A journey through sound, memory, and landscapes, questioning the origins, perception, and cultural implications of music. A lifelong relation to sound and music underlies Latifa Echakhch’s work. On the occasion of her representation of the Swiss Pavilion for the 59th Venice Biennale, she has edited a volume on sound, memory, and perception. In the book, images of her installation in the Swiss Pavilion, The Concert, accompany her own writings along with this by Alexandre Babel and Francesco Stocchi, the co-curators (...) of the pavilion. The volume also includes interviews with and collected texts by François J. Bonnet, Emanuele Quinz, Maxime Guitton, Alvin Curran, Salomé Voegelin, Antoine Chessex, Jonathan Sterne, Juliette Volcler, and Raphaël Brunner. Confronting knowledge, reflection, and intuition, their combined concert of thoughts confirms how sound and music—and their absence—play a crucial role in our physical and cultural perception of the world, and how they allow us to expand our bodily and cognitive experience. This study investigates how adoption of advisory governance policy encourages firms to become more responsive to their shareholders over time. Although shareholder activism is costly and often viewed as unable to drive meaningful change, we identify increasing shareholder voice as an underlying mechanism to explain how advisory policy adoption ultimately reshapes board–shareholder relations. Drawing on signaling theory and behavioral views of board–shareholder dynamics, we test our predictions following the broad shift in corporate board voting policies from plurality to majority vote (...) standards. While prior research shows that majority vote adoption has little to no direct impact on director elections, empirical results from 2,390 firm-year observations provide support for our hypotheses that adoption of this advisory electoral standard signals a willingness to hear shareholder concerns, leading to increased shareholder activism and, in turn, board responsiveness to shareholder proposals. Overall, our results help explain why some firms continue to fight the purely advisory policy and why an era of shareholder empowerment followed the majority vote campaign. (shrink)

Christian missionary evangelization reached its culminating point during the nineteenth century. Many experts in the field of missionary studies owe this flurry of Christian missions to an equivalent extending reach of imperialism, which, they contend, had largely facilitated the work of the Christian missions, providing them with the necessary logistic and financial support. The present paper puts forward a different view based on the trajectory of the Christian missions in Morocco at the epoch. It argues that the grand aims of (...) imperialism were far from being spiritual. Furthermore, the political situation of Morocco during the colonial era, being a highly disputed colonial territory amongst the then superpowers, Britain and France, generated a conflict of interests that influenced the missions’ strategies of work there. The claim that Christian missionaries served as imperial agents in Morocco, working on promoting the high interests of their colonial countries, is open to question. (shrink)

This paper discusses in critical terms Muhammad ‘Abd al-Jabiri’s influential philosophical work. It engages, in particular, in the analysis of the assumptions underlying the radical contrast that al-Jabiri sets up between Avicenna’s philosophy – which is supposed to represent irrationality and Gnosticism – and that of Averroes who, according to him, breaks decisively with that current of thought and thus makes exercising philosophical thought once again possible. After a close discussion of the positions of classical philosophers , the author concludes (...) that it is the very validity of the notion of “Arab reason” that has to be questioned in al-Jabiri’s analysis. Background Protecting the privacy of research participants is widely recognized as one of the standard ethical requirements for clinical research. It is unknown, however, how research professionals regard concepts of privacy as well as the situations in the research setting that require privacy protections. The aim of this study was to explore the views of research professionals from Arab countries regarding concepts and scope of privacy that occur in clinical research. Methods We adopted an exploratory qualitative approach by the use (...) of focus group discussions. We recruited individuals involved in research from Egypt and Morocco. We analyzed focus group data via a constant comparison approach, which consisted of close reading of the transcribed interviews followed by coding and then determining themes and subthemes. Results Between August 2016 and July 2018, we conducted nine focus group discussions. Respondents discussed several privacy issues that occurred before the research began ; during research, and after the research. Respondents revealed their perspectives of patients towards privacy in the clinical and research settings and mentioned that patients are more likely to permit access to their privacy in the clinical setting compared with research setting due to the existence of benefits and trust in clinical care. Respondents also recommended training regarding data protections for individuals involved in research. Conclusions Our study shows that research professionals discussed a range of privacy issues that are present during the different stages of research. We recommend 1) development of standards regarding privacy protections during recruitment efforts; 2) additional training for individuals involved in research regarding best practices with data security in secondary research; 3) a quantitative study involving investigators and REC members to determine their knowledge, attitudes and practices regarding privacy issues that occur in research; and 4) a quantitative study involving patients to elicit their views regarding their privacy concerns in research. If Place Spirituality is considered as an attachment experience to a geographic place or an “object,” for Muslims this concept can be explained by the sharia or Islamic law. However, in the highest level of experience as a Muslim, one may attach to God everywhere and at all times, without consideration of any place, time, or object. This experience can clearly be understood with the explanation of the three levels for Muslims: sharia or “conceptual knowledge,” tariqa or “experiential knowledge,” and (...) ma’rifa or “divine spiritual experiences” or “spiritual consciousness”. At the first and second levels, one may have a Place Spirituality, while at the third level the understanding of and connection to God might be enhanced, and the experience to connect to God can be everywhere, all the time. This paper presents a methodology to design and implement programs intended to decide cases, described as sets of factors, according to a theory of a particular domain based on a set of precedent cases relating to that domain. We useDialectical Frameworks, a recent development in AI knowledge representation, as the central feature of our design method. ADFs will play a role akin to that played by Entity–Relationship models in the design of database systems. First, we explain how the factor hierarchy (...) of the well-known legal reasoning system CATO can be used to instantiate an ADF for the domain of US Trade Secrets. This is intended to demonstrate the suitability of ADFs for expressing the design of legal cased based systems. The method is then applied to two other legal domains often used in the literature of AI and Law. In each domain, the design is provided by the domain analyst expressing the cases in terms of factors organised into an ADF from which an executable program can be implemented in a straightforward way by taking advantage of the closeness of the acceptance conditions of the ADF to components of an executable program. We evaluate the ease of implementation, the performance and efficacy of the resulting program, ease of refinement of the program and the transparency of the reasoning. This evaluation suggests ways in which factor based systems, which are limited by taking as their starting point the representation of cases as sets of factors and so abstracting away the particular facts, can be extended to address open issues in AI and Law by incorporating the case facts to improve the decision, and by considering justification and reasoning using portion of precedents. The third of Berman and Hafner’s early nineties papers on reasoning with legal cases concerned temporal context, in particular the evolution of case law doctrine over time in response to new cases and against a changing background of social values and purposes. In this paper we consider the ways in which changes in case law doctrine can be accommodated in a recently proposed methodology for encapsulating case law theories, and relate these changes the sources of change identified by Berman and (...) Population-based genomics studies have proven successful in identifying genetic variants associated with diseases. High-quality biospecimens linked with informative health data from diverse segments of the population have made such research possible. However, the success of biobank research depends on the willingness of the public to participate in this type of research. We aimed to explore the factors associated with the willingness of the public to participate in biobank research from four low- and middle-income countries in the Arab region (Egypt, Jordan, (...) Morocco, and Sudan). We used a previously validated questionnaire to assess several constructs that included the public’s perceptions, attitudes, and willingness to participate in biobank research. We recruited 967 participants. More than half did not have prior awareness of biobanks. Participants’ willingness to donate biospecimens and health data was less than 10%. Our results also showed that participants harbored concerns with trust, privacy, and with data-sharing involving international researchers. Predictors of willingness to participate in biobank research included no previous involvement in research and positive attitudes toward biobanks. Finally, our study showed several differences between the four countries regarding several of the investigated constructs. We conclude there should be additional efforts to raise public awareness and enhance perceptions of the public in biobanking research to enhance trust. We further recommend qualitative research to explore the underlying factors that contribute to the public’s concerns with international data sharing that would enhance global health. (shrink)

Members of research ethics committees (RECs) face a number of ethical challenges when reviewing genomic research. These include issues regarding the content and type of consent, the return of individual research results, mechanisms of sharing specimens and health data, and appropriate community engagement efforts. This article presents the findings from a survey that sought to investigate the opinions and attitudes of REC members from four Arab countries in the Middle East and North Africa (Egypt, Morocco, Sudan, and Jordan) toward these (...) ethical issues. Our findings suggest that efforts are required to better familiarize REC members with the requirements for ethical biobank research. Additionally, we recommend that further research is undertaken with REC members regarding the main items that should be present in the Material Transfer Agreements /Data Transfer Agreements in their corresponding countries and the type of consent that should be used in genomic research. Constitutional and judicial law-making is increasingly beginning to find its reflection not only in the Anglo-Saxon, but also in the Romano-Germanic legal family. However, the prerequisites for the use of this legal instrument are different, which determines the relevance of conducting a comparative analysis regarding the provision of such a mechanism in the USA and Kazakhstan. The purpose of the research is to identify common and distinctive features in the process of implementation of constitutional and judicial law-making in countries belonging (...) to different legal systems. The article uses the methods of analysis, synthesis, comparison, deduction and generalization. As a result, the specificity of ensuring the mechanism of constitutional law-making in the USA was expressed, taking into account various forms of law-making activity. It has been established that the development of constitutional provisions in the United States takes place with the help of the constitutional doctrines of the Supreme Court of the United States, which provide for the introduction of amendments to constitutional provisions without a formal procedure. As a result of the study of the experience of Kazakhstan, it was established that special priority was given to the role of precedent, in particular, the decision of the Supreme Court of the Republic of Kazakhstan. This is explained by the integrative nature of the Romano-Germanic legal system, which allows effective development of national legislation as a whole and its provisions. The obtained results can be used during the professional training of judges in the Republic of Kazakhstan. (shrink)

French description: Ce texte d'Avicenne est l'un des seuls commentaires sur Aristote laisses par le philosophe persan. Il s'attaque au noyau theologique de la Metaphysique du Stagirite, les chapitres 6 a 10 du livre Lambda. Avicenne depend d'une tradition greco-arabe (Alexandre d'Aphrodise, Themistius, l'ecole "peripateticienne" (...) de Bagdad). La tradition arabe a aussi attribue a Aristote plusieurs oeuvres d'origine neoplatonicienne, notamment une Theologie adaptee de Plotin, et un Livre du Bien pur, adaptation des Elements de Theologie de Proclus. Le Dieu d'Aristote est ainsi pour Avicenne la Cause premiere efficiente de l'etre. La structure hierarchique de l'univers resulte de l'emanation produite par l'autointelligence du premier Principe. Pour lui rendre hommage, quatorze collègues et amis de renommée internationale se sont réunis pour poursuivre ses réflexions sur ces thèmes. In two studies, we explored whether susceptibility to false memories and the underestimation of prior memories tap overlapping memory phenomena. Study 1 investigated this issue by administering the Deese/Roediger–McDermott task and the forgot-it-all-along task to an undergraduate sample . It was furthermore explored how performances on these tasks correlate with clinically relevant traits such as fantasy proneness, dissociative experiences, and cognitive efficiency. Results show that FIA and DRM performances are relatively independent from each other, suggesting that these measures empirically apparently (...) refer to separate dimensions. However, they do not seem to define different profiles in terms of dissociation, fantasy proneness, and cognitive efficiency. Study 2 replicated the finding of relative independence between false memory propensity and the underestimation of prior memories in people with a history of childhood sexual abuse. (shrink)

Latifa ez-Zeyyat is among the leading women writers of Egypt in the twentieth century. She has many works in different fields such as novels, stories, critical articles and translations. The period when she started her writing career was a period when Socialism and Marxism movements peaked in the Arab world. These movements influenced many writers of that period and this situation was also reflected in their works. Since Zeyyat has a Marxist view of life, traces of these movements can (...) be seen in her works. Zeyyat, one of the Socialist Realist writers, generally focused on social themes in her works. The story "el-Memerru'd-Dayyik" is a story in Zeyyât's "e-Şeyhûha ve Kısasun Uhrâ" story series. The story is fictionalized in the context of the life adventures, struggles and family relationships of the mother and her two primary school daughters. However, the writer's criticisms of society and socio-economic order also show themselves in the story. In this study, the technical analysis of Latîfe ez-Zeyyât's "el-Memerru'd-Dayyik" story was made and the story was examined within the framework of sociological criticism and psychoanalysis literary theories. In this way, it is aimed to have information about the structure of the story, its fiction, the themes it deals with and the author's story. (shrink)

The radical Islamist regime of the Taliban affords an extensive view of the logic of Muslim fundamentalism regarding the public and private spheres. I argue that the Taliban de-privatized several life-spheres, "publicizing" religion and the body. The Taliban performed power as public spectacle, employing public executions, amputations and whippings. Religion, too, was to be completely public, as Habermas argues it was in Europe before the 18th century. As soon as they took Kabul, the Taliban insisted that all residents had to (...) say their five daily prayers, the men in mosques. Likewise, men were given six weeks to grow out their beards to a hand's length and to trim their moustaches in accordance with a literal reading of sayings about the Prophet Muhammad's appearance. The young female memoirist of life in Taliban Kabul, Latifa, reported that her middle class father complied with the new rule, but insisted, "My beard belongs to the Taliban, not to me!" The rendering public of religion made public property of every religious act. His body had a choice, of being conformed to the movements and shaping of religion, or of being tortured because of lack of compliance. This publicization of the believer's body resulted in an alienation from individuals of parts of themselves. Likewise, the gendered character of the public and private spheres, with women being confined to the private, is as visible in Taliban thinking as it is in Hegel. The expansion of the public realm of religion and morality by the Taliban had the effect of shrinking the private sphere and so constraining women further. Girls' schools were shuttered and many war widows were reduced to begging and risking sanctions for being in the street without a male guardian. Posters of Bollywood actresses were forbidden, and Kate Winslet was condemned to death in absentia for portraying a fornicator in The Titanic. It is argued that the goal of perfectly privatizing the female body lay behind these Draconian measures. (shrink)
