The objective of this study is to evaluate if use of a patient decision aid, when choosing between a repeat cesarean or a trial of labor after a cesarean, reduces medical liability exposure. The authors conclude that use of a PDA conferred liability protection when potential jurors were presented with a hypothetical malpractice claim against an obstetrician following a TOLAC.

Recently several philosophers have argued that racial, gender, and other social generic generalizations should be avoided given their propensity to promote essentialist thinking, obscure the social nature of categories, and contribute to oppression. Here I argue that a general prohibition against social generics goes too far. Given that the truth of many generics require regularities or systematic rather than mere accidental correlations, they are our best means for describing structural forms of violence and discrimination. Moreover, their accuracy, their persistence in (...) the face of counterexamples, and features of the contemporary socio-political context make generics useful linguistic tools in social justice projects. Models are of central importance in many scientific contexts. The centrality of models such as the billiard ball model of a gas, the Bohr model of the atom, the MIT bag model of the nucleon, the Gaussian-chain model of a polymer, the Lorenz model of the atmosphere, the Lotka-Volterra model of predator-prey interaction, the double helix model of DNA, agent-based and evolutionary models in the social sciences, or general equilibrium models of markets in their respective domains are cases in point. (...) Scientists spend a great deal of time building, testing, comparing and revising models, and much journal space is dedicated to introducing, applying and interpreting these valuable tools. In short, models are one of the principal instruments of modern science. -/- Philosophers are acknowledging the importance of models with increasing attention and are probing the assorted roles that models play in scientific practice. The result has been an incredible proliferation of model-types in the philosophical literature. Probing models, phenomenological models, computational models, developmental models, explanatory models, impoverished models, testing models, idealized models, theoretical models, scale models, heuristic models, caricature models, didactic models, fantasy models, toy models, imaginary models, mathematical models, substitute models, iconic models, formal models, analogue models and instrumental models are but some of the notions that are used to categorize models. While at first glance this abundance is overwhelming, it can quickly be brought under control by recognizing that these notions pertain to different problems that arise in connection with models. For example, models raise questions in semantics (what is the representational function that models perform?), ontology (what kind of things are models?), epistemology (how do we learn with models?), and, of course, in philosophy of science (how do models relate to theory?; what are the implications of a model based approach to science for the debates over scientific realism, reductionism, explanation and laws of nature?). The generation of three-dimensional cerebral organoids from human-induced pluripotent stem cells (hPSC) has facilitated the investigation of mechanisms underlying several neuropsychiatric disorders, including stress-related disorders, namely major depressive disorder and post-traumatic stress disorder. Generating hPSC-derived neurons, cerebral organoids, and even assembloids (or multi-organoid complexes) can facilitate research into biomarkers for stress susceptibility or resilience and may even bring about advances in personalized medicine and biomarker research for stress-related psychiatric disorders. Nevertheless, cerebral organoid research does not come without its own set (...) of ethical considerations. With increased complexity and resemblance to in vivo conditions, discussions of increased moral status for these models are ongoing, including questions about sentience, consciousness, moral status, donor protection, and chimeras. There are, however, unique ethical considerations that arise and are worth looking into in the context of research into stress and stress-related disorders using cerebral organoids. This paper provides stress research-specific ethical considerations in the context of cerebral organoid generation and use for research purposes. The use of stress research as a case study here can help inform other practices of in vitro studies using brain models with high ethical considerations. (shrink)

ABSTRACTThe Ant Trap is a terrific book, which opens up new opportunities to use philosophical methods in the social realm, by drawing on the tools and techniques of contemporary metaphysics. Epstein uses concepts of dependence, constitution, and grounding, of parts and whole, of membership and kindhood, both to clarify existing accounts of social reality and to develop an account of his own. Whilst I admire the general strategy, I take issue with some aspects of Epstein’s implementation, notably his distinction between (...) grounding and anchoring. I recommend that he give up this distinction, which is not crucial to his project. (shrink)

This paper argues for an interpretation of what Heidegger means by 'angst' in Being and Time that begins from the methodological role angst is supposed to play in Division I as that which disrupts falling. It argues that angst is a distinctive kind of ontological insight.

Analysis of Emmy Noether's 1918 theorems provides an illuminating method for testing the consequences of coordinate generality, and for exploring what else must be added to this requirement in order to give general covariance its far-reaching physical significance. THIS PAPER is not a piece of "research"; it simply offers a series of reflections on the transcendental method. It is occasioned by the realization that, while this method is interesting and important in the opinion of some, it can count on little familiarity in the United States. And where philosophers and students of philosophy make the effort, they have great difficulty appreciating transcendental philosophy or understanding its proposals. This difficulty is, as I say, largely circumstantial and due to a (...) lack of familiarity with the relevant works, but, viewed less superficially, it is motivated by a positive affiliation to another philosophical tradition. In fact, the positions of this other tradition are, if largely in a modern guise, the very ones against which transcendental philosophy reacted. This historical relationship has also systematic relevance. In many ways, pre-transcendental positions seem to have priority: we need only think of formal logic, certain basic stances in empiricist epistemology, common sense. Accordingly, the subjective difficulty of philosophers and students of such persuasions can be treated "objectively," as the difficulty of ever establishing arguments for the transcendental turn or for what Kant calls the "Copernican revolution." Transcendental philosophy must provide arguments, so it seems, on the pre-transcendental level to establish the transcendental position. Further, supposing this problem can be overcome, there is the genuine difficulty of understanding what the transcendental theory actually says and in what way it does its job. And lastly, supposing we find that it lives up to its program, there may still be difficulty with certain implications such that philosophers and students take refuge in non-transcendental positions rather than calling for improvements of transcendental philosophy. In this paper we cannot, of course, fully discuss to what extent the transcendental position can take care of its critics. Two studies document that people are more willing to express emotions that reveal vulnerabilities to partners when they perceive those partners to be more communally responsive to them. In Study 1, participants rated the communal strength they thought various partners felt toward them and their own willingness to express happiness, sadness and anxiety to each partner. Individuals who generally perceive high communal strength from their partners were also generally most willing to express emotion to partners. Independently, participants were more willing (...) to express emotion to particular partners whom they perceived felt more communal strength toward them. In Study 2, members of romantic couples independently reported their own felt communal strength toward one another, perceptions of their partners’ felt communal strength toward them, and willingness to express emotions to each other. The communal strength partners reported feeling toward the participants predicted the participants’ willingness to express emotion to those partners. This link was mediated by participants’ perceptions of the partner’s communal strength toward them which, itself, was a joint function of accurate perceptions of the communal strength partners had reported feeling toward them and projections of their own felt communal strength for their partners onto those partners. The numerically definite syllogistic is the fragment of English obtained by extending the language of the classical syllogism with numerical quantifiers. The numerically definite relational syllogistic is the fragment of English obtained by extending the numerically definite syllogistic with predicates involving transitive verbs. This paper investigates the computational complexity of the satisfiability problem for these fragments. We show that the satisfiability problem (= finite satisfiability problem) for the numerically definite syllogistic is strongly NP-complete, and that the satisfiability problem (= finite (...) satisfiability problem) for the numerically definite relational syllogistic is NEXPTIME-complete, but perhaps not strongly so. We discuss the related problem of probabilistic (propositional) satisfiability, and thereby demonstrate the incompleteness of some proof-systems that have been proposed for the numerically definite syllogistic. This article traces the rapid progression of policy pertaining to human genome germline modifications using genome editing. It provides an overview of how one fertility physician implemented and advertised experimental techniques as part of his fertility clinic services, examines US law and policy, and assesses the impact of rhetoric influencing global policy and interpretation of the law. This article provides an in-depth examination of the medical rationale driving the acceptance of genome editing human embryos in two contexts: to cure disease (...) and treat infertility. It describes complexities in genomics and outlines risks currently associated with genome editing, asserting the available evidence fails to demonstrate genome editing constitutes a curative therapy. I discuss the three distinctions “absolute and relative”, “true and apparent”, and “mathematical and common”, for the specific case of time in Newton’s Principia. I argue that all three distinctions are needed for the project of the Principia and can be understood within the context of that project without appeal to Newton’s wider metaphysical and theological commitments. I argue that, within the context of the Principia, the three claims that time is absolute rather than relative, true rather than apparent, and (...) mathematical rather than common, are to be evaluated with respect to the needs of, and relative to the success of, the project of the Principia. I claim that Newton is thereby offering a new, and empirical, philosophy of time. (shrink)

Science presents us with a variety of accounts of the world. While some of these accounts posit deep theoretical structure and fundamental entities, others do not. But which of these approaches is the right one? How should science conceptualize the world? And what is the relation between the various accounts? Opinions on these issues diverge wildly in philosophy of science. At one extreme are reductionists who argue that higher-level theories should, in principle, be incorporated in, or eliminated by, the basic-level (...) theory. According to this view, higher-level theories do not ultimately exhibit conceptual integrity or provide genuine explanations. At the other extreme are pluralists who take higher levels of description and explanation seriously and argue for their independence and indispensability. It was the aim of the first Sydney–Tilburg conference on “Reduction and the Special Sciences”, which took place at the Tilburg Center for Logic and Philosophy of Science (TiLPS) in Tilburg, The Netherlands, over the 10–12th April 2008, to bring researchers working on these questions together and provide a platform to discuss them in a focused way. The papers in this special issue were presented at this conference. There is a long philosophical tradition of addressing questions in philosophy of science and epistemology by means of the tools of Bayesian probability theory (see Earman (1992) and Howson and Urbach (1993)). In the late '70s, an axiomatic approach to conditional independence was developed within a Bayesian framework. This approach in conjunction with developments in graph theory are the two pillars of the theory of Bayesian Networks, which is a theory of probabilistic reasoning in artificial intelligence. The theory has been (...) very successful over the last two decades and has found a wide array of applications ranging from medical diagnosis to safety systems for hazardous industries. Aside from some excellent work in the theory of causation (see Pearl (2000) and Spirtes et al. (2001)), philosophers have been sadly absent in reaping the fruits from these new developments in artificial intelligence. This is unfortunate, since there are some long-standing questions in philosophy of science and epistemology in which the route to progress has been blocked by a type of complexity that is precisely the type of complexity that Bayesian Networks are designed to deal with: questions in which there are multiple variables in play and the conditional independences between these variables can be clearly identified. Integrating Bayesian Networks into philosophical research leads to theoretical advances on long-standing questions in philosophy and has a potential for practical applications. (shrink)

The formalism of quantum mechanics provides us with the probabilities for certain events to occur—this much is uncontroversial. But how are we to understand these probabilities? The essays in this special issue approach this question from different angles. The first three contributions take as their point of departure the philosophy of probability and discuss what the two main outlooks—objective and subjective interpretations of probability—have to offer in the context of quantum mechanics. The following five papers explore the question of how (...) probabilities in particular interpretations of quantum mechanics—modal interpretations, relative state interpretations, Bohmian mechanics, and GRW theory—can be interpreted. The last three essays address specific issues: non-standard probability and algebraic quantum field theory, quantum propensities, and the relation between decoherence and the interpretation of probability. This article uses the US debate over elective Cesarean section to re-consider some of the more contentious issues raised in feminist debates about childbirth. Three waves of feminist commentary and critique in the United States are analysed in light of the ongoing debate over whether women should be able to choose Cesarean for non-medical reasons. I argue that the alternative birth movement's essentialist and occasionally moralistic rhetoric is problematic, and the idea that some women's preference for high-tech obstetrics is the (...) result of a passive 'socialization' into 'dominant values' is theoretically inadequate. On the other hand, the invocation of women's choice and appreciation of high-tech childbirth serves as a weak foundation for a feminist perspective on childbirth. By limiting their analysis to the rhetorical and discursive nature and functions of 'the medical' and 'the natural', poststructuralist critics of the alternative birth movement obscure the connection of these discourses to practices that have very different consequences for maternal and infant health and, most importantly, for the consumption of health care resources. Dieser versteht die Wende als eine Abwendung vom Naturalismus, wie er in der Position Quines am radikalsten vertreten wird. Gegen die Annahme, die im Rahmen einer naturalisierten Erkenntnistheorie typischerweise formuliert wird, dass eine absolute Beobachterperspektive innerhalb der Naturwissenschaften eingenommen werden kann, wird geltend gemacht, dass die naturwissenschaftliche Praxis die normative Unterscheidung zwischen wahr und falsch voraussetzt, um gelingend betrieben werden zu (...) können. Die Abwendung vom Naturalismus führt aber nicht in den Kulturrelativismus, da mit dem Handlungserfolg ein außerdiskursives Element des Einlösens von Geltungsansprüchen zur Verfügung steht. Die Aufforderung zur kulturalistischen Wende beinhaltet zum einen eine Abwendung von Szientismus, ohne dabei auf die sprachkritischen Mittel des linguistic turn zu verzichten, und zum anderen eine Hinwendung zu Themengebieten, die der Methodische Konstruktivismus - die Vorgängerposition zum Methodischen Kulturalismus - bislang ausgeblendet hatte. In der Einführung der Sektion zur Philosophie der Person auf dem 21. Kongress der Deutschen Gesellschaft für Philosophie wird der Beginn der modernen Debatte bei John Locke verortet. Das grundlegende Thema ist die Personale Identität und die Unterscheidung zwischen den Fragen nach den Kriterien der Personalität und den Kriterien personalen Identität. Vor diesem Hintergrund werden zwei Trends in der philosophischen Diskussion der letzten Jahrzehnte identifiziert. Danach ist zum einen zu beobachten, dass zunehmend von einer Thematisierung der abstrakt-analytischen Kriterien der Personalität (...) und der personalen Identität zu einer Anwendung dieser Ergebnisse übergegangen wird. Zum anderen wird in der Diskussion der personalen Identität zunehmend auch die subjektive Perspektive von Personen auf sich selbst berücksichtigt. (shrink)

Human evolution has been punctuated by climate anomalies, structuring environments, deadly infections, and altering landscapes. How well humans adapted to these new circumstances had direct effects on fitness and survival. Here, how the gut microbiome could have contributed to human evolutionary success through contributions to host nutritional buffering and infectious disease resistance is reviewed. How changes in human genetics, diet, disease exposure, and social environments almost certainly altered microbial community composition is also explored. Emerging research points to the microbiome as (...) a key player in host responses to environmental change. Therefore, the reciprocal interactions between humans and their microbes are likely to have shaped human patterns of local adaptation throughout our shared evolutionary history. Recent alterations in human lifestyle, however, are altering human microbiomes in unprecedented ways. The consequences of interrupted host–microbe relationships for human adaptive potential in the future are unknown. (shrink)

This paper reimagines the traditional problem of other minds. On a Cartesian view, the problem involves humans’ inability to perceive other persons’ minds. Similarly, Gilbert Ryle claims that we cannot directly access another’s mind. The paper’s rethinking of the problem of other minds moves beyond these questions of perceptibility and accessibility. It asks whether there are certain groups of people whose minds are systematically misinterpreted, or even denied mentality. It argues that there are. This claim builds off recent work in (...) philosophy and social psychology on epistemic injustice and the role of social categories in mental state attribution. The paper proposes the Problem of the Other’s Mind: the phenomenon of a (relatively) socially privileged person’s inability or lack of desire to understand the mind of a (relatively) socially underprivileged person. Being and Time begins by asking, “Do we in our time have an answer to the question of what we really mean by the word ‘being’ [seiend]?” (SZ1). Heidegger’s project is thus often understood as an attempt to answer this question of being. But Heidegger immediately goes on to say that the problem is not that we lack an answer to this question so much as that we do not even have a sense of the question: “But are we nowadays (...) even perplexed at our inability to understand the expression ‘Being’ [Sein]? Not at all” (SZ1). Instead of, or at least before, giving us an answer to the question of being, Heidegger wishes to gift us the openness of that question. I argue that the question of being asks after the meaningful presencing of entities, where this means it asks what it is to hold entities up to, or grasp them in light of, ontological standards. I show that the metaphors of holding, grasping, and light mask a deep perplexity about this phenomenon, and I suggest that the ontological-epistemological problem of being that Heidegger wants to bequeath to us has general philosophical significance beyond the scope of his own philosophising. Phänomenologie des Unbewussten.--Metaphysik des Unbewussten.--Das Unbewusste und der Darwinismus.

Employer studies indicate recent college graduates are underprepared for workplace communication. Philosophy instructors should offer alternative writing assignments to improve career readiness. I propose philosophy instructors offer white paper assignments in lieu of, or in addition to, traditional academic writing assignments like argumentative papers. White papers provide students familiarity with business writing and inclusive and empowering learning opportunities. I present my argument as a white paper and provide sample white paper topics, scaffolding suggestions, and assessment examples.

The essays in Object-Oriented Feminism explore OOF: a feminist intervention into recent philosophical discourses--like speculative realism, object-oriented ontology (OOO), and new materialism--that take objects, things, stuff, and matter as primary. Object-oriented feminism approaches all objects from the inside-out position of being an object too, with all of its accompanying political and ethical potentials. This volume places OOF thought in a long history of ongoing feminist work in multiple disciplines. In particular, object-oriented feminism foregrounds three significant aspects of feminist thinking in (...) the philosophy of things: politics, engaging with histories of treating certain humans (women, people of color, and the poor) as objects; erotics, employing humor to foment unseemly entanglements between things; and ethics, refusing to make grand philosophical truth claims, instead staking a modest ethical position that arrives at being "in the right" by being "wrong." Seeking not to define object-oriented feminism but rather to enact it, the volume is interdisciplinary in approach, with contributors from a variety of fields, including sociology, anthropology, English, art, and philosophy. Topics are frequently provocative, engaging a wide range of theorists from Heidegger and Levinas to Irigaray and Haraway, and an intriguing diverse array of objects, including the female body as fetish object in Lolita subculture; birds made queer by endocrine disruptors; and truth claims arising in material relations in indigenous fiction and film. Intentionally, each essay can be seen as an "object" in relation to others in this collection. This paper presents methods and challenges attendant on the use of protocol analysis to develop a model of heuristic processing applied to research ethics. Participants are exposed to ethically complex scenarios and asked to verbalize their thoughts as they formulate a requested decision. The model identifies functional parts of the decision-making task: interpretation, retrieval, judgment and editing and seeks to reliably code participant verbalizations to those tasks as well as to a set of cognitive tools generally useful in such work. (...) Important difficulties in the reliability and external validity of measurement are evaluated and a small set of illustrative data is used in support of that discussion. Results indicate that both intuitive emotional but also more deliberative cognition is present which is consistent with work in related literatures in expertise and in neuropsychology. Finally, the theoretical and practical potential of the approach is elaborated, particularly through links to a framing in Aristotelian ethics. (shrink)

My job has been made easier tonight, given that Larry Hickman has already done most of the ‘heavy lifting’ for me. I think his paper is an excellent and convincing intervention into this debate, and one of the problems for me in constructing my talk has been that our discussions have forced me to rethink what I wanted to say. Given my Continental biases, I had expected to come out on Rorty’s side; in writing this paper, however, things have become (...) more complicated. So let me here thank Larry for both at once making my job tonight easier, and much to my chagrin, surprisingly difficult. What I want to suggest, in contrast to what you’ve just heard, is that the neopragmatism of Richard Rorty is not wholly inconsistent with Dewey’s pragmatism – or, at least, with a ‘thin’ version of Deweyian pragmatism. As we shall see, while the differences between Dewey and Rorty on the status of metaphysics are in all probability irreconcilable, Rorty’s reclamation of a ‘thin’ Dewey can be read as consistent with at least the spirit of Dewey’s work. I will try to make the stronger case that this reconciliation is possible according to the letter of Dewey’s philosophy as well, and the interrelated issues of method and social hope will serve as the avenues for this investigation. Given my audience, I imagine that what I’m about to say will be fodder for some interesting conversation, and so, in the spirit of Rorty’s thought, let me get on with my paper. (shrink)

In his 1991 book, Parts of Classes, David Lewis discusses the idea that composition is identity, alongside the idea that mereological overlap is a form of partial identity. But this notion of partial identity does nothing to help Lewis achieve his goals in that book. So why does he mention it? I explore and resolve this puzzle, by comparing Parts of Classes with Lewis's invocation of partial identity in his 1993 paper ‘Many But Almost One’, where he uses it to (...) address Unger's problem of the many. I raise some concerns about this way of thinking of partial identity, but conclude that, for Lewis, it is an important defence against accusations of ontological profligacy. (shrink)
