argues that upholding this principle in the digital public forum requires a comprehensive strategy, including (1) the automated removal and demotion of contents that threaten to cause serious harm; (2) changes to engagement optimization algorithms; and (3) changes to affordances inside the platform. These changes are necessary to create a fertile environment for deliberation, which is crucial to epistemic resilience. If such a comprehensive strategy is absent, platforms may actively undermine the societal value of speech. (shrink)

Utría National Park is a remote biodiversity hotspot in Colombia. It encompasses ancestral territories of the Embera indigenous peoples and borders territories of Afro-descendant communities in El Valle. We explore environmental value conflicts regarding the use of the park, describing them as a Wicked Problem that has no clear solution. Juxtaposing how the territory is perceived by different communities, we employ Faber et al.'s heuristic of the three tele of living nature to search for deficiency in the third telos, service, (...) which we take to be symptomatic of Wicked Problems. Based on field data encoded using the three-tele heuristic, concerning how the respective communities would like to use the park area, we identify deficiencies in the third telos and develop recommendations regarding how these might be addressed. El estudio acerca de la influencia de las pasiones en el voluntario libre ha sido recurrente en la tradición tomista. Sin embargo, las causas de los dos efectos psicológicos de la intentio volitiva mencionados por Tomás de Aquino, la redundantia y la distractio, pasaron desapercibidas, y podrían aclarar algunos comportamientos consecuencia de la dinámica de las pasiones del hombre. La acción de la intentio volitiva originada por los afectos, al alcanzar cierto grado de intensidad, puede llegar a sobrepasar el control (...) de la voluntad y la inteligencia. Además, otro punto original de esta temática es que, a la par que el influjo de “abajo hacia arriba” (pasiones hacia la voluntad) —algo ya mencionado por Aristóteles cuando habla de la intemperancia y por los medievales en el estudio de la voluntad—, también puede detectarse otro de “arriba hacia abajo” (influjos afectivos superiores que influyen en la inteligencia —conocimiento afectivo⎯ y ésta sobre la voluntad), de tal manera que cierto tipo de concentraciones psicológicas hacen que la persona deje de tener sensaciones somáticas hasta producirse en él evasiones temporales, trances inconscientes y efectos extremos similares. Finalmente, desde el punto de vista de la Historia de la Filosofía, este trabajo también muestra que ha habido un olvido en el estudio de esta faceta volitiva de la intentio, ya que se ha estudiado sobre todo su aspecto ético, pero sin relación con la intentio cognoscitiva (“intencionalidad”). En cualquier caso, las tesis sobre la intentio y sus efectos muestran cómo es preciso rebasar el estudio del ámbito natural-biológico para completarlo con el ámbito personal-cultural. (shrink)

Previous studies have shown a robust bias to express the goal path over the source path when describing events. Motivated by linguistic theory, this study manipulated the causal structure of events and measured the extent to which adults and 3.5- to 4-year-old English-speaking children included the goal and source in their descriptions. We found that both children's and adults’ encoding of the source increased for events in which the source caused the motion of the figure compared to nearly identical events (...) in which the source played no such causal role. However, a goal bias persisted overall for both causal and noncausal motion events. These findings suggest that although the goal bias in language is highly robust, properties of the source influence its likelihood of being encoded in language, thus shedding light on how properties of an event can influence the mapping of event components into language. En su libro "La primavera silenciosa" acusaba del deterioro ambiental al poder ilimitado del ser humano. La creencia surgida en la modernidad de que todo lo que el hombre decidía era en sí mismo lo mejor por haber sido fruto de una voluntad libérrima, daba primacía y legitimidad absoluta a su acción sobre la naturaleza. Surgieron con gran fuerza numerosos grupos (...) ecologistas que adoptaron un pensamiento que responde al nombre de "ecología profunda" o "Deep Ecology" descrito por primera vez por Arme Naess en un artículo publicado por la revista Inquiry y titulado "The Shallow and the Deep, Long Range Ecology Movement". Los principios que proponía este movimiento (Naess 1984) pueden ser resumidos en ocho grandes puntos: 1) la vida de los seres no humanos es un valor en sí: 2) la riqueza y la diversidad de estas formas de vida son también valores en sí; 3) los seres humanos no pueden intervenir de manera destructiva en la vida; 4) a este respecto, la intervención humana actual es eminentemente excesiva; 5) por consiguiente, las reglas de juego deben ser radicalmente modificadas; 6) esta modificación radical debe hacerse tanto a nivel de las estructuras económicas como de las estructuras ideológicas y culturales; 7) a nivel ideológico, el cambio principal consiste en apreciar más la calidad de la vida que el goce de los bienes materiales; 8) las personas que acepten estos principios tienen la obligación de contribuir, directa o indirectamente a la realización de los cambios fundamentales que aquellos implican. Siminoff (bio), and Renie Schapiro (bio)This issue of the Kennedy Institute of Ethics Journal (KIEJ) centers on a piece of empirical research. The motivation behind the study of Laura Siminoff, Christopher Burant, and Stuart Youngner (2004) was to find out more about what the general public understands and believes about when a person is dead. More specifically, the study tried to (...) determine how members of the public define death, especially their acceptance and interpretation of the medical concept of "brain death," and their attitudes toward the so-called "dead donor rule," an informal but powerful social and legal norm insisting that the taking of organs for transplantation not cause the death of the source of those organs.As the demand for organs increases and the waiting list grows, the United States has explored multiple ways to expand the pool of potential donors. One approach has been to gerrymander (coherently or not) the line between life and death to shift patients who are extremely compromised but traditionally considered to be in the living category into the dead category. In this way, the dead donor rule remains technically intact. This reasoning is explicit in the report of the Harvard Medical School Ad Hoc Committee (1968) that "introduced" "brain death" to the American culture. Since then, other efforts to redraw the line have been proposed and rejected.One alternative to gerrymandering is to consider under what conditions, if any, it is morally acceptable to violate the dead donor rule. Some would argue that this alternative is the more "honest" approach. Rather than sidestepping moral problems by calling people dead, it brings the moral problems to the surface where the necessity of sticking to the rule can be considered on its own merits. However, when the Journal of the American Medical Association printed a position paper that proposed making anencepahlic newborns an exception to the dead donor rule, along with arguments about why this was acceptable, the outcry was so great that the proposal was retracted (AMA 1995).Clearly, our society has identified organ transplantation as a priority, although two papers in this volume (those by Courtney Campbell and by Megan Crowley-Matoka and Robert Arnold) take issue with that prioritization. The fact that the donor pool has remained relatively stable (and inadequate) despite massive efforts [End Page 211] to increase it speaks, at least in part, to the cultural and legal resistance to "new" ways to procure more organs. Voluntarism seems to have peaked. Financial incentives clash with the heavily endorsed notion of the "gift of life" and seem to many to violate the dignity of the human body. Presumed consent or eminent domain, in which the community has a greater claim to a person's organs than that person or his/her family, go against the grain of American individual freedom and the ethos of patient autonomy.Abandoning the dead donor rule generally is regarded as an even tougher sell to the American public and its legislators. The study by Siminoff and colleagues attempts, among other things, to gauge just how tough this sell would be. What the data actually demonstrate is a matter of interpretation, and this issue of the KIEJ is devoted to some of those interpretations. The authors, with the exception of Daniel Hausman, came together for a meeting in Cleveland, Ohio, during which the study's methods and data were presented with time for questions, clarifications, and general discussion. The authors then worked with the editors to generate the papers printed in this volume.The issue begins with a presentation of the study conducted by Siminoff and colleagues. Marie Curie is the first scientist woman awarded the Nobel Prize in Physics (1903) and another in Chemistry (1911). Her life and her work summarize the tenacity, effort and passion for knowing aspects related to the reality of a new physical-chemical phenomenon: radioactivity. In this semblance, in addition to the scientific aspect, the human aspect that accompanies and sometimes overshadows the lives of great men is shown.

The reporting of clinical trial data is necessary not only for doctors to determine treatment efficacy, but also to explore new questions without unnecessarily repeating trials, and to protect patients and the public from dangers when data are withheld. This issue is particularly salient in those trials involving invasive neurosurgical interventions, such as deep brain stimulation (DBS), for ‘treatment refractory’ psychiatric disorders. Using the federal database ClinicalTrials.gov, it was discovered that out of the completed or unknown‐status trials related to psychiatric (...) DBS up to November 2018, only two had submitted results to ClinicalTrials.gov. These results suggest that, despite federal requirements to report clinical trial data, reporting on psychiatric DBS trials is problematically minimal. It is argued that a human rights approach to this problem establishes a legal and ethical foundation for the need to report clinical trial results in this area. (shrink)

From the use of IV relaxants on criminal suspects during the 1920s to the Global War on Terror, the nexus of drugs, testing, and interrogations will be explored in both the domestic and international contexts.

Este trabalho busca analisar os desdobramentos da relação entre infâncias, juventudes e sexualidades que se apresentam nas escolas em tempos de cerceamentos e perseguições presentes na última década à escola. Falar de infância é discorrer sobre corpos e, justamente por isso, é indissociável da sexualidade. As relações interpessoais que ocorrem nos espaços escolares são imprescindíveis para socializações com vidas outras. No entanto, após a censura da temática de gênero e sexualidades nos planos educacionais recentes, bem como na Base Nacional Comum (...) Curricular, e frente às sistemáticas perseguições aos professores interessados em sua discussão, nosso intuito é indagar o lugar do corpo e da sexualidade na escola, sobretudo em tempos de neoconservadorismo e pós-fascismo. Enquanto definição, entendemos por neoconservadorismo os novos agenciamentos que a matiz conservadora se utilizou para a sua consolidação na população brasileira; e, por pós-fascismo, as novas esferas de sociabilidades a partir de pragmatismos à identificação de valores comum na sociedade na promoção do pânico moral. Para sustentarmos nossa análise, utilizaremos três cenas escolares de educação para a sexualidade, entendidas aqui como práticas de resistências. Estas, muito embora recentemente vistas na sociedade como responsáveis pela destruição da família tradicional brasileira (de base heteronormativa), são valorizadas para a promoção de infâncias seguras. Tras una descripción de las características de nuestra actual cultura tecnocientífica y con ejemplos de su influencia en nuestra sociedad, se pone de manifiesto una tendencia en la educación superior que consiste en eliminar la reflexión acerca de quiénes somos y cómo vivimos en la sociedad. El futuro del conocimiento se orienta hacia una “hipertrofia” tecnológica produciendo una “atrofia” antropológica por dejar de lado “el saber sapiencial” de las Humanidades, sobre todo de la Filosofía, que ayuda a comprender mejor el (...) “todo” y no quedar anclados en “partes” desencajadas. Esto aumentaría las posibilidades de descubrir estrategias adecuadas para corregir muchos de los problemas que estamos viviendo en nuestra era tecnocientífica. (shrink)

Uno de los temas fundamentales de la filosofía realista es la intentio. Este concepto surgió en la filosofía árabe a partir de la idea aristotélica que explica la posibilidad del alma de apropiarse de las formas de las cosas. La intentio es el vínculo referencial entre la realidad y el intelecto en el acto de conocer. En la primera parte del artículo se hace una revisión conceptual del término con especial énfasis en Avicena y Averroes; y en la segunda parte (...) se explica la idea de la intentio en dos filósofos tomistas contemporáneos. El objetivo principal de este estudio es volver a subrayar la conexión real que se establece entre el sujeto cognoscente y las cosas de la realidad. Que la tecnología nos ha cambiado la vida es una verdad de perogrullo. Y, la pertinencia de una reflexión científica sobre la tecnología, a estas alturas, tampoco plantea dudas. La técnica nos rodea y no es posible ignorarla ni detenerla, ya no hay vuelta atrás, a menos que se produzca una catástrofe. Pero, ¿es posible que se produzca? En esta comunicación pongo de manifiesto la necesidad de congeniar dos puntos que suelen presentarse enconados: la naturaleza y la tecnología. Esta necesidad (...) no viene impuesta por un deseo romántico de contemporizar a los partidarios de ambos extremos, sino de poner de manifiesto que este enfrentamiento y ruptura es uno de los peligros que pueden impedir la prolongación de la vida de la especie humana. Deseo a toda costa evitar el catastrofismo, pero también mostrar que con la tecnología, en poco tiempo, hemos llegado muy lejos y es perentorio asumir responsabilidades. (shrink)

La intuición es un tipo de conocimiento que consiste en captar de modo inmediato la esencia de las cosas y comprenderlas de forma directa sin llevar a cabo un proceso discursivo. Algunas filosofías rechazan este modo de conocer por ser falible, otros la enmarcan dentro de los fenómenos extrasensoriales e incluso paranormales. En este trabajo se considera la intuición en Jacques Maritain, no en su aspecto de fenómeno sobrenatural, sino como una vía de aprehensión de la realidad adquirida por métodos (...) ordinarios de conocimiento que nos revelan aspectos a los que no podemos llegar de otra forma. Los análisis sobre crónica periodística se basan en concepciones amplias, atemporales e inasibles que no consideran factores como la historización de los textos, las particularidades de sus autores, así como las coyunturas a las que deben responder sus temáticas en tanto trabajos periodísticos. Por ello proponemos estudiar la crónica como un producto cultural e histórico que se redefine al ser estudiado dentro del contexto en que se origina, valorarlo en tanto producto textual y después ponerlo en diálogo con su autor (...) y su sociabilidad. Para profundizar en ello, tomamos como ejemplo tres crónicas de autoras mexicanas contemporáneas (Magali Tercero, Marcela Turati y Lydiette Carrión) y las sometemos a la metodología propuesta. The studies on Nietzsche and Buddhism in the Nietzsche literature are rather recent. The first English monograph on the subject was Freny Mistry’s Nietzsche and Buddhism: Prolegomenon to a Comparative Study, followed by Robert G. Morrison’s Nietzsche and Buddhism: A Study in Nihilism and Ironic Affinities. While Mistry’s study focuses on the Buddhist and the Nietzschean theories of eternal recurrence, Morrison’s compares Nietzsche’s concepts with Buddhist tenets. Desde la consideración de Tomás de Aquino del conocimiento por connaturalidad, "el conocimiento que aporta a la inteligencia más datos que los puramente racionales, especialmente todos los datos proporcionados por la afectividad", es posible hacer un acercamiento integral a la realidad y establecer una relación con otras áreas de sabiduría y sus objetos de estudio. Esto ayuda a confrontar algunos problemas filosóficos reales, como la pérdida de la visión holística de la realidad, el reduccionismo epistemológico y el relativismo gnoseológico. Recordar (...) el estudio iniciado en la primera parte del siglo XX por tomistas bien conocidos sobre la connaturalidad ayudaría a comprender mejor la realidad y el ser humano, y facilitaría el diálogo entre Filosofía, Ciencia y Teología sobre temas como Ecología, Estética o Mística.
