We explicate and evaluate arguments both for and against the insanity defense itself, different versions of the insanity defense (M'Naghten, Model Penal Code, and Durham (or Product)), the Irresistible Impulse rule, and various reform proposals.

The present study extends the study of individuals' ethical ideology withinthe context of marketing ethics issues. A national sample of marketing professionals participated. Respondents' ethical ideologies were classified as absolutists, situationists, exceptionists, or subjectivists using the Ethical Position Questionnaire (Forsyth, 1980). Respondents then answered questions about three ethically ambiguous situations common to marketing and sales. The results indicated that marketers' ethical judgments about the situations differed based on their ethical ideology, with absolutists rating the actions as most unethical. The findings (...) are consistent with those of two earlier studies that utilized samples of business students (Barnett et al., 1994, 1995). The results suggest that personal moral philosophy is an important influence on ethical decision making that should be considered in empirical studies of business ethics. The results also support the utility of the Ethical Position Questionnaire (Forsyth, 1980) as a means for researchers and practitioners to assess individuals' ethical ideology. (shrink)

Coherentism in epistemology has long suffered from lack of formal and quantitative explication of the notion of coherence. One might hope that probabilistic accounts of coherence such as those proposed by Lewis, Shogenji, Olsson, Fitelson, and Bovens and Hartmann will finally help solve this problem. This paper shows, however, that those accounts have a serious common problem: the problem of belief individuation. The coherence degree that each of the accounts assigns to an information set (or the verdict it gives as (...) to whether the set is coherent tout court) depends on how beliefs (or propositions) that represent the set are individuated. Indeed, logically equivalent belief sets that represent the same information set can be given drastically different degrees of coherence. This feature clashes with our natural and reasonable expectation that the coherence degree of a belief set does not change unless the believer adds essentially new information to the set or drops old information from it; or, to put it simply, that the believer cannot raise or lower the degree of coherence by purely logical reasoning. None of the accounts in question can adequately deal with coherence once logical inferences get into the picture. Toward the end of the paper, another notion of coherence that takes into account not only the contents but also the origins (or sources) of the relevant beliefs is considered. It is argued that this notion of coherence is of dubious significance, and that it does not help solve the problem of belief individuation. (shrink)

For a large proportion of our daily lives, spontaneously occurring thoughts tend to disengage our minds from goal-directed thinking. Previous studies showed that EEG features such as the P3 and alpha oscillations can predict mind-wandering to some extent, but only with accuracies of around 60%. A potential candidate for improving prediction accuracy is the Steady-State Visual Evoked Potential, which is used frequently in single-trial contexts such as brain-computer interfaces as a marker of the direction of attention. In this study, we (...) modified the sustained attention to response task that is usually employed to measure spontaneous thought to incorporate the SSVEP elicited by a 12.5-Hz flicker. We then examined whether the SSVEP could track and allow for the prediction of the stickiness and task-relatedness dimensions of spontaneous thought. Our results show that the SSVEP evoked by flickering words was able to distinguish between more and less sticky thinking but not between whether a participant was on- or off-task. This suggests that the SSVEP is able to track spontaneous thinking when it is strongly disengaged from the task but not off-task thought in general. Future research should determine the exact dimensions of spontaneous thought to which the SSVEP is most sensitive. (shrink)

Precursors of inferential capacities concerning self- and other- understanding may be found in the basic experience of social contingency and emotional sharing. The emergence of a sense of self- and other-agency receives special attention here, as a foundation for self-understanding. We propose that synchrony, an amodal parameter of contingent self-other relationships, should be especially involved in the development of a sense of agency. To explore this framework, we have manipulated synchrony in various ways, either by delaying mother’s response to infant’s (...) behaviour, disorganizing mother’s internal synchrony between face and voice, freezing the partner in a still attitude, or on the contrary maximizing synchrony through imitation. We report results obtained with healthy and clinical populations that are supposed to be at the beginning of basic experiences concerning the ownership of their actions: infants of 2 months and 6 months, low-functioning children with autism and MA matched young children with Down Syndrome. Our results support the idea of a two-step process linking understanding of self to understanding of other and leading on to form the concept of human beings as universally contingent entities. Metadata helps users locate resources that meet their specific needs. But metadata also helps us to understand the data we find and helps us to evaluate what we should spend our time on. Traditionally, staff at libraries, archives, and museums (LAMs) create metadata for the content they manage. However, social metadata—content contributed by users—is evolving as a way to both augment and recontextualize the content and metadata created by LAMs. Many cultural heritage institutions are interested in gaining a better understanding (...) of social metadata and also learning how to best utilize their users' expertise to enrich their descriptive metadata and improve their users' experiences. The lateral mobility of membrane lipids and proteins is presumed to play an important functional role in biomembranes. Photobleaching studies have shown that many proteins in the plasma membrane have diffusion coefficients at least an order of magnitude lower than those obtained when the same proteins are reconstituted in artificial bilayer membranes. Depending on the protein, it has been shown that either the cytoplasmic domain or the ectodomain is the key determinant of its lateral mobility. Single particle tracking microscopy, which (...) allows the motions of single or small groups of membrane molecules to be followed, promises not only to reveal new features of membrane dynamics, but also to help explain longstanding puzzles presented by the photobleaching studies, particularly the so‐called immobile fraction. The combination of the two complementary technologies should measurably enhance our understanding of membrane microstructure. (shrink)

Ken Binmore's previous game theory textbook, Fun and Games, carved out a significant niche in the advanced undergraduate market; it was intellectually serious and more up-to-date than its competitors, but also accessibly written. Its central thesis was that game theory allows us to understand many kinds of interactions between people, a point that Binmore amply demonstrated through a rich range of examples and applications. This replacement for the now out-of-date 1991 textbook retains the entertaining examples, but changes the organization to (...) match how game theory courses are actually taught, making Playing for Real a more versatile text that almost all possible course designs will find easier to use, with less jumping about than before. In addition, the problem sections, already used as a reference by many teachers, have become even more clever and varied, without becoming too technical. Playing for Real will sell into advanced undergraduate courses in game theory, primarily those in economics, but also courses in the social sciences, and serve as a reference for economists. Ken Safir, Rutgers University ABSTRACT: It is argued that the indexicality of first person pronouns is arises from a restriction on the pronouns themselves, as opposed to any operator that binds them. The nature of this restriction is an asyntactic constant function that picks out individuals to the context of utterance (following Kaplan, 1989)). Constant function pronouns do not require an antecedent, neither an operator nor an argument, although this does not prevent them from participating in bound readings if an (...) appropriate antecedent is introduced. The notion that agents of contexts and agents of propositional attitudes are versions of the same operator-variable relation is thus rejected, along with certain less fine-grained versions of the nature of de se interpretation. Consequently, indexical pronouns such as first person ones contrast with logophoric pronouns, which are necessarily operator-bound by perspectival operators introduced by propositional attitude verbs. Scope-sensitive properties of operator-binding and the perspectival interpretations that are imposed on logophoricity distinguish the latter from constant function phenomena, which are sensitive neither to scope, as it is usually treated, nor perspectival shifts. Constant function phenomena are also detectable as restrictions on third person forms, and two such examples are lightly explored: the English generic pronoun one and the proximate/obviative distinction in languages like Fox. Molinism promises the strongest account of God's providence consistent with our freedom. But is it a coherent view, and does it provide a satisfying account of divine providence? The essays in this volume examine the status, defensibility, and application of this recently revived doctrine, and anticipate the future direction of the debate.

It's hard to say exactly when modern science began. Many scholars would date it at roughly 1600, when both Kepler and Galileo started using precision measurement to map the universe. But one thing is certain: starting from whatever date we choose, modern science was, in many important ways and right from the start, deeply antagonistic to established religion.

This short paper begins with a summary of the views of a sympathetic game theorist on the current state of play in what is still called the New Institutional Economics. It continues with a much abbreviated summary of my own attempts to treat justice as a kind of institution in the hope that this will serve as a case study in how game theory can serve as a useful intellectual framework for the study of human institutions.

It is shown that we can render Nietzsche's (...) prima facie conflicting assertions regarding free will compatible by interpreting him as rejecting deserts free will while accepting the possibility of agency free will. It is argued that Nietzsche's advances an original form of compatibilism which takes agency free will to be a rare achievement rather than a natural endowment. /// [Christopher Janaway] This paper aims to distinguish a conception of 'free will' that Nietzsche opposes (that of the pure agent unaffected by contingencies of character and circumstance) and one that he supports. In Human, All Too Human Nietzsche propounds the 'total unfreedom' of the will. But by the time of Beyond Good and Evil and the Genealogy he is more concerned (a) to trace the affective psychological states underlying beliefs in both free will and 'unfree will', (b) to suggest that the will might become free in certain individuals, a matter of having a consistent strong character, self-knowledge, and ability to create values. The growing availability and consumption of Fairtrade products is recognised as one of the most widespread ethically inspired market developments, and as an example of activist-driven change within the wider marketing system. The Fairtrade Towns movement, now operating in over 1700 towns and cities globally, represents a comparatively recent extension of Fairtrade marketing driven by local activists seeking to promote positive change in production and consumption systems. This paper briefly explores the conventional framing of the role that ethically related activism (...) plays in the operation of markets and in influencing market participants. It then presents key insights gathered from a grounded theory exploration of Fairtrade Towns as activist-driven marketing systems, revealing the atypical nature of the activism involved. The findings demonstrate how local activists leverage their social networks to exert pressure and generate support to promote ethical consumption. The study suggests that Fairtrade Towns offer a new role for activists as Fairtrade itself becomes more mainstream, and considers the role they are fulfilling as ‘informal’ local marketers. The marketing dynamics revealed represent a complex and distinctive form of relational activism that seeks to build Fairtrade markets and highlight their positive benefits, with potential lessons for other local ethical market-building efforts in future. Nietzsche never presented a worked-out normative ethical theory and appeared to regard any attempt to do so as woefully misguided. He poured scorn on the main contenders for such a theory in his day, and in ours – Kantian ethics and utilitarianism. Moreover, he repeatedly referred to himself as an 'immoralist' and gave one of his books the title Beyond Good and Evil, thus seeming only to confirm the impression that he was more interested in demolishing, and even abolishing morality (...) altogether than in making any constructive contribution to the subject. While the topic of morality appears as a central and almost obsessive interest in his works – especially in the sequence of books from Daybreak: Thoughts on the Prejudices of Morality (1881) to On the Genealogy of Morality (1887) – it generally does so as the target of relentless criticism. Many have concluded, not surprisingly, that Nietzsche, rather than being interested in replacing an existing conception of morality with a better one of his own, was in the business of advising us to abandon morality altogether – to live, in some sense, without morality. Faith healing deaths occur infrequently in Canada, but when they do they pose a considerable challenge for criminal justice. Similar to caregivers who absent-mindedly and fatally forget a child in a hot vehicle, faith healers do not intentionally harm their children. It can seem legally excessive and unjust to prosecute achingly bereaved parents. But unlike ‘hot-car’ deaths, faith healing parents are not absent minded in the deaths they cause. Rather, significant deliberation and strength of will is necessary to treat their (...) child’s ailment with faith alone. Two different Criminal Code provisions can be brought to bear upon these deaths, namely, s. 215 ‘Failing to provide the necessaries of life’ and s. 219 ‘Criminal negligence’. From a public, medical, and scientific perspective treating potentially fatal ailments with ‘faith’ and ‘prayer’ seems like reckless endangerment, giving apparent justification to the more serious criminal negligence charge. But, the fault element in the criminal negligence offence continues to be a vexing issue in Canadian jurisprudence. People accused of negligence-based offences are commonly held to the standard of what a reasonable person might predictably have done in similar circumstances. While it is unnecessary for the impartial trier of fact to conceive of faith healing as ‘reasonable’, it is an open question whether faith healers are sufficiently unreasonable to warrant serious criminal condemnation and possible incarceration when their course of action causes death. Is it justifiable to think of faith healers who cause death as criminally unreasonable? That is, do they depart markedly enough from the standard that criminal negligence is rightly attributed to them? Public attitudes toward religion, religious fundamentalism, and healthcare must be considered when trying to discern what a reasonable person does when treating an ailing child at risk of death. The attempt to explicate the intuitive notions of confirmation and inductive support through use of the formal calculus of probability received its canonical formulation in Carnap's The Logical Foundations of Probability. It is a central part of modern Bayesianism as developed recently, for instance, by Paul Horwich and John Earman. Carnap places much emphasis on the identification of confirmation with the notion of probabilistic favorable relevance. Notoriously, the notion of confirmation as probabilistic favorable relevance violates the intuitive transmittability condition that (...) if e confirms h and h' is part of the content of h then e confirms h'. This suggests that, pace Carnap, it cannot capture our intuitive notions of confirmation and inductive support. Without transmittability confirmation losses much of its intrinsic interest. If e, say a report of past observations, can confirm h, say a law-like generalization, without that confirmation being transmitted to those parts of h dealing with the as yet unobserved, then it is not clear why we should be interested in whether h is confirmed or not. The following paper rehearses these difficulties and then proposes a new probabilistic account of confirmation that does not violate the transmittability condition. (shrink)
