The Public International Law Theory of Hans Kelsen: Believing in Universal Law.Jochen von Bernstorff - 2010 - Cambridge University Press.
This analysis of Hans Kelsen's international law theory takes into account the context of the German international legal discourse in the first half of the twentieth century, including the reactions of Carl Schmitt and other Weimar opponents of Kelsen. The relationship between his Pure Theory of Law and his international law writings is examined, enabling the reader to understand how Kelsen tried to square his own liberal cosmopolitan project with his methodological convictions as laid out in his Pure Theory of (...)

  18. How to Do Things with Words: The William James Lectures Delivered in Harvard University in 1955.J. L. Austin - 1962 - Oxford, England: Oxford University Press UK.
First published in 1962, contains the William James Lectures delivered at Harvard University in 1955. It sets out Austin's conclusions in the field to which he directed his main efforts for at least the last ten years of his life. Starting from an exhaustive examination of his already well- known distinction of performative utterances from statements, Austin here finally abandons that distinction, replacing it by a more general theory of 'illocutionary forces' of utterances which has important bearings on a wide (...)

Inference and Inductive Risk in Disorders of Consciousness.L. Syd M. Johnson - 2016 - American Journal of Bioethics Neuroscience 7 (1):35-43.
Several types of inferences are employed in the diagnosis and prognosis of patients with brain injuries and disorders of consciousness. These inferences introduce unavoidable uncertainty, and can be evaluated in light of inductive risk: the epistemic and nonepistemic risks of being wrong. This article considers several ethically significant inductive risks generated by and interacting with inferences about patients with disorders of consciousness, and argues for prescriptive measures to manage and mitigate inductive risk in the context of disorders of consciousness.

Alan Millar's paper (2011) involves two parts, which I address in order, first taking up the issues concerning the goal of inquiry, and then the issues surrounding the appeal to reflective knowledge. I argue that the upshot of the considerations Millar raises count in favour of a more important role in value-driven epistemology for the notion of understanding and for the notion of epistemic justification, rather than for the notions of knowledge and reflective knowledge.

Kvanvig develops a philosophical account of hell which does not depend on a retributive model and argues that it is adequate on both philosophical and theological grounds.

Conceptions of autonomy in western philosophy and ethics have often centred on self-governance and self-determination. However, a growing bulk of literature also questions such conceptions, including the understanding of the autonomous self as a self-governing independent individual that chooses, acts, and lives in accordance with her or his own values, norms, or sense of self. This article contributes to the critical interrogation of selfhood, autonomy, and autonomous decision making by combining a feminist focus on relational dimensions of selfhood and autonomy (...)

Ex-vivo tissue engineering is an emerging medical technology. Its aim is to regenerate tissues and organs and to restore them to full physiological activity. Some clinical trials with human tissue engineered products have been conducted and others will follow. These trials not only have to confirm the therapeutic value of the HTEP, they also have to provide insight in its regenerative activity, its safety and long-term effects. The development of these trials is aggravated by the complexity of the tissue engineering (...)

  31. Quod non omnia possibilia ad existentiam perveniant.Mogens Lærke - 2007 - The Leibniz Review 17:1-30.
In the Nouveaux Essais, Leibniz famously declared that he once had “begun to lean towards” Spinozist necessitarianism. In this article, I argue that this remark refers to his modal philosophy anterior to 1677. Leibniz’s mature refutation of Spinoza’s necessitarianism relies on the notion that pure possibility has some sort of reality in God’s mind, because only this allows for a strong notion of divine choice. But I believe that Leibniz only developed this ontology of possibility after 1677. Before this date, (...)

On one view of ethical development, someone not yet virtuous can reliably progress by engaging in what meaningfully resembles virtuous conduct. However, if the well-intended conduct is psychologically demanding, one's character, precisely because one is not yet virtuous, may worsen rather than improve. This risk of degradation casts doubt on the developmental view. I counter the doubt through one interpretation and one application of the Mengzi. In passage 2A2, invoking the image of a farmer who “helped” the crop grow by (...)

In this aricle, I argue that Descartes can be seen as a occupying a distinct middle ground between ancient music theory, which was being revived in the Renaissance, and eighteenth-century aestheticians. Descartes’ approach to music had its roots in humanist thought but, even from the start, it wasn’t simply another humanist theory of music. The views Descartes begins to develop in his early years, in the Compendium musicae (1618), is continuous with the views he articulates near the end of his (...)

The Subjective Perspective in Introspection.L. Salje - 2016 - Journal of Consciousness Studies 23 (3-4):128-145.
As an empirical example of introspective conditions in which the normal sense of self is disrupted, the delusion of thought insertion is of special interest to philosophers investigating the epistemic and phenomenological structures of introspection. A common strategy is to use immunity to error through misidentification as a tool with which to pick apart the implications of thought insertion for our understanding of the faculty of introspection. In this paper I turn that strategy on its head: I draw on our (...)

In this article, I discuss Leibniz's interpretation of the cosmological argument for the existence of God. In particular, I consider whether Leibniz's position on this point was developed partly in reference to Spinoza's position. First, I analyze Leibniz's annotations from 1676 on Spinoza's Letter 12. The traditional cosmological argument, as found in Avicenna and Saint Thomas for example, relies on the Aristotelian assumption that an actual infinite is impossible and on the idea that there can be no effect without a (...)

This article explores the philosophical concept of akrasia, also known as weakness of will, and demonstrates its relevance to clinical practice. In particular, it challenges an implicit notion of control over one’s actions that might impede recovery from substance misuse. Reflecting on three fictional case vignettes, we show how philosophical work on akrasia helps avoid this potentially harmful notion of control by supporting a holistic engagement with people for whom substance misuse is a problem. We argue that such engagement enhances (...)
