There is an expectation that all researchers will act ethically and responsibly in the conduct of research involving humans and animals. While research ethics is mentioned in quality indicators and codes of responsible researcher conduct, it appears to have little profile in doctoral assessment. There seems to be an implicit assumption that ethical competence has been achieved by the end of doctoral candidacy and that there is no need for candidates to report on the ethical dimensions of their study nor (...) for examiners to assess this integral aspect of researcher development. In the context of ensuring that institutions are fulfilling their responsibility of producing ethically sensitive and competent researchers, it is salient to investigate whether doctoral thesis examiners make comment about ethical issues in their reports. This study analysed an archive of examiner reports to identify the frequency, magnitude and nature of examiner comment about ethics. Although comment was rare examiners provided: prescriptive instruction on ethical review processes; formative instruction on the design, conduct, and reporting of research projects; and positive or negative judgments about a candidate's ethical competence, the latter often aligned with meeting, or not meeting, 'doctoral standards'. The scarcity of ethics in examination criteria and examiner reports implies a silence that needs to be addressed to ensure graduating candidates are prepared to conduct ethical and responsible research. Introduction Understanding the views of the public is essential if generally acceptable policies are to be devised that balance research access to general practice patient records with protection of patients' privacy. However, few large studies have been conducted about public attitudes to research access to personal health information. Methods A mixed methods study was performed. Informed by focus groups and literature review, a questionnaire was designed which assessed attitudes to research access to personal health information and factors that influence these. (...) A postal survey was conducted of an electoral roll-based sample of the adult population of Ireland. Results Completed questionnaires were returned by 1575 (40.6%). Among the respondents, 67.5% were unwilling to allow GPs to decide when researchers could access identifiable personal health information. However, 89.5% said they would agree to ongoing consent arrangements, allowing the sharing by GPs of anonymous personal health information with researchers without the need for consent on a study-by-study basis. Increasing age (by each 10-year increment), being retired and primary level education only were significantly associated with an increased likelihood of agreeing that any personal health information could be shared on an ongoing basis: OR 1.39 (95% CI 1.18 to 1.63), 2.00 (95% CI 1.22 to 3.29) and 3.91 (95% CI 1.95 to 7.85), respectively. Conclusions Although survey data can be prone to response biases, this study suggests that prior consent agreements allowing the supply by GPs of anonymous personal health information to researchers may be widely supported, and that populations willing to opt in to such arrangements may be sufficiently representative to facilitate valid and robust consent-dependent observational research. Bullying remains a pervasive problem in healthcare, and evidence suggests systems in place are not utilised due to perceptions of ineffectiveness and inequity. This study examines bystander responses to bullying and factors that influence decisions to intervene. We explore relationships between bystanders’ perceptions of psychological safety across three levels (organisation, supervisor and colleague) and reactions to witnessing bullying. We suggest psychological safety would be positively associated with the decision to intervene. Findings indicate the most pervasive reaction to witnessing incidents of (...) bullying is to discuss with colleagues, a low‐involvement reaction. We find perceptions of supervisory and organisational safety/support are positively related to high‐involvement decisions such as formal reporting of the incidents, highlighting the importance of support from those in power. However, perceptions of collegial support may lead to low‐involvement responses, which risk reinforcing and underpinning dysfunctional organisational dynamics by providing informal social and emotional responses that may substitute more formal organisational responses to this persistent problem. This study highlights the importance of support from individuals in power if bystanders are to feel comfortable making high‐involvement interventions. (shrink)

ABSTRACTOn 28 October 2012, Savita Halappanavar, an Indian woman living in Ireland, died in hospital while under medical care for a miscarrying pregnancy. According to her husband, her repeated requests for an abortion were ignored because of the presence of a foetal heartbeat. Ms Halappanavar’s death was a critical event in the process leading to a referendum on 25 May 2018, when the Irish electorate voted to repeal the Eighth Amendment of the Constitution, removing the constitutional ban on abortion. The (...) name Savita has become indelibly linked to the changing course of abortion politics, so it is timely to reassess the role of the media in shaping the parameters of the debate about the impact of her death on the issue. This study presents a frame analysis of Irish newspapers in the weeks following her death, mapping the political, medical, legal and socio-ethical discourses, as well as the related contemporaneous events that set the agenda for the type of debate that was to follow. It identifies four media frames: Public Tragedy, Political Opportunity, Abortion Legacy and Maternal Health. Our central argument is that the overall effect of media framing provided much face-saving for politicians in the way that the legislative issue was viewed through a conservative party-political lens, despite public outrage. In addressing objections to the theological voluntarist program, the consensus response by defenders of theological voluntarism has been to affirm a restricted theological voluntarism on which some, but not all, important normative statuses are to be explained by immediate appeal to the divine will. The aim of this article is to assess the merits and demerits of this restricted view. While affirming the restricted view does free theological voluntarism from certain objections, it comes at the cost of committing the theological (...) voluntarist to the view that no theses about the divine nature itself could alone be sufficient to motivate a theological voluntarist thesis about any normative status. And when we examine the case for a theological voluntarist account of any particular normative status – say, rightness, or obligatoriness – there are severe difficulties with that case as it stands. It is thus unclear whether the theological voluntarist program of providing good reasons to affirm a voluntarist explanation of non‐trivially‐theistic normative statuses has borne fruit. (shrink)

Some commentators argue that conception signals the onset of human personhood and that moral responsibilities toward zygotic or embryonic persons begin at this point, not the least of which is to protect them from exposure to death. Critics of the conception threshold of personhood ask how it can be morally consistent to object to the embryo loss that occurs in fertility medicine and research but not object to the significant embryo loss that occurs through conception in vivo. Using that apparent (...) inconsistency as a starting point, they argue that if that embryo loss is tolerable as a way of conceiving children, it should be tolerable in fertility medicine and human embryonic research. Double-effect reasoning shows, by contrast, that conception in vivo is justified even if it involves the death of persons because the motives for wanting children are not inherently objectionable, because the embryo loss that occurs in unassisted conception is not the means by which successful conception occurs, and because the effect of having children is proportionate to the loss involved. A similar outcome holds true for in vitro fertilisation in fertility medicine but not for in vitro fertilisation for research involving human embryos. (shrink)

Developments in uterus transplant put assisted gestation within meaningful range of clinical success for women with uterine infertility who want to gestate children. Should this kind of transplantation prove routine and effective for those women, would there be any morally significant reason why men or transgender women should not be eligible for the same opportunity for gestation? Getting to the point of safe and effective uterus transplantation for those parties would require a focused line of research, over and above the (...) study of uterus transplantation for non-transgender women. Some commentators object to the idea that the state has any duty to sponsor research of this kind. They would limit all publicly-funded fertility research to sex-typical ways of having children, which they construe as the basis of reproductive rights. This objection has no force against privately-funded research, of course, and in any case not all social expenditures are responses to ‘rights’ properly speaking. Another possible objection raised against gestation by transgender women is that it could alter the social meaning of sexed bodies. This line of argument fails, however, to substantiate a meaningful objection to gestation by transgender women because social meanings of sexed bodies do not remain constant and because the change in this case would not elicit social effects significant enough to justify closing off gestation to transgender women as a class. Jürgen Habermas has argued against prenatal genetic interventions used to influence traits on the grounds that only biogenetic contingency in the conception of children preserves the conditions that make the presumption of moral equality possible. This argument fails for a number of reasons. The contingency that Habermas points to as the condition of moral equality is an artifact of evolutionary contingency and not inviolable in itself. Moreover, as a precedent for genetic interventions, parents and society already affect children's traits, which (...) is to say there is moral precedent for influencing the traits of descendants. A veil-of-ignorance methodology can also be used to justify prenatal interventions through its method of advance consent and its preservation of the contingency of human identities in a moral sense. In any case, the selection of children's traits does not undermine the prospects of authoring a life since their future remains just as contingent morally as if no trait had been selected. Ironically, the prospect of preserving human beings as they are – to counteract genetic drift – might even require interventions to preserve the ability to author a life in a moral sense. In light of these analyses, Habermas' concerns about prenatal genetic interventions cannot succeed as objections to their practice as a matter of principle; the merits of these interventions must be evaluated individually. Ayahuasca, an ancient Amazonian psychedelic tea traditionally used ceremonially among indigenous peoples, has recently become known as a possible treatment for a wide range of disorders. The awareness of this sacred medicine has grown exponentially over the past decade, attracting westerners from a wide variety of backgrounds, hoping to find treatment for a myriad of emotional and physical illnesses, as well as spiritual needs. In the wake of the commercialization and westernization of the use of ayahuasca, and the subsequent proliferation (...) of ayahuasca treatment centers, this paper examines the benefits and possible risks of this form of therapy in an effort to create a safety protocol for Westerners in this context. The most practical approach to increasing safety for Westerners attending these Amazonian treatment centers is to educate the seeker prior to treatment and to provide access to specialized therapeutic aftercare services. In some areas of clinical medicine, discussions about fertility preservation are routine, such as in the treatment of children and adolescents facing cancer treatments that will destroy their ability to produce gametes of their own. Certain professional organizations now offer guidelines for people who wish to modify their bodies and appearance in regard to sex traits, and these guidelines extend to recommendations about fertility preservation. Since the removal of testicles or ovaries will destroy the ability to have genetically related children (...) later on, it is imperative to counsel transgender people seeking body modifications about fertility preservation options. Fertility preservation with transgender people will, however, lead to unconventional outcomes. If transgender men and women use their ova and sperm, respectively, to have children, they will function as a mother or father in a gametic sense but will function in socially reversed parental identities. There is nothing, however, about fertility preservation with transgender men and women that is objectionable in its motives, practices, or outcomes that would justify closing off these options. In any case, novel reproductive technologies may extend this kind of role reversal in principle to all people, if sperm and ova can be derived from all human beings regardless of sex, as has happened with certain laboratory animals. The move to patient-centered medical practice is important for providing relevant and sustainable health care. Narrative medicine, for example, suggests that patients should be involved significantly in diagnosis and treatment. In order to understand the meaning of symptoms and interventions, therefore, physicians must enter the life worlds of patients. But physicians face high patient loads and limited time for extended consultations. In current medical practice, then, is narrative medicine possible? We argue that engaging patient perspectives in the medical visit does (...) not necessarily require a lengthy interview. Instead, a new orientation to this process that emphasizes dialogue between practitioners and patients should be considered. In this new model, the purpose of the visit is to communicate successfully and develop a mutual understanding of illness and care. (shrink)

Despite their obvious importance to social and political life, custom and customary law have largely escaped philosophical scrutiny. There are important recent philosophical analyses of convention, but none of custom. And customary law has been recently neglected by the dominant legal positivism. One reason for the neglect of custom is the familiar dichotomy between nature and convention. Social practices are said to be either by nature, and therefore assumed to be unalterable, or they are said to be by convention, and (...) therefore assumed to be created at will. But customs arise neither simply from nature nor from deliberate stipulation, so they are excluded by the familiar opposition of nature and convention. Custom is a notoriously vague concept: custom seems both to be natural and conventional. I attempt to show how custom bridges human nature and social norms. I argue that custom must be analyzed into two more logically basic concepts: habit and convention. Custom is a habitual convention and a conventional habit. I discuss habit and convention in relation to contemporary psychology and analytic philosophy. Habit roots custom in the physiology of human nature while convention links custom to social norms. Aristotle pioneered this approach to custom by using two words to describe what we call custom: ethos and nomos. Ethos focuses our attention on the habitual dimension of custom while nomos focuses our attention on the conventional dimension of custom. I argue that the function of law is to remedy the deficiencies of custom: law is custom’s instrument for shaping its own evolution. (shrink)

Jeffrie G. Murphy's third collection of essays further pursues the topics of punishment and retribution that were explored in his two previous collections: Retribution, Justice and Therapy and Retribution Reconsidered. Murphy now explores these topics in the light of reflections on issues that are normally associated with religion: forgiveness, mercy, and repentance. He also explores the general issue of theory and practice and discusses a variety of topics in applied ethics - e.g., freedom of artistic expression, the morality (...) of gambling, and the value of forgiveness in psychological counseling. As always, his perspective may be described as Kantian; and, indeed, this collection contains the first extended piece of Kant scholarship that he has done in years: a long essay on Kant on theory and practice. We argue that the claim that essence-based causal explanations emerge, hydra-like, from an inherence heuristic is incomplete. No plausible mechanism for the transition from concrete properties, or cues, to essences is provided. Moreover, the fundamental shotgun and storytelling mechanisms of the inherence heuristic are not clearly enough specified to distinguish them, developmentally, from associative or causal networks.

Murphy's study is the first to bring a broad interdisciplinary perspective to the subject and to present postmodernism as a coherent social theory.

The importance of financial advice for individuals is difficult to refute, however the degree to which the financial planning industry has been able to provide this to date is in debate. As a result, the industry, which is still in its infancy, has been subject to rapid growth, various controversies and regulatory intervention. The Global Financial Crisis (GFC) has contributed to the pace of this change with increased client, regulatory and self scrutiny as a result of the heightened dissatisfaction with (...) advice outcomes. The coalescence of these factors has led to significant internal and external changes within the industry, resulting in the apparent commitment to becoming a profession. This paper will examine the implication of this agenda for tertiary education in relation to the role it could play to support the development of the financial planning profession. The paper achieves this by (1) reviewing the background to the financial planning industry and the move towards professionalism; (2) discussing current developments in the industry; (3) establishing the role of tertiary education and (4) assessing the role that tertiary education has played in supporting the financial planning sector. We argue that tertiary education has a critical role to play, however it is yet to achieve this. This study will be useful for those in both the managerial and operational/ academic elements of tertiary education in terms of providing considered avenues for engagement in this discipline. Indeed, if the paper provokes debate and discussion in tertiary education around the nation then we would consider our task complete. (shrink)

The reply which Socrates makes to Zeno in the Parmenides and that which he makes to the φιλοθμονς in the Republic are perhaps connected chiefly by the fact that a false interpretation of either might prejudice the other, but it seems convenient to take them together for that reason even if they have not much actual connection in themselves. Both are controversial, and in the case of Socrates' reply to Zeno, no re-statement of it could be secure which did not (...) take account of Parmenides' reply to Socrates. For if Parmenides, as is maintained by some, is not attacking the doctrine of forms as such, but only Socratic theories of their relation with particulars, it would be natural to think that these theories about ‘participation’ had been the substance of Socrates' answer to Zeno. So it is impossible to avoid some discussion of the later passage, however cursory, as a preliminary. (shrink)

Philosophy has always been parasitic on other bodies of knowledge, especially religious thought. Greek philosophy in Italy emerged as a purification of Orphic religious traditions. Orphic votaries adopted various disciplines in the attempt to become divine, which led Pythagoras and Empedocles to define philosophy as a path to divinity. According to Plato and Aristotle, the goal of philosophy is to become “as much like a god as is humanly possible.” Classical Greek philosophy is not the study of the divine but (...) the project of becoming divine, a project which it shares with Christianity. Greek philosophy and Christianity have different paths to the divine, but they share a common aspiratio. (shrink)

ABSTRACTJohn Tomasi argues that a theory of justice should include economic liberty since it provides people with a way of living self-authored lives. However, as Aristotelians have pointed out, even seemingly neutral theories of justice rely on non-neutral conceptions of the good. In Tomasi's case, the ideal of self-authorship assumes that it is good to exert economic agency and in so doing, exercise one's economic liberty. Thus, Tomasi equates self-authorship with participation in market activities, tacitly universalizing what is, in fact, (...) a narrow and objectionable conception of the good. (shrink)

By analyzing the feminist debates on Hans-Georg Gadamer, the author shows that feminist critics point to the need either to supplement or to replace Gadamer's philosophy with a greater sensitivity to the historical implications of women's experience. Thus, they are of the view either that Gadamer's philosophy has yet to come to terms with specific historical situations or that Gadamer's philosophy cannot come to terms with historical situatedness per se. The author contends that Gadamer's femi-nist critics do not locate the (...) source of his residual transcendentalism where it should be located: in the account of aesthetic judgment as a "pure feeling" that underpins his entire philosophy. This has the effect, of appearing to preserve aesthetic judgment as "pure feeling" as an apparently innocent remedy, to which some of his feminist critics actually appeal in opposition to his transcendentalism. The author argues, to the contrary, that aesthetic judgment, as a "pure feeling," is at once too com-plicit in the tradition that feminists seek to engage with, traditionally too insubstantial to make a rich resource for a feminist critique of that tradition, and ultimately too traditionally male-centered to be easily coopted by a feminist philosopher. Erin Murphy-Graham draws on more than a decade of qualitative research to examine the experiences of Juanita and eighteen other women who participated in the SAT program.

Professors Murphy and Choi use postmodern philosophy to expose an important source of racism and cultural domination. The metaphysics of domination is examined, along with institutions based on this foundation which they regard as repressive. Postmodernism is shown to be useful in conceptualizing and implementing a pluralistic polity.

H. L. A. Hart, in his classic book Law, Liberty, and Morality, is unsuccessful in arguing that James Fitzjames Stephen’s observations about the role of vice in criminal sentencing have no relevance to a more general defense of legal moralism. He does, however, have a very important insight about the special significance of sexual liberty.

There is a need to better understand how individuals in different religious groups construct and maintain their worldviews. This study explores how religious practices, beliefs, and relationships create and sustain the worldviews of five British Muslims. Semi-structured interviews were inductively analyzed using interpretative phenomenological analysis (IPA) to idiographically explore the participants’ lived experiences. This analysis developed multiple subordinate themes that formed two superordinate themes: “Submitting to Allah” and “Being a British Muslim.” The participants’ experiences of being raised in Muslim families (...) strongly shaped their beliefs and they each strongly identify themselves as both Muslim and British. These important relationships taught them to follow the teachings of the Qur’an and to live their lives in submission to God. The analysis suggests the belief that the Qur’an is the authoritative and enduring revelation of God to mankind provided the core of their worldview and that this belief had far-reaching implications for every aspect of their lives. Their social relationships and religious practices both continually affirmed this fundamental belief in their sacred text and created a social reality in which the participants experienced God and submitted to the will of Allah. The combination of many different religious practices, social relationships, and personal experiences imbued the Qur’an with the power and authority to shape the participants’ lives and sustained their religious community. The participants’ intratextually fundamentalist approach to the Qur’an helped them create coherent worldviews that were filled with meaning and purpose. (shrink)

I argue that there are good reasons to deny both type-type and token-token mind-brain identity theories. Yet on the other hand there are compelling reasons for thinking that there is a causal basis for the mind. I argue that a path out of this impasse involves not only showing that criteria of individuation do not determine identity, but also that there are sound methodological reasons for thinking that the cause of intelligent behavior is a real natural kind. Finally, a commitment (...) to this methodology suggests both that these familiar anti-reductionist arguments fail to establish that identity is impossible and at the same time suggest that the preferred alternative will be some version of neutral monism. The rhetoric of moral, spiritual and political decline represents a recurrent rhetorical form, one that has appeared throughout history in a variety of contexts. This article takes a closer look at one episode in the history of decline rhetoric -- the fourth-century anti-Christian critiques regarding Roman imperial decline, and Augustine's responses to them in his City of God -- in order to explore the phenomenon of decline rhetoric more deeply. Augustine's response to those who blamed Christianity for the empire's decline (...) took place on both the empirical and the interpretive levels. First, he drew on the Roman historians Sallust and Livy to argue that moral decline, if it took place at all, predated Christianity. Second, his theory of the two cities took issue with the notion of decline as a fundamental misunderstanding of historical change. The article closes by drawing out some implications of this particular study for approaching decline rhetoric in political life more generally, concluding with a consideration of the controversial remarks of Pat Robertson and Jerry Falwell, who viewed the 11 September attacks as divine punishment for American moral decline.
