In the UK, the Recommended Summary Plan for Emergency Care and Treatment (ReSPECT) is a widely used process, designed to facilitate shared decision-making between a clinician and a patient or, if the patient lacks capacity to participate in the conversation, a person close to the patient. A key outcome of the ReSPECT process is a set of recommendations, recorded on the patient-held ReSPECT form, that reflect the conversation. In an emergency, these recommendations are intended to inform clinical decision-making, and thereby (...) enable the attending clinician—usually a general practitioner (GP) or paramedic—to act in the patient’s best interests. This study is the first to explore the extent to which ReSPECT recommendations realise their goal of informing best interests decision-making in community contexts. Using a modified framework analysis approach, we triangulate interviews with patients and their relatives, GPs and nurses and care home staff. Our findings show that inconsistent practices around recording patient wishes, diverging interpretations of the meaning and authority of recommendations and different situational contexts may affect the interpretation and enactment of ReSPECT recommendations. Enacting ReSPECT recommendations in an emergency can be fraught with complexity, particularly when attending clinicians need to interpret recommendations that did not anticipate the current emergency. This may lead to decision-making that compromises the patient’s best interests. We suggest that recording patients’ values and preferences in greater detail on ReSPECT forms may help overcome this challenge, in providing attending clinicians with richer contextual information through which to interpret treatment recommendations. William James and the Reinstatement of the Vague. By William Joseph Gavin. Anti‐foundationalism Old and New. Edited by Tom Rockmore and Beth Singer.

We define a notion of difference-making for partial grounds of a fact in rough analogy to existing notions of difference-making for causes of an event. Using orthodox assumptions about ground, we show that it induces a non-trivial division with examples of partial grounds on both sides. We then demonstrate the theoretical fruitfulness of the notion by applying it to the analysis of a certain kind of putative counter-example to the transitivity of ground recently described by Jonathan Schaffer. First, we show (...) that our conceptual apparatus of difference-making enables us to give a much clearer description than Schaffer does of what makes the relevant instances of transitivity appear problematic. Second, we suggest that difference-making is best seen as a mark of good grounding-based explanations rather than a necessary condition on grounding, and argue that this enables us to deal with the counter-example in a satisfactory way. Along the way, we show that Schaffer's own proposal for salvaging a form of transitivity by moving to a contrastive conception of ground is unsuccessful. We conclude by sketching some natural strategies for extending our proposal to a more comprehensive account of grounding-based explanations. (shrink)

On its intended interpretation, logical, mathematical and metaphysical discourse sometimes seems to involve absolutely unrestricted quantification. Yet our standard semantic theories do not allow for interpretations of a language as expressing absolute generality. A prominent strategy for defending absolute generality, influentially proposed by Timothy Williamson in his paper ‘Everything’, avails itself of a hierarchy of quantifiers of ever increasing orders to develop non-standard semantic theories that do provide for such interpretations. However, as emphasized by Øystein Linnebo and Agustín Rayo, there (...) is pressure on this view to extend the quantificational hierarchy beyond the finite level, and, relatedly, to allow for a cumulative conception of the hierarchy. In his recent book, Modal Logic as Metaphysics, Williamson yields to that pressure. I show that the emerging cumulative higher-orderist theory has implications of a strongly generality-relativist flavour, and consequently undermines much of the spirit of generality absolutism that Williamson set out to defend. This paper explores the claims made by various authors that the fair-trade network provides an initial basis for a challenge to the commodification of goods under global capitalism. Proponents of fair trade generally advance two essential arguments in this regard. First, they claim that fair trade reveals the social and environmental conditions under which goods are produced and brings producers and consumers together through 'ethical consumerism', which challenges the commodification of goods into items with an independent life of their own. (...) Second, they argue that fair trade affirms non-economic values of co-operation and solidarity which challenge the capitalist imperatives of competition, accumulation, and profit-maximisation. Drawing from cases in the fair-trade coffee sector, these assertions are critically examined and it is argued that, while fair trade can provide a symbolic challenge to commodity fetishism, in the end this challenge is strictly limited by the power of global market imperatives and the network's market-driven approach. Children and adults with dementia are vulnerable populations. Both groups are also relatively seldom included in biomedical research. However, including them in clinical trials is necessary, since both groups are in need of scientific innovation and new therapies. Their dependence and limited decision‐making capacities increase their vulnerability, necessitating extra precautions when including them in clinical trials. Beside these similarities there are also many differences between the groups. The most obvious one is that children have an entire life ahead of them (...) and will become persons with certain ideals and preferences, while adults with dementia have lived a life in which they have expressed their ideals and preferences. Some of the available research guidelines recognize these differences, setting one list of specific requirements for groups of incapacitated adults and another list for children. Other documents, however, do not differentiate and only set requirements for subjects unable to consent as a single category of subjects.In this article we analyse to what extent the similarities and differences between the two groups are represented in legal documents and ethical guidelines. The article presents an overview and an analysis of the requirements for doing research with children and dementia patients. We conclude with suggestions about how to better incorporate the morally relevant aspects of these two groups in legislation and ethical guidelines. (shrink)

The main purpose of this paper is to draw attention to an important part of Habermas’ critique of genetic enhancement, which has been largely ignored in the discussion; namely his use of Kierkegaard’s reflections on the existential conditions for becoming one-self from Either/or and the Sickness unto Death. It will be argued that, although Habermas presents some valuable and highly significant perspectives on the effect of genetic enhancement on the individual’s self-understanding and ability to experience him- or herself as a (...) free and equal individual, he does not succeed in working out a consistent argument. The claim is that he fails to explain how the existential analysis is related to his reflections on the sociological and psychological impacts of genetic enhancement in the realm of communicative action. It is this lack of theoretical clarity, which seems to render Habermas vulnerable to some of the critique which has been raised against his theory from a number of different scientific disciplines and areas of research. Hence, the first part of the paper provides some examples of the nature and variety of this critique, the second part presents Habermas’ own critique of genetic enhancement in the context of a dispute between so-called ‘liberal’ and ‘conservative’ arguments, and finally, the third part discusses the limits and possibilities of his position in a future debate about genetic enhancement. In lieu of an abstract, here is a brief excerpt of the content:Judith Butler’s “New Humanism”A Thing or Not a Thing, and So What?Sina KramerA few thinkers in the last few years, such as Stefan Dolgert and Miriam Leonard, but especially political theorist Bonnie Honig, have argued that Judith Butler’s most recent work (Antigone’s Claim, 2000; Undoing Gender, 2004; Precarious Life, 2005; Frames of War, 2009) institutes a new form of humanism, based on the universality of grief, mourning, vulnerability, and (...) precariousness that Butler describes in these texts. These critiques call into question an incipient foundationalism in the feminist political theory Butler produces in these texts, one seemingly at odds with her previous antifoundationalist commitments. In this article I will argue that, while these critiques oversimplify the relationship between politics and ethics or politics and ontology in their critique of Butler’s new mortalist humanism, the problem of the relation of politics to ethics or ontology—or, more exactly, the problem of the relation of politics to its outside, or to its conditions—remains nevertheless a real problem in Butler’s work. This is because, without a clear account of a method of rendering foundations contingent, or of rendering ontologies provisional, we tend to repeat the political move to establish an apolitical ground on which we can found a politic. This foundationalist move thus shields that ground from political critique and transformation—a move that Butler herself has done so much work to expose and displace.In this article, I ask whether feminist theory must repeat a recourse to foundations by examining the charge that Butler does so her in most recent work. The article will proceed as follows: in the first section, I examine the [End Page 25] charge that Butler is instituting a new humanism. In the second section, I look at some of Butler’s discussion of humanism, and look more closely at the relation between ethics and politics the question of humanism opens up in her work. In the third, I explore whether or not the charge that Butler is instituting a new humanism is correct. And in the fourth, I question what is at stake in this charge. Essentially, the article asks of this new humanist charge: Is this a thing or not a thing, and so what? I argue that, while the charge is somewhat overdetermined, it does point to a larger problem in Butler’s work, and that is the recourse to foundations, or to gesturing to an outside of or beyond of politics as the condition for altering political conditions. I will conclude by arguing that a greater attention to method can help to avoid the reification of the distinction between politics and its conditions that leads to the recourse of foundations.Butler’s New Mortalist HumanismIn her 2010 article “Antigone’s Two Laws: Tragedy and the Politics of Humanism”—as well as in her 2013 book Antigone, Interrupted—Bonnie Honig argues that Butler’s ethical turn institutes a new mortalist humanism, predicated on the “ontological fact of mortality, not the capacity to reason but the vulnerability to suffering” (Honig 2010, 1). She differentiates this new mortalist humanism, which she also diagnoses in the work of Nicole Loraux and Stephen White, from earlier rationalist forms of humanism that are based on the universal principle of human rationality, and from forms of antihumanism based on the “signs of a monstrous, dehumanizing animality” (Honig 2010, 3). Either form is problematic, Honig argues, insofar as they both seek to settle essentially political questions by recourse to a position beyond politics: through a stable and recognizably human figure who either secures its belonging to the polity by means of its rationality, or an exclusion rendered through the dehumanization of otherwise ostensibly human figures.This new mortalist humanism Honig diagnoses in Butler’s recent work falls into the same problem: in this version, Butler settles political questions by recourse to a principle of mortality, or the universal experience of mourning. This would seem to be contrary to Butler’s earlier commitments to a radical critique of foundationalism, especially in her famous critique of the naturalization of sex as the grounds for a political understanding of gender. Dementia is highly prevalent and up until now, still incurable. If we may believe the narrative that is currently dominant in dementia research, in the future we will not have to suffer from dementia anymore, as there will be a simple techno-fix solution. It is just a matter of time before we can solve the growing public health problem of dementia. In this paper we take a critical stance towards overly positive narratives of techno-fixes by placing our empirical analysis of (...) dementia research protocols and political statements in a framework of technology assessment. From this perspective, it becomes obvious that a techno-fix is just one of many ways to approach societal problems and more importantly that technologies are way less perfect than they are presented. We will argue that this narrow scope, which focusses on the usual suspects for solving illnesses, reduces dementia to organismic aspects, and may be counterproductive in finding a cure for dementia. We conclude with outlining how the narrow scope can be balanced with other narratives and why we should have a reasonable scepticism towards the usual suspects. (shrink)

There has always been a strong connection historically between aesthetics and radical politics, and this is no less true for the global justice movements current preoccupation with cultural approaches to political action. The essays collected here seek to engage with past and present convergences between the theories and practices of artists and writers and the theories and practices of movements for radical social change. There is already a massive amount of literature on Marxist approaches to aesthetics, art and literature, and (...) whilst recognising the usefulness of such approaches, the essays collected here attempt to engage with culture from other radical critical positions - whether they be anarchist, autonomist, ecological or otherwise. Such perspectives have often been overlooked historically, but it is arguable that they now more centrally influence the activities of radical artists and activists. As such, the perspectives of these essays, which are often drawn from or inspired by the practices of the current global justice movement, exhibit an exhilarating political and generational break with the suppositions of earlier radical theoretical approaches to cultural critique. South Africa has a long history of orality deeply embedded in the archival memory of the ‘Other’ or the history of the poor and oppressed. Their untold stories, undocumented histories with displacing identities are how the historical ‘Other’ has been perceived by colonialism and the apartheid regime. The ‘Other’ or primary oral communities in the context of this article can be seen by a name, a face and a particular identity, namely, indigenous people. This article will engage the work of (...) Finnegan on what is ‘Orality – if anything’. The term ‘orality’, as a conceptual tool, can help us to widen our horizons and attention to forms of human creativity and imagination which was neglected or unnoticed by scholars. Orality has forced scholars to ask new questions on what is the meaning of ‘text’ and encouraged and challenge scholars in orality and literacy research with a new analysis of what we thought we already knew. The article engages oral and written research and how it can assist in understanding the discourse of the ‘Other’ and the power relation in reconstructing and re-ordering of their social universe through collective memory, songs, rituals, satire, drama and political protest which at large was perceived by the apartheid era and Western colonisers as savage, uncivilised and barbaric. The oral discourse of the ‘Other’ has become part of the power struggles politically and educationally in South Africa. Orality has further reshaped the Christian discourse in South Africa and Africa as the poor and oppressed find new power in a discourse of metaphysics of presence of the Gospel through preaching and bearing witness of their new encounter spiritually. Illuminated Mirrors and “No Rights” concerns the peregrinations of El Greco, from Crete to Spain, and various influences acquired along the way. The primary argument is that El Greco suffered a double exile: 1/ voluntary exile from Crete; and 2/ involuntary exile from Renaissance art and its humanist biases. As such, much of the art-historical record is a confused and often-doctored record of El Greco’s manufactured persona—i.e., he is not assimilable to the usual categories of art and art history.

(Runner-up, Royal Institute of Philosophy 2020 Philosophy Essay Prize) Technological developments have led to the digitization of certain sectors of the economy, and this has many authors looking ahead to the prospects of a post-work society. While it is valuable to theorize about this possibility, it is also important to take note of the present state of work. For better or worse, it is what we are currently stuck with, and as the COVID-19 pandemic has ensured, much of that work (...) is now taking place online. Though a ‘return to normalcy’ is on the horizon, part of that normalcy involves online work, which is itself a significant change in the lives of many workers. Here I develop an account of work on which work is teleologically structured. This gives the result that working is something we can fail at doing, even when we try, and we can also be unsure of whether we’ve succeeded or failed. The shift of certain work from in-person to online modes generates a persistent uncertainty for workers in affected professions. Because our ability to work is something we typically value, this uncertainty has significant negative consequences for a worker’s self-conception. Indeed, it is analogous to disorders of agency and generates a kind of alienation. (shrink)

The article discusses the dynamics of currencies, of media of exchange in a perspective of longue durée. It explores the concept of ›toxic media‹ and of an ›ecology of practices‹ by tracing discussions on cacao as money and as consumable since the 15th century. Furthermore, historically specifi c versions of general purpose money, such as the Spanish Silver-Peso and the U.S. dollar are compared with to self-restricting currencies: currencies that are more tightly knit into the »web of life« ( Jason (...) Moore), into local economies and ecologies and into cultural systems. The article determines toxic effects of generalized media of exchange in the Capitalocene and discusses the interplay of situated money-regimes with generalized, globalized media of exchange. (shrink)
