The Second Amendment to the U.S. Constitution states: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” Until recently, no federal appellate court had ever struck down any gun law as a violation of the Second Amendment. In fact, even laws outlawing most handgun possession, or restricting other types of firearms, had been upheld, in part, because the laws did not interfere with (...) the functioning of state militias.Then, in 2008, the U.S. Supreme Court — for the first time in nearly 70 years — decided a case squarely addressing the meaning of the Second Amendment. In District of Columbia v. Heller, the Supreme Court concluded that the Second Amendment protected an individual right to own handguns in the home, invalidating a Washington, D.C. law.But Heller left many issues undecided, including the precise scope of the Second Amendment. Within legal scholarship and practice, among the most pervasive tasks is the interpretation of texts. And within legal interpretation, perhaps the most pervasive inquiry is the search for “ordinary meaning.” Jurists often treat ordinary meaning analysis as an empirical inquiry, aiming to discover a fact about how people understand language. When evaluating ordinary meaning, interpreters rely on dictionary definitions or patterns of common usage, increasingly via “legal corpus linguistics” approaches. However, the most central question about these popular methods remains open: (...) Do they reliably reflect ordinary meaning? This Article presents a series of experiments that assess whether (a) dictionary definitions and (b) common usage data reflect (c) how people actually understand language today. -/- The Article elaborates the implications of two main experimental results. First, neither the dictionary nor legal corpus linguistics methods reliably track ordinary people’s judgments about meaning. This shifts the argumentative burden to jurists who rely on these tools to identify “ordinary meaning” or “original public meaning”: these views must articulate and demonstrate a reliable method of analysis. Moreover, this divergence illuminates several interpretive fallacies. For example, advocates of legal corpus linguistics often contend that the nonappearance of a specific use in a corpus indicates that the use is not part of the relevant term’s ordinary meaning. The experiments reveal this claim to be a “Nonappearance Fallacy.” Ordinary meaning exceeds datasets of common usage — even very large ones. -/- Second, dictionary and legal corpus linguistics verdicts diverge dramatically from each other. Part of that divergence is explained by the finding that broad dictionary definitions tend to direct interpreters to extensive interpretations, while data of common usage tends to point interpreters to more prototypical cases. This suggests two different criteria that are often relevant in interpretation: a more extensive criterion and a more narrow, prototypical criterion. Although dictionaries and corpus linguistics might, in some cases, help us identify these criteria, a hard legal-philosophical question remains: Which of these two criteria should guide the interpretation of terms and phrases in legal texts? Insofar as there is no compelling case to prefer one, the results suggest that dictionary definitions, legal corpus linguistics, or even other more scientific measures of meaning may not be equipped in principle to deliver simple and unequivocal answers to inquiries about the so-called “ordinary meaning” of legal texts. Timothy Williamson’s anti luminosity argument has received considerable attention. Escaping unnoticed, though, is a strikingly similar argument from David Hume. This paper highlights some of the arresting parallels between Williamson’s reasoning and Hume’s that will allow us to appreciate more deeply the plausibility of Williamson’s reasoning and to understand how, following Hume, we can extend this reasoning to undermine the “luminosity” of simple necessary truths. More broadly the parallels help us to identify a common skeptical predicament underlying both arguments, which (...) we shall call “the quarantine problem”. The quarantine problem expresses a deep skepticism about achieving any exalted epistemic state. Further, the perspective gained by the quarantine problem allows us to easily categorize existing responses to Williamson’s anti luminosity argument and to observe the deficiencies of those responses. In sum, the quarantine problem reveals the deeply fallibilistic nature of whatever knowledge we may possess. (shrink)

Physical theories give us the best available information about what there exists. Although physics is not ontology, it can be ontologically interpreted. In the present study, I propose to interpret physical theories à la Quine, i.e. not to speculate about what really exists, but rather to identify what a given physical theory presupposes that exists. I briefly suggest how Quine’s program should by adapted to this goal. To put the idea to the test, I apply it to the famous Hartle–Hawking (...) model of the quantum creation of the universe from nothing, and try to discover what kind of nothingness the model presupposes. I also make some remarks concerning ontological commitments of the method of physics itself. (shrink)

Despite broad agreement that forgiveness involves overcoming resentment, the small philosophical literature on this topic has made little progress in determining which of the many ways of overcoming resentment is forgiveness. In a recent paper, however, Pamela Hieronymi proposed a way forward by requiring that accounts of forgiveness be “articulate” and “uncompromising.” I argue for these requirements, but also claim that Hieronymi’s proposed articulate and uncompromising account must be rejected because it cannot accommodate the fact that only some agents have (...) the standing to forgive. I end by sketching an alternative account which, I claim, explains the phenomenon of standing. (shrink)

Bayesian reasoning has been applied formally to statistical inference, machine learning and analysing scientific method. Here I apply it informally to more common forms of inference, namely natural language arguments. I analyse a variety of traditional fallacies, deductive, inductive and causal, and find more merit in them than is generally acknowledged. Bayesian principles provide a framework for understanding ordinary arguments which is well worth developing.

It is held that the quality of the working environment afforded to an individual critically affects the health and well-being of that individual. This has consequences for both the quality of work which that individual can actually perform, and for the quality of the society in which that individual has a place. Conceptions of a fit working environment have led to the idea of a human-centred system, and this idea is applicable to the area of knowledge-based systems (KBS). A system (...) structure is discussed, which permits a human-centred approach to be adopted towards KBS design. It is held that the performance of such a system will generally exceed that of unaided KBS operation. (shrink)

Several recent attempts to develop models of moral reasoning have attempted to use some form of casuistry as a way to resolve the moral controversies of clinical ethics. One of the best known models of casuistry is that of Jonsen and Toulmin who attempt to transpose a particular model of casuistry, that of Roman Catholic confessional practice, to contemporary moral disputes. This attempt is flawed in that it fails to understand both the history of the model it seeks to transpose (...) and the morally pluralistic context of secular, postmodern society. The practice of casuistry which Jonsen and Toulmin wish to revive is a practice set in the context of a community with a shared set of moral values and structures of moral authority. Without a set of common moral values and rankings, and a moral authority to interpret cases the casuistry of the postmodern age will be pluralistic; that is, there will be many casuistries not just one. The standard philosophical view is that compulsive behaviors are caused by “irresistible” desires. Gary Watson famously argued that this view conflates compulsion with weakness of the will, and proposed differentiating weakness and compulsion by appealing to the normal strength-of-will of members of the community. This extrinsic distinction leaves no room for phenomenological differences between weakness and compulsion. Evidence from clinical psychology shows, however, that compulsion is associated with certain phenomenological features that are absent in cases of weakness. I therefore reject (...) the irresistible desire account. Instead, I propose that psychological compulsions “wear down” an individual’s normal faculty of self-control, i.e., the will. The recurrent inhibition of the behavior by the will overexerts this faculty, causing the psychological stress noted by psychologists. This stress raises the cost of resistance until it is unbearable. The subject abandons resistance and therefore performs the behavior. (shrink)

This brief chapter provides a general overview of evidentialism by explaining evidentialism’s most fundamental claim about epistemic justification, that such justification supervenes on an agent’s evidence. Additionally, the chapter explains that evidentialism requires more clarification and detailing. Finally, short summaries of the other chapters included in this book are provided in this chapter.

Two important thought-experiments are associated with the work of Hilary Putnam, one designed to establish multiple realizability for mental kinds, the other designed to establish essentialism for natural kinds. Comparing the thought-experiments with each other reveals that the scenarios in both are structurally analogous to each other, though his intuitions in both are greatly at variance, intuitions that have been simultaneously well received. The intuition in the former implies a thesis that prioritizes pre-scientific over scientific indicators for identifying mental kinds (...) in certain circumstances, while his intuition in the latter implies a converse thesis, prioritizing scientific over pre-scientific indicators for identifying natural kinds in analogous circumstances. In this paper I question whether we can consistently endorse both of these intuitions. A consideration is presented to attempt to justify the common intuition found in the multiple realization thought-experiment. Then it is argued that this same consideration has application in the structurally analogous Twin-Earth thought-experiment. This recommends a kind of multiple realization thesis for natural kinds, in opposition to a scientific essentialist approach. The various respects in which mental kinds like pain and natural kinds like water are similar to each other, such that similar philosophical treatments are warranted for both, are enumerated. Textualism is now the Court’s lingua franca. In response, some have proposed a “progressive textualism,” defined by the use of traditional textualist methods to reach politically progressive results. This Article explores a different kind of “progressive textualism.” Rather than starting with the desired policy outcome—politically progressive or conservative—we begin from one of modern textualism’s central values: A commitment to “democratic” interpretation. As Justice Barrett argues, this commitment views textualists as “agents of the people” who “approach language from the perspective of (...) an ordinary English speaker.” Textualists thereby claim to promote democracy by interpreting law consistently with what it communicates to the ordinary public. However, recent empirical studies reveal discrepancies between textualist interpretive commitments and how ordinary people understand legal texts. These discrepancies undermine claims that textualists’ methodology is committed to democratic interpretation. -/- A textualism centered on democratic interpretation would be methodologically more progressive if it centered facts rather than fictions about how ordinary people interpret language. It would recognize that people understand legal language in light of linguistic “(co)text” and “(con)text,” and sometimes nonliterally; they often understand ambiguous terms in law to have legal, not ordinary, meanings; and their understanding of law is informed by its apparent purpose and sometimes by interpretive rules that are conventionally justified on normative grounds. In contrast, current textualism is often methodologically regressive, crafting a fictional “ordinary person” more closely connected to ideological policy goals than facts about ordinary language comprehension. This book explores and examines current topics and issues in teacher education through the lens of eight practicing teachers. Their voices add a new perspective on the effectiveness and practicality of current trends and reforms in teacher education.

Along with offering an historically-oriented interpretive reconstruction of the syntax of PM ( rst ed.), I argue for a certain understanding of its use of propositional function abstracts formed by placing a circum ex on a variable. I argue that this notation is used in PM only when de nitions are stated schematically in the metalanguage, and in argument-position when higher-type variables are involved. My aim throughout is to explain how the usage of function abstracts as “terms” (loosely speaking) is (...) not inconsistent with a philosophy of types that does not think of propositional functions as mind- and language-independent objects, and adopts a nominalist/substitutional semantics instead. I contrast PM’s approach here both to function abstraction found in the typed λ-calculus, and also to Frege’s notation for functions of various levels that forgoes abstracts altogether, between which it is a kind of intermediary.
