This paper begins with the decisive moment of the 2010 Champions League final, as Diego Milito dribbles past van Buyten to settle the score. By taking a closer look at this situation we witness a complex and ambiguous movement phenomenon that seems to transcend established phenomenological accounts of performance, as a creative performance such as this cannot be reduced to bodily self-awareness or absorbed skilful coping. Instead, the phenomenon of the feint points to a central question we need to ask (...) when investigating performance in football: ?How can one intentionally transcend the expectations of others?? In order to clarify this, the paper will conduct a contextual analysis of a feint drawing on existential philosophy and phenomenology. The main argument is that the feint incarnates a fundamental and indispensable strategy in the game context of football and the analysis of it throws light on central existential phenomena involved in game creativity, with appearance, seduction, commitment and value being the focal ones. The analysis suggests a broader notion of expertise by pointing to the need of stressing the dynamic and social game context. What the feint explicates is that in football it is not enough to be aware of your own body or rely on your embodied habits. In order to cope in the game situation it is also necessary to be absorbed in the other and transcend his or her expectations. (shrink)

In this article, I develop the idea of the “institutional insight” as a pathway to two foundational values for applied ethics: human dignity and the common good. I explore—but do not offer a definitive analysis of—these two values that I believe are critical to the progress of business ethics. In several previous articles, I have alluded to this theme, but here I hope to show that human dignity and the common good underlie both management's fiduciary duty to shareholders, and management's (...) obligations to “stakeholders.” Indeed, it may be that the frequently observed tension between the latter two normative paradigms can be resolved only by engaging in the comprehensive moral thinking afforded by the institutional insight. It is widely held that there are no indigenous roots in China for the rule of law; it is an import from the West. The Chinese legal tradition, rather, is rule by law, as elaborated in ancient Legalist texts such as the Han Feizi. According to the conventional reading of these texts, law is amoral and an instrument in the hands of a central ruler who uses law to consolidate and maintain power. The ruler is the source of all law (...) and stands above the law, so that law, in the final analysis, is whatever pleases the ruler. This essay argues, to the contrary, that the instrumentalism of the Han Feizi is more sophisticated and more principled than the conventional reading acknowledges. It suggests that, by examining the text of the Han Feizi through the lens provided by American legal theorist Lon Fuller, we can detect an explicit articulation of what Fuller called the internal morality of law. The principles of this morality are elaborated and their importance explained. In this way, the Han Feizi is retrieved as a significant reference point for thinking about legal reform in China today. There is an apparent tension in Laozi 老子 between his denial of the adequacy of positive theoretical formulations and his concomitant endorsement of certain kinds of practical action over others. Laozi writes, for example, “Where they all know the good as good, there is evil, Therefore Being and non-being produce each other” (Laozi 2.3–5), which suggests that good and evil produce each other the way being and non-being produce each other; in which case to do good will lead to evil (...) and to do evil will lead to good. The result threatens to become moral paralysis. I argue that this destabilization of moral concepts does not amount to a moral relativism, but leaves us with a consistent moral point of view in its own way. (shrink)

This paper will defend the cognitivist view of cognition against recent challenges from Andy Clark and Richard Menary. It will also indicate the important theoretical role that cognitivism plays in understanding some of the core issues surrounding the hypothesis of extended cognition.

It seems that the above account of explanation-strategy in the area of temperature adaptation underscores many of the points made earlier. First, it discloses the fruitful interaction of classical, evolutionary, and molecular approaches. Secondly, it indicates that biological characterizations are not rival accounts to chemical ones. Thirdly, it stresses the importance of the DNA sequence order in chemical explanations of biological organisms.One feature which this area does not seem to reveal, which genetics does, is the development of a biological (that (...) is, non-chemical) theory which would explain temperature adaptation in nonchemical terms. What this shows is that one should not always expect systematization at the biological level, in the sense of being able to refer many phenomena to a small number of basic principles. The future development of laws and theories in biological terms in this area is, of course, not precluded by the fact that none have yet been discovered. The case does indicate that physical and chemical language and theories are extremely useful in biological investigations, and the physicochemical approach may well be the best approach in this area. In any event, ultimate reduction of the biological to the chemical seems to be a foregone non-controversial conclusion here as elsewhere. (shrink)

Walter Benjamin is discussed in this article to speak to the character of our experiences in the world as we try to animate our freedom in the midst of phantasmagoria. While we may indeed be trapped in the slumber of phantasmagoria and its many nightmares of despair, it is still possible to blast away the sands of sleep and awaken to a morally redeemed world fashioned through our engagement with various dreams of freedom. First, this article will explore the concept (...) of phantasmagoria, which is a symbolically rich term used by Benjamin to speak to the complex ways in which we are mired within the combined material and aesthetic trappings of an advanced capitalist world. Such an exploration will consider three archetypes of character (the gambler, the flâneur and the collector) and their corresponding experiences (fashion, boredom and interiority) in an attempt to unite various convolutes from The Arcades Project to consider freedom in a world spectrally haunted by such phantasmagoria. Second, we will consider the possibility of becoming dialectically startled before the angel of history and its potential to animate our weak Messianic power. Such an act must involve the building-up of a redemptive imagination as a means to speak the truth of our place as the makers of value in the world challenged to destine our own journey in the ongoing project of justice. We address how the leaders of a Catholic business school can articulate and assess how well their schools implement the following six principles drawn from Catholic social teaching : produce goods and services that are authentically good; foster solidarity with the poor by serving deprived and marginalized populations; advance the dignity of human work as a calling; exercise subsidiarity; promote responsible stewardship over resources; and acquire and allocate resources justly. We first discuss how the CST principles give substantive content and (...) meaning to the Good Goods, Good Work, and Good Wealth framework in The Vocation of the Business Leader and then discuss their congruencies and tensions with the UNGC and UNPRME principles. Next, we describe the Catholic Identity Matrix, an assessment tool that provides a quantitative and qualitative portrait of how well a Catholic business school integrates, within the scope of its mission and capacities, the three goods and related CST principles in its strategies, policies, activities, and processes. The concluding section discusses implications for ongoing UNGC and UNPRME assessment, reporting, and development efforts, and addresses the generalizability of our approach to business schools who draw their inspiration and moral principles from other faith-based or secular traditions. I do not wish at this time to dispute either or. I do not believe, however, that the intermediate step can be adequately justified, and hence remain unconvinced by the purported conclusion. The most recent presentation of this argument is in Professor Dreyfus' article "Why Computers must have Bodies in order to be Intelligent," a discussion of which will serve to explain my lack of confidence in any argument of this general form.

Rejection of the philosophical relevance of history of philosophy remains pronounced within contemporary analytic philosophy. The two main reasons for this rejection presuppose that strict deduction is both necessary and sufficient for rational justification. However, this justificatory ideal of scientia holds only within strictly formal domains. This is confirmed by a neglected non-sequitur in van Fraassen’s original defence of ‘Constructive Empiricism’. Conversely, strict deduction is insufficient for rational justification in non-formal, substantive domains of inquiry. In non-formal, substantive domains, rational justification (...) is also, in part, ineliminably social and historical, for sound reasons Hegel was the first to articulate. Demonstrating this involves considering closely two key reasons many analytic philosophers (still) reject the philosophical relevance of historical philosophy (§2). As specific example of presumed, though fallacious, deductivism about justification in the non-formal domain of empirical knowledge is found in van Fraassen’s (1980) defence of ‘Constructive Empiricism’ (§3). These first two sections contend that philosophical consideration of historical philosophy is required to properly formulate key issues in non-formal domains. I next consider the further issues involved rational justification in non-formal domains, issues quintessentially posed by the Pyrrhonian Dilemma of the Criterion (§4). Finally I consider what kind of history of philosophy is required for cogent philosophy in non-formal domains (§5). (shrink)

In this rejoinder to the three preceding comments, I provide some additional philosophical warrant for the biomedical sciences' focus on model organisms. I then relate the inquiries on model systems to the concept of 'deep homology', and indicate that the issues that appear to divide my commentators and myself are in part empirical ones. I cite recent work on model organisms, and especially C. elegans that supports my views. Finally, I briefly readdress some of the issues raised by Developmental Systems (...) Theory. (shrink)

The essay begins with an explanation of the underlying theological vision that supports Catholic social teaching's commitment to the centrality of the common good and the role of solidarity as both a virtue and a norm. The vision of humanity as one family and the church as a sacrament of unity is the foundation for a communitarian ethic that prizes inclusion, participation, and relative equality in the quest for a truly just society. An array of social science studies is then (...) employed to show that economic inequality “bleeds” into other realms of public life to undermine fundamental commitments of American society, namely, equal opportunity and political democracy. The essay concludes that an understanding of Catholic social teaching promotes a critical perspective that is deeply at odds with ongoing trends in the U.S. economy. (shrink)

Henry Harris noted that ‘the Baconian applied science of this world is the solid foundation upon which Hegel’s ladder of spiritual experience rests’. Understanding the philosophical character of Hegel’s Philosophy of Nature requires recognizing some basic legitimate philosophical issues embedded in the development of physics from Galileo to Newton (§2). These issues illuminate the character of Hegel’s analysis of philosophical issues regarding nature (§3) and the central aims and purposes of Hegel’s philosophy of nature (§4). Hegel recognized some key weaknesses (...) in Newton’s own mathematical treatment of planetary orbits which were only rectified when Johann Bernoulli recast Newtonian gravitational theory on the basis of mathematical analysis (calculus). So reconstructed, Newtonian physics provides sufficient grounds to ascribe gravitational force to matter (Enz. §§262, 269). Hegel incorporated this important point into his illuminating accounts of causal laws of nature and natural-scientific explanation. These points reveal how Hegel’s Science of Logic and Philosophy of Nature are interdependent works, integrated in part by Hegel’s critical, moderately holistic theory of semantic meaning and reference. Highlighting these features of Hegel’s Philosophy of Nature illuminates Hegel’s emergentist account of structural and functional organization of various kinds of natural phenomena. (shrink)

Over the past two decades we have seen dramatic improvements in the efficacy, safety and availibity of antiretroviral therapy (ART). In the USA and Europe, life expectancy in people living with HIV disease approaches that of the HIV-uninfected.1 Even in regions hardest hit by the HIV epidemic, effective HIV therapy has reversed more than a decade of HIV-related decreased survival. Despite these advances in ART, motivations to pursue HIV cure remain strong due to the toxicity, adherence challenges, cost and access (...) to care issues associated with HIV therapy, as well as the persistant stigma associated with having HIV infection. Further and renewed motivation comes from a single case of HIV cure after stem cell transplantation for acute leukaemia. Given the tremendous improvements in ART, it is important to assess how effective and safe an HIV cure would need to be in order to be a viable option compared to ART. We argue that this should be done prior to the availability of a cure to provide realistic goals for researchers and policy makers. One methodology that has been increasingly popular over the past decade is the use of mathematical simulation modelling to assess the clinical impact, cost-effectiveness and clinical role of different treatment strategies in HIV disease, as well as in medicine broadly.2 Such models provide a framework and approach for using the best available data at any point in time, and assessing the potential impact of emerging innovations. Further, unlike individual trials focused on a single endpoint, these models can integrate multiple data sources to project beyond the timeline or outcomes of individual studies and project long-term outcomes in many domains, including virologic, immunologic, clinical and cost.3 Mathematical models have particular value in their ability to assess uncertainty in clinical care. The formal properties of orbits in a plane are explored by elementary topology. The notions developed from first principles include: convex and polygonal orbits; convexity; orientation, winding number and interior; convex and star-shaped regions. It is shown that an orbit that is convex with respect to each of its interior points bounds a convex region. Also, an orbit that is convex with respect to a fixed point bounds a star-shaped region.Biological considerations that directed interest to these patterns are indicated, and (...) the implications of the prospect of higher orders of star-shapedness mentioned. Drawing from the varieties of capitalism theoretical framework, the study explores the home country influences of multinational corporations on their corporate social responsibility practices when they operate outside their national/regional institutional contexts. The study focusses on a particular CSR practice of seven MNCs from three varieties of capitalism – coordinated, mixed and liberal market economies – operating in the oil and gas sector of the Nigerian economy. The study concludes that the corporate codes of conduct of these MNCs operating in (...) Nigeria, to a large extent, reflect the characteristics of their home countries' model of capitalism, respectively, albeit with certain degree of modifications. The home countries' model of capitalism is also found to have implications for the degree of adaptability of these MNCs' CSR practices to the Nigerian institutional context – with the mixed market economy model of capitalism adapting more flexibly than the liberal and coordinated market economies, respectively. The findings of this study will contribute to the emerging literature on the institutional embeddedness of CSR practices in transnational social spaces, understanding of varieties of capitalism, and CSR in developing economies.
