This chapter explores critically ethical concerns arising from forms of suffering to which domesticated nonhuman animals are subjected in scientific instruction and research and within the industrial-factory-farm-food complex, as well as other contexts. Consideration is given to the views of Arthur Schopenhauer on suffering, René Descartes’s designation of ontological differences between human and non-human animals, and Donna Haraway’s reconfiguration of the relationship between human and nonhuman animals in scientific laboratory settings. Proceeding from a discussion of David Benatar’s “antinatalist” views (...) the focus of analysis is on the forms of suffering imposed on domesticated nonhuman animals by humans. In response to ethical concerns raised about the suffering inflicted on nonhuman animals in the course of scientific research, scientists have sought a “solution” in the form of genetically engineered nonhuman animals whose responses to painful stimuli are presented as modulated to reduce pain. This reductive conceptualization of suffering reduces the complexity of suffering to physical sensation alone and does not engage with the ethical issues involved. Drawing on the work of Emmanuel Levinas and Albert Schweitzer the chapter concludes that an ethical solution to the complex issues explored lies in refraining from exposing nonhuman animals to pain and suffering. What makes a government legitimate? Arthur Isak Applbaum rigorously argues that the greatest threat to democracies today is not loss of basic rights or despotism. It is the tyranny of unreason: domination of citizens by incoherent, inconstant, incontinent rulers. A government that cannot govern itself cannot legitimately govern others.

The adversary professions--law, business, and government, among others--typically claim a moral permission to violate persons in ways that, if not for the professional role, would be morally wrong. Lawyers advance bad ends and deceive, business managers exploit and despoil, public officials enforce unjust laws, and doctors keep confidences that, if disclosed, would prevent harm. Ethics for Adversaries is a philosophical inquiry into arguments that are offered to defend seemingly wrongful actions performed by those who occupy what Montaigne called "necessary offices."Applbaum (...) begins by examining the career of Charles-Henri Sanson, who is appointed executioner of Paris by Louis XVI and serves the punitive needs of the ancien régime for decades. Come the French Revolution, the King's Executioner becomes the king's executioner, and he ministers with professional detachment to each defeated political faction throughout the Terror and its aftermath. By exploring one extraordinary role and the arguments that can be offered in its defense, Applbaum raises unsettling doubts about arguments in defense of less sanguinary professions and their practices.To justify harmful acts, adversaries appeal to arguments about the rules of the game, fair play, consent, the social construction of actions and actors, good outcomes in equilibrium, and the legitimate authority of institutions. Applbaum concludes that these arguments are weaker than supposed and do not morally justify much of the violation that professionals and public officials inflict. Institutions and the roles they create ordinarily cannot mint moral permissions to do what otherwise would be morally prohibited. (shrink)

In this paper I take up a critical position in regard to the theme of debility around which this collection is framed. I argue that theorisations of ‘debility’ do little to progress theory and policy in regard to disability and share many of the problems inherent to the social model. I also suggest that the theorisation of debility is rooted in and reinforces ablebodied privilege. I begin with a critical analysis of the social model of disability and explore the dualisms (...) by which it either negates the body altogether or can only conceive the disabled body in negative terms. I then go on to explore how Puar's work on debility continues this negation of the disabled body. From this position I use the work of Inahara to excavate the foundations of ablebodied privilege. In Inahara's work gender is the analytic starting point, but for me white privilege is a much more effective mechanism through which to understand the impact and reproduction of ablebodied privilege— what McRuer refers to as ‘compulsory ablebodiedness'—which I argue underpins Puar's work. I conclude with some reflections upon how a critical analysis of ablebodied privilege might function and I reiterate its importance for a critical theory that goes beyond the mere repetition of binary structures of ablebodiedness and disability. Kant saw in the apriori the precondition for objective knowledge. But with the new conception of science the apriori (if it is not to be only logic) has become problematic. With it, however, the objectivity of scientific knowledge is at stake. As long as one grants objectivity to scientific knowledge, the question of the apriori remains topical. (...) On the one hand, this volume wants to trace the historical roots as well as the different interpretations of the apriori, and on the other hand, it wants to ask for approaches for a contemporary reinterpretation of this basic concept. Much of the mathematics with which Felix Klein and Sophus Lie are now associated (Klein’s Erlangen Program and Lie’s theory of transformation groups) is rooted in ideas they developed in their early work: the consideration of geometric objects or properties preserved by systems of transformations. As early as 1870, Lie studied particular examples of what he later called contact transformations, which preserve tangency and which came to play a crucial role in his systematic study of transformation groups and differential equations. This note examines Klein’s efforts in the 1870s to interpret contact transformations in terms of connexes and traces that interpretation (which included a false assumption) over the decades that follow. The analysis passes from Klein’s letters to Lie through Lindemann’s edition of Clebsch’s lectures on geometry in 1876, Lie’s criticism of it in his treatise on transformation groups in 1893, and the careful development of that interpretation by Dohmen, a student of Engel, in his 1905 dissertation. The now-obscure notion of connexes and its relation to Lie’s line elements and surface elements are discussed here in some detail. (shrink)

In this paper we review selected international legal instruments, the effect, if any, that they have had on global health, and how these instruments might have contributed to the realization of health rights. We consider a number of instruments from the international health law field as well as two from the field of international environmental law.1 The latter two, in addition to the considerable link between health and climate/environment, are considered with the purpose of drawing more generalized lessons about what (...) contributes to the success or failure of an international legal instrument; the lessons are then applied to our analysis of the health law instruments that are the primary focus of our paper. Since 9/11 the European Court of Human Rights (the European Court) has raised anew the question of the relationship between religion and public education. In its reasoning, the European Court has had to consider competing normative accounts of the secular, either to accept or deny claims to religious liberty within Europe's public education system. This article argues that the trajectory on which the term 'secularism' had been used by the European Court pointed increasingly towards secular fundamentalism. This study is located (...) at the cutting edge of religion, education and the law and builds on previous work in the field (Arthur, 1998, 2008). It examines, through extensive research of legal cases, the most important developments of the usage of secular and secular education in modern discourse and explores the background to these concepts. Unless otherwise stated, religion in this article shall refer to the Christian tradition because Christianity has been the historical context for the development of the concept of 'secular' in Europe. The paper outlines three models of secular education before moving on to scrutinise how the European Court has understood and evaluated various legal cases before it on the interaction between secular States, public education and notions of religious symbolism and influence. The paper will discuss the significance of the European Court's reasoning and decisions for public education within a secular State context and offer some conclusions on the implications of these decisions. It examines the legal principles that underpin the European Court's supervision of the State's role in the provision of education. It focuses on the chimeric goal of neutrality and highlights the risks attached to the use of an ideological conception of secularism that could lead potentially to the complete removal of the religious as a vital cultural and intellectual dimension of public education. Analyses of assisted reproductive technologies have demonstrated how objectification and agency can coexist in infertility centres. How objectification creates opportunities for empowerment, however, has not yet been explored. In analysing women’s narratives of assisted conception in Colombian infertility clinics, I demonstrate the complexity in women’s embodied experiences of various objectifying stages of assisted conception and argue that their experiences produced multiple forms of embodied agency. Women used diagnostic procedures to learn about their bodies and infertility complications, which augmented their authority (...) over their bodies and treatment. They drew upon their embodied knowledge to reduce treatment anxieties, while sensations such as pain were made purposeful, and hence meaningful, as women strove to reconfigure the significance of the embodied sensations of conception in a context of medicalized reproduction. In these narratives, we see that lived bodies are productive agents of social change, generating meanings and working to reshape dominant social understandings. (shrink)

Since the outburst of the financial-economic crisis in 2008, there has been quite some public discussion about the failure of neoliberal policies since the 1980s. Much less attention has been paid to its ideological character. Meanwhile, neoliberalism is still there, guiding the course of societies, organizations and individuals. We can observe the ‘strange non-death of neoliberalism’. In this article two questions are explored: which key philosophical elements characterize neoliberalism, and why has it got an ideological character? First, three statements on (...) neoliberalism are formulated. Next, its anthropological and social-philosophical development is considered, taking advantage of Taylor’s grand narrative of modernity. We provide a suitable theoretical foundation for the notion of the quantum coherent state which describes the electrostatic field due to a static external macroscopic charge distribution introduced by the author in 1998 and use it to rederive the formulae obtained in 1998 for the inner product of a pair of such states. (We also correct an incorrect factor of 4π\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$4\pi$$\end{document} in some of those formulae.) Contrary to what one might expect, (...) this inner product is usually non-zero whenever the total charges of the two charge distributions are equal, even if the charge distributions themselves are different. We actually display two different frameworks that lead to the same inner-product formulae, in the second of which Gauss’s law only holds in expectation value. We propose an experiment capable of ruling out the latter framework. We then address the problem of finding a product picture for QED—i.e. a reformulation in which it has a total Hamiltonian, arising as a sum of a free electromagnetic Hamiltonian, a free charged-matter Hamiltonian and an interaction term, acting on a Hilbert space which is a subspace (the physical subspace) of the full tensor product of a charged-matter Hilbert space and an electromagnetic-field Hilbert space. (The traditional Coulomb gauge formulation of QED isn’t a product picture in this sense because, in it, the longitudinal part of the electric field is a function of the charged matter operators.) Motivated by the first framework for our coherent-state construction, we find such a product picture and exhibit its equivalence with Coulomb gauge QED both for a charged Dirac field and also for a system of non-relativistic charged balls. For each of these systems, in all states in the physical subspace (including the vacuum in the case of the Dirac field) the charged matter is entangled with longitudinal photons and Gauss’s law holds as an operator equation; albeit the electric field operator (and therefore also the full Hamiltonian) while self-adjoint on the physical subspace, fails to be self-adjoint on the full tensor-product Hilbert space. The inner products of our electrostatic coherent states and the product picture for QED are relevant as analogues to quantities that play a rôle in the author’s matter-gravity entanglement hypothesis. Also, the product picture provides a temporal gauge quantization of QED which appears to be free from the difficulties which plagued previous approaches to temporal-gauge quantization. (shrink)

The work of Giorgio Agamben relies heavily on two rather opaque notions: the messianic and the irreparable. This essay is devoted to an analysis of the latter. After surveying the existing literature, I take my cue from Dietrich Bonhoeffer's prison letters and prepare the way for my own analysis of Agamben's irreparable. In the final part of the essay, I compare the irreparable with Agamben's use of Benjamin's thought of something unforgettable. I understand the role of the irreparable in this (...) light, since, for Agamben, it means the chance of something given up by language, something given up altogether, and as such serves as entry to the paradigmatic. Following the liberation of Poland 1945, the childrens organization of the Jewish-Socialdemocratic "Bund" SKIF formed itself anew and remained in existence until the communists' ban of social democratic organizations. Starting with the first post-war conference of the International of social democratic children and youth education in October 1945 until the mid-sixties the SKIF played a recognizable role within these international structures of the "Falcons" movement. In the late forties the SKIF simultaneously existed in Paris, where a successor organization is still (...) active, and in Brussels. During the seventies and eighties a "SKIF-ist" holiday colony existed in New York and from 1950 until this day further groups exist in Melbourne. Since 1945 the SKIF has existed primarily as an organization of survivors and their children. Later it managed to develop a new function and to offer an educational model for the following generations of Jewish children, which lies beyond religion and Zionism. (shrink)

Since its inception, the field of political ecology has served as a critical hub for inclusive and transformative environmental inquiry. Doing Political Ecology offers a distinctive entry point into this ever-growing field and argues that our scholarly "foundations", today more than ever, comprise a cross-cutting latticework of research approaches and concepts.
