Are philosophers of science limited to conducting autopsies on dead scientific theories, or might they also help resolve contemporary methodological disputes in science? This essay (1) gives an overview of thought experiments, especially in mathematics; (2) outlines three major positions on the current dose-response controversy for ionizing radiation; and (3) sketches an original mathematical thought experiment that might help resolve the low-dose radiation conflict. This thought experiment relies on the assumptions that radiation "hits'' are Poisson distributed and that background conditions (...) cause many more radiation-induced cancers than human activities. Only ten to twelve percent of Americans would voluntarily live within a mile of a nuclear plant or hazardous waste facility. But industry spokespersons claim that such risk aversion represents ignorance and paranoia, and they lament that citizen protests have delayed valuable projects and increased their costs. Who is right? In _Risk and Rationality_, Kristin Shrader-Frechette argues that neither charges of irresponsible endangerment nor countercharges of scientific illiteracy frame the issues properly. She examines the debate over methodological norms for (...) risk evaluation and finds analysts arrayed in a spectrum. Points of view extend from cultural relativists who believe that any risk can be justified to naive positivists who believe that risk evaluation can be objective, neutral, and value free. Both camps, she argues, are wrong, because risk evaluation as a social process is rational and objective, even though all risk-evaluation rules are value-laden. Shrader-Frechette defends a middle position called "scientific proceduralism." She shows why extremist views are unreliable, reveals misconceptions underlying current risk-evaluation methods and strategies, and sketches the reforms needed to set hazard assessment and risk evaluation on a publicly defensible foundation. These reforms involve mathematical, economic, ethical, and legal procedures. They constitute a new paradigm for assessment when acceptance of public hazards is rational, recognizing that laypersons are often more rational in their evaluation of societal risks than either experts or governments have acknowledged. Such reforms would provide citizens with more influence in risk decisions and focus on mediating ethical conflicts, rather than seeking to impose the will of experts. We explain three phenomena in legal discourse in terms of MacFarlane’s assessment-sensitive semantics: incompatible applications of law, assessments of statements about what is legally the case, and retrospective overruling. The claim is that assessment sensitivity fits in with the view, shared by many legal theorists at least with respect to hard cases, that the final adjudicator’s interpretation of legal sources is constitutive of the applied norm. We argue that there are strong analogies between certain kinds of statements in legal discourse (...) as understood in light of that view and discourse about matters of taste and future contingents. Thus, if assessment-sensitive semantics provides a compelling account of discourse about matters of taste and future contingents, then it likewise provides a compelling account of those statements in legal discourse. While their strength, electrical, optical, or magnetic properties are expected to contribute a trillion dollars in global commerce before 2015, nanomaterials also appear to pose threats to human health and safety. Nanotoxicology is the study of these threats. Do nanomaterial benefits exceed their risks? Should all nanomaterials be regulated? Currently nanotoxicologists cannot help answer these questions because too little is known about nanomaterials, because their properties differ from those of bulk materials having the same chemical composition, and because they differ (...) so widely in their applications. Instead, this paper answers a preliminary ethical question: What nanotech policies are likely to contribute to society’s ability to give or withhold free informed consent to the potential risks associated with production and use of nanomaterials? This paper argues that at least four current policies appear to jeopardize the risk-disclosure condition that is required for informed consent. These are the funding problem, the conflict-of-interest problem, the labeling problem, and the extrapolation problem. Apart from future decisions on how to ethically make, use, and regulate nanomaterials, this paper argues that, at a minimum, these four policies must be modified. Government must spend greater monies on nanotoxicology; ensure independent nanotoxicology research; label consumer products containing nanomaterials; and avoid assuming that nanotoxicological properties are based merely on mass and chemical composition. Otherwise free informed consent to these new technologies and materials may be jeopardized. (shrink)

This article shows why it is important to do normative or practical philosophy of science, especially philosophy of science that criticizes and evaluates contemporary use of scientific methods to analyze welfare-affecting societal problems. The article introduces the scientific, ethical, and social problem of environmental injustice—disproportionate environmental and pollution threats that are responsible for roughly 40% of all preventable disease and death. Next it explains that many deadly threats continue in part because of “special-interest science”, methodologically flawed science that is done (...) to promote corporate profits, rather than truth, then argues that philosophers of science should use normative or practical philosophy of science to critique and expose special-interest science. To illustrate special-interest science, the article provides two case studies, on diesel-particulate-matter pollution and on organophophate-pesticide pollution, and shows how diesel and pesticide polluters use special-interest science. For instance, they often ignore observational data, illegitimately demand statistically significant evidence of harm from observational data, use small sample sizes, do the wrong tests, or demand certainty—rather than a preponderance of evidence—to justify a conclusion about pollution harm. They also use flawed normative arguments to defend both diesel and pesticide pollution. The article concludes that, given the epistemic, scientific, human-welfare toll of special-interest science, philosophers of science need to do normative or practical philosophy of science that exposes these scientific flaws. The celebrity effect is the well-documented phenomenon in which people ascribe an enhanced worth to artefacts owned by famous individuals. This effect has been attributed to a belief in psychological contagion, the transmission of a person’s essence to an object via contact. We examined people’s judgments of the persisting worth of celebrity-owned artefacts following transformations of their parts/material and found that the celebrity effect was evident only for post-transformation artefacts that were composed of parts/material that had direct physical contact with (...) the celebrity. Insofar as the celebrity effect arises from psychological contagion, the findings suggest that the essence imparted to a celebrity-owned artefact is conceived as akin to a residue deposited in/on the object rather than a germ capable of spreading in an indirect manner to new parts/material added to the object. The results illuminate the nature of psychological contagion and offer insight into how best to preserve the value of historically important artefacts. (shrink)

A leading international expert on environmental issues, Shrader-Frechette brings a new standard of rigor to philosophical discussions of environmental justice in her latest work. Observing that environmental activists often value environmental concerns over basic human rights, she points out the importance of recognising that minority groups and the poor in general are frequently the biggest victims of environmental degradation, a phenomenon with serious social and political implications that the environmental movement has failed to adequately address. She argues for their (...) equal rights to 'environmental justice' and maintains that they should not have to bear most of the weight of the burdens of pollution and resource depletion. Advocating a greater awareness on the part of professionals in a position to help these victims, Shrader-Frechette proposes a more equitable distribution of environmental resources and, in doing so, makes an important contribution to the fields of environmental ethics and applied philosophy. Nearly all current attempts at environmental impact analysis and technology assessment fall victim to an ethical and methodological assumption that Keniston termed “the fallacy of unfinished business.” Related to one version of the naturalistic fallacy, this assumption is that technological and environmental problems have only technical, but not social, ethical, or political solutions. After using several impact analyses to illustrate the policy consequences of the fallacy of unfinished business, I suggest how it might be overcome. Next I present three standard (...) arguments, repeatedly used in technology and environmental impact assessments, by those who subscribe to this “fallacy.” I briefty examine the logical, consequentialist, and historical reasons for rejecting all three arguments in favor of this assumption. If my suggestions are correct, then environmental impact analysis is not only a matter of discovering how to finish our technological business, but also a question of learning how to recognize the ethical and epistemological dimensions of our assessment tasks. In this book Shrader-Frechette reveals how politicians, campaign contributors, and lobbyists--and their power over media, advertising, and public relations--have conspired to cover up environmental disease and death.

Following the recommendations of the US National Academy of Sciences and the mandates of the 1987 Nuclear Waste Policy Amendments Act, the US Department of Energy has proposed Yucca Mountain, Nevada as the site of the world's first permanent repository for high-level nuclear waste. The main justification for permanent disposal (as opposed to above-ground storage) is that it guarantees safety by means of waste isolation. This essay argues, however, that considerations of equity (safer for whom?) undercut the safety rationale. The (...) article surveys some prima facie arguments for equity in the distribution of radwaste risks and then evaluates four objections that are based, respectively, on practicality, compensation for risks, scepticism about duties to future generations, and the uranium criterion. The conclusion is that, at least under existing regulations and policies, permanent waste disposal is highly questionable, in part, because it fails to distribute risk equitably or to compensate, in full, for this inequity. Week-old embryos are considered the richest source of stem cells usable in medical treatments. Because the embryos are destroyed when the stem cells are removed, the debate over the embryo's legal, moral, political, and scientific status has exploded. In this debate, Sheldon Krimsky's Stem Cell Dialogues: A Philosophical and Scientific Inquiry into Medical Frontiers is the single best book. Evenhanded, eminently readable, up to date, educational, scientifically precise, powerfully researched, and very entertaining, Krimsky's slim volume is one that no scientist, (...) policy-maker, ethicist, or intelligent reader should miss. An offshoot of decision analysis, risk-cost-benefit analysis (RCBA) dominates US policymaking regarding science and technology. In this paper a central normative presupposition of RCBA, called "the linearity assumption" is argued against. This is that there is a linear relationship between the actual probability of fatality and the value of avoiding a social risk or the cost of a social risk. The main object of this essay is to show that the presuppositions underlying the linearity assumption are highly questionable. Neurodevelopmental disorders such as autism affect one-eighth of all U.S. newborns. Yet scientists, accessing the same data and using Bradford-Hill guidelines, draw different conclusions about the causes of these disorders. They disagree about the pesticide-harm hypothesis, that typical United States prenatal pesticide exposure can cause neurodevelopmental damage. This article aims to discover whether apparent scientific disagreement about this hypothesis might be partly attributable to questionable interpretations of the Bradford-Hill causal guidelines. Key scientists, who claim to employ Bradford-Hill causal guidelines, yet (...) fail to accept the pesticide-harm hypothesis, fall into errors of trimming the guidelines, requiring statistically-significant data, and ignoring semi-experimental evidence. However, the main scientists who accept the hypothesis appear to commit none of these errors. Although settling disagreement over the pesticide-harm hypothesis requires extensive analysis, this article suggests that at least some conflicts may arise because of questionable interpretations of the guidelines. The International Commission on Radiological Protection — whose regularly updated recommendations are routinely adopted as law throughout the globe — recently issued the first-ever ICRP protections for the environment. These draft 2005 proposals are significant both because they offer the commission’s first radiation protections for any non-human parts of the planet and because they will influence both the quality of radiation risk assessment and environmental protection, as well as the global costs of nuclear-weapons cleanup, reactor decommissioning and radioactive waste management. This piece argues that the 2005 recommendations are scientifically and ethically flawed, or gray, in at least three respects: first, in largely ignoring scientific journals while employing mainly “gray literature;” second, in relying on non-transparent dose estimates and models, rather than on actual radiation measurements; and third, in ignoring classical ethical constraints on acceptable radiation risk. In this volume, the authors discuss what practical contributions ecology can and can't make in applied science and environmental problem solving. In the first section, they discuss conceptual problems that have often prevented the formulation and evaluation of powerful, precise, general theories, explain why island biogeography is still beset with controversy and examine the ways that science is value laden. In the second section, they describe how ecology can give us specific answers to practical environmental questions posed in individual case (...) studies, and argue for a new way to look at scientific error. Neoclassical economists have been telling us for years that if we behave in egoistic, individualistic ways, the invisible hand of the market will guide us to efficient and sustainable futures. Many contemporary Greens also have been assuring us that if we behave in holistic ways, the invisible hand of ecology will guide us to health and sustainable futures. This essay argues that neither individualism nor holism will provide environmental sustainability. There is no invisible hand, either in economics or in ecology. (...) Humans have no guaranteed tenure in the biosphere. Likewise there is no philosophical quick fix for environmental problems, either through the ethical individualism of Feinberg, Frankena, and Regan, or through the ecological holism of Callicott and Leopold. The correct path is more complex and tortuous than either of these ways. The essay argues that the best way to reach a sustainable environmental future probably is through a middle path best described as "hierarchical holism.". (shrink)

Sydney Shoemaker has recently given an account of emergent properties according to which emergent properties are a special type of structural property and the determination relation holding between emergent properties and their base properties is one of "mere nomological supervenience." According to Shoemaker, emergent properties are what he calls type-2 microstructural properties, whereas physical properties are type-1 microstructural properties. After highlighting the advantages of viewing emergent properties as a special class of microstructural properties, I show how according to his own (...) causal theory of properties type-2 microstructural properties actually reduce to type-1 microstructural properties, and thus do not truly count as emergent. I then suggest an alternative view according to which emergent properties are actually a third type of microstructural property, one not considered by Shoemaker. I conclude with reflections why we might view the dependence relation between emergent properties and their physical base properties as a causal relation rather than one of mere supervenience. One way to do socially relevant investigations of science is through conceptual analysis of scientific terms used in special-interest science (SIS). SIS is science having welfare-related consequences and funded by special interests, e.g., tobacco companies, in order to establish predetermined conclusions. For instance, because the chemical industry seeks deregulation of toxic emissions and avoiding costly cleanups, it funds SIS that supports the concept of "hormesis" (according to which low doses of toxins/carcinogens have beneficial effects). Analyzing the hormesis concept of its (...) main defender, chemical-industry-funded Edward Calabrese, the paper shows Calabrese and others fail to distinguish three different hormesis concepts, H, HG, and HD. H requires toxin-induced, short-term beneficial effects for only one biological endpoint, while HG requires toxin-induced, net-beneficial effects for all endpoints/responses/subjects/ages/conditions. HD requires using the risk-assessment/regulatory default rule that all low-dose toxic exposures are net-beneficial, thus allowable. Clarifying these concepts, the paper argues for five main claims. (1) Claims positing H are trivially true but irrelevant to regulations. (2) Claims positing HG are relevant to regulation but scientifically false. (3) Claims positing HD are relevant to regulation but ethically/scientifically questionable. (4) Although no hormesis concept (H, HG, or HD) has both scientific validity and regulatory relevance, Calabrese and others obscure this fact through repeated equivocation, begging the question, and data-tri mm ing. Consequently (5) their errors provide some undeserved rhetorical plausibility for deregulating low-dose toxins. (shrink)

Comparing alternative scientific theories obviously is relevant to theory assessment, but are comparativists (like Laudan) correct when they also make it necessary? This paper argues that they are not. Defining rationality solely in terms of theories' comparative problem-solving strengths, comparativist philosophers of science like Laudan subscribe to what I call the irrelevance claim (IC) and the necessity claim (NC). According to IC, a scientific theory's being well or poorly confirmed is "irrelevant" to its acceptance; NC is the claim that "all (...) evaluations of research traditions and theories must be made within a comparative context," how any theory "compares with its competitors" (Laudan 1977, 21, 120). Using current competing theories (T1 and T2) of population viability assessment (PVA) for the Florida panther, the paper investigates IC/NC. In part because dominant T2 panther biologists accept IC/NC (which T1 theorists reject), the paper argues that they appear both to have accepted flawed T2 and to have contributed to flawed panther science and policy. Correcting Laudan's Comparativist Philosophy of Science (LCPS), underlying the T1-versus-T2 debate, thus may hold promise for helping resolve both the scientific and policy controversy over panther PVA.
