Entre 1909 et 1913 le physicien Jakob Kunz proposa une théorie de l’effet photoélectrique fondée sur l’idée que la lumière est constituée de puises électromagnétiques, ainsi que l’avait proposé J.J. Thomson. L’histoire de cette théorie est résumée ici en examinant plus particulièrement la façon dont Kunz exploita ses résultats expérimentaux à l’aide d’une analyse a posteriori de ses données.

This analysis of Hans Kelsen's international law theory takes into account the context of the German international legal discourse in the first half of the twentieth century, including the reactions of Carl Schmitt and other Weimar opponents of Kelsen. The relationship between his Pure Theory of Law and his international law writings is examined, enabling the reader to understand how Kelsen tried to square his own liberal cosmopolitan project with his methodological convictions as laid out in his Pure Theory of (...) Law. Finally, Jochen von Bernstorff discusses the limits and continuing relevance of Kelsenian formalism for international law under the term of 'reflexive formalism', and offers a reflection on Kelsen's theory of international law against the background of current debates over constitutionalisation, institutionalisation and fragmentation of international law. It sets out Austin's conclusions in the field to which he directed his main efforts for at least the last ten years of his life. Starting from an exhaustive examination of his already well- known distinction of performative utterances from statements, Austin here finally abandons that distinction, replacing it by a more general theory of 'illocutionary forces' of utterances which has important bearings on a wide (...) variety of philosophical problems. Several types of inferences are employed in the diagnosis and prognosis of patients with brain injuries and disorders of consciousness. These inferences introduce unavoidable uncertainty, and can be evaluated in light of inductive risk: the epistemic and nonepistemic risks of being wrong. This article considers several ethically significant inductive risks generated by and interacting with inferences about patients with disorders of consciousness, and argues for prescriptive measures to manage and mitigate inductive risk in the context of disorders of consciousness.

Alan Millar's paper (2011) involves two parts, which I address in order, first taking up the issues concerning the goal of inquiry, and then the issues surrounding the appeal to reflective knowledge. I argue that the upshot of the considerations Millar raises count in favour of a more important role in value-driven epistemology for the notion of understanding and for the notion of epistemic justification, rather than for the notions of knowledge and reflective knowledge.

This work develops an understanding of hell that is common to a broad variety of religious perspectives, and argues that the usual understandings of hell are incapable of solving the problem of hell. Kvanvig develops a philosophical account of hell which does not depend on a retributive model and argues that it is adequate on both philosophical and theological grounds.

Conceptions of autonomy in western philosophy and ethics have often centred on self-governance and self-determination. However, a growing bulk of literature also questions such conceptions, including the understanding of the autonomous self as a self-governing independent individual that chooses, acts, and lives in accordance with her or his own values, norms, or sense of self. This article contributes to the critical interrogation of selfhood, autonomy, and autonomous decision making by combining a feminist focus on relational dimensions of selfhood and autonomy (...) with phenomenological philosophy of the embodied self as being-in-the-world. It offers a philosophical investigation of different dimensions of bodily relational autonomy by turning to phenomenological accounts of the lived body as self-reflexive. When so doing, we hope to contribute to bridging the gap that sometimes exists between discussions of autonomy in analytic moral philosophy and of freedom and facticity in phenomenological philosophy. We see this gap as unfortunate, and hold that a nuanced understanding of autonomy and autonomous decision making can be reached if these strands of philosophy are brought into dialogue. (shrink)

Objective: To describe the frequency of support for terminal sedation among internists, determine whether support for terminal sedation is accompanied by support for physician assisted suicide , and explore characteristics of internists who support terminal sedation but not assisted suicide.Design: A statewide, anonymous postal survey.Setting: Connecticut, USA.Participants: 677 Connecticut members of the American College of Physicians.Measurements: Attitudes toward terminal sedation and assisted suicide; experience providing primary care to terminally ill patients; demographic and religious characteristics.Results: 78% of respondents believed that if (...) a terminally ill patient has intractable pain despite aggressive analgesia, it is ethically appropriate to provide terminal sedation . Of those who favoured terminal sedation, 38% also agreed that PAS is ethically appropriate in some circumstances. Along a three point spectrum of aggressiveness in end of life care, the plurality of respondents were in the middle, agreeing with terminal sedation but not with PAS. Compared with respondents who were less aggressive or more aggressive, physicians in this middle group were more likely to report having more experience providing primary care to terminally ill patients and attending religious services more frequently .Conclusions: Support for terminal sedation was widespread in this population of physicians, and most who agreed with terminal sedation did not support PAS. Most internists who support aggressive palliation appear likely to draw an ethical line between terminal sedation and assisted suicide. (shrink)

Ex-vivo tissue engineering is an emerging medical technology. Its aim is to regenerate tissues and organs and to restore them to full physiological activity. Some clinical trials with human tissue engineered products have been conducted and others will follow. These trials not only have to confirm the therapeutic value of the HTEP, they also have to provide insight in its regenerative activity, its safety and long-term effects. The development of these trials is aggravated by the complexity of the tissue engineering (...) process and product. This paper investigates how this complexity influences the ethical conduct of clinical trials with HTEPs. We focus on the value and validity of the trial, the risk-benefit ratio and the protection of the trial participant. We argue that trials with HTEPs need a robust methodology. The risk-benefit ratio of a new HTEP must be determined and compared with available efficacious therapies. This requires the identification and minimisation of risks associated with tissue engineering. Finally a process as complex as tissue engineering presents serious challenges for the informed consent process, and for the protection of the trial participant during and after the trial. (shrink)

In the Nouveaux Essais, Leibniz famously declared that he once had “begun to lean towards” Spinozist necessitarianism. In this article, I argue that this remark refers to his modal philosophy anterior to 1677. Leibniz’s mature refutation of Spinoza’s necessitarianism relies on the notion that pure possibility has some sort of reality in God’s mind, because only this allows for a strong notion of divine choice. But I believe that Leibniz only developed this ontology of possibility after 1677. Before this date, (...) he inclined towards the view that non existing possibilities are mere logical abstractions that God never actually conceives. In order to show this, I analyze a series of early texts written between 1668 and 1676. Next, I consider a series of texts from 1677-1678, where Leibniz developed his ontology of possibility and put it to use against Spinozist necessitarianism for the first time. (shrink)

On one view of ethical development, someone not yet virtuous can reliably progress by engaging in what meaningfully resembles virtuous conduct. However, if the well-intended conduct is psychologically demanding, one's character, precisely because one is not yet virtuous, may worsen rather than improve. This risk of degradation casts doubt on the developmental view. I counter the doubt through one interpretation and one application of the Mengzi. In passage 2A2, invoking the image of a farmer who “helped” the crop grow by (...) pulling the sprouts, MENG Ke cautions, “do not help it grow.” I defend a novel interpretation: do not advance with a naïve negligence about your psycho-physiological constitution. I also show how to advance with realistic care by pointing out an overlooked application of a much-discussed cultivation technique illustrated in Mengzi 1A7: ethical reflection can conciliate one with one’s ongoing or past advanced action, lowering the action’s risk of degradation. In this aricle, I argue that Descartes can be seen as a occupying a distinct middle ground between ancient music theory, which was being revived in the Renaissance, and eighteenth-century aestheticians. Descartes’ approach to music had its roots in humanist thought but, even from the start, it wasn’t simply another humanist theory of music. The views Descartes begins to develop in his early years, in the Compendium musicae (1618), is continuous with the views he articulates near the end of his (...) life in the Passions of the Soul (1649). And the position on the effects of music is an interesting and important one, bridging humanist thought with the new philosophy. Unlike the humanists, Descartes will be unwilling to identify particular musical proportions as intrinsically connected with pleasure or other affects, but he will nevertheless develop an objective account of aesthetic value. As an empirical example of introspective conditions in which the normal sense of self is disrupted, the delusion of thought insertion is of special interest to philosophers investigating the epistemic and phenomenological structures of introspection. A common strategy is to use immunity to error through misidentification as a tool with which to pick apart the implications of thought insertion for our understanding of the faculty of introspection. In this paper I turn that strategy on its head: I draw on our (...) understanding of introspection and of thought insertion to make two correctives to the literature on immunity to error through misidentification. The first is the identification of a formal distinction between two phenomena sometimes conflated under the rubric of misidentification errors. The second is a weakening of the presumed significance of claims to immunity to error through misidentification. With these tightenings to the notion of immunity to error through misidentification in hand, we will be in a better position to turn again to questions about the epistemic and phenomenological nature of introspection. In this article, I discuss Leibniz's interpretation of the cosmological argument for the existence of God. In particular, I consider whether Leibniz's position on this point was developed partly in reference to Spinoza's position. First, I analyze Leibniz's annotations from 1676 on Spinoza's Letter 12. The traditional cosmological argument, as found in Avicenna and Saint Thomas for example, relies on the Aristotelian assumption that an actual infinite is impossible and on the idea that there can be no effect without a (...) cause. From these premises, the argument concludes that God must be the uncaused first cause of all things. In Letter 12, Spinoza follows Chasdai Crescas and rejects this proof. Instead, he develops a variant of the cosmological argument which depicts God as the self-caused ground of all causes or things. In his annotations, Leibniz agrees with Spinoza about the inadequacy of the traditional argument, but remains ambiguous as to Spinoza's conception of God as a self-caused being. Next, I turn to Leibniz's comments from 1678 on Spinoza's Ethics. Here, Leibniz develops an original interpretation of the cosmological argument based entirely on the consideration of conceptual relations. Leibniz's argument depicts God as an uncaused being conceived through itself which is the condition of conceivability of all things. I argue that Leibniz developed this argument in deliberate opposition to Spinoza's conception of God as the self-caused ground of all causes or things. (shrink)

Nous explorons le dispositif théorique qu’il propose pour déterminer les limites justes entre la censure et la liberté de pensée; dispositif qui permet, dans chaque cas, de choisir entre la réfutation savante et la suppression autoritaire des textes estimés pernicieux pour la morale ou la piété.

This article explores the philosophical concept of akrasia, also known as weakness of will, and demonstrates its relevance to clinical practice. In particular, it challenges an implicit notion of control over one’s actions that might impede recovery from substance misuse. Reflecting on three fictional case vignettes, we show how philosophical work on akrasia helps avoid this potentially harmful notion of control by supporting a holistic engagement with people for whom substance misuse is a problem.
